6、 pactci me n - n Ia indv luai ml-er, bt ioing a te wib opertin ,nd a frm conentatd e on l o reu eduatm e_ "s o imo - n i- -Vas num_s of第一章总则第一条 为了进一步加强对劳务派遣人员的规范化管理, 充分调动劳务派遣 人员的工作积极性和创造性,更好地为地税事业服务,根据国家和省、市有关规 定,结合我局实际,特制定本办法。第二条本办法所指劳务派遣人员,是我局因工作需要,由劳务派遣公司统 一派遣、经市局同意接受、使用期限在一个月以上的人员。第三条首次接受劳务

7、派遣公司派遣的人员,均实行一个月试用期制度。第二章劳务派遣人员的派遣、使用及条件第四条 劳务派遣人员由劳务派遣公司按照市局提出的劳务派遣人员用工数量、岗位要求和聘用条件等统一派遣,由市局进行监督、检查及考核。第五条劳务派遣人员的使用,依据金昌市地方税务局与金昌市锲城伟创人 力资源有限责任公司签订的劳务派遣协议书进行。劳务派遣协议应当约定派遣岗位和人员数量、 派遣期限、劳动报酬和社 会保险费的数额与支付方式以及违反协议的责任。劳务派遣公司要将我局与劳务派遣公司签订劳务派遣协议书的事实告知 劳务派遣人员。第六条劳务派遣人员应具备下列条件(一)思想品德好,遵纪守法,无违法乱纪等行为。(二)诚实守信,

15、 a frm conen_td edcatont o r - la eduatme_"so imo - n i nitaiesVas mes of(四)税收征管岗位应具有中专以上文化程度,其他岗位应具有初中以上文化程度。(五)身体健康,无传染性疾病,持有本人身体健康证明(县、区级以上医 院体检证明)。(六)持有本人所在社区介绍信、计划生育证明(或未婚证明卜身份证等。(七)从事符合国家规定的技术工种,须持有效的职业技术资格证书。(八)根据工作性质和实际岗位需要,要求具有的其他特殊条件。第三章劳务派遣人员使用程序第七条劳务派遣人员使用程序(一)用人单位根据工作需要提出需求申请,由市局人教

16、科审核后,报市局研究决定。(二)市局人教科按照市局的决定,提出用工数量、岗位要求及聘用条件, 交由市局机关后勤服务中心负责与劳务派遣公司协议、派遣。(三)凡劳务派遣公司派遣到我局的人员,需填写金昌市地方税务局劳 务派遣人员登记表,并提交个人身份证复印件、身体健康证明和计划生育证明, 技术工种需要提交相关的上岗证件。第八条 劳务派遣人员由劳务派遣公司与其签订劳动合同。劳务派遣公司与劳务派遣人员签订的劳动合同应当载明被派遣劳动者 的用工单位、工作岗位、派遣期限等情况。第四章劳动派遣人员的管理basd m thi at ual, stvng o be "lean ng Ind "

34、规定制度。第十一条劳务派遣人员的管理、监督、 考核等参照金昌市地方税务局行政执法 (管理)责任制考核办法以及市局相关制度规定执行。第十二条各用人单位应结合劳务派遣人员的岗位制定岗位责任制, 并对岗位责任制执行和落实情况进行经常性的监督检查。第十三条各用人单位应加强对劳务派遣人员的教育培训, 不断提高其综合素质, 增强其服务技能, 积极引导其爱岗敬业, 努力工作, 不断提高服务质量。第五章 劳务派遣人员的考核、奖惩第十四条劳务派遣人员的考核分为经常性考核和定期考核两种。经常性考核由各用人单位根据市局相关制度和劳务派遣人员的岗位责任制情况进行考核。定期考核分别为半年考核和年度考核。 半年考核结合市

52、0元/人月,当年评为优秀等次的,从次年1 月1日起在当年工资基础上加薪100元。年度加薪最多不得超过6次。第十七条劳务派遣人员当年年度考核评为不合格等次的,留岗查看 3个月,期间扣发工资100元/人月。留岗查看期满后,经市局考核合格后方可继续上岗。第十八条因违反劳动纪律、出现服务态度和工作作风等行为,造成经济损 失或不良影响,尚未构成辞退条件的劳务派遣人员, 将视情节给予适当处罚。对 于情节较轻的,扣发半月工资;对于情节较重的,扣发全月工资。第六章劳务派遣关系的解除第十九条劳务派遣人员有下列情形之一的,由我局退回劳务派遣公司:1、在试用期内不符合我局工作要求的。2、严重违反劳动纪律或者市局的规

53、章制度,影响工作秩序的。3、违反工作规程,损坏公共财务,造成经济损失的。4、服务态度恶劣,影响地税部门形象的。5、有贪污、盗窃、赌博、营私舞弊等违法行为,尚未构成犯罪的。6、无理取闹、打架斗殴,严重影响社会秩序或犯有其他严重错误的。7、被依法追究刑事责任的。8、其他违规违纪行为。第二十条有下列情形之一的,由我局提前 30日以书面形式通知劳务派遣公司后,可以解除劳务派遣关系:basd m thi at ual, stvng os not no rules I hee i .dionanyimpoebe "lean ng Ind "doe" maks S gheing
