年4月19日外国专家管理制度文档仅供参考，不当之处，请联系改正。慈溪市新未来文化培训学校外国专家管理制度ARegulationofForeignProfessionalsEmployedbyCixinewfuturetrainingschool.第一章总则PartOnegeneralprinciples第一条为了维护国家和学院的尊严与权益，维护外事工作的严肃性，保障在我院工作的外国专家的正当权益，特制定此管理制度。ArticleOneTheregulatoryruleisenactedtomaintainthedignityandlegalrightsofthePeople’sRepublicofChinaandHumanisticManagementnewfuturetrainingschool.theseriousnessofitsforeignaffairs,andsafeguardthelegalinterestsoftheforeignprofessionalsemployedbyHumanisticManagement.第二条聘请外国专家的工作方针是：根据培养师资和教学工作的需要，有计划地聘请具有真才实学的外国专家.ArticleTwoThegeneralprincipleofemployingforeignprofessionalsisthatqualifiedforeignprofessionalsshouldbeemployed,inaccordancewiththeCollege’sworkingschedule.第三条聘请外国专家的范围是：以英语专业为基础，逐渐扩展到日语等其它专业及学科。ArticleThreeTheemploymentofforeignprofessionalsbeginsfromthemajoroftheEnglishlanguageandliterature,andthengraduallyexpandstoothermajorsincludingtheJapaneselanguage.第四条外国专家授课的对象主要是中小学生的英语学习和英语兴趣交流。ArticleFourTheforeignprofessionalsshallteachcoursestothepupilsandmiddleschoolstudents.第二章聘请原则及条件PartTwoPrinciplesandQualificationsofEmployment第五条应聘我院的外国专家应同时具备以下条件：ArticleFiveThecandidateswhoapplytotheSchoolshallmeetallofthefollowingqualifications:（一）具有良好的职业道德，遵守中国的法律、法规和学院的教学规章制度；教书育人，为人师表，对华友好、愿与我方合作。SectionOneThecandidatesshouldbeequippedwithdecentprofessionalconducts,observationofChineselaws,rulesandregulations;theyshouldbetruetotheirprofessionalobligations,andbewillingtocooperatewiththeCollegeunderthefriendlyatmospherewithPeople’sRepublicofChinaanditspeople.（二）具有学士以上学位，一年以上英语（语言）教学经历。SectionTwoThecandidatesshouldbeequippedwithabachelor’degreeandabove,andanexperienceasanEnglishinstructorformorethanoneyear.（三）年龄在55岁以下。SectionThreeThecandidatesshouldbebelow55attheage.（四）应聘者必须提交简历（姓名、性别、年龄、国籍、所在国工作单位，最高学历、专业及学术职称、来华任教期限等）、求职信、推荐信及学位证书复印件和健康报告。SectionFourThecandidatesshouldhandintheirresume(fullname,sex,age,nationality,professionalexperienceinothercountries,supremeacademicdegree,professionaltitle,previousprofessionalexperienceinChina),anapplicationletter,arecommendationletter,acopyofdiploma,andafreehealthyreport.第三章教学管理PartThreeAdministrationofTeachingAffairs第六条外国专家不得在学校内从事与其教学身份不符的活动，不得干涉中国的内部事务；未经许可不得承担校内、外其它劳务事项。ArticleSixTheforeignprofessionalsmustnotbeinvolvedinillegalactivities,mustnotinterferewiththeinternalaffairsofPeople’RepublicofChina;besides,theyshouldnotbeengagedinpart-timejobswithinandbeyondtheSchoolunlessauthorizedbytheSchool.第七条外国专家到任后，应尽快熟悉我校教育理念、教学制度和培养目标等。任教期间，教务处及相关教学单位有权对外国专家进行教学管理，并安排其开展教研活动。ArticleSevenTheforeignprofessionals,onceemployed,shallacquaintthemselveswiththeeducationalguidelines,regulationsofteachingaffairsandtargetsforundergraduatedevelopment.TheDean’sOfficehasthepowertoexerciseitsadministrationofteachingovertheforeignprofessionals,andobligethemtobeactiveintheteachingandresearchdesignedbythedepartmentstheyareworkingwith.第八条外国专家须服从学校的日常工作安排，按照学校制定的教学计划、教学大纲进行教学；开学两周内，须向教务处呈交教学进度表。ArticleEightTheforeignprofessionalsshallcarryouttheirteachingactivitiesinaccordancewiththeSchool’sworkingplans,generalandspecific,anditssyllabus;theyaresupposedtohandintheirteachingschedulewithinthefourteendaysafteranewtermbegins.第九条外国专家每周工作量一般不少于18课时，不得自行调课，如需要调课，应按照教务处调课手续办理。ArticleNineTheforeignprofessionalsshallbegivennolessthaneighteenworkinghours.Theyshouldnotcancel,change,rearrangeorpostponethetimeandplaceofteaching.Ifnecessary,theyaresupposedtomakeawrittenapplicationundertheregulationdesignedbyDean’sOffice.第十条对教学成绩显著的外国专家，应给予精神或物质鼓励；对教学质量差，屡出教学事故，学生评教不合格或学生反映强烈的，经警示后，在规定时间内仍无改进者，依照合同条款可予以解聘。ArticleTenTheforeignprofessionals,whenevaluatedGood,shallbeawardedspirituallyormaterially;they,whenevaluatedBadorinvolvedinfailuresofnormalteaching,shallbegivenawarning.Iftheexecutionoftheirdutyisnotputingoodorderinthedesignatedtimelimit,theywillbeunemployedinaccordancewiththeemploymentcontract.第十一条尊重外国专家的宗教信仰，但不准在中国境内进行传教活动，不得以教学名义在学生中散发“圣经”等宗教书籍，更不得在教学中宣传宗教。ArticleElevenTheforeignprofessionalsshallberespectedinreligiousfaith,butnotallowedtopreachreligionwithinthePeople’sRepublicofChina,notallowedtohandoutthereligiouspressworkincludingtheHolyBible,andnotallowedtopreachreligiontotheundergraduates.第十二条外国专家不能自行在教学活动中让学生填写任何国外登记表或调查表，如确需填写，须经学院批准。外国专家不能发表反对中国四项基本原则的言论以及攻击或挑衅性的政治言论。