2025澳大利亚教育机构雇佣合同(中英文)2025澳大利亚教育机构雇佣合同(EmploymentContractforEducationalInstitutioninAustralia2025)ContractNumber:DateofSigning:ThisEmploymentContract("Agreement")ismadeandenteredintoonthisdayof,2025,byandbetweenthefollowingparties:PartyA(Employer):Name:Address:ABN:PartyB(Employee):Name:Address:PassportNumber/TFN:1.Appointment1.1PartyAherebyappointsPartyBtothepositionof("thePosition")attheeducationalinstitutionlocatedat("theInstitution").TheappointmentissubjecttothetermsandconditionssetforthinthisAgreement.1.2Thetermofemploymentshallcommenceon("StartDate")and,unlessterminatedearlierinaccordancewiththeprovisionsofthisAgreement,shallcontinueuntil("EndDate").2.JobDescriptionandDuties2.1PartyBagreestoperformthedutiesandresponsibilitiesassociatedwiththePositionasoutlinedinthejobdescriptionprovidedbyPartyA.Thesedutiesinclude,butarenotlimitedto:Deliveringlessonsandteachingmaterialstostudents;Preparinglessonplansandcoursematerials;Assessingstudentperformanceandprovidingfeedback;Participatinginstaffmeetingsandprofessionaldevelopmentactivities;Maintainingasafeandinclusivelearningenvironment.2.2PartyBagreestocomplywithallpolicies,procedures,andregulationsoftheInstitution,includingbutnotlimitedtothoserelatedtohealthandsafety,discrimination,harassment,anddataprivacy.3.WorkingHoursandLocation3.1ThenormalworkinghoursforPartyBshallbeperweek,inaccordancewiththeInstitution'sacademiccalendarandschedule.3.2PartyBagreestoworkprimarilyattheInstitutionlocatedat.However,PartyBmayberequiredtoworkatotherlocationsorattendeventsoractivitiesasdirectedbyPartyA.4.SalaryandRemuneration4.1PartyAagreestopayPartyBagrossmonthlysalaryofAUD("theSalary"),whichisinclusiveofallapplicableallowancesandbonuses.TheSalaryshallbereviewedannuallyon,subjecttotheperformanceevaluationconductedinaccordancewithSection5.3ofthisAgreement.4.2InadditiontotheSalary,PartyBshallbeentitledtothefollowingbenefits:HealthinsurancecoverageasprovidedbyPartyA;Superannuationcontributionsatarateof%oftheSalary;AnnualleaveentitlementsinaccordancewiththeFairWorkAct2009(Cth);Sickleaveandpersonal/carer’sleaveasperAustralianemploymentlaws.4.3AllpaymentsunderthisAgreementshallbemadetoPartyBonorbeforethelastdayofeachmonth,unlessotherwiseagreedinwriting.5.PerformanceEvaluation5.1PartyAreservestherighttoconductaperformanceevaluationofPartyBatleastonceeverytwelvemonths.TheevaluationwillassessPartyB’sabilitytomeettherequirementsofthePositionandcompliancewithInstitutionpolicies.5.2Theevaluationprocessshallincludefeedbackfromstudents,peers,andsupervisors,aswellasanassessmentofteachingeffectivenessandprofessionaldevelopmentactivities.5.3IfPartyB’sperformanceisdeemedsatisfactoryorabove,PartyAmayincreasetheSalaryinaccordancewithmarketstandardsandbudgetaryconsiderations.6.IntellectualProperty6.1Allmaterials,documents,andintellectualpropertycreatedbyPartyBduringthecourseofemploymentshallbethesolepropertyofPartyA.Thisincludes,butisnotlimitedto,lessonplans,teachingresources,researchpapers,andothereducationalcontent.6.2PartyBagreesnottouseordiscloseanysuchmaterialsforpersonalgainorincompetitionwithPartyAwithoutpriorwrittenconsentfromPartyA.7.Confidentiality7.1PartyBacknowledgesthatduringthecourseofemployment,he/shewillhaveaccesstoconfidentialandproprietaryinformationofPartyA("ConfidentialInformation").SuchConfidentialInformationincludes,butisnotlimitedto,studentrecords,staffinformation,financialdata,andstrategicplans.7.2PartyBagreestomaintaintheconfidentialityofallsuchinformationandnottodiscloseittoanythirdpartywithoutpriorwrittenconsentfromPartyA.ThisobligationshallcontinueindefinitelyaftertheterminationofthisAgreement.8.Termination8.1EitherPartymayterminatethisAgreementuponprovidingdays’writtennoticetotheotherParty,exceptincasesofseriousmisconductorbreachofcontract.8.2IntheeventofterminationbyPartyAforcause(e.g.,grossnegligence,breachofduty,ormisconduct),PartyBshallnotbeentitledtoanyfurtherremunerationbeyondthedateoftermination.8.3Upontermination,PartyBshallreturnallpropertyandConfidentialInformationbelongingtoPartyAandcompleteanyoutstandingobligationsunderthisAgreement.9.Non-competitionClause9.1Duringthetermofemploymentandforaperiodofmonthsaftertermination,PartyBagreesnottoengageinanyactivitythatcompeteswiththeInstitutionorprovidessimilareducationalserviceswithinaradiusofkilometersfromtheInstitution’slocation.9.2ThisclausedoesnotpreventPartyBfromseekingemploymentatanothereducationalinstitutionunlesssuchemploymentwoulddirectlycompetewiththeInstitution’sprogramsandofferings.10.GrievanceResolution10.1AnydisputesarisingoutoforinconnectionwiththisAgreementshallberesolvedthroughmutualdiscussionbetweentheparties.10.2Ifthedisputecannotberesolvedwithindays,eitherPartymayreferthemattertotheFairWorkCommissionforconciliationandarbitrationinaccordancewithAustralianemploymentlaws.11.MiscellaneousProvisions11.1ThisAgreementconstitutestheentireagreementbetweenthepartiesandsupersedesallpriorunderstandingsoragreements,whetherwrittenororal.11.2Anya
