中国高等教育存在的问题及解决方法ProblemsofChina'sHigherEducationandtheSolutions目前，我国高等教育在管理过程中普遍存在一些亟待解决的突出的问题。近年来，一向在人们心目中远离是非纷扰之地的圣洁的象牙塔--高校也频频被学生推上行政诉讼的被告席。高校被学生起诉，一方面反映了我们正处在一个"走向权利的时代"，人们的权利意识得到了普遍的提高，越来越多的人，包括莘莘学子们都在"认真地对待权利"并"为权利而斗争"，另一方面也反映了目前我国高等教育在管理过程存在的问题确实十分严重。Currently,China'shighereducationinthemanagementprocessprevalentsomeproblemstosolveanoutstandingproblem.Inrecentyears,hasbeenawayfromtheeyesofpeopleinnondisputetothesanctityoftheivorytower--Collegestudentsalsofrequentlyontotheadministrativeproceedingsthedock.Collegestudentshavebeenindicted,ontheonehand,reflects,weareina"totherightoftimes."awarenessofrightstobeuniversal,andincreasingnumbersofpeople,includingstudentswhoare"seriouslytreattheright"and"thestrugglefortherights,"otherhand,italsoreflectsthecurrenthighereducationinthemanagementprocessisreallyaveryseriousproblem.一、目前高等教育管理中存在的突出问题主要表现在以下四个方面：1,Thehighereducationmanagementinthemajoroutstandingissuesinthefollowingfouraspects:1、招生方面受教育权与平等权是我国宪法所明文确认的我国公民所享有的基本权利。但由于历史的及其它的种种原因，这两项基本权利在我国高等教育招生中往往并未得到完整的贯彻。1,EnrollmentTherighttoeducationandequalrightsisexplicitlyrecognizedbytheConstitutionofourcitizensenjoybasicrights.However,becauseofhistoricalandotherreasons,ThesefundamentalrightsofhighereducationenrollmentinChinaisoftennotbeencarriedoutinitsentirety.2、对学生管理、尤其是在处分学生方面2,Studentmanagement,particularlyinthepunishmentofstudents高校往往仅依据学校内部的一纸超越甚至违反我国现行法律规定的管理规定，就剥夺了受处分学生享有的受《宪法》保护的受教育权，这种处分的合宪性实在值得怀疑。另外，高校在管理过程中往往还缺乏程序观念。Universitiesoftenonlyonthebasisofaninternalschoolpaperorevenbeyondourexistinglawsviolateprovisionsoftheregulationsdeprivedstudentshavebeendisciplinedbythe"Constitution"toprotecttherighttoeducation,thisactionistheconstitutionalityisquestionable.Inaddition,collegesanduniversitiesinthemanagementprocessisoftenalackofideas.3、学术管理问题3,Academicmanagementissues目前一些高校制定的学术管理的规定本身往往从实体上或程序上却是不合法、不合理、荒谬及不近人情的。Somecollegesanduniversitiesdevelopacademicmanagementoftenrequiresitsownentityoraprocedureisnotillegal,unreasonable,absurdandunreasonable.4、对教师的管理问题4,Theteacher'smanagementproblems在高校对教师的管理问题中，容易发生冲突之处主要表现在职称评定、人事流动两个问题上。Collegeteachersinthemanagement,conflict-proneliesmainlyintheTitleperformanceevaluation,personnelmovementonthetwoissues.二、解决问题的对策2,Problem-solvingmeasures1、必须加强高等教育自身的及有关高等教育方面法学理论的研究，加快高等教育立法以及及时清理不适应时代要求的高等教育管理类法律、法规的步伐，解决目前我国高等教育无法可依和法律、法规严重落后于时代发展要求的现状。1.Theneedtostrengthentheirownhighereducationandtertiaryeducationinthelegaltheoryoftheresearch,acceleratehighereducationlegislationandtimelyliquidationnotsuitedtothedemandsoftheeraofHigherEducationManagementlaws,regulations,thepacesolveourhighereducationandnolegalbasisforlawsandregulationsarelaggingseriouslybehindinthedevelopmentofthetimesofthestatusquo.2、高等教育要与时俱进，锐意改革。2,Thehighereducationtokeeppacewiththetimesandcarryingoutreform.3、高校管理中，必须贯彻依法治校，尤其是依法律程序或合理程序治校的原则。3,Thecollegemanagement,wemustmanagetheschool,especiallyonlegalproceedingsorreasonableproceduresforadministrationoftheschoolprinciple.4、最后一点，必须强调的是，以上所有的这些措施都必须建立在以人为本的基础上。高等教育的核心在于解决人的问题，关键是要培养人的健全的人格、开放的心态、创新的思维方式和掌握创新的手段。因此，必须大力转变高等教育的观念，进一步加强对高等教育的内涵、发展、规律以及未来发展趋势等观念性问题的理论性研究，不断地更新教育观念。4,Thelastpointtobeemphasizedisthatallofthesemeasuresmustbebasedonapeople-orientedbasis.Highereducationisthecoreofsolvingtheproblems,thekeyistocultivatepeople'ssoundpersonality,anopenmind,innovativewaysofthinkingandinnovativemeanstograsp.Therefore,wemuststrivetochangetheconceptofhighere
