租赁合同协议英文版
ThisLeaseContractAgreement(the"Agreement")ismadeandenteredintoasof[date]byandbetween:
Lessor:[Lessor'sfullname],a[nationality]national,withanaddressat[address](hereinafterreferredtoasthe"Lessor");and
Lessee:[Lessee'sfullname],a[nationality]national,withanaddressat[address](hereinafterreferredtoasthe"Lessee").
I.LeaseObject
TheLessorherebyleasestotheLessee,andtheLesseeherebyleasesfromtheLessor,thefollowingrealproperty(the"LeasedPremises")locatedat[addressoftheleasedpremises]:
TheLeasedPremisesconsistsof[describethenumberoffloors,rooms,etc.,e.g.,atwostorybuildingwithatotalfloorareaof[x]squaremeters,including[number]bedrooms,[number]livingrooms,[number]bathrooms,andakitchen].ThespecificlayoutandfeaturesoftheLeasedPremisesareasdetailedintheattachedfloorplanandpropertydescription(collectivelyreferredtoasthe"LeaseDescription").
II.LeaseTerm
Theleasetermshallmenceon[startdate]andexpireon[enddate],foratotaldurationof[leaseterminmonths/years].
III.RentandPaymentTerms
A.RentAmount
TheLesseeshallpaytheLessoramonthlyrentof[currency][rentamount].
B.PaymentSchedule
Therentshallbepaidinadvanceonamonthlybasis.TheLesseeshallremittherenttotheLessor'sdesignatedbankaccountonorbeforethe[duedate]ofeachmonth.
C.SecurityDeposit
TheLesseeshallpayasecuritydepositof[currency][depositamount]totheLessoruponsigningthisAgreement.ThesecuritydepositshallbeusedtocoveranydamagestotheLeasedPremises,unpaidrent,orotherliabilitiesoftheLesseeunderthisAgreement.UpontheexpirationoftheleasetermandtheLessee'sfullpliancewithalltermsandconditionsofthisAgreement,theLessorshallrefundthesecuritydeposittotheLesseewithin[numberofdays]daysaftertheLesseevacatestheLeasedPremises.
IV.RightsandObligationsoftheLessor
A.Rights
1.TheLessorhastherighttoreceivetherentandotherpaymentsdueunderthisAgreementinatimelymanner.
2.TheLessorhastherighttoinspecttheLeasedPremisesduringreasonablehourswithpriornoticetotheLesseetoensurethattheLesseeisusingtheLeasedPremisesinaccordancewiththetermsofthisAgreement.
3.IntheeventoftheLessee'smaterialbreachofthisAgreement,theLessorhastherighttoterminatetheAgreementandtakepossessionoftheLeasedPremises.
B.Obligations
1.TheLessorshalldelivertheLeasedPremisestotheLesseeintheconditiondescribedintheLeaseDescriptiononthemencementdateoftheleaseterm.
2.TheLessorshallberesponsibleformaintainingthestructuralintegrityoftheLeasedPremisesandshallmakeanynecessaryrepairsorrenovationstoensurethehabitabilityoftheLeasedPremises,exceptwheresuchrepairsorrenovationsarecausedbytheLessee'snegligenceormisuse.
3.TheLessorshallnotinterferewiththeLessee'speacefulenjoymentoftheLeasedPremisesduringtheleaseterm,exceptaspermittedbylaworasotherwiseprovidedinthisAgreement.
V.RightsandObligationsoftheLessee
A.Rights
1.TheLesseehastherighttousetheLeasedPremisesforthepurposeofresidentialormercialuse(asspecifiedinthisAgreement)duringtheleaseterm.
2.TheLesseehastherighttomakereasonablemodificationstotheLeasedPremisesforthepurposeofitsuse,providedthatsuchmodificationsdonotdamagethestructuralintegrityoftheLeasedPremisesandareapprovedinwritingbytheLessorinadvance.
3.TheLesseehastherighttorequesttheLessortomakerepairsorrenovationstotheLeasedPremisesasrequiredunderthisAgreement.
B.Obligations
1.TheLesseeshallpaytherentandotherpaymentsdueunderthisAgreementinatimelymanner.
2.TheLesseeshallusetheLeasedPremisesonlyforthepurposespecifiedinthisAgreementandshallnotusetheLeasedPremisesforanyillegalorimmoralactivities.
3.TheLesseeshalltakegoodcareoftheLeasedPremisesandshallnotcauseanydamagetotheLeasedPremisesoritsfixturesandfittings.IntheeventofanydamagecausedbytheLessee,theLesseeshallberesponsibleforrepairingorpensatingforsuchdamage.
4.TheLesseeshallkeeptheLeasedPremisescleanandtidyandshallplywithallrelevantenvironmentalandhealthregulations.
5.TheLesseeshallnotsublet,assign,ortransferitsrightsandobligationsunderthisAgreementtoanythirdpartywithoutthepriorwrittenconsentoftheLessor.
