3、erIGeneralProvisionsArticle1ThisLawisformulatedforthepurposeofprotectingandsavingthespeciesofwildlifewhicharerareornearextinction,protecting,developingandrationallyutilizingwildliferesourcesandmaintainingecologicalbalances.Article2AllactivitieswithintheterritoryofthePeoplesRepublicofChinaconcerningt

4、heprotection,domestication,breeding,developmentandutilizationofspeciesofwildlifemustbeconductedinconformitywiththisLaw.ThewildlifeprotectedunderthisLawreferstothespeciesofterrestrialandaquaticwildlifewhicharerareornearextinctionandthespeciesofterrestrialwildlifewhicharebeneficialorofimportanteconomi

5、corscientificvalue.ThewildlifereferredtointheprovisionsofthisLawmeansthewildlifewhichshallenjoyprotectionasprescribedintheprecedingparagraph.Asregardstheprotectionofthespeciesofaquaticwildlifeotherthanthosewhicharerareornearextinction,theprovisionsoftheFisheriesLawshallapply.Article3Wildliferesource

6、sshallbeownedbytheState.Thestateprotectsthelawfulrightsandinterestsofunitsandindividualsengagedinthedevelopmentorutilizationofwildliferesourcesaccordingtolaw.3Article4TheStatepursuesapolicyofstrengtheningtheprotectionofwildliferesources,activelydomesticatingandbreedingthespeciesofwildlife,andrationa

7、llydevelopingandutilizingwildliferesources,andencouragesscientificresearchonwildlife.Unitsandindividualsthathavemadeoutstandingachievementsintheprotectionofwildliferesources,inscientificresearchonwildlife,orinthedomesticationandbreedingofwildlifeshallbeawardedbythegovernment.Article5CitizensofthePeo

8、plesRepublicofChinashallhavethedutytoprotectwildliferesourcesandtherighttoinformtheauthoritiesoforfilechargesagainstactsofseizureordestructionofwildliferesources.Article6Thegovernmentsatvariouslevelsshallstrengthentheadministrationofwildliferesourcesandformulateplansandmeasuresfortheprotection,devel

9、opmentandrationalutilizationofwildliferesources.Article7ThedepartmentsofforestryandfisheriesadministrationundertheStateCouncilshallberespectivelyresponsibleforthenationwideadministrationofterrestrialandaquaticwildlife.Thedepartmentsofforestryadministrationunderthegovernmentsofprovinces,autonomousreg

10、ionsandmunicipalitiesdirectlyundertheCentralGovernmentshallberesponsiblefortheadministrationofterrestrialwildlifeintheirrespectiveareas.Thedepartmentsinchargeoftheadministrationofterrestrialwildlifeunderthegovernmentsofautonomousprefectures,countiesandmunicipalitiesshallbedesignatedbythegovernmentso

11、fprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment.Thedepartmentsoffisheryadministrationunderthelocalgovernmentsatorabovethecountylevelshallberesponsiblefortheadministrationofaquaticwildlifeintheirrespectiveareas.ChapterIIProtectionofWildlifeArticle8TheStateprotectswildlif

12、eandtheenvironmentforitssurvival,andprohibitstheillegalhunting,catchingordestructionofwildlifebyanyunitorindividual.Article9TheStategivesspecialprotectiontothespeciesofwildlifewhicharerareornearextinction.Thewildlifeunderspecialstateprotectionshallconsistoftwoclasses:wildlifeunderfirstclassprotectio

13、nandwildlifeundersecondclassprotection.ListsorrevisedlistsofwildlifeunderspecialstateprotectionshallbedrawnupbytheadministrativedepartmentforwildlifeunderthestateCouncilandannouncedafterbeingsubmittedtoandapprovedbytheStateCouncil.Thewildlifeunderspeciallocalprotection,beingdifferentfromthewildlifeu

14、nderspecialstateprotection,referstothewildlifespeciallyprotectedbyprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment.Listsofwildlifeunderspeciallocalprotectionshallbedrawnupandannouncedbythegovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyunder4theCentralGove

15、rnmentandshallbesubmittedtotheStateCouncilfortherecord.Listsorrevisedlistsofterrestrialwildlifeunderstateprotection,whicharebeneficialorofimportanteconomicorscientificvalue,shallbedrawnupandannouncedbytheadministrativedepartmentforwildlifeundertheStateCouncil.Article10Theadministrativedepartmentforw

16、ildlifeundertheStateCouncilandgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshall,inthemaindistrictsandwaterareaswherewildlifeunderspecialstateorlocalprotectionlivesandbreeds,designatenaturereservesandstrengthentheprotectionandadministrationofwildlifeunder

17、specialstateorlocalprotectionandtheenvironmentforitssurvival.ThedesignationandadministrationofnaturereservesshallbeeffectedinaccordancewiththerelevantprovisionsoftheStateCouncil.Article11Administrativedepartmentsforwildlifeatvariouslevelsshallkeepwatchonandmonitortheimpactoftheenvironmentonwildlife.

