慈善事业论文：中国慈善事业之发展瓶颈分析【中文摘要】对制约慈善事业发展的瓶颈展开分析,不能简单地考察法律制度是否完善、慈善组织是否发达以及人们的慈善观念是否先进,而需将制度、组织与观念三者统一起来,从“制度·组织·观念”三者的交互关系出发综合分析中国慈善事业发展的制约因素。翻检以往学者围绕中国慈善事业相对于西方国家所呈现出来的滞后现象所展开的讨论,主要有如下三种模式:其一,一些学者将中国慈善事业滞后的原因归结为中国保障慈善事业发展的法律欠缺,或者相关法律缺乏可操作性,据此他们主张中国慈善事业的发展需要从建立健全保障慈善事业的法律制度出发,这种学术建议无非是立法完善、执法加强、监管适当等等,似乎中国保障慈善事业的法律制度应对中国慈善事业之发展当担负起主要责任,有的学者在这方面走的更远,往往会陷入“唯法律制度论”的泥潭之中而难以自拔;其二,与“唯法律制度论”针锋相对的观念是“慈善观念决定论”,主张此种学说的学者认为中国慈善制度不发达的原因在于中国传统慈善观念或者中国传统的财产观念与现代慈善观念格格不入,进而得出这种观念上的滞后性决定了中国慈善事业发展的滞后,而相应的解决之道在于国家与社会应当承担起培养“现代慈善观念”之责任;其三,另外一些学人跳出“唯法律制度论”与“观念决定论”的争论,开出慈善事业不发达第三种诊断的药方,即“慈善组织至上论”。他们认为中国慈善事业不发达的主要原因在于中国慈善组织的不发达,或者中国慈善组织大多处于“非正式化”状态之中,这就决定了中国慈善事业落后于西方国家,相应的解决之道也在于促进中国慈善组织的勃兴。从积极意义上讲,上述三种学术研究倾向为中国慈善事业发展之瓶颈研究提供了丰富的学术滋养,但是三种论说都具有自身难以克服的不足与缺陷,即缺乏一种整体论视角。因此,从“制度·组织·观念”三个维度出发,即将中国有关慈善事业保障方面的法律制度、中国政府与中国公民的慈善观念以及中国慈善组织三个层面结合起来,探讨三者之间的耦合关系,全方位透视中国慈善事业的发展历程,总结中国慈善事业区别于西方国家的根源所在,或许能够更加全面地找出中国慈善事业发展滞后的症结所在,并开出更加准确的“病理诊断”结论。或许,将这种以“制度·组织·观念”交互关系为视角的研究方法应用于中国慈善事业发展的研究,将更具理论与实践意义。【英文摘要】AnalyzingthebottleneckofrestrictingChinesephilanthropydevelopment,wecan’tsimplyexaminewhetherthelegalinstitutionsareperfectornot,ifthephilanthropicorganizationsaredevelopedandwhetherthecharitableconceptisadvanced.Weneedtounifythesystem,organizationandconcepttogether,andanalyzethefactorswhichrestrictingthedevelopmentofphilanthropycomprehensivelyintheviewoftheinteractiverelationshipof‘system·organization·concept’.Weglancethroughandcheckthepreviousscholars’discussingthehysteresisphenomenaofChinesephilanthropy,comparedwithwesterncountries’.Therearemainlythefollowingthreemodes:Firstly,somescholarsthinkthelagofChinesephilanthropycanbeattributedtothelackoflawonChinesecharitydevelopment,ortherelatedlawlackingofmaneuverability.Accordingtothat,theyclaimChinesephilanthropydevelopmentneedsestablishingandperfectingthelegalsystemofcharitablesecurity.Thisacademicsuggestionisnothingbutlegislativeimprovement,strengtheningoflawenforcementofficer,appropriateregulatoryandsoon.ItseemsthatthelegalsystemofChinesecharitablesecurityshouldbearthemainresponsibility.Whilesomescholarslookfurtherinthisrespect,theyevenmireinthemudof“theoryofonlyfollowinglegalsystem”andhardtoextricatethemselves.Secondly,‘theoryofcharitableconceptiondeterminism’counterpoises“theoryofonlyfollowinglegalsystem“completely.AndthescholarswhoadvocatecharitableconceptiondeterminismbelievethecauseofunderdevelopmentofChinesecharitiesisthetraditionalChinesecharitableideasortraditionalChinesepropertyconceptisincompatiblewiththemoderncharitableideas.ThentheydrawthelagofthisidealeadstothelagofChinesecharitabledevelopment,andthecorrespondingsolutionliesinthatthenationandsocietyshouldundertaketheresponsibilityoftraining‘moderncharitableconception’.Thirdly,someotherscholarsjumpoutofdebateaboutthe‘theoryofonlyfollowinglegalsystem’and‘conceptdeterminism’,andgivethethirddiagnosisprescriptiononcharitableunderdevelopment,namely‘Charitableorganizationsupremacy’.TheysaythemainreasonofChinacharitableunderdevelopmentliesinthefactthatChinacharitableorganizationisunderdeveloped,orChinesecharitableorganizationismostlyinastateof‘informalchange’,whichdeterminestheChinesephilanthropylagsbehindthatinthewesterncountries.AndthecorrespondingsolutionalsoliesinpromotingChina’scharityorganizationgrowingvigorouslyInthepositivesense,theabovethreeacademicresearchtendenciesprovidealotofacademicnourishforresearchingbottleneckofChinesephilanthropydevelopment.Butthethreepropositionshavetheirownshortagesanddefectswhicharedifficulttoovercome.Inoneword,theylackaholisticperspective.Therefore,intheangleofthethreedimensionalities,as‘system·organization·concept’,weunifytheChinesecharitablelawsystem,ChinesegovernmentandcharitableconceptionofChinesecitizens,andtheChinesecharitableorganizationtogether.Thenwediscussthecoupledrelationshipamongthethreeaspects.What’more,welookoverthedevelopmenthistoryofChinesephilanthropy,inordertosummarizetheoriginofthat’sdifferentfromwesterncountries’,andperhapswouldgainthesourceofChinesephilanthropydevelopmentlagbehindcompletelyandproposethemoreaccurateverdictofthe‘pathologicaldiagnosis’.Perhaps,weapplytheresearchmethod,whichisintheviewofinteractiverelationshipamongthe‘system·organization·concept’,tothestudyondevelopmentofChinesecharities,andtherewillbemoresignificanceofresearchtheoryandhepractice.【关键词】慈善事业制度特质组织机制观念系统【英文关键词】PhilanthropyInstitutionalfeaturesOrganizedmechanismConceptsystem【目录】中国慈善事业之发展瓶颈分析
