perationofCompanyfacilities;andtoimplementmeasuresdeemednecessarybyCompanymanagementtomaximizeproductivityandefficiencyTheenumerationofspecificrightsinthisSectionshallnotbeconstruedassupportinganegativeimplicationthatotherrightsoftheCompanyhavebeenwaivedorcompromisedinanywayNorshalltheenumerationofsuchrightsbeconstruedasexpandingorcontractinginanywaytheUnionsright,totheextentotherwisesecuredbyapplicableprecedentsundertheNationalLaborRelationsActasamended,todemandthattheCompanyengageincollectivebargainingovertheeffectsoftheexerciseofsuchrightsonthewages,termsandconditionsofemploymentandemploymentsecurityofemployeescoveredbythisAgreement3Furthermore,theCompanyretainstherighttotakewhateverstepsitdeemsnecessarytomeetandcomplywithallFederal,stateorlocalregulationsincludingbutnotlimitedtothosepromulgatedbyDEA,FDAandanyregulatoryagency4WithinthelimitsprescribedinArticleXII,Section4ofthisAgreement,Managementhastherighttousesupervisorsandothernon-bargainingunitpersonneltoperformunitwork5WithrespecttoanyrightsheretoforeexercisedbyorinherentintheCompanyandnotexpresslylimitedbythetermsofthisAgreement,andwithrespecttoanyrightsretainedbyorconferredupontheCompanyinthetermsofthisAgreement,anyfailurebytheCompanytoexercisesuchrights,ortheexerciseofsuchrightsbytheCompanyinaparticularmanner,shallnotbeconstruedtobeawaiveroforlimitationonanysuchright,awaiveroforlimitationontherighttoexerciseanysuchright,orawaiveroforlimitationontherighttoexerciseanysuchright,orawaiveroforlimitationontherighttoexerciseanysuchrightinadifferentmannerNorshallenumerationofrightsreservedtotheCompanyinthisAgreementbeconstruedas,orconsideredasevidenceof,animpliedlimitationonorpreclusionofanyCompanyrightsnotsoenumeratedIIIUNIONACTIVITIES1Thereshallbenogrievanceinvestigated,presented,discussed,processedorhandledduringworkinghourswithouttheVicePresidentHumanResourcesortheManagerHumanResourcesfirstbeingnotifiedandherpermissiontodosoobtained,norshalltheinvestigation,presentation,discussion,processingorhandlingofgrievancesinterfereinanywaywiththenormalandefficientconductoftheCompanysoperationsInthecaseofDepartmentalStewards,however,thisSectionshallbedeemedtohavebeencompliedwithincaseswheresuchStewardsfinditnecessarytobeexcusedfromtheirregularworkresponsibilitiesforbriefperiodsoftimeforsuchpurposesifnoticeisprovidedandpermissionobtainedinadvancefromtheStewardsPlantManager2AnauthorizedagentoftheUnionshallbepermittedtovisittheplantduringworkinghours,afterfirstnotifyingtheVicePresidentHumanResourcesorherdesignee,forthepurposeofinvestigatingandsettlinggrievancesandinsuringtheproperadministrationofthecontract;provided,however,thatsaidrepresentativeshallconducthisbusinessinsuchmannersoasnottointerferewiththenormalandefficientconductoftheCompanysoperationsTheUnionshallkeeptheCompanycurrentlyadvised,inwriting,oftheofficerorrepresentativeoftheUnionwhoisauthorizedtodealwiththeCompany,andnooneshallbedeemedsucharepresentativeunlessheissodesignatedbytheUniontotheCompanyIVHOURS1Thestandardworkweekshallbefiveconsecutivedays,fortyhoursperweek;eighthoursperday,from12:01amMondayto12:00pmthefollowingSunday,exclusiveoflunchThestandardworkdayshallconsistofeightandone-half8-1/2consecutivehourswithaone-halfhourunpaidlunchbreakbetweenthehoursof7:00amand5:00pmHowever,theCompanyretainssoleandunrestricteddiscretiontochangeworkschedulesforemployeesinanypartorallofitsoperationstobestservetheCompanysoverallinterestsinensuringregulatorycomplianceandproductqualityandintegrity,andmaximizingproductivity,efficiencyandsafetyTheUnionandemployeesaffectedbysuchachangewillbeprovidednoticeatleasttwoweeksinadvanceofimplementationofthechangeShiftsmaybeestablishedordiscontinuedinthesoleandunrestricteddiscretionoftheEmployeronnoticetotheUnionandtheaffectedemployeesofthirtycalendardayswheneverreasonablypracticable,butinanyeventnotlessthanfourteencalendardaysWheneverashiftchangeisimplementedforlessthanalloftheemployeesinadepartment,theCompanyshallfirstseektoobtainenoughemployeestostaffthenewshiftbyaskingforvolunteersfromamongtheemployeesinthedepartmentIntheeventtherearemorevolunteersthanopenings,employeesshallbeselectedonthebasisoftheirseniorityIntheeventaninsufficientnumberofvolunteerscomeforth,theCompanymayhavetheworkdonebynonbargainingunitemployeesforuptotwomonths,hireforsuchpositionsfromoutsidethebargainingunit,and/orrequireadditionalemployees,inreverseorderofseniority,toeitherworkthenewshiftorgoontolayoffstatusTheEmployermayimplementaTuesdaythroughSaturdayworkweekorWednesdaythroughSundayworkweekprovidedthefollowingcriteriaaremet:aEmployeesassignedtoworkTuesdaythroughSaturdayorWednesdaythroughSundayworkweeksmustworkafiveconsecutivedayweekbTheCompanyshallfirstseektoobtainemployeesforsuchworkweeksbyaskingforvolunteersIfmorevolunteerscomeforwardthanthereareopenings,employeesshallbeselectedonthebasisoftheirseniorityIfaninsufficientnumberofvolunteerscomeforth,theCompanymayhavetheworkdonebynonbargainingunitemployeesforuptotwomonths,hireforsuchpositionsfromoutsidethebargainingunit,and/orrequireadditionalemployees,inreverseorderofseniority,toeitherworkthenewworkweekorgoontolayoffstatuscThoseemployeeshiredfortheTuesdaythroughSaturdayorWednesdaythroughSundayworkweekshallhavearighttobidintoopeningsoccurringlessthanonehundredandeightydaysaftertheirinitialhiredatetheMondaythroughFridayworkweek,exceptasotherwiseprovidedinArticleV,Section7dTheEmployeragreestopreserveathreedayweekendduringholidayweeksEmployeesassignedtoworkTuesdaythroughSaturdayorWednesdaythroughSundayworkweekspursuanttothetermsofthisSectionandwhobyvirtueofsuchassignmentworkonSaturdayorSunday,shallreceivepremiumpayintheamountofcents$perhourforeachhourworkedonsuchdaysExceptasprovidedinArticleXXIV,nothinginthisAgreementshallbeconstruedasobligatingtheCompanytoprovideanyminimumhoursofworkperday,perweek,permonthorperyear2TheEmployerhassoleandunrestricteddiscretiontoestablishatenhoursperdayshift,exclusiveofthethirtyminuteunpaidlunchperiod,atthestraight-timewagerateForemployeesassignedtoworksuchashift,exceptasotherwiseprovidedbelow,fortyhoursperweekshallconstituteaweeksworkIfatenhourworkdayashereinbeforedescribedisimplemented,theEmployershallscheduleemployeesassignedtoworksuchshiftsinsuchamannerastomakeallstraight-timeworkdaysafterthefirstoneineachworkweekfolloweachotherconsecutivelyTheEmployershallhavetherighttoschedulesuchfourdayworkweekstobeginonMonday,TuesdayorWednesdayinthesamemannerandsubjecttothesameconditionsexceptforthefiveconsecutivedayweekrequirementaswouldapplyunderSection1ofthisArticletotheassignmentofemployeestoworkfivedayworkweeksbeginningonthosedaysTheEmployershallalsohavetheoptiontoscheduletwocrewstoworkatenhourworkdaysinsuchamannerastoprovideemployeecoverageinthedepartmentoneachofthesevendaysoftheworkweek,providedhoweverthatinsucheventemployeesineachcrewshallbescheduledtoworkeightconsecutivedays,withthefirstandlastoftheeightdaysbeingonThursdayandwithbothcrewsoverlappingforthefulltenhourshiftonThursdayTheEmployerwillprovidenoticetotheUnionandaffectedemployeesatleasttwoweeksbeforecommencementofanyofthespecialshiftsprovidedforinthisSectionEmployeesworkingten-hourdaysshallbeentitledtoanadditionalrestperiodoffifteenminutesafterworkingeighthoursEmployeeswhoareassignedtoworkspecialshiftspursuanttothisSectionshallbeentitledtotaketheHolidaysspecifiedinArticleXV,Section2ofthisAgreementoffwithoutlossofpayor,ifrequiredtoworkonaHoliday,shallbecompensatedatarateequaltotwoandone-halftimestheratetheywouldhavebeenpaidhadtheworkbeenperformedonanormalworkdayEmployeesassignedtoworkspecialshiftsunderthisSectionwhoseworkweekdoesnotencompassaHolidayshallreceiveanadditionaleighthoursstraight-timepayforthatworkweekEmployeesscheduledtoworkhoursonSaturdayorSundaypursuanttothisSectionshallbepaidapremiumofcents$perhourforallsuchweekendhoursworked3OVERTIME:EmployeesshallbepaidovertimepremiumpayforallhoursworkedovereighthoursinanyonedayexceptasotherwiseprovidedaboveinSection2ofthisArticle,orfortypaidhoursinanyoneworkweekandforanytimeworkedonscheduledholidaysenumeratedinArticleXVEmployeeswhofailtoworkanyportionofthestraighttimeworkforwhichtheyarescheduledinagivenworkweekwillnotbeentitledtopremiumpayforovertimeinthatweek,excepttotheextentthattheirtotalhoursworkedinthatweekexceedfortyhours,unlesstheemployeesfailuretoworksuchstraighttimeisduetoseriousillnessorseriousinjury,ortheemployeesbeingonjuryduty,vacation,paidsickleave,orbereavementleave;andSaturdayandSundayovertimeshallbepaidonthesamebasisExceptasotherwiseprovidedinthisArticle,overtimehoursworkedonSundaysshallbecompensatedatarateequaltotwicetheemployeesbasewagerateOnlytimeactuallypaidshallbeincludedincomputingovertimeAnytimeworkedwhenonceincludedincomputingovertimeunderanyapplicableprovisionofthisAgreementshallnotthereafterbeincludedincomputingovertimeunderanyotherapplicableprovisionshereofInnoevent,shalltherebeanyduplicationorpyramidingofanyovertimeorpremiumpay,whetherforSundays,holidaysorovertimepurposesorotherwiseTheCompanyshallhavediscretiontodeterminewhichjobclassificationswillbeneededtoperformavailableovertimeworkOvertimeshallfirstbeofferedtoqualifiedemployeeswithinthejobclassificationwithinthedepartmentinwhichtheovertimeisavailableSuchopportunitiesshallbeequallydividedamongtheemployeesinthedepartmentinthesamejobclassificationandassignedtoworkinthesamebuildingForpurposesofequalization,anopportunityofferedandrefusedshallbecountedasovertimeworkedIfaninsufficientnumberofemployeeswithinthedepartmentandcurrentlyassignedtotheclassificationthattheCompanyhasdesignatedtoworkovertimeareavailableforsuchwork,theCompanymayfilltheovertimewithqualifiedvolunteersfromoutsidethedepartmentonthebasisofseniorityinwhichcasetheCompanyshalloffertheovertimetoemployeesthenassignedtoworkintheclassificationthattheCompanyhasdesignatedtoworktheovertimeandworkinginthelocationNorthvaleorPomonawheretheovertimeistobeworked,thentoemployeesassignedtoworkinsuchclassificationatanyotherCompanyfacilitiescoveredbythisAgreement,andthentoanyotherqualifiedemployeesassignedtoworkatanysuchfacilities,and/orbydraftingemployeesfromwithinthebuildinganddepartmentinreverseorderofseniorityInanysituationsinwhichovertimeworkisofsuchanatureastorequiretheemployeeperformingittohaveanyspecialskillsorexperience,theCompanyhassoleandunrestricteddiscretiontoassignovertimeworktotheemployeeoremployeeswho,intheCompanysjudgment,isorarebestsuitedtocarryouttheassignmentcompetently,efficientlyandsafelyTotheextentovertimeassignmentsdonot,inthejudgementoftheCompany,requireemployeesofspecialskilland/orexperience,however,theCompanyshallberequiredtodistributesuchassignmentsevenlyamongemployeesinthedepartment;andanytimeworkedbyanemployeeinanovertimeassignmentmadeonthebasisofspecialskillsorexperienceshallbecreditedtothatemployeeforovertimeequalizationpurposes,aswouldanyotherovertimeworkedTheUnionshallbeinformedofallspecialovertimeassignmentsmadeonthebasisofspecialskillsorexperienceonatleastaweeklybasisItisunderstoodthattheCompanyshallnotberequiredtocreateunnecessaryovertimeforanypurpose4WhenanemployeeisrequestedbytheCompanytoworkoutsideoforbeyondhisregularhours,heshallbeexpectedtodoso,unlesstheCompanydeterminesthatextraordinaryhardshipwouldresultbyrequiringtheemployeetoworksuchanovertimeassignmentHowever,undernocircumstanceswillnoticeformandatoryovertimebegivenlessthanfourhoursbeforesuchovertimewouldbeginNoemployeeshallberequiredtoworkmorethanfourteenhoursinanyworkdayormorethanfifty-sixhoursinanyworkweek,exceptasotherwiseprovidedinSection2ofthisArticleIntheeventanemployeeisrequiredtoworkanovertimeassignmentandhasdifficultywithworkingtheassignmentduetoascheduleconflict,heshallnotberequiredtoworktheovertimeifheisabletofindaqualifiedvolunteertotakehisplacewhoisacceptabletothesupervisorschedulingtheovertimeInsuchcases,theemployeeshallbechargedwithhavingworkedtheovertimeforthepurposesofovertimedistribution;andthevolunteerwhoworkstheovertimeshallnotbesocharged5HOLIDAYWORK:TheCompanyshall,unlessextraordinaryhardshipwouldresult,givesevendaysnoticeofovertimeworkscheduledonaholidayorduringaholidayweekendie,aweekendprecededorfollowedbyadaydesignatedasaholidayinArticleXV,Section2ofthisAgreementTheCompanyshallhavetherighttoopentheplantforbusinessonholidaysandtoexpectemployeestoworkonsuchdaysExceptasotherwiseprovidedaboveinSection3ofthisArticle,workperformedbyemployeesonholidaysshallbeconsideredaspremiumwork,andsuchworkshallbepaidforattimeandone-half6Hoursandpayrepresentingholidaypay,andvacationpayandallotherhoursofpayrepresentingnon-workingtimewillbeincludedinfiguringovertimefor