18、Iftheenvironmentalimpactcausesharmtowildlife,theadministrativedepartmentsforwildlifeshallconductinvestigationanddealwiththematterjointlywiththedepartmentsconcerned.Article12Ifaconstructionprojectproducesadverseeffectsontheenvironmentforthesurvivalofwildlifeunderspecialstateorlocalprotection,theconst

19、ructionunitshallsubmitareportontheenvironmentalimpact.Thedepartmentofenvironmentalprotectionshall,inexaminingandapprovingthereport,seektheopinionoftheadministrativedepartmentforwildlifeatthesamelevel.Article13Ifnaturaldisasterspresentthreatstowildlifeunderspecialstateorlocalprotection,thelocalgovern

20、mentsshalltaketimelymeasurestorescuethem.Article14Iftheprotectionofwildlifeunderspecialstateorlocalprotectioncauseslossestocropsorotherlosses,thelocalgovernmentsshallmakecompensationforthem.Measuresforsuchcompensationshallbeformulatedbythegovernmentsofprovinces,autonomousregionsandmunicipalitiesdire

21、ctlyundertheCentralGovernment.ChapterIIIAdministrationofWildlifeArticle15Theadministrativedepartmentsforwildlifeshallregularlycarryoutsurveysofwildliferesourcesandkeeprecordsofthem.Article16Thehunting,catchingorkillingofwildlifeunderspecialstateprotectionshallbeprohibited.Wherethecatchingorfishingfo

22、rwildlifeunderfirstclassstateprotectionisnecessaryforscientificresearch,domesticationandbreeding,exhibitionorotherspecialpurposes,theunitconcernedmustapplytotheadministrativedepartmentforwildlifeundertheStateCouncilforaspecialhuntingandcatchinglicense;wherethecatchingorhuntingofwildlifeundersecondcl

23、assstateprotectionisintended,theunitconcernedmustapplytotherelevantadministrativedepartmentforwildlifeunderthegovernmentofaprovince,anautonomousregionoramunicipalitydirectlyundertheCentral5Governmentforaspecialhuntingandcatchinglicense.Article17TheStateencouragesthedomesticationandbreedingofwildlife

24、.Anyonewhointendstodomesticateandbreedwildlifeunderspecialstateprotectionshallobtainalicense.AdministrativemeasuresforsuchlicensesshallbeformulatedbytheadministrativedepartmentforwildlifeundertheStateCouncil.Article18Anyonewhointendstohuntorcatchwildlifethatisnotunderspecialstateprotectionmustobtain

25、ahuntinglicenseandobservethehuntingquotaassigned.Anyonewhointendstohuntwithagunmustobtainagunlicensefromthepublicsecurityorganofthecountyormunicipalityconcerned.Article19Anyoneengagedinthehuntingorcatchingofwildlifeshallobservetheprescriptionsinhisspecialhuntingandcatchinglicenseorhishuntinglicensew

26、ithrespecttothespecies,quantity,areaandtimelimit.Article20Innaturereservesandareasclosedtohunting,andduringseasonsclosedtohunting,thehuntingandcatchingofwildlifeandotheractivitieswhichareharmfultothelivingandbreedingofwildlifeshallbeprohibited.Theareasandseasonsclosedtohuntingaswellastheprohibitedhu

27、ntinggearandmethodsshallbespecifiedbygovernmentsatorabovethecountylevelorbytheadministrativedepartmentsforwildlifeunderthem.Article21Thehuntingorcatchingofwildlifebytheuseofmilitaryweapons,poisonorexplosivesshallbeprohibited.Measuresforthecontroloftheproduction,saleanduseofhuntingriflesandbulletssha

