选题的研究现状1.2.1 我国的招标现状改革开放以来,招标一直作为经济体制改革的有效措施之一而在各行各业加以推行:首先是农村的土地承包经营招标,后来是企业,商业的竞争招标承包,到近年来的反腐败运动,强调减少政府行政审批制度,扩大招标的运用范围。西方国家一般没有专门的招标代理机构,而是政府采购代理机构或政府采购执行机构。目前,西方一些国家已经逐渐接受企业参与政府采购代理的观念。它是基于竞争和公平两个核心。代理机构在政府采购操作过程中扮演着两种角色:首先,以经营者的身份从事政府采购,与卖方直接联系和对话。其次,以政府部门的身份从事政府采购活动。因此,政府采购执行机构及代理即使是企业性质,也必须接受政府部门行政,法规的管理和制约,政府采购执行部门和代理也要保证其行为具有透明度和信息公开。实践证明，招投标制度是比较成熟而且科学合理的工程承发包方式，也是保证工程质量、加快工程进度的最佳办法。但由于机制不完善，法制不健全，致使当前的招投标现状仍存在不少不容忽视的问题:1）陪标现象：由于现今基本建设管理体制还没有完全从“计划”为中心转移到以“项目”为中心。一些部门滥用权利，将建设工程内定给某些施工单位中标，其他单位只是陪衬；或者是投标人之间进行串标，相互约定提高或压低投标报价，而获取中标资格，使招投标成为徒具形式的空壳,无法做到公开、公平、公正。2）承包单位转包问题:“转包”现象的存在是现今“豆腐渣工程”存在的一个根源。有的企业中标后，直接转包或违法分包给其他单位，从中收取管理费，以包代管，而对工程质量、安全不从事管理、不负责任。这种转包的现象，使得一些资质不够，没有施工经验的企业，进入施工现场，为质量安全问题埋下隐患。3）评标办法不够科学，专家水平有待提高:目前我们还没有建立起一套科学的评标办法，以至于有些单位，单纯着重报价高低，且整个评分方法重定性评分，轻定量评分.专家评标水平和职业素质有待提高。4)招标代理机构的行为有待进一步规范:由于我国招标代理业务起步晚，招标代理市场发育尚不完善，一些相关的配套制度还不健全，致使一些代理机构在实际工作中缺乏自律，步入误区，利用自己的特殊身份帮助业主选择有倾向性的选择中标单位的结果。其次对于代理机构的工作成果，还没有一个很好的可操作、量化的评价标准。5)对招投标过程中的违法、违纪现象执法监察力度不大。随着公开招标和招标投标法的深入实施，建设市场必将形成政府依法监督，招投标活动当事人在建设工程交易中心依据法定程序进行交易活动，各中介组织提供全方位服务的市场运行新格局，我国的招标投标制度也必将走向成熟，它是招标投标发展的必然趋势。建设市场规则将趋于规范和完善。市场规则是有关机构制定的或沿袭下来的由法律、法规、制度所规定的市场行为准则，其内容包括：市场准入规则：市场的进入需遵循一定的法规和具备相应的条件，对不再具备条件或采取挂靠、出借证书、制造假证书等欺诈行为的应采取清出制度，逐步完善资质和资格管理，特别应加强工程项目经理的动态管理。市场竞争规则：这是保证各种市场主体在平等的条件下开展竞争的行为准则，为保证平等竞争的实现，政府必须制定相应的保护公平竞争的规则。1.2.2 国外招投标现状在国外招投标主要体现了公开竞争的原则。针对这一原则采取了相应的措施:1)坚持公开招标制度。欧盟、美国、英国、意大利、瑞士等国都规定使用公共资金必须采取公开招标方式。实行招标制度的目的是为了保证公开竞争原则能够有效贯彻。公开招标制度要让采购招待人特别是政府采购的官员的行为要“象金鱼缸里的鱼一样”透明，得到有前机构的监督，以保证招标采购既经济节省又能使公共利益的重大实现。2)明确招标步骤和程序。有标准的招标公告格式、标书格式、规范和合同样本，对招投标的管理人员进行定位，确定不同的人员在招标过程中的工作范围。3)明确强制招标的主体范围。强制招标。任何政府部门、机关的主体范围包括三类：第一类是政府及所属机构或任何下属机构，除法律规定外，都应当实行招标采购。第二类是为公共利益而设定，受国家资助的机构。第三类是由政府机构授专营权的公用企业或者属于具有自然垄断性质企业。4)明确强制招标的限额。世界各国和国际组织关于物质采购和工程，服务项目招标，都有限额规定。低于限额的可以不招标。5)明确招标方式。主要有三种：a.公开招标，也称“无限竞争性招标”；b.选择性招标，也称“有限竞争性招标”；c.限制性招标，也称“单一招标”，对那些没有人应标的特殊项目，选择有条件的一两家企业参加。6）明确招标信息的发布。规定招标信息发布主要包括两个方面：一是发布招标公告，要对投标者进行资格预审的，要公告审查标准和程序：二是提供招标文件：编写投标文件的说明；投标者为证明其资格而必须提交有关的资料；提交投标担保的要求；开启投标书的时间、地点和程序；对投标的评审程序和确定中标的标准等等。7）明确评标和中标的标准。评标要求客观、公正、公平、公开，防止串标，防止不公平交易。中标标准主要有两条，在保证招标项目质量的前提下：a.标价最低的投标中标；b.最低的中标。1.3 拟采用的研究方法本毕业设计先是通过与指导教师和同学间的讨论，确定研究的目标。然后自己在平时的设计中，通过自己的不断摸索与对有关资料和文献的查阅，对图纸和有关规范的不断掌握，从而达到理论与实践的结合。而工程量清单的编制是招标文件的核心部分，所以，首要工作是努力编制好工程量清单。2.2
