双方经协商一致签订本协议如下：员工培训协议TrainingProgramandPeriod1．培训项目与时间：PartyBhasreceivedanofferfromPartyAtoparticipateinatrainingprogram (programname)whichissponsoredbyPartyAin (country/city)from (date)to (date).乙方接受甲方提供的培训机会，于 (日期)前往 (国家/城市)参加由甲方出资的 培训项目。PartyAmaydecideatitsowndiscretiontoadvance,delay,extend,shortenorcancelthistrainingprogramdependingonpracticalsituationsofPartyBduringthetrainingperiodandPartyA'sevaluationonPartyB'sfuturedevelopment.PartyAshallinformPartyBofsuchadjustmentstothetrainingpromptlyandPartyBshallbesubjecttotheadjustmentmadebyPartyA.甲方可以根据乙方在培训期间内的表现以及甲方对乙方日后发展的评估，提前、推迟、延长、缩短或取消本次培训计划。甲方将及时把上述调整决定通知乙方，乙方应服从甲方的调整安排。1.3Accordingtojobandskillrequirements,PartyAwilldesigntrainingplanincludingtrainingscheduleandcontent.Theassignedtrainingcontentislistedbelow:甲方将按工作和职能岗位的要求制定培训计划，安排乙方的主要培训内容为：-ITrainingExpense2．培训费用PartyAwillbefullyresponsibleforallexpensesrelatedtotheprogram,includingvisafee(foroverseastraining),trainingcost,accommodation&transportationexpensesandtravelallowance,etc.TheabovetrainingexpensesareexpectedtobeRMB[]andthefinalexpensesshallbedeterminedaccordingtotheactualexpenditures.甲方负责支付乙方在培训期间所有与培训相关的费用，包括签证费(适用于海外培训)、培训费、住宿费、交通费、出差生活补贴等。以上培训费用预计为人民币[ ]元，最终的费用将依据实际支出情况而定。Duringthetrainingperiod,PartyB'scompensationpackshallremainunchangedduringthetraining.培训期间，乙方所享有的工资和其它待遇，保持不变。Referringtocertifications,PartyAisresponsibleforexpensesofthefirstexaminationorcertification.Iffailtobecertificatedorrequiredtomakeupexamination,relatedexpensesshouldbechargedbyPartyB.培训涉及需获取证书的，甲方将仅负责第一次参加考试或取证的费用，因乙方原因未能成功取得证书，培训费用将由乙方承担；甲方同意复试，复试相关费用也需由乙方承担。2.4Providingexpensesforthefirsttimetraining,PartyAwillfileoriginalcertification.Otherwise,originalcertificationwillbekeptbyPartyBandcopieddocumentortemporaryoriginalfilewillbereasonable.由甲方出资初次获取的培训相关证书，原件由甲方保管；乙方入职时具备的证书或由甲方出资复审的，原件由乙方保管，并按甲方要求提供复印件或允许甲方临时使用原件。ObligationofTrainingRelatedTermofService3.培训服务期义务PartyBagreestoservePartyAoritsaffiliatesforaminimumof consecutiveyearsuponcompletionoftraining.Thistermofserviceshallcommenceon[DDMMYY]andendon[DDMMYY].IfthetermofserviceexceedsthetermagreeduponintheLaborContract,unlessPartyAexemptsPartyB'sobligationinwrittenform,PartyBagreestoextendthetermofLaborContracttotheexpirationdateofthetermofserviceautomatically.IfbothpartiesconcludeanewlaborDocumentNo:Ver1.00员工培训协议contract,unlessotherwiseagreeduponbybothparties,theobligationofserviceperiodshallcontinuetoperform.乙方同意在培训结束后，至少连续为甲方或其关联机构服务 年，此期限自［ ］至［ ］止。若乙方的服务期超过劳动合同中约定的期限，除非甲方以书面形式免除乙方的服务期义务，否则乙方将同意该劳动合同将自动延续至上述服务期届满之时止。如果双方重新订立新的劳动合同，除非双方另有约定，否则服务期义务应继续履行。IfPartyBisarrangedbyPartyAtoterminatethelaborcontractduringthetermofthisAgreementandthenPartyBworksforPartyA'saffiliate,unlessPartyAreleasestheobligationofPartyBunderthisAgreementinwrittenform,PartyA'saffiliateshallsucceedtoPartyA'srightsunderthisAgreementandPartyBshallcontinuetoperformtheobligationofservicetermunderthisAgreementforPartyA'saffiliate.