21、海关核准可予以办理退税手续： (重要考点 )(1) 已缴纳进口关税和进口环节税税款的进口货物，因品质或者规格原因原状退货复运出境的 ;(2) 已缴纳出口关税的出口货物，因品质或者规格原因原状退货复运 进境，并已经重新缴纳因出口而退还的国内环节有关税收的 ;(3) 已缴纳出口关税的货物，因故未装运出口申报退关的 ;(4) 散装进出口货物发生短卸、短装并已征税放行的，如果该货物的 发货人、承运人或者保险公司已对短卸、短装部分退还或者赔偿相应货款 的，纳税义务人可以向海关申请退还进口或者出口短卸、短装部分的相应 税款 ;（5）进出口货物因残损、品质不良、规格不符的原因，由进出口货物 的发货人、承运人

22、或者保险公司赔偿相应货款的，纳税义务人可以向海关 申请退还赔偿货款部分的相应税款 ;（6）因海关误征，致使纳税义务人多缴税款的。（ 二 ） 退税的期限及要求1、进出口货物的收、发或人或他们的代理人，在缴纳税款后发现多 缴税款的，自缴纳税款之日起 1 年内，向海关申请退税，逾期海关不予受 理。2、海关应当自受理退税申请之日起 30 日内查实并通知纳税义务人办 理退还手续，纳税义务人应当自收到通知之日起 3 个月内办理有关退税手 续。（ 三 ） 退税凭证：“收入退还书”三、税款追征和补征退补税是指海关短征和纳税人短缴和漏缴的税款，由海关照章进行追 征和补征的行为。（ 一 ） 追征和补征的范围 （
