2026年国际货物保险合同

ThisInternationalCargoInsuranceContract("Contract")ismadeandenteredintoasof[InsertDate],byandbetween:

[InsurerName],aninsurancecompanydulyincorporatedandorganizedunderthelawsof[Insurer'sCountry/State],havingitsprincipalplaceofbusinessat[Insurer'sAddress]("Insurer"),and

[InsuredName],acompanydulyincorporatedandorganizedunderthelawsof[Insured'sCountry/State],havingitsprincipalplaceofbusinessat[Insured'sAddress]("Insured").

Now,therefore,inconsiderationofthepremiumshereinafterpaidortobepaidbytheInsured,theInsureragreesasfollows:

1.SubjectMatterofInsurance

TheContractcoverstheriskoflossordamagetothefollowinggoodsduringtheircarriageby[SpecifyMode(s)ofTransport,e.g.,oceanvoyage,airway,multimodaltransport]from[OriginPoint]to[DestinationPoint]:

Thegoodsarebeingcarriedunderorsubjecttothetermsandconditionsof[Mentionrelevanttransportdocument(s),e.g.,BillofLadingNo.B/LXXXdated[Date],MasterAirWaybillNo.MAWXXXdated[Date]].

2.PeriodofInsurance

Theinsurancecovershallcommenceat[Time,e.g.,onboardthevessel]on[StartDate]andshallcontinueuntil[Time,e.g.,ondischarge]at[DestinationPoint]on[EndDate],oruntilthegoodsaredeliveredtothefirstcarrierreceivingthematthedestination,whicheveroccursfirst.

3.PerilsInsured

SubjecttothetermsandconditionssetoutinthisContract,theInsurershallbeliabletopaycompensationforlossordamagetotheinsuredgoodsarisingfromtherisksof:

ICC(C)-AllRisks,asdefinedintheInstituteCargoClauses(C)(2026Edition)publishedbytheInternationalChamberofCommerce,subjecttothefollowingExclusionssetoutinClause4.

4.Exclusions

TheInsurershallnotbeliableforlossordamagearisingfrom:

(a)RisksspecificallyexcludedbynameinthisClause4,includingbutnotlimitedto:

(i)WarRisks(asdefinedintheInstituteWarandStrikesClauses(2026Edition));

(ii)Strikes,RiotsandCivilCommotions(SRCC)(asdefinedintheInstituteWarandStrikesClauses(2026Edition));

(iii)WilfulActsofInsuredorhisagentsoremployees;

(iv)Nuclearrisks;

(v)Lossordamagecausedbytheuseofnuclear,biologicalorchemicalweapons;

(vi)Consequencesofradioactivity,radioactivecontaminationortheuseofatomicornuclearenergy;

(vii)Breakageorleakageofpackedgoodsduetoinherentdefectsinpackingmaterials;

(viii)Inherentviceornatureoftheinsuredgoods;

(ix)Lossordamageresultingfromdelayintransit;

(x)LossordamagecausedbyorarisingfrominsolvencyorbankruptcyoftheInsuredoranypersoninpossessionofthegoods;

(xi)Lossordamagecausedbythefailureoftheship'snavigationorfailuretomakeportofcallataportofdestinationstipulatedinthecontractofcarriage;

(xii)AnylossordamagewhichmaybereasonablyconsideredtohavebeencausedbytheInsuredoranypersonbywhomhemaybelawfullyliable;

(xiii)Anylossordamagearisingfromorresultingfromtheuseorconsumptionoftheinsuredgoods;

(xiv)Theconsequencesofanybreachofanyduty,warranty,undertaking,agreementorarrangementtowhichtheInsuredissubjectbyorunderanylaw,regulationordecree,orbyanyruleorcustomofanytrade,craftorprofession;

(b)AnylossordamagenotcoveredbytheInstituteCargoClauses(C)(2026Edition)unlessexpresslyincludedbythisContract.

5.InsuredValue

TheInsuredValueunderthisContractistheAssessedValuespecifiedinClause1,being[InsuredValueinCurrency].

6.Premium

ThepremiumforthisContractis[PremiumAmountinCurrency],calculatedonthebasisoftheAssessedValue,thespecifiedPerilsInsured,thePeriodofInsurance,andthedescribedgoodsandvoyage,andissubjecttotheInsurer'sconfirmation.ThepremiumispayabletotheInsurerbeforetheCommencementoftheinsurancecover.

7.Claims

(a)NoticeofLoss:TheInsuredshallgivepromptnoticeofanylossordamageoccurringduringtheperiodofinsurancetothecarrierandtotheInsurerattheInsurer'saddressorsuchotheraddressastheInsurermaydesignate.Noticeshallbegivenwithin[Number,e.g.,24]hoursoftheknowledgeofthelossordamage,whicheverislater.

(b)Survey:Intheeventoflossordamagebyperilsinsuredagainst,theInsuredshall,athisownexpense,procureasurveyfromaSurveyoracceptabletotheInsurer.TheSurveyorshall,uponbeingrequestedbytheInsurer,completeandforwardaSurveyReporttotheInsurer.ThecostofthesurveyshallbefortheInsured'saccount,unlesstheSurveyReportestablishesthatthelossordamageisattributabletoariskinsuredagainstunderthisContract,inwhichcasethecostshallbepaidbytheInsurer,providedtheInsuredshallsubmitavalidinvoiceforreimbursementwithin[Number,e.g.,30]daysofreceivingtheinvoicefromtheSurveyor.

(c)ClaimSubmission:TheInsuredshallsubmititsclaim,togetherwithallnecessarydocumentation(includingtheSurveyReport,invoice,etc.),totheInsurerwithin[Number,e.g.,24]monthsfromthedateofthelossordamagebeingcertifiedbytheSurveyor.

(d)SettlementofClaim:TheInsurershallconsidertheclaimanddeterminetheamount,ifany,tobepaidunderthisContract.Paymentshallbemade[Mentionpaymentterms,e.g.,within30daysfromreceiptofallrequireddocuments]attheInsurer'splaceofbusinessorasotherwisedirectedbytheInsurer.TheInsurershallbeentitledtothebenefitofanyrightsorclaimsoftheInsuredagainstanythirdpartyinrespectofanylossordamageforwhichcompensationhasbeenpaidbytheInsurer.

8.Subrogation

AllrightsandtitleoftheInsurertoanyamountrecoverablefromanypersonwhomaybelegallyliabletotheInsuredinrespectofanylossordamagecoveredbythisContractshall,uponthepaymentbytheInsurerofcompensationtotheInsured,betransferredtoandvestintheInsurer,withoutfurtherassignmentbeingrequired,togetherwithallprocesses,rightsofaction,recoveries,anddefensesbywayofsuitorotherwise.

9.Indemnity

TheInsuredshall,athisownriskandexpense,takeallsuchmeasuresasmaybereasonableinthecircumstancestopreventorminimizeanylossordamagetotheinsuredgoods.TheInsuredshallindemnifytheInsureragainstalllosses,liabilities,damages,costs,charges,expenses,orpenaltiesincurredbytheInsurerasaresultofanybreachofthisContractbytheInsured.

10.LawandDisputeResolution

ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsof[SpecifyJurisdiction,e.g.,EnglandandWales]withoutregardtoitsconflictoflawsprinciples.Anydispute,controversy,orcla