6.TheLesseeshallnotifytheLessorimmediatelyofanysignificantchangesinitscontactinformationorbusinessoperationsduringtheleaseterm.
VI.MaintenanceandRepairs
A.Lessee'sObligationtoMaintain
TheLesseeshallberesponsibleformaintainingtheinterioroftheLeasedPremisesingoodconditionduringtheleaseterm.Thisincludes,butisnotlimitedto,keepingthefloors,walls,ceilings,andfixturesclean,andmakingminorrepairsasneeded.
B.Lessor'sObligationtoRepair
TheLessorshallberesponsibleformaintainingthestructuralintegrityoftheLeasedPremisesandformakingmajorrepairstothebuildingsystems(suchasplumbing,electrical,andheating/cooling)thatarenecessaryfortheproperfunctioningoftheLeasedPremises.However,ifsuchrepairsarecausedbytheLessee'snegligenceormisuse,theLesseeshallberesponsibleforthecostofsuchrepairs.
C.NoticeofRepairs
Intheeventthateitherpartybesawareofaneedforrepairs,theyshallpromptlynotifytheotherpartyinwriting.Thepartyresponsiblefortherepairshallthentakereasonablestepstopletetherepairwithinareasonabletimeframe.
VII.Insurance
A.Lessee'sInsurance
TheLesseeshallobtainandmaintainduringtheleaseterminsurancecoveragefortheLeasedPremisesanditscontentsagainstfire,theft,andotherrisksasmaybereasonablyrequired.TheLesseeshallnametheLessorasanadditionalinsuredundersuchinsurancepolicyandshallprovidetheLessorwithacopyoftheinsurancepolicyuponrequest.
B.Lessor'sInsurance
TheLessorshallobtainandmaintaininsurancecoverageforthebuildingstructureoftheLeasedPremisesagainstdamageorlossduetoperilssuchasfire,earthquake,andothernaturaldisasters.
VIII.DefaultandRemedies
A.Default
AdefaultbyeitherpartyunderthisAgreementshalloccurifsuchpartyfailstoperformanyofitsobligationshereunderwithinthetimeperiodsspecifiedorifsuchpartybreachesanyofthetermsandconditionsofthisAgreementinamaterialmanner.
B.RemediesforLessor'sDefault
IntheeventoftheLessor'sdefault,theLesseeshallhavetherightto:
1.TerminatethisAgreementandrecoveranyprepaidrentandsecuritydeposit;
2.RequiretheLessortoperformitsobligationsasrequiredbythisAgreement;
3.SeekdamagesforanylossessufferedasaresultoftheLessor'sdefault.
C.RemediesforLessee'sDefault
IntheeventoftheLessee'sdefault,theLessorshallhavetherightto:
1.TerminatethisAgreementandreentertheLeasedPremises;
2.Forfeitthesecuritydeposit;
3.SuetheLesseeforanyunpaidrent,damagestotheLeasedPremises,orotherlossessufferedasaresultoftheLessee'sdefault;
4.TakeanyotherlegalactionavailabletoenforcethetermsofthisAgreement.
Ix.Indemnification
A.IndemnificationbyLessee
TheLesseeshallindemnifyandholdtheLessorharmlessfromandagainstanyandallclaims,damages,losses,liabilities,andexpenses(includingreasonableattorneys'fees)arisingoutoforinconnectionwiththeLessee'suseoftheLeasedPremises,itsbreachofthisAgreement,oritsnegligenceormisconduct.
B.IndemnificationbyLessor
TheLessorshallindemnifyandholdtheLesseeharmlessfromandagainstanyandallclaims,damages,losses,liabilities,andexpenses(includingreasonableattorneys'fees)arisingoutoforinconnectionwiththeLessor'sbreachofthisAgreement,itsnegligenceormisconduct,oranydefectintheLeasedPremisesexistingatthetimeoftheleasemencement.
x.AssignmentandSubletting
A.Assignment
NeitherpartymayassignitsrightsandobligationsunderthisAgreementtoanythirdpartywithoutthepriorwrittenconsentoftheotherparty.Anyattemptedassignmentwithoutsuchconsentshallbenullandvoid.
B.Subletting
TheLesseemaysubletallorpartoftheLeasedPremisestoathirdpartyonlywiththepriorwrittenconsentoftheLessor.Suchconsentshallnotbeunreasonablywithheld.Intheeventofsubletting,theLesseeshallremainfullyliableunderthisAgreementfortheperformanceofallobligationsofthesublessee.
xI.GoverningLawandJurisdiction
A.GoverningLaw
ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsof[jurisdiction].
B.Jurisdiction
AnydisputesarisingoutoforinconnectionwiththisAgreementshallbesubjecttotheexclusivejurisdictionofthecourtsof[jurisdiction].
