图书馆服务承诺书：数字资源普及合同编号：__________LibraryServiceCommitmentLetter:DigitalResourcePopularizationThisLibraryServiceCommitmentLetter(the“CommitmentLetter”)isenteredintoasof__________(the“EffectiveDate”)andbetween:[InsertNameofLibrary](the“Library”),alegalentityorganizedandexistingunderthelawsof[InsertJurisdiction],withaprincipaladdressat[InsertAddress].(eacha“Party”andcollectivelythe“Parties”)RECITALS:WHEREAS,theLibrarydesirestoexpanditsdigitalresourceofferingstoitspatronsandtoensurethattheseresourcesareaccessibleandusedeffectively;NOW,THEREFORE,inconsiderationofthemutualpromisescontainedhereinandforothergoodandvaluableconsideration,thereceiptandsufficiencyofwhicharehereacknowledged,thePartiesagreeasfollows:1.DigitalResourceAccessandAvailability1.1TheLibraryshallprovideitspatronswithaccesstoawiderangeofdigitalresources,includingbutnotlimitedtoebooks,onlinejournals,databases,andaudiovisualmaterials.1.2TheLibraryshallensurethatthesedigitalresourcesareaccessibletopatronsthroughtheLibrary’swebsiteandotherappropriateplatforms,andthatappropriateinstructionsandsupportareprovidedtoassistpatronsinutilizingtheseresources.1.3TheLibraryshallmakereasonableeffortstomaintainandupdatethesedigitalresources,andtoreplaceorrepairanydefectiveormalfunctioningequipmentorsoftwarenecessaryforaccessingtheresources.2.QualityandReliabilityofDigitalResources2.1TheLibraryshallusereasonableeffortstoselectandprovidedigitalresourcesthatareofhighquality,reliable,andrelevanttotheneedsofitspatrons.2.2TheLibraryshallregularlyreviewandevaluatethedigitalresourcesprovided,andshallmakeadjustmentsorchangesasnecessarytoensuretheircontinuedqualityandrelevance.3.PrivacyandConfidentiality3.1TheLibraryshallprotecttheprivacyandconfidentialityofitspatrons’personalinformationandusagedata,inaccordancewithapplicablelawsandregulations.3.2TheLibraryshallimplementandmaintainappropriatesecuritymeasurestoprotectagainstunauthorizedaccess,use,modification,ordestructionofanydigitalresourcesorpatroninformation.4.TrainingandSupport4.1TheLibraryshallprovidetrainingandsupporttoitsstaffandpatronstoensurethattheyareabletoeffectivelyutilizethedigitalresourcesprovided.4.2TheLibraryshallestablishahelpdeskorothersupportmechanismtoassistpatronswithanyquestions,problems,orissuesrelatedtotheuseofthedigitalresources.5.TermandTermination5.2eitherPartymayterminatethisCommitmentLetteruponwrittennoticetotheotherPartyiftheotherPartybreachesanymaterialtermorconditionofthisCommitmentLetterandfailstocuresuchbreachwithin[InsertCurePeriod]afterreceiptofwrittennoticethereof.6.GoverningLawandDisputeResolution6.1ThisCommitmentLettershallbegovernedandconstruedinaccordancewiththelawsof[InsertGoverningJurisdiction],withoutregardtoitsconflictoflawsprinciples.6.2AnydisputesarisingoutoforinconnectionwiththisCommitmentLettershallberesolvedarbitrationinaccordancewiththerulesofthe[InsertArbitrationInstitution],andthedecisionofthearbitrator(s)shallbefinalandbindingupontheParties.7.EntireAgreement7.1ThisCommitmentLetterconstitutestheentireagreementbetweenthePartieswithrespecttothesubjectmatterhereof,andsupersedesallprioragreements,understandings,negotiations,anddiscussions,whetheroralorwritten,oftheParties.INWITNESSWHEREOF,thePartieshaveexecutedthisCommitmentLetterasoftheEffectiveDatefirstabovewritten.Library:By:___________________________Name:Title:Date:Patron:By:___________________________Name:Date:一、附件列表：1.数字资源清单2.培训材料3.技术支持手册4.隐私政策声明5.安全协议6.仲裁协议二、违约行为及认定：1.未能提供或维护访问数字资源的手段。2.数字资源的选择和提供不符合质量和相关性标准。3.未能保护用户隐私和保密信息。4.未按时履行培训和支持义务。5.未能在规定时间内纠正违约行为。6.违反任何其他条款或条件，包括但不限于期限、终止条款、法律适用和争端解决。三、法律名词及解释：1.数字资源：指图书馆通过电子手段提供的书籍、期刊、数据库和其他信息材料。2.隐私和保密：保护用户个人信息不被未经授权的访问、使用或披露。3.违约：违反合同中约定的任何条款或条件。4.争端解决：处理合同执行过程中出现的争议的方法，本合同中通过仲裁解决。5.有效日期：合同开始执行的日期。四、执行中遇到的问题及解决办法：1.技术问题：与供应商沟通，及时更新或修复软件和硬件。2.用户培训：定期举办培训研讨会，提供操作指南和常见问题解答。3.访问限制：确保用户身份验证系统的稳定性和安全性，同
