1、中英文对照租房合同公寓租赁协议TENANCYAGREEMENT租方:【李宝华】(以下简称出租方)(代理人:王峰)Lessor:(hereinafterknownastheLessor).承租方:GIOVANNIDILIBERTO(以下简称承租方)。Lessee:(hereinafterknownastheLessee).中介方:【湖岸天地地产顾问有限公司】(以下简称中介)Agent:RelocateChinaCompanyLtd(hereinafterknownastheAgent)1,鉴于:WHEREAS:出租方愿意根据下述条款和条件出租、承租方愿意承租位于该物业的6-1005单元供其本人或

2、其家人居住(住户)。TheLessorisagreeabletoleasingout,andtheLesseeisagreeabletoleasing,theapartmentNo.is6-1005inthesaidPropertyasresidencefortheLessees/clientsandhisfamilymembers(Residents)inaccordancewiththefollowingtermsandconditions.就上述事宜,双方兹协议如下:Bothpartieshaveenteredintothefollowingagreementwithregardtoth

3、eabovematter:2.出租标的ThePremises:位于中华人民共和国【江苏省*工业园区】的名为【和乔丽晶公寓】的16-1005】单元的全装修房屋,该房屋总建筑面积约为【130.59平方米,该房屋的配备列于承租人签收的财产清单之中(以上统称租赁单元)。ThepremisewithrenovationsandfurnishingsisapartmentBlock6-1005inChateauRegencySIP,215021withaGrossFloorAreaof130.59sqm(hereinafterknownasthePremises).TheFurnishingshavebe

4、enincludedinthepropertyinventorylist.3.房屋用途RentalPurpose:租赁单元仅供居住之用,承租人不得将其用于任何其他用途,也不应将其用于任何违法或不道德行为;未征得出租方之书面同意,承租方不得以任何形式将租赁单元的全部或任何部分转让、转租或分享给任何第三方。ThePremisesisonlymeantforresidentialpurposes.TheLesseeshallnotusethePremisesoranypartthereofforany川egalorimmoralpurposeorforanyotherpurpose.TheLesse

5、eshallbeforbiddenfromtransferring,sublettingorsharingalloranypartthereofofthePremisestoanythirdpartyinanywaypriortoobtainingwrittenconsentfromtheLessor.4.租赁期限LeaseTerm:租赁期限:租期由2019年3月05日起至2019年3月04日止。(12个月).Thetenancytermshalllastfrom1st/Jan/2019to31st/Dec/2019(12months).5.租金TheRent:房屋租金(人民币3900元/月)

6、;RentforthePremises(RMB3900/month);包括:Includes:(1)宽带安装费;InstallationfeeonTelephoneBroadband;(2)物业费TaxFeeandManagementfee除上述内容之外,其他服务均不包括在租金之内。房租尤其不包括:Besidestheaboveitems,otherservicesprovidedbytheLessororitsauthorizedmanagingagentshallnotbeincludedintheRent,especiallythefollowing:(1)宽带使用费Internetus

7、ingfee.(2)能源使用费(水、电、煤)Utilities(water,gas,electricity).(3)清洁服务CleaningService(4)本地有线电视费LocalCableFee(5)卫星电视安装InstallationfeeofSATTV6.押金SecurityDeposit:相当于人民币4000元的押金。租赁期满:承租方需在租约期满当日搬出单元,在租约期满后,若属终止合同,出租方在承租方付清由承租方支付的所有费用后,且不损坏房屋、家电、家具的前提下迁空、点清、交还房屋及设施和所有家电、家具,出租方在7天内将全部退还承租押金(不计利息)至承租方。若出租方于到期日7日后仍

8、未能支付,则应就每一迟延退款日,按应退款项金额的0.5%/日之标准向承租方支付滞纳金,直至全部款项清偿完为止。RequiredonemonthrentalRMB4000asthesecuritydeposit,LesseeshallvacatethePropertyontheexpirydateofthisContract.IfeitherpartydoesntwishtorenewthisContractuponitsexpiry,Lessorshallreturnthe100%deposit(withoutinterest)within7daystoLesseeafterLesseehas

