1、最新专利英译指导手册(新版)一 专利根本知识专利的种类在不同的国家有不同规定，在我国专利法中规定有：实用新型专利、创造专利和外观设计专利。(1) 实用新型专利我国?专利法?第二条第二款对实用新型的定义是：“实用新型是指对产品的形状、构造或者其结合所提出的适于实用的新的技术方案。 所谓产品是指工业上能够制造的各种新制品，包括有一定形状和结构的固体、液体、气体之类的物品。所谓方法是指对原料进行加工，制成各种产品的方法。实用新型保护的是一个技术方案。实用新型专利保护的范围较窄，它只保护有一定形状或结构的新产品，不保护方法以及没有固定形状的物质。实用新型的技术方案更注重实用性，其技术水平较创造而言，要

2、低一些，多数国家实用新型专利保护的都是比拟简单的、改进性的技术创造，可以称为小创造。实用新型是指对产品的形状、构造或者其结合所提出的适于实用的新的技术方案，授予实用新型专利不需经过实质审查，手续比拟简便，费用较低，因此，关于日用品、机械、电器等方面的有形产品的小创造，比拟适用于申请实用新型专利。 (2) 创造专利我国?专利法?第二条第一款对创造的定义是：“创造是指对产品、方法或者其改进所提出的新的技术方案。 创造专利并不要求它是经过实践证明可以直接应用于工业生产的技术成果，它可以是一项解决技术问题的方案或是一种构思，具有在工业上应用的可能性，但这也不能将这种技术方案或构思与单纯地提出课题、设想

3、相混淆，因单纯地课题、设想不具备工业上应用地可能性。创造是指对产品、方法或者其改进所提出的新的技术方案，主要表达新颖性、创造性和实用性。取得专利的创造又分为产品创造如机器、仪器设备、用具和方法创造制造方法两大类。 (3) 外观设计专利我国?专利法?第二条第三款对外观设计的定义是：“外观设计是指对产品的形状、图案或其结合以及色彩与形状、图案的结合所作出的富有美感并适于工业应用的新设计。并在?专利法?第二十三条对其授权条件进行了规定，“授予专利权的外观设计，应当不属于现有设计；也没有任何单位或者个人就同样的外观设计在申请日以前向国务院专利行政部门提出过申请，并记载在申请日以后公公告的专利文件中。，

4、相对于以前的专利法，最新修改的专利法对外观设计的要求提高了。外观设计与创造、实用新型有着明显的区别，外观设计注重的是设计人对一项 产品的外观所作出的富于艺术性、具有美感的创造，但这种具有艺术性的创造，不是单纯的工艺品，它必须具有能够为产业上所应用的实用性。外观设计专利实质上是保护美术思想的，而创造专利和实用新型专利保护的是技术思想；虽然外观设计和实用新型与产品的形状有关，但两者的目的却不相同，前者的目的在于使产品形状产生美感，而后者的目的在于使具有形态的产品能够解决某一技术问题。例如一把雨伞，假设它的形状、图案、色彩相当美观，那么应申请外观设计专利，如果雨伞的伞柄、伞骨、伞头结构设计精简合理，

5、可以节省材料又有耐用的功能，那么应申请实用新型专利。外观设计是指对产品的形状、图案或者其结合以及色彩与形状、图案的结合所作出的富有美感并适于工业应用的新设计。外观设计专利的保护对象，是产品的装饰性或艺术性外表设计，这种设计可以是平面图案，也可以是立体造型，更常见的是这二者的结合，授予外观设计专利的主要条件是新颖性。 二 专利英译常用词解析1.实用新型：utility model 这个词在使用时前面一定要加定冠词，即只要出现，其形式必为 the utility model。 例如：本实用新型公开了一种液控伸缩臂。 The utility model discloses a hydraulic c

47、、输出机构，其中，拍照机构用于对被扫描件的正反两面进行拍摄，获取被扫描件的正反两面的图像；图像处理机构与拍照机构连接，用于将被扫描件的正反两面的图像拼合成一幅图像；输出机构与图像处理机构连接，用于将图像处理机构处理后的图像输出至外部打印设备打印。之后就可以用以上标红的方式来翻译，这样句子结构相对就清晰很多，到达了化繁为简的目的，而且保证了译文的正确性和也尊重了原文所要表达的意思。格式要求：专利写作对格式的要求较少，目前只有三个是必须遵守的，即：1) 对于简单的名词并列，要在最后两个并列项之间加 and。其余并列项之间用逗号隔开。例如：I have a book, a pen and a pen

48、cil-box.2) 对于句子的并列，一般在两个句子之间加分号，并在最后一个分号的后面加and。如上面例如中的wherein之后的并列项所示。3) 如果并列的是名词，但名词有后置定语修饰，此时要在最后一个 and 前加，以防止产生歧义。30. “还包括的“还要译成 further四 优点的英译在中文专利摘要中，最后几句话往往是对专利的“表扬，是一些优点相关的词句，这些词句的特点是结构松散，逻辑关系混乱，因此英译时特别困难，所以在这里单独讲解一番。例一：本实用新型中的玩具通过多个部件的旋转操作，可以在所述三个状态下任意变化，操作者可以根据自己的创意，通过不同的变形步骤和方法，实现变形，从而很大的

49、增强了玩具的娱乐性，并对于开发智力和创新能力具有良好的作用。首先，虽然中文里写的是“本实用新型，但在英译时，应尽量使用具体的名词来代替“本实用新型，在本文中，具体的名词是 green pepper serpent transformer青椒毒蛇变形玩具；“可以在所述三个状态下任意变化，不要直接简单地译为 can change at random under the three states，在的状态下，介词用 in，不是 under，而且意思也不对。这句的意思是可以变成这三种状态中的任意一种状态。参考译文：The green pepper serpent transformer can swi