ArticleTwelveTheforeignprofessionalsshallbeforbiddentoaskundergraduatestofillintheforeignregistrationsheetsandquestionnaires.Ifreallynecessary,itmustbefirstauthorizedbytheCollegeauthoritiesbeforetheveryactofdoingit.TheforeignprofessionalsshallbeforbiddentosaysomethingthatrunsencountertotheFourCardinalPrinciples(theprincipleofupholdingthe\o"Socialism"socialistpath,theprincipleofupholdingthe\o"People'sdemocraticdictatorship"people'sdemocraticdictatorship,theprincipleofupholdingtheleadershipofthe\o"CommunistPartyofChina"CommunistPartyofChina,andtheprincipleofupholding\o"Maoism"Marxist-Leninist-Maoistthought)第十三条外国专家提供的视频教材须经教务处等相关教学单位审查，凡属有利于教学的资料片、风光片、故事片，可向学生放映。内容反动或淫秽的视频不得放映。ArticleThirteenTheforeignprofessionalsshallhavefor-teaching-usevideoscensoredbyDean’sOfficebeforemakinguseoftheminclass;itissuchvideosasareusefultoteaching,aboutinformation,scenery,story-tellingthatcanbeshowntotheundergraduates.Illegalorfilthyvideosshallnotbeplayedtotheundergraduates.第四章生活管理PartFourAspectsofBoardandLodging第十四条外国专家必须遵守我校公寓管理的有关规定，允许与学校教职员工相互拜访，拜访时需出示有效证件，一般会客时间不得超过22︰30，不准留宿。外国专家的直系亲属从外地探亲需留宿的，须提前一天填写住宿申请单一式两份，由外事办和保卫部门审查批准，并持有效证件报公安局备案。ArticleFourteenTheforeignprofessionalsshallbeallowedtopayavisittoeachotherwiththestaffoftheSchoolinaccordancewiththeregulationofthelodgingmanagement;theforeignprofessionalsshallshowtheiridentificationswhilecommunicatingandendvisitsbythetime22:30p.m.Theforeignprofessionals,whennecessarytoaccommodatethefamilymemberscomingfromabroadtovisitthem,shallbesupposedtofillintheblanksandmakeanapplicationtotheSchoolauthorities(OfficeofForeignAffairsandDivisionofPublicSecurity)and,keeptheBureauofPPublicSecurityinformedofit.第十五条外国专家不准在公共场所吸烟、酗酒；不准私自接电或超规定使用电热设备；禁止存放易燃易爆品及其它危险品；禁止从事赌博、吸毒、邪教等违法活动。 ArticleFifeenTheforeignprofessionalsshallbewellawarethatthefollowingdeedsareforbiddentotakeplace:smokingandalcoholisminpublic,illegalaccesstoelectricalappliancesofultrahighvoltage,storageofcombustiblematerialsandexplosivedevicesandotherhazardousarticles,gamblinganddrugtakingandpracticeofheresy.第五章工作时间和休息休假PartFiveWorkingTime,RestandVocation第十六条外国专家享受中国下列节日休假；ArticleSixteenForeignprofessionalsareentitledtoenjoythefollowingholidays.元旦、春节、国际劳动节、国庆节及法律、法规规定的其它节日。NewYear’sDay,SpringFestival,NationalDayandotherChineselegalholidays.第六章病假和事假PartSixSickLeaveandPrivateAffairLeave第十七条在工作时间内，外国专家不得擅自外出，如有特殊邀请，应向学院外事办请示，批准后方可参加活动。ArticleseventeenInworkinghours,foreignprofessionalsarenotallowedtoleavewithoutpermission.AskfortheForeignAffairOffice’spermissionifinvitedtoparticipateactivitiesoutside.第十八条外国专家因故不能上课，应按学院规定履行请假手续。假满返回后要及时销假，未办理请假手续或请假未获准擅自离开岗位者，视情况给予处罚，情节严重者我院有权解除合同并进行索赔。ArticleeighteenIfunabletowork,foreignprofessionalsshallgothroughtheprocedureoftakingaleaveinlightoftherulesandreportbackfromleave.Penaltyshallbegivenifforeignprofessionalsleavewithoutpermission.Certainoffencesareseriousenoughtowarrantimmediatedischargeandclaimcompensation.第十九条在合同期内，外国专家在台湾、香港、澳门地区和中国境外就诊的医疗费用自理。ArticleninteenInthecontractedperiod,themedicalcostsinTaiwan,HongKong,andMacaoandoutsideChinaclinicsshallbepaidbyoneself.第二十条未经允许擅离职守的，旷职一天，扣发三天工资。情节严重的，我院有权解除合同，并追究其违约责任。ArticletwentyBeawayfromworkforonedaywithoutaskingforaleavewillleadtolossofthreedays’payment.Certainoffencesareseriousenoughtowarrantimmediatedischarge,andthecollegehastherightstoholdtheviolatorsberesponsible第七章工资支付方式PartSeven:PaymentMethod第二十一条工资以人民币支付。ArticletwentyoneSalaryispaidinRMB.第二十二条工资应当自到职之日起至合同期满之日止，按月支付给专家本人。不足整月的，按日计发。日工资为月工资的1/30（二月份同）。ArticletwentytwoFromthefirstworkingdaytillthecontractexpirationdate,salaryispaiddirectlytoforeignprofessionalsmonthly.Ifworkingdaysarelessthanonemonth,salaryispaidbyday.Dailypayis1/30ofmonthlypay.第二十三条我校不得克扣或者拖欠工资。ArticletwentythreePay-skimpingandpay-defaultingisforbidden.第二十四条外国文教专家应当按照《中华人民共和国个人所得税法》依法交纳个人所得税。ArticletwentyfourForeignprofessionalsshallpayindividualincometaxinaccordancewiththeIndividualIncomeTaxLawofthePeople’sRepublicofChina.第八章安全管理Parteight:Safety第二十五条外国专家外出，必须提前向外事办请示，未经许可，不得擅自离校。外出时要随身携带护照、专家证等证件，外出旅游只能在节假日进行，旅行只能到开放地区。ArticletwentyfiveWithoutpermissionoftheDepartmentofForeignAffairs,foreignexpertsarenotallowedtoleavetheschool.Documentssuchaspassports,certificateofforeignexpertsarenecessaryoutsidetheschool.Tripsarelimitedtolegally-allowedareasonweekendsorholidays.第二十六条外国专家出行前须向外事办人员登记出行的目的地、起止日、出行方式、联系方式等相关信息，并与之保持电话联系，确保无事故发生。ArticletwentysixBeforeleavingthecollege,foreignexpertsshouldregistertheinformationtotheDepartmentofForeignAffairs,suchasdestination,departing/returningdate,meansoftransportationandcontact.Thecellphoneshouldalwaysbeonforcontactincaseofemergency.第九章聘用合同的履行和违反合同的责任PartnineThePerformanceofEmploymentContractandLiabilityforBreachoftheContract第二十七条合同一经签订，即具有法律约束力。当事人应履行合同约定的义务，任何一方不得擅自变更或解除合同。