9、clearedtheentirerentalandfees,dontdamageanyfurnitureappliance.TheLessorshallpayafineof0.5%oftheamountdueperdayforeachdaythatdepositisnotreturnedaftersevendaysfromtheduedate,untilalloverduepaymentsarepaid.7.续租ExtensionofLease租赁期限届满,若承租人于租赁期内没有任何违反本协议项下的任何条款的行为,则承租人可以选择续租,但应至少于租赁期限届满的两个月前将此一意图书面通知出租人,

10、新的租赁条款和条件将由双方按届时的情况协商确定。UpontheexpirationofthisAgreement,theLesseemay,ifithasnotbreachedanyofthetermsandconditionsasstipulatedinthisAgreementduringtheTermchoosetoextendthetermoftheAgreement.However,theLesseeshallgiveatleastwrittennotificationofsuchintentionatleasttwomonthspriortotheexpirationofthete

11、nancytotheLessor.ThetermsandconditionsoftherenewedtenancytermshallbenegotiatedbetweentheParties,basedontheprevailingcircumstances.8.付款Payment租金每三个月支付一次。每季度租金由承租方在第一个月的5号交与出租房(或其代理人)。在承租方入住前,出租方应将附件二中所列的所有家具电器配齐,所有待修整的事项完成,服务设施连接好。在以上事情完成且承租方能够顺利入住的前提下,承租方将在签订合同5个工作日内付给出租方第一次的三个月租金和押金。Therentwillbepa

12、ideverythreemonths.BeforeLesseemovesin,Lessorhastomakesureallthefurnitureandelectricalapplianceslistedintheappendixarefullyinstalled,alllistedthingstobefixedareproperlydoneandallservicesareconnected.AfterLesseehasbeenallowedtomoveinsmoothlyandalltheaboverequirementaremetsatisfactorily,Lesseeshouldpa

13、ythefirstthreemonthsrentandsecuritydepositwithin5workingdaysaftersigningtheleasecontractbythreeparties.9.维持原状NochangetothePremises9.1未征得出租人的书面同意,承租人不得改变租赁单元之原状。若承租人对出租人的房屋任何部分及其任何设施、装修及配备造成损坏或破损(正常损耗除外),则具有义务按租赁时的状态对其进行维修修复或更换,且最迟不得迟于收到出租人通知的24小时内作出。PriortoobtainingwrittenconsentfromtheLessor,theLes

14、seeshallnotchangeinanywaytheexistingconditionofthePremise.ShouldtheLesseedamageordestroyanyofthefacilities,RenovationsandFurnishing(normalwearandtearexcepted),theLesseeshallberesponsiblefortherepair,restorationorreplacementofanydamagesmadetothefacilities,renovationsandinstallations(normalwearandtear

15、excepted)andreturnittoTheoriginalconditionasatthecommencemenofthetenancywithin24hoursofnotificationbytheLessor.9.2对于该单元的内部结构以及属出租方的家具电器设备由于非承租方原因(包括自然损耗和不可抗力(如:水灾、火灾、地震、雷击等)而引起的损坏,出租方须及时负责安排修理,费用由出租方支付。若出租方在收到承租方书面通知或电话通知后3个工作日内未能履行维修义务,则承租方可以自行维修或找第三方维修,维修费用由出租方承担。IftheinteriorstructureofthePremise

16、soritsfurnitureandappliancesofLessoraredestroyedordamagedforanyreasonsnotowingtothedefaultorneglectofLessee(e.g.bynaturalwearandtearorbyforcemajeureasflood,fire,earthquake,lightingstrike,etc.),LessorshallrepairitimmediatelytoensureitsuseandLessorpayallthecostincurred.IncasethatLessorcannotgivemainte

17、nanceservicewithinthreeworkingdaysafterreceiptofwrittennoticeorphonenoticefromLessee,Lesseecanrepairithimselforaskforexternalmaintenance.AllcostsincurredshallbebornbyLessor.10.遵守规则RulesandRegulations承租人应遵守出租人或管理公司为管理【和乔丽晶】物业而规定的所有规定。出租人应有权于任何时间及不时就【和乔丽晶】物业的规则、条例及规定作出合理添加、补充、取消或暂停执行。TheLesseeshallcom

18、plywithallrelatedrulesandregulationslaidoutbytheLessororthemanagingagentwithregardtotheoverallmanagementofthewholeChateauRegency.TheLessorshallhavetherighttoaddon,makeadditions,cancelortemporarilysuspendexecutionofanyoftherulesandregulationsregardingChateauRegencyatanytimeandfromtimetotime.11.进入Less

19、orsrightofentry为管理或维护公寓及租赁单元或为履行其提供服务的义务,出租人及其妥为授权的人士有权于合理的时间进入租赁单元,若情况允许应事先通知承租人,但紧急情况除外。承租人知悉并授权出租人保留和持有进入租赁单元的钥匙或电子门卡。TheLesseeshallgrantaccesstotheLessoranditsauthorizedagentsintothePremisesasandwhentheLessordeemsthereisaneedtoundertakethemaintenanceorworkrelatedtothemanagementormaintenanceofthe

20、PropertyandthePremisesortoperformitsobligationsaccordingtothisAgreement,atreasonablehours,althoughpriornoticeshouldbegiventotheLesseeifcircumstancespermitandexcepttheemergency.TheLesseeisawareofandconsentstotheLessorretainingandholdingthekeysorelectroniccardkeystothePremises.12.交还Yieldingupofpremise

21、s在本协议书届满或被提前终止之日,承租人应将租赁单元连同所有设施、装修及配备按单元出租时的状态(正常损坏除外)完好及完整交还给出租人,而无须任何通知或要求;若承租人未能如此交还的,则就每一迟延日,应按本协议书所规定之日租金(月租金/30)2倍的标准交纳租金,直至妥为交还之日。TheLesseeshall,upontheexpirationorearlyterminationofthisagreement,returnthePremisesanditsattachedfacilities,RenovationsandFurnishingsinitsoriginalstateasatthecomm

22、encementofthetenancy(normalwearandtearexcepted)backtotheLessorregardlessofwhetherhe/shehadobtainpriornoticefromtheLessor.TheLesseeshallpaytwicetheamountofthedailyrent(monthlyrent/30)stipulatedinthisAgreementforeverydaythathe/shefailstoreturnthePremisesanditsattachedfacilities,RenovationsandFurnishin

23、gsinaccordancewiththeaforesaidconditions,tillthedayhe/shefulfilsthesaidobligation.13.违约责任BreachofContract13.1.在租赁期内,承租方若提前终止合同,需提前一个月书面通知出租方,承租方所付押金作为违约金不予退还,同时承租方应付清此期间内承租方应付费用,出租方应退还承租方预先支付的剩余房租(如有)。出租方若提前终止合同,须提前一个月书面通知承租方,出租方除了退还承租方所付押金及剩余租金以外须赔相当于承租方所付押金金额的违约金,同时承租方应付清此期间内承租方应付费用。Duringtheleasi

24、ngperiod,ifLesseewantstoearlyterminatethecontract,LesseeshouldnotifyLessorinwrittenformonemonthinadvance.ThedepositwillbeconfiscatedasthedefaultfeeandLesseeshallalsoclearallthefeeswhichshouldbepaidbyLesseeduringthisperiodoftime,theremainingrentpaidbyLesseeinadvance(ifany)afterLesseehaspaidinfullallt

25、heexpenseswhichshallbebornebyLessee.IfLessorwantstoearlyterminatethecontract,LessorshouldnotifyLesseeinwrittenonemonthinadvance.LessorshouldreturnthedepositandtherestpaymentofrentalandinadditiontopaythedefaultfeewhichisequaltotheamountofthedepositpaidbyLessee.Lesseeshallalsoclearallthefeeswhichshoul

26、dbepaidbyLesseeduringthisperiodoftime.13.2.承租方延付费用:若延付费用因承租方引起,承租方应按合同规定支付上述费用在承租方付款逾期七日内,出租方有义务向承租方发出再次书面付款通知.若逾期14日未付,除应及时支付所欠费用外,还应每天支付出租方月租金的0.1%滞纳金;延期超过三十天,出租方有权单方面解除合同并没收押金及保留追索欠款及索赔的权利。LesseeshallpaytheaboverentandallotherfeesinaccordancewiththeprovisionsofthisContract.LessorshallinformLessee

27、againinwrittenformwithin7daysfromtheduedate.Iftherentalisnotpaidwithin14daysfromtheduedate,Lesseeshall,inadditiontopaytherentalinarrears,payLessorlatepaymentchargeof0.1%ofmonthlyrentalperdayoflatepayment.Ifthepaymentofrentalisoverduebymorethan30days,Lessorshallhavetherighttounilaterallyterminatethis
