ARBITRA

DELAY/NON-DELIVERYIntheeventofdelay/non-deliveryofcontractualquantitytheSELLERshallbearfollowingduties.Incaseofdelayeddelivery,theSELLERSshallpaytotheBUYERSforeveryweekofdelayapenaltyamountingto0.5%ofthetotalvalueofthegoodswhosedeliveryhasbeendelayed.Anyfractionalpartofaweekistobeconsidered

14、asafullweek.Thetotalamountofpenaltyshallnot,however,exceed1%ofthetotalvalueofthegoodsinvolvedinlatedeliveryandistobedeductedfromtheamountduetotheSELLERSbythepayingbankatthetimeofnegotiation,orbytheBUYERSdirectatthetimeofpayment.Incasetheperiodofdelayexceeds60daysafterthestipulateddeliverydatetheBUYE

LICENSE,TARIFFS,TAXESANDDUTIESAlllicense,tariffs,taxesanddutieswhetherexistingornewonthemerchandiseanditscontentsorcommercialdocumentsrelatingtheretoshallbebornebyBUYERintheeventoftheirexistencein

16、China.Anyexportrelatelicense,taxesordutieswhetherexistingornewleviedinthecountryoforiginshallbebornebyBILUUTMININGCO.,LTD17. FORCEMAJEURETheSELLERshallnotbeheldresponsibleforlatedeliveryornon-deliveryofthegoodsowingtogenerallyrecognized"ForceMajeure"causes.Insuchcases,however,theSELLERshallimmediatelyinformtheBUYERtheaccidentandairmailtotheBUYERwithin15daysaftertheaccident,acertificateoftheaccidentissue