ArticletwentysevenThecontractshallbelegallybindingassoonasitisestablishedinaccordancewiththelaw.Thepartiesshallperformtheirobligationsstipulatedinthecontract.Nopartyshallunilaterallymodifyorrescindthecontract.

第十章聘用合同的变更、解除和终止Part10Modification,RescissionandTerminationoftheContract第二十八条有下列情形之一的，当事人一方有权通知另一方解除合同：

Article28Inanyofthefollowingcircumstances,apartyshallhavetherighttonotifytheotherpartytoterminatethecontractatanytimeif:

（一）另一方违反合同，以至严重影响合同所确定的工作任务和工作质量；

（二）另一方在合同约定的期限内没有履行合同，在被允许推迟履行的合理期限内仍未履行；

（三）发生不可抗力事件，致使合同的义务不能履行；

（四）合同约定的解除合同的条件已经出现；

（五）当事人一方要求解除合同，应提前一个月以书面形式向另一方提出，一个月以后方可解除合同。

(a)iftheotherpartyhasbreachedthecontract,thusadverselyaffectingtheworkrequirementstheyexpectedtoreceiveagreeduponinthecontract;(b)

iftheotherpartyfailstoperformthecontractwithinthetimelimitagreeduponinthecontract,andagainfailstoperformitwithinthereasonableperiodoftimeallowedfordelayedperformance;(c)

ifalltheobligationsunderthecontractcannotbeperformedowingtoforcemajeure;or

(d)ifthecontractuallyagreedconditionsfortherescissionofthecontractarepresent.(e)Incaseeitherpartyaskstoterminatethiscontract,itshallgivea30daynoticetotheotherpartyinwriting,andthecontractshallonlybeterminatedafter30days.
