12、 ll l l llll lllIII l l II签约须知1、签约双方应仔细阅读本合同书,以明确各自的权利、义务。2、劳动合同必须由用人单位法定代表人或其委托代理人与劳动者本人签订。3、本合同一律使用钢笔或签字笔填写,字迹清楚,文字简练、准确。合同中凡 需双方协商的,经协商一致后明确填写在空格内;涉及货币数字应填写“ 0000.00 ”式样或大写金额。合同中空格处双方如无约定内容须画“/”或填“无”。本合同一经签订,不得涂改。对劳动合同的效力有争议,由劳动 争议仲裁委员会或人民法院确认。4、甲方招用乙方时,应查验乙方提供未与其他用人单位存在劳动关系的凭证后, 方可与其签订劳动合同;乙方与原用

13、人单位未解除劳动关系的,以及甲方聘 用的退休人员,不能签订劳动合同。甲方有权了解乙方与劳动合同直接相关 的基本情况,乙方应当如实说明。5、劳动合同期限三个月以上不满一年的,试用期不得超过一个月;劳动合同期 限一年以上不满三年的,试用期不得超过二个月;三年以年固定期限和无固 定期限的劳动合同,试用期不得超过六个月。同一用人单位与同一劳动者只 能约定一次试用期,试用期包含在劳动合同期限内。6、社会保险费按国家规定缴纳,双方不能协商约定。7、按照国家就业准入制度的规定,甲方招用技术复杂以及涉及到公民生命安全 和消费者利益工种的从业人员,必须从取得相应职业资格证书的人员中录用。8、解除、终止劳动合同的

25、业危害防护第六条甲方应根据国家有关规定,为乙方提供符合国家标准的劳动安全卫 生设施和必要的劳动保护用品,建立、健全符合安全卫生的操作规程,保障乙方 安全与健康。乙方在劳动过程中,必须严格遵守安全操作规程。对从事有职业危 害作业的劳动者,甲方应当定期组织乙方进行健康检查。甲方应按照国家有关规定为未成年工和在孕期、产期、哺乳期间的女职工提 供劳动保护。五、劳动报酬第七条乙方执行标准工时工作制或综合计算工时工作制的,甲方每月日前以货币形式支付乙方工资,月工资为 元。试用期间的 月工资 元。乙方执行不定时工作制的,甲方每月 日前支付乙方的工资按 执行。第八条 乙方在法定的工作时间内提供正常劳动,甲方支

35、izati on re quireme nts, 18se ssi onofthe第十三条经甲乙双方协商一致,可以变更本合同。第十四条本合同订立时所依据的法律、行政法规、规章发生变化,本合同应变更相关内容。第十五条本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,可以变更本合同相关内容。九、劳动合同的解除第十六条经甲乙双方协商一致,本合同可以解除。第十七条乙方有下列情形之一,甲方可以解除本合同;1、 、 在试用期间被证明不符合录用条件的;2、 严重违反劳动纪律或甲方规章制度的;3、 严重失职、营私舞弊,给甲方利益造成重大损害的;4、 劳动者同时与其他用人单位建

36、立劳动关系,对完成本单位的工作任务造成严重影响,或者经用人单位提出,拒不改正的;5、 以欺诈、胁迫的手段或者乘人之危,使对方在违背真实意思的情况下订立的或者变更劳动合同的;6、 被依法追究刑事责任的。第十八条有下列情形之一,甲方提前三十日以书面形式通知乙方或者额外支付劳动者一个月工资后,可以解除劳动合同:1 、乙方患病或者非因工负伤,在规定的医疗期满后,不能从事原工作也不能从事由甲方另行安排的工作的;2、乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;3、劳动合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,经双方协商不能就变更合同内容达成协议的。第十九条甲方濒临破产进