28、llbeformulatedbythedepartmentofforestryadministrationundertheStateCounciljointlywiththepublicsecuritydepartment,andshallenterintoforceafterbeingsubmittedtoandapprovedbytheStateCouncil.Article22Thesaleandpurchaseofwildlifeunderspecialstateprotectionortheproductsthereofshallbeprohibited.Wherethesale,p

29、urchaseorutilizationofwildlifeunderfirstclassstateprotectionortheproductsthereofisnecessaryforscientificresearch,domesticationandbreeding,exhibitionorotherspecialpurposes,theunitconcernedmustapplyforapprovalbytheadministrativedepartmentforwildlifeundertheStateCouncilorbyaunitauthorizedbythesamedepar

30、tment.Wherethesale,purchaseorutilizationofwildlifeundersecondclassstateprotectionortheproductsthereofisnecessary,theunitconcernedmustapplyforapprovalbytheadministrativedepartmentforwildlifeunderthegovernmentoftherelevantprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentorbyauni

31、tauthorizedbythesamedepartment.Unitsandindividualsthatdomesticateandbreedwildlifeunderspecialstateprotectionmay,bypresentingtheirdomesticationandbreedinglicenses,sellwildlifeunderspecialstateprotectionortheproductsthereof,inaccordancewiththerelevantregulations,topurchasingunitsdesignatedbythe6govern

32、ment.Theadministrativeauthorityforindustryandcommerceshallexercisesupervisionandcontroloverwildlifeortheproductsthereofthatareplacedonthemarket.Article23Thetransportationorcarryingofwildlifeunderspecialstateprotectionortheproductsthereofoutofanycountymustbeapprovedbytheadministrativedepartmentforwil

33、dlifeunderthegovernmentoftherelevantprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment,orbyaunitauthorizedbythesamedepartment.Article24Theexportofwildlifeunderspecialstateprotectionortheproductsthereof,andtheimportorexportofwildlifeortheproductsthereof,whoseimportorexportisrest

34、rictedbyinternationalconventionstowhichChinaisaparty,mustbeapprovedbytheadministrativedepartmentforwildlifeundertheStateCouncilorbytheStateCouncil,andanimportorexportpermitmustbeobtainedfromthestateadministrativeorganinchargeoftheimportandexportofthespecieswhicharenearextinction.TheCustomsshallclear

35、theimportsorexportsafterexaminingtheimportorexportpermit.TheexportofthespeciesofwildlifeinvolvingscientificandtechnologicalsecretsshallbedealtwithinaccordancewithrelevantprovisionsoftheStateCouncil.Article25Theforgery,saleorresaleortransferofspecialhuntingandcatchinglicenses,huntinglicenses,domestic

36、ationandbreedinglicenses,andimportandexportpermitsshallbeprohibited.Article26Whereanyforeignerintends,intheterritoryofChina,tomakesurveysofortofilmorvideotapewildlifeunderspecialstateprotectioninthefield,hemustapplyforapprovalbytheadministrativedepartmentforwildlifeundertheStateCouncilorbyaunitautho

37、rizedbythesamedepartment.TheestablishmentofhuntinggroundsopentoforeignersshallberegisteredwiththeadministrativedepartmentforwildlifeundertheStateCouncil.Article27Anyoneengagedintheutilizationofwildlifeortheproductsthereofshallpayafeefortheprotectionandadministrationofwildliferesources.Thescheduleoft

38、hefeeandtheprocedureforcollectingitshallbeformulatedbytheadministrativedepartmentforwildlifeundertheStateCounciljointlywiththefinancialandpricingauthoritiesandshallenterintoforceafterbeingsubmittedtoandapprovedbytheStateCouncil.Article28Anyonewhohascausedlossestocropsorotherlosseswhilehuntingorcatch

39、ingwildlifeshallbeheldresponsibleforcompensation.Article29Thelocalgovernmentsconcernedshalltakemeasurestopreventandcontroltheharmcausedbywildlifesoastoguaranteethesafetyofhumanbeingsandlivestockandensureagriculturalandforestryproduction.Article30Theadministrativemeasuresforwildlifeunderspeciallocalp

40、rotectionandforotherwildlifethatisnotunderspecialstateprotectionshallbeformulatedbythestandingcommitteesofthepeoplescongressesofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentral7Government.ChapterIVLegalLiabilitiesArticle31Anyonewhoillegallycatchesorkillswildlifeunderspecialstatepr