如经甲方同意或安排乙方在履行本协议期间与甲方解除劳动合同并且到甲方的关联公司工作，除非甲方以书面形式免除乙方在本协议下的义务，否则甲方在本协议下的权利均由甲方的关联公司承继，同时乙方应继续向甲方的关联公司履行本协议下的义务。IftheemployeehassignedseveraltrainingagreementswiththeCompanyfordifferenttrainingprogramsduringtheemployment,therequiredservicetermwillnotbeaddedtogether.Therefore,theemployeewillbeobligatedtoremainemployedwiththeCompanyuntiltheexpiryofthelongestserviceterm;however,iftheemployeeterminatethelaborcontractbeforetheexpiryofthelongestserviceterm,thenheorshewillberesponsibleforrepayingtheexpensesofthetrainingprogramstotheCompanyaccordingtothetrainingagreements.如果员工在受雇期间就不同的培训项目分别与公司签订多份培训协议，则多份培训协议所约定的服务期限不简单累加，员工必须在公司工作直到最长的服务期限届满之时。但如果员工于该最长服务期满前提前解除劳动合同，员工应根据培训协议的约定，向公司支付多次培训所发生的各项费用。PartyB'sobligation4．乙方的义务4.1.Duringtheperiodoftraining,PartyBshallobeythelocallawsandregulationsatthetrainingplaceandrespectlocalcustomsandhabits.InthecasethatPartyB'scriminalliabilityispursuedduringthetrainingperiod,PartyAshallhavetherighttoterminatethisAgreementandtheLaborContractbetweentheParties,andrequestPartyBtocompensaterelevantlosses.Duringthetrainingperiod,PartyBshallcomplywiththeEmployeeHandbook,RulesandRegulationsandGuidetoConductoflocaltraininginstitution.IfPartyBfailstocompletethetrainingduetoitsviolationoftherulesofthetraininginstitutionoritsownreason,PartyBshallcompensatePartyAthetrainingfeeandexpenses.在培训期间，乙方应遵守培训地当地的法律法规，并尊重当地的风俗、习惯。如在培训期间，乙方因其行为在培训地被追究刑事责任甲方有权立即解除本培训协议以及双方之间的劳动合同，并要求乙方赔偿有关的损失。在培训期间，乙方必须遵守当地培训机构的雇员手册、规章制度以及行为指引。如乙方在培训期间因违反培训机构的规定或其个人原因而未能完成培训，乙方应赔偿甲方支出的培训费用。PartyBshallreturntoPartyBtoworkintimeafterthetrainingiscompleted.InthecasethatPartyBfailstodosoforanyreasons,theconsentfromPartyAshallbeobtainedinadvance.PartyBshallnotmakeanychangesonthereturndateandvisatypewithouttheconsentofPartyA.IfPartyBdoesnotreturntoworkorleavethepositionwithoutPartyA'sconsent,PartyBshallbearthebreachliabilityandcompensatealltrainingexpensesandalllossespaidandincurredbyPartyA.乙方应在培训结束后按时返回甲方报到上班，因故不能按期上班的，应提前报甲方批准。未经甲方同意，乙方不应变更回程日期和签证种类。乙方未经甲方批准而擅自离职或逾期未归的，应承担违约责任并赔偿甲方的所有培训费用及相关损失。InthecasethatPartyBfailstocompletethetrainingduetoillnessorotherforcemajeurefactors,orPartyBhastosuspendorterminatethetrainingduetoemergenciesduringthetrainingperiod,DocumentNo:Ver1.00

