业主论文：业主委员会 业主委员会制度【中文摘要】业主委员会制度,是指特定物业管理区域内的全体业主通过依法选举产生的业主委员会,对全体业主的公共事务进行管理的一种法律制度,设立宗旨是为了更好的维护特定物业管理区域内全体业主的合法权益。建筑物区分所有权理论是其法理基础,基本内容包括设立制度、会议制度、职权职责制度。我国业主委员会制度尚不完善,立法缺位,司法实践中矛盾和纠纷时有发生。应进一步健全法律体系,颁布行政法规业主自治条例；明确业主委员会非法人组织的法律性质；明确业主委员会的法律地位,即具有民事主体地位和诉讼主体地位；强化业主委员会的法律责任,委员应承担民事责任；规范其运作机制,委员的选任可以实行奖惩结合的制度和专职化制度；完善对业主委员会的监督和管理机制,充分发挥业主和业主大会的内部监督作用,可增设监事会,加强政府相关部门和居委会的监督,强化物业服务企业的监督。【英文摘要】The system of owners committee, refers that all the owners in the specific property management region manage the public affairs by the owners committee, the purpose is in order to better maintain the legitimate rights and interests of all the owners. The theory of condominium ownership of buildings is the legal basis. The content includes the establishment of the basic system, the meeting system, the terms and responsibility system. The system of owners committee is not perfect, for example, the absence of legislation, the conflicts and disputes always occur in practice.
