内容提要 行政权是国家权力的一种，对一个国家有着重要的意义。随着经 济的发展和社会的进步，行政权呈现出不断扩展的趋势，其中一个主 要的表现就是行政自由裁量权的产生。作为现代行政法的一个核心内 容，行政自由裁量权有其存在的必要，行政自由裁量权是现代行政不 可缺少的权限，它是提高行政效率的必要条件。但我们对行政自由裁 量权的行使要适当的控制，否则会出现行政权力的滥用。 本文从行政自由裁量权的概述出发，详细论述了行政自由裁量权 的种类以及对行政自由裁量权对社会的影响，借鉴了国外有关对行政 自由裁量权进行适当控制的有益制度，就如何构建我国对行政自由裁 量权的控制制度提出了看法和设想。 关键词：行政自由裁量权行政程序合理规范有效控制 论文摘要 行政自由裁量权是行政权力的重要组成部分，也是行政权力中最 显著、最独特、最活跃的一部分权力。行政自由裁量权是行政机关的 一种自行决定权。从其权力来源、特点、效力以及法律幅度内的选择 均有独具的特征。 行政自由裁量权的存在既有其积极的作用，也有其消极的影响， 其出路在于合理控制行政自由裁量权。怎么适当而合理地运作行政自 由裁量权，近年来引起了各国不少行政法学者的关注，本文通过分析行 政自由裁量权的滥用及其引起的负面效应，旨在提出对行政自由裁量 权有效控制的途径，使行政自由裁量权的运用日臻完善。 本文在第一部分行政自由裁量权概述中，对行政自由裁量权的概 念、分类标准进行了概括和分类，即行政自由裁量权是行政主体( 能 以自己的名义对外行使行政权，并对行为后果承担法律责任的组织) 在法定权限范围内就行为条件、行为程序、作出作为与否和作出何种 行为作合理选择的权力，亦指行政主体在法律规定的范围和幅度内， 基于法律规定的耳的和宗旨，自主寻找判断事实与法律的结合点，并 据此作出或不作出具体行政行为的权力。行政自由裁量权分为以下种 类：在行政处罚幅度内的自由裁量权；选择行为方式的自由裁量权； 作出具体行政行为时限的自由裁量权；对事实性质认定的自由裁量权； 自主确定处罚种类的自由裁量权；对情节轻重认定的自由裁量权；决 定是否执行的自由裁量权；是否给予行政处罚的自由裁量权。 本文同时对行政自由裁量权存在的社会成因以及社会意义进行了 归纳，指出行政自由裁量权的两面性，通过对该部分的内容分析，得 出赋予行政机关一定自由裁量权是十分必要的，但对行政自由裁量权 的适当控制也是必需的。 在本文的第二部分即控制行政自由裁量权的基本制度一节，援引 了国外控制行政自由裁量权的制度并对该制度进行了一定的分析，论 述了行政程序对控制行政自由裁量权的重要性，从程序中立制度、情 报公开制度、告知并说明理由制度入手，详细阐明了运用程序控制行 政自由裁量权的内在价值。在步入“行政国”时代的今天，从法治的 本质要求看，对公共权力予以规范和制约的重心需要落脚于行政权之 上，即强调政府守法或“依法行政”。正是在这个意义上，得出现代法 治的核心是行政法治的结论。监督行政执法、促进行政效率和公开性、 透明度越来越成为迫在眉睫的要求。制定科学的行政程序对行政自由 裁量权进行适当的控制是符合于完善行政法体系的“工具理性”要求， 更是行政公正与行政民主的内在价值体现。随着法治原则在中国的进 一步展开和具体适用，行政程序必将发挥其应有的重要作用。 本文的第三部分对我国行政自由裁量权滥用现状进行了分析，对 自由裁量权的表现形式进行了分类；偏离法律的目的、法律条文的原 旨，将行政自由裁量权成为牟取个人或集体利益的手段：违反比例性、 必要性的要求，严重偏离各方利益和价值的博弈均衡；程序实施和方 法不当。接下来从个人的私欲、行政权力本身的内在弱点、外在环境 缺乏对法律的监督与制约以及我国制度目前存在的弊端等方面分析了 行政自由裁量权滥用的社会成因和社会危害。通过对行政自由裁量权 的社会成因分析，指出了行政机关行使自由裁量权范围的广泛性，并 几乎渗透到行政执法的全过程。强调所谓“自由”应是相对的，而不 是绝对的“自由”。自由裁量权的行使应该根据合理和公正的原则、本 着法律和法规的立法精神去做某一件事，而不是根据个人好恶和个人 意见做某事；自由裁量权不能成为专横专制的代名词。如果让权力的 属性变成含糊不清、捉摸不定，则必然产生一定程度上的权力腐败。 本文的第四部分，笔者提出了构建我国对行政自由裁量权进行适 当控制的措施，在立法领域，加大对行政相对人权利的授予，“以权力 制约权力”，另一方面加大人大机关对权力的制约，完善程序立法。当 公民权利和公共权力达到一种自我均衡状态，就会形成自主的、互动 的、平衡的社会稳定结构。有效的制度安排需要在同一个权力级层体 系、上下级权力体系中和公民权利与公共权力之间建立起多向度的、 互相制约和监督的立体的平台。政府的权力必须是有限的而且是受到 严格限制的，有权力与权力之间的分权与制衡，更有公民权利对公共 权力的监督与制衡。而公民权利对公共权力的监督与制衡应当作为中 国进步和制度转型的一个突破口。在司法领域，要扩大司法审查的受 案范围，把抽象行政行为列入司法机关的审理范围内，为法院审查行 政自由裁量行为树立一个合理性审查原则，同时加强法官队伍的素质 建设。最后要保障社会对行政自由裁量权的公众监督，以上三个方面 构成了我国对行政自由裁量权进行适当控制的基本架构，三者相互结 合，相互作用必将使我国的行政自由裁量权在社会中得到合理、规范 的运行。 a b s t r