员工培训协议PartyBshallinformPartyApromptlyandmayterminatethetrainingwiththewrittenconsentofPartyA.乙方如由于患病或其它不可抗力等因素无法完成培训的，或在培训过程中因突发事件必须中止或终止培训任务的，必须及时通知甲方，并应在征得甲方书面同意后方可停止培训。Duringthetrainingperiod,PartyBshallneitherengageinthecommercialactivitieswhicharenotrelatedtothetrainingnorprovideservicesforanythirdpartywithouttheconsentofPartyA.未经甲方同意，乙方在培训期间不得擅自参与培训无关的商业活动，也不得为任何与培训活动无关的第三方提供服务。BreachoftheContractand/orPaymentofCompensation5.违约责任及赔偿金的支付5.1.IfPartyBfailstocompletethetrainingduetohis/herviolationofthisAgreement,PartyBshallbeliableforallconsequencesresultedtherefrom.Inaddition,PartyBshallnotbeexemptedfromcompensatingPartyAforallrelativetrainingexpensesandalllossespaidandincurredbyPartyA.如乙方因违反本协议而不能顺利完成本次培训，乙方应承担由此而引起的一切后果，同时并不免除其应赔偿给甲方所有相关培训费用及赔偿甲方的所有损失。IfPartyBterminatestheemploymentrelationshipwithPartyAduringthetermofserviceagreedinArticle3.1,PartyBshallbearthebreachliabilityandmakeliquidateddamagestoPartyA.Thecalculationmethodforliquidateddamagesisasfollows:Liquidateddamages(TermofService一Liquidateddamages(TermofService一Yearsthathavebeenserved)=paidbyPartyATermofService如乙方在第3.1条约定的服务期限内与甲方解除劳动关系，乙方应当向甲方承担违约责任并支付违约金，违约金的计算方法如下：违约金X（服务期-已服务年限）违约金X（服务期-已服务年限）=总费用~服务期5.3IfPartyBisdismissedbyPartyAduetohis/herunsatisfactoryworkingperformances,his/herbreachofPartyA'spoliciesorregulationsorviolationofthelawsduringthetermofservice,PartyBshallcompensatePartyAforalltheexpensespaidbyPartyAforthistrainingprogramaccordingtotheaforesaidcalculationmethod.如乙方在服务期中由于工作表现不佳、违反甲方规章制度或违反国家法律被甲方解雇，乙方应根据以上的计算公式赔偿甲方支付的本次培训费用。AfterPartyAsendsawrittennoticeofcompensationpayment,PartyBshallpayinalumpsumtoPartyAtheliquidateddamagesand/orcompensation,failingwhich,PartyAmayrecoverliquidateddamagesand/orcompensationbythefollowingmeans:甲方发出书面赔偿付款通知书后，乙方应一次付清全部违约及/或赔偿金。否则甲方可以以下列方式索回违约及/或赔偿金：MakingdeductionfromthesalariesofPartyBorthefeesduetoPartyBwhenhe/shecancelsorterminatestheLaborContract(iftheamountfailstomakeupforthetrainingexpenseswhichshouldbepaidtoPartyAforcompensation,PartyBshallcompensatefortheshortfall);5.4.1从乙方的薪金或解除或终止劳动合同时应获得款项中扣除(如果该等款项不足以弥补其应当向甲方赔偿的培训费用，乙方还应当就不足部分予以赔偿)；DocumentNo:Ver1.00员工培训协议PartyAmayclaimthepaymentbyotherlegalmeans.Alltheexpensesincurredfromtheclaim,includingbutnotlimitedtolawyer'sfee,investigationfee,translationfee,nortarizationfeeandwitnessfeeshallbebornebyPartyB.5.4.2甲方可以通过其他适用的法律方式索偿。因索赔而引起的所有费用，包括但不限于律师费、调查费、翻译费、公证费及见证费均由乙方承担。DisputeSettlement6．争议的解决IfadisputebetweenthePartiesarisesfromtheperformanceofthisAgreement,eitherpartymayapplyforarbitrationtothelocalLaborDisputeArbitrationCommissionwherePartyAislocatedwithinthestipulatedtimelimit.IfeitherPartyisdissatisfiedwiththearbitrationaward,suchPartymayinstituteproceedingsinthePeople'sCourtintheplacewherePartyAislocatedwithin15daysofthereceiptofthearbitrationaward.若甲乙双方因履行本协议发生争议，任何一方可以在规定时效内向甲方所在地的劳动争议仲裁委员会申请仲裁。仲裁裁决后，不服从仲裁裁决的一方，可在收到仲裁裁决书之日起十五日内，向甲方所在地人民法院提起诉讼。Miscellaneous7.其他ThisagreementisasupplementofEmploymentContractsignedbybothparties,withsamelegaleffect.本协议为甲乙双方在原签订的“劳动聘用合同”基础上达成的补充协议，与原合同具有同等的法律效力。ThisAgreementisexecutedintwooriginals.Eachpartyshallkeeponeoriginalandbothorig
