1、EMPLOYMENT CONTRACTEmployer (Party A):Employee (Party B):ID Card No.:ThisEmploymentContractismade and enteredintothroughfriendly negotiation on the day of,by and between thefollowingEmployer (hereinafterreferredtoas “ PartyA”) andEmployee (hereinafter referred toas“ Party B”).Article I General Provi

2、sions1. Party A agrees to employ Party B as(Type of work) toJamaica.2. The contractvaliditytermisfiveyears,since thedateofPartyB arrived in Jamaica. After the expiration of the contract, bothparties could extend contract by mutual consent.3. Termination3.1 If Party A proposes the termination of empl

3、oyment due tothe reasonsnotrelatedto PartyB beforethe expirationdate,PartyA shall paymonths base salariestoParty B as compensation,and provide free airfares to Party B for return to China.3.2 If Party B proposes the termination of employment due to- 1 -its own reasons before the expiration date, it

4、should notify PartyA in written formmonth(s) ahead of time, and should returnthe costs (ticket fares, application and renewal charges for workpermitpaid by PartyA) proportionallyaccordingto the timesaheadof the expirationof contract.Party B should leave and returnChinaaccording to the arrangement of

5、 Party A, airfares back to Chinashould be self-afforded.Article Obligations to Be Performed by Party A1. Monthly salary, working time and form of payment1.1Party A shall pay monthly basic salary of US$toParty B before the(date) once each month.1.2 The pay period is from(domestic boarding date ofPart

6、y B) to the expiration date while Party B leaves the work site(terminate early is calculated to the actual end date).1.3 Party B will workdays a week,hours a dayduring the contract period.Weekday overtime or work on Saturday shall be paidby Party A, payment atrate.Work on Sunday or publicholidayalso

7、 should be paidby Party A, payment atrate.2. Accommodations2.1 Party A should offerfreeaccommodations which are not lowerthanthelocallegalstandard,includes:furniture,bedding,- 2 -supplies, electricity, water and other basic living facilities.2.2PartyA shouldprovidebasicmeals forParty B in Jamaica,en

8、suring health and proper nutrition.3. Visa and other papers3.1PartyA shalltransactalltheformalitiesabout enter andexitChina forPartyB accordingtotheregulationsmade by Chinesegovernment, and to bear the associated costs.3.2PartyA shallbearalltheseexpenses forPartyB: passportfees,visa fees, planefares

9、(fly to Jamaica and returnChina aftercontract expires).If Party B returns China early due to personalaffairs, airfares back to home should be self-afforded.4. Insurance and Other Matters4.1PartyA shallpayinsurancepremium forParty B in China from the date ofParty B to leave China tothe date ofParty B

10、 to return China.4.2If Party B suffers sickness or non-work-related injury,Party B is entitled to medical treatment period and sick leavetreatment provided by Jamaica municipality.4.3PartyB isentitledtoalltheholidaysand leaves providedby the State, to which the ImplementationRules forEmployees Worki

11、ngHours and Holidays formulated by Party A shall apply.Article Obligations to Be Performed by Party B1. Party B shall comply with the management directions of Party A- 3 -and obey thebylawsand labordisciplinesofPartyA, shallundertakethe obligation to keep and not to disclose the trade secret for the

12、PartyA duringthe periodofthiscontract.PartyB shouldstrictlyabide by the foreign affairs discipline and adherence to the Partyandstatesecrets;notallowedtodoorsayanythingagainstmotherland.2. Party B shallabide by alllocalgovernment laws and regulationsand respectingthelocalcustoms and practices;notall

13、owed toparticipateinany political,religious,and unhealthyplaces localactivities;dont to do following things:defection, smuggle, sextrade, stealing, gambling, drug abuse, street-fighting, drunken behavior and other behaviors of breaching laws and regulations.3. Party B shall not provide service to em

14、ployers than for Party A without Party A s approval, or go out to work or do any part-time job during the period of the contract.4. Party B shall work hard and unite local workers and accept the arrangements made by Party A, to finish the overseas labor service tasks to completion within the time li

15、mited prescribed in the contract.5. Party B should return at specified time and route according toParty A aftercomplete contractor accomplishthe laborservicestask,and are not allowedto strandin outsideChina with any excuses;mustobserve the management rulesof ports,checkpointsand customs,and- 4 -it i

16、s prohibited to bring any contraband or articles exceedingallowances, and no one is allowed to be a“water guest” or helpother “water guest ” to carryitemsor resell foreigncurrencyandnecessities for personal use free of duty.6. Party B shall pay the deposit of RMBof documents(passport,work permit,tax

17、 exemptioncertificate),and depositofRMBof labor security to Party A. Party B should keepreceipt properly, if it is lost or stolen, the deposit will not bereturned.7.PartyB shallcooperatewith PartyA inhandling theformalitiesforresignationand othermattersconcerned aftertheexpirationofthe contract or m

18、idway to resign or be repatriated due to theviolation of discipline, and should return all documents concernedabout overseas labor services to Party A.8. Party B shall pay its own individual income tax.Party B should shoulder economic, political or legalresponsibility If violated above requirements.

19、 Then Party A isentitled to cancel the Party B s right of labor services. Ifviolationsconstitutecrimes,thejudicialorgansshallinvestigatethe criminal responsibilities according to law.Article DismissesThe contract may be terminated by Party A with immediate effect if Party B violated any of the follo

20、wing articles and Party B will- 5 -not be compensated. On the contrary,Party B should returnthe costs(ticketfares,applicationand renewal charges forwork permit)paidby Party A.1. Violations of laws and regulations in Jamaica;2. Violations of the company rules;3. Provide services to employers than for

21、 Party A without Party As approval;4. Caused by concealing diseases are not suitable for to continueto work;5. Proved to be unable or unqualified for the work specified ordisobey the arrangement of work by Party A ,and already warn in legal paper for 2 times(certain offenses are serious enough to wa

22、rrant immediate discharge without and preliminary warnings.).6. Absence from work for hours, (with late attendance or early leave more than three times without decent explanation will be regarded as absence one day.).7. Slack working.8. Participating in local political activities and illegal gatheri

23、ngs.9. Involved in illegal credit, gambling, drugs, alcohol and fight;10. Strike; identified conditions of the strike are:10.1 Out of place of work lasting more thanhours(including holiday overtime).- 6 -10.2 Willful work stoppage reacheshours bypeople at the same time.Article Negotiation and Arbitr

24、ationAnydisputearisingfromimplementationofthisContractbetweenthetwopartiesshallbe settledthroughfriendlyconsultation. If such effort fails, the dispute shall be submittedto China InternationalEconomic and Trade ArbitrationCommission forarbitration.The arbitrageoftheCIETACshallbe finaland authorityfor all parties.Article Effective Date of This ContractThe Contract is made in two counterparts each in Chines
