LEASECONTRACT lessor(hereinafterreferredtoaspartya): lessee(hereinafterreferredtoaspartyb): partyaandbhavereachedanagreementthroughfriendlyconsultationtoconcludethefollowingcontract. 1.locationofthepremises partyawillleasetopartybthepremisesandattachedfacilitiesownedbyitselfwhichislocatedatandingoodconditionfor. 2.sizeofthepremises theregisteredsizeoftheleasedpremisesissquaremeters(grosssize). 3.leaseterm theleasetermwillbefrom(month)(day)(year)to(month)(day)(year).partyawillclearthepremisesandprovideittopartybforusebefore(month)(day)(year). 4.rental 1)amount:therentalwillbepermonth(includingmanagementfees).partybwillpaytherentaltopartyaintheformofcash. 2)paymentofrentalwillbeoneinstallmenteverymonth(s).thefirstinstallmentwillbepaidbefore(month)(day)(year). eachsuccessiveinstallmentwillbepaidbydayofeachmonth.partybwillpaytherentalbeforeusingthepremisesandattachedfacilities(incasepartybpaystherentalintheformofremittance,thedateofremittingwillbethedayofpaymentandtheremittancefeewillbebornebytheremitter.)partyawillissueawrittenreceiptafterreceivingthepayment 3)incasetherentalismorethan7workingdaysoverdue,partybwillpay0.3percentofmonthlyrentalasoverduefineeveryday,iftherentalbepaid10daysoverdue,hissituation,partyahastherighttotakebackthepremisesandtakeactionsagainstpartybsbreach. 5.deposit 1)guarantyingthesafetyandgoodconditionsofthepremisesandattachedfacilitiesandaccountofrelevantfeesaresettledonscheduleduringtheleaseterm,partybwillpaytopartyaasadepositbefore(month)(day)(year).partyawillissueawrittenreceiptafterreceivingthedeposit. 2)unlessotherwiseprovidedforbythiscontract,partyawillreturnfullamountofthedepositwithoutinterestonthedaywhenthiscontractexpiresandpartybclearsthepremisesandhaspaidallduerentalandotherexpenses. 3)incasepartybbreachesthiscontract,partyahasrighttodeductthedefaultfine,pensationfordamageoranyotherexpensesfromthedeposit.incasethedepositisnotsufficienttocoversuchitems,partybshouldpaytheinsufficiencywithintendaysafterreceivingthewrittennoticeofpaymentfrompartya. 4)ifpartybcantnormallyusetheapartmentbecauseofpartya,partyashouldreturnthedeposittopartybatonce.and,partybhastherighttoaskforthepensationfrompartya 6.obligationsofpartya 1)partyawillprovidethepremisesandattachedfacilities(seetheappendixoffurniturelistfordetail)onscheduletopartybforusing. 2)incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesoraccidents,partyawillberesponsibletorepairandpaytherelevantexpenses.ifpartyacantrepairthedamagedfacilitiesintwoweekssothatpartybcantusethefacilitiesnormally,partybhastherighttoterminatethecontractandpartyamustreturnthedeposit. 3)partyawillguaranteetheleaserightofthepremises.incaseofoccurrenceofownershiptransferinwholeorinpartandotheraccidentsaffectingtherightofleasebypartyb,.partyashallquarantcethatthenewowner,andotherassociated,thirdpartiesshallbeboundbythetermsofthiscontract.otherwise,partyawillberesponsibletopensatepartybslosses. 4)partyamustregisterthiscontractwiththerelevantgovernmentauthorityifnotdoingsoresultingthatthiscontractisinvalidorpartybsrightofleasingmaybedamaged,partyashouldtaketheallresponsibilities.partyashouldalsobearthealltherelevanttaxes. 7.obligationsofpartyb 1)partybwillpaytherentalandthedepositontime. 2)partybmayaddnewfacilitieswithpartyasapproval.whenthiscontractexpires,partybmaytakeawaytheaddedfacilitieswithoutchangingthegoodconditionsofthepremisesfornormaluse. 3)partybwillnottransfertheleaseofthepremisesorsubletitwithoutpartyasapprovalandshouldtakegoodcareofthepremises.otherwise,partybwillberesponsibletopensateanydamagesofthepremisesandattachedfacilitiescausedbyitsfaultandnegligence. 4)partybwillusethepremiseslawfullyaccordingtothiscontractwithoutchangingthenatureofthepremisesandstoringhazardousmaterialsinit.otherwise,partybwillberesponsibleforthedamagescausedbyit 5)partybwillbearthecostofutilitiessuchastelephonemunications,water,electricityandgasontimeduringtheleaseterm. 8.terminationanddissolutionofthecontract 1)withinonemonthbeforethecontractexpires,hissituation,twopartieswilldiscussmattersovertheextension.underthesametermspartybhastheprioritytoleasethepremises. 2)whentheleasetermexpires,hissituation,partyahastherighttodisposeofitandpartyawillraisenoobjection. 3)thiscontractwillbeeffectiveafterbeingsignedbybothparties.anypartyhasnorighttoterminatethiscontractwithoutanotherpartysagreement.anythingnotcoveredinthiscontractwillbediscussedseparatelybybothparties. 9.breachofthecontract 1)duringtheleaseterm,anypartywhofailstofulfillanyarticleofthiscontractwithouttheotherpartysunderstandingwillbedeemedtobreachthecontract.bothpartiesagreethatthedefaultfinewillbe.incasethedefaultfineisnotsufficienttocoverthelosssufferedbythefaultlessparty,thepartyinbreachshouldpayadditionalpensationtotheotherparty. 2)bothpartieswillsolvethedisputesarisingfromexecutionofthecontractorinconnectionwiththecontractthroughfriendlyconsultation.incasetheagreementcannotbereached,anypartymaysummitthedisputetothecourtthathasthejurisdictionoverthematter.