41、otectionshallbeprosecutedforcriminalresponsibilityinaccordancewiththesupplementaryprovisionsonpunishingthecrimesofcatchingorkillingthespeciesofwildlifeunderspecialstateprotectionwhicharerareornearextinction.Article32Ifanyone,inviolationoftheprovisionsofthisLaw,huntsorcatcheswildlifeinanareaorduringa

42、seasonclosedtohuntingorusesprohibitedhuntinggearormethodsforthepurpose,hiscatch,huntinggearandunlawfulincomeshallbeconfiscatedandheshallbefinedbytheadministrativedepartmentforwildlife;ifthecircumstancesareseriousenoughtoconstituteacrime,heshallbeprosecutedforcriminalresponsibilityinaccordancewiththe

43、provisionsofArticle130oftheCriminalLaw.Article33Ifanyone,inviolationoftheprovisionsofthisLaw,huntsorcatcheswildlifewithoutahuntinglicenseorinviolationoftheprescriptionsofthehuntinglicense,hiscatchandunlawfulincomeshallbeconfiscatedandheshallbefinedbytheadministrativedepartmentforwildlifeand,inadditi

44、on,hishuntinggearmaybeconfiscatedandhishuntinglicenserevoked.Ifanyone,inviolationoftheprovisionsofthisLaw,huntswildlifewithahuntingriflewithoutalicensefortherifle,heshallbepunishedbyapublicsecurityorganbyapplyingmutatismutandistheprovisionsoftheRegulationsonAdministrativePenaltiesforPublicSecurity.A

45、rticle34Ifanyone,inviolationoftheprovisionsofthisLaw,destroysinnaturereservesorareasclosedtohuntingthemainplaceswherewildlifeunderspecialstateorlocalprotectionlivesandbreeds,heshallbeorderedbytheadministrativedepartmentforwildlifetostophisdestructiveactsandrestoretheseplacestotheiroriginalstatewithi

46、naprescribedtimelimit,andshallbefined.Article35Ifanyone,inviolationoftheprovisionsofthisLaw,sells,purchases,transportsorcarrieswildlifeunderspecialstateorlocalprotectionortheproductsthereof,suchwildlifeandproductsandhisunlawfulincomeshallbeconfiscatedbytheadministrativeauthorityforindustryandcommerc

47、eandhemayconcurrentlybefined.Ifanyone,inviolationoftheprovisionsofthisLaw,sellsorpurchaseswildlifeunderspecialstateprotectionortheproductsthereof,andifthecircumstancesareseriousenoughtoconstituteacrimeofspeculationorsmuggling,heshallbeprosecutedforcriminalresponsibilityaccordingtotherelevantprovisio

48、nsoftheCriminalLaw.Thewildlifeortheproductsthereofthusconfiscatedshall,inaccordancewiththerelevantprovisions,bedisposedofbytherelevantadministrativedepartmentforwildlifeorbyaunitauthorizedbythesamedepartment.Article36Ifanyoneillegallyimportsorexportswildlifeortheproductsthereof,heshallbe8punishedbyt

49、heCustomsaccordingtotheCustomsLaw;ifthecircumstancesareseriousenoughtoconstituteacrime,heshallbeprosecutedforcriminalresponsibilityinaccordancewiththeprovisionsoftheCriminalLawonthecrimesofsmuggling.Article37Ifanyoneforges,sellsorresellsortransfersaspecialhuntingandcatchinglicense,ahuntinglicense,ad

50、omesticationandbreedinglicense,oranimportorexportpermit,hislicenseorpermitshallberevokedandhisunlawfulincomeshallbeconfiscatedandhemayconcurrentlybefinedbytherelevantadministrativedepartmentforwildlifeortheadministrativeauthorityforindustryandcommerce.Ifanyonewhoforgesorsellsorresellsaspecialhunting

51、andcatchinglicenseoranimportorexportpermit,andifthecircumstancesareseriousenoughtoconstituteacrime,heshallbeprosecutedforcriminalresponsibilitybyapplyingmutatismutandistheprovisionsofArticle167oftheCriminalLaw.Article38Anystaffmemberofaadministrativedepartmentforwildlifewhoneglectshisduty,abuseshispowerorengagesinmalpracticesforpersonalgainsshallbesubjecttoadministrativesanctionsbythedepartmenttowhichhebelongsorbythecompetentauthorityatahigherlevel;ifthecircumstancesareseriousenoughtoconstituteacrime,heshallbeprosecutedforcriminalresponsibilityaccordingtolaw.Article39Anypartywhoisdiss
