The deposit cannot be balanced out as the rent.5. 甲方应提前10日发付款通知给乙方, 乙方须将租金按时汇入甲方指定账户。Party A shall send invoice to Party B 10 days in advance. Party B shall pay the rental to Party As designated account on time。6. 付款方式 means of payment:以美金/人民币月付/季付USD/RMB payment every month/quarter.7. 甲方指定账号名称:Party As designated account name:银行名称:Name of bank:银行账号(美金/人民币):Account No:(USD/RMB):地址:Bank Add:三、约定事项:Agreed on:1. 租赁用途:乙方向甲方承租上述物业(以下简称单元)作为 之用。乙方不得将该单元用于本条款限定之外用途。Use of property: Party B is leasing from Party A the above-mentioned property (hereinafter called as the Premises) for use. The Premises shall not be used in ways other than those prescribed in this clause.2. 费用支付: 租用单元之水,电,煤气,电话费,网络费,有线电视费由乙方支付。 Party B shall pay charges of water, electricity, gas, internet , cable television and telephone fees of the premises.3. 家具及电器配置:家具清单详见本合同后附件一。Furniture and electrical appliances: Party A shall supply Party B with furniture and electrical appliances of the premises. The list is attached to this contract. (See Annex 1). 4. 乙方如未续租则应在到期当日搬出该单元。甲方在乙方付清由乙方支付的所有费用(含水,电,煤气及电话费)后,在7天内全部退还乙方承租押金(不计利息)。 如甲方延迟退还,应按日加付滞纳金0.5给乙方。Party B shall vacate the Premises on expire date of this Contract. If either party doesnt wish to renew this Contract upon its expiry, Party A shall return the deposit in full (without interest) within seven days to Party B after Party B has paid in full for the rent, including utility fees telephone expenses which shall be borne by Party B. If Party A delay the pay back the deposit, then a penalty of 0.5% per day will be added to Party B. 5. 乙方若需续租该单元,应提前两个月书面通知甲方。在同等条件下,乙方有优先续租权; 续租租金视当时市场价格而定。If Party B wishes to choose to renew the Lease Contract at the end of the term, it shall notify Party A in writing two months in advance. Party B shall be given the priority of tenancy over the Premises while the rent shall be dependent on the market standard by then.四、双方责任Responsibilities1. 甲方责任:Party As responsibilities:(1) 甲方应保证该物业的合法性及出租该物业的合法权利。Party A should guarantee the legality of the leased property and its legal right to lease the property.(2) 甲方须按时交房,因未及时交房而引起的损失由甲方承担。Party A shall give the possession of the Premises to Party B on the effective day of this Contract. Party A shall bear all liabilities for the delay.(3) 合同期内,甲方不得将该单元出租给任何其他第三方。Party A shall not rent the Premises or part of it to any third party within the valid term.(4) 如果该单元的内部结构,属甲方的家具电器设备由于非乙方原因而是由于自然损耗原因引起损坏,致使乙方无法正常生活,甲方须及时安排修理。If the interior structure of the Premises or its furniture and appliances which belongs to Party A are substantially destroyed or damaged which makes it impossible for Party B to live, and not owing to the default or neglect of Party B, then Party A shall arrange to repair it immediately to ensure its use. (5) 甲方应尽力督促管理公司提供充分的保安及消防工作。Party A shall be responsible to do his best to procure the estate manager to provide adequate security & fire prevention.(6) 甲方应遵守政府部门所规定的有关该房屋的任何法律规定。Party A shall comply with any laws regulations of government authority.(7) 甲方应支付由政府机构规定的应由业主所承担的各项税费。To pay the applicable taxes and charges payable on the said premises as designated by any relevant government authority or other lawful authority to be payable only by the Party A.2. 乙方责任Party Bs responsibilities:(1) 乙方须按上述付款日期支付各项费用,因乙方延期付款而引起的损失由乙方承担。Party B shall pay the fees in accordance with the provisions of this Contract. Party B shall bear all the liabilities for the delay of the payment.(2) 乙方应正确维护使用单元内属甲方的家具电器设备,因乙方的故意或过失损毁甲方物品,由乙方承担赔偿责任。乙方需更换单元内属甲方物品须有同甲方协商解决。Party B shall properly use and maintain the furniture and equipment belonging to Party A in the Premises. Party B shall be liable for compensating any damage caused by its improper or wrongful use. Party B shall consult Party A if it has to change the furniture of equipment belonging to Party A in the Premises.(3) 非经甲方及物业管理公司书面许可,乙方不得在单元内搭建,增减建筑物,不得将单元内建筑结构及装修予以改变,但允许乙方在墙上安装钉子挂相片等物品, 否则,乙方将承担由此产生的一切责任。Party B may not, without the permission of Party A and the building management company, erect, add or remove any structures and decoration in or from the Premises. It may not change the structural construction of Premises, except for nailing up pictures, etc. It shall be liable for expenses incurred there from. (4) 入住前提供护照复印件、照片等,并保证本合同期内其个人在京签证及工作签证为有效签证。Provide passport copy, photo etc before move in and make the work permit and the visa in Beijing is all-valid during the lease term in this premises.(5) 在甲方预先通知的情况下,租赁期最后两个月,允许甲方或其代理人带领 有意租赁或购买房屋的客人视察房屋。With Party As prior notice, Party A shall have the right to show the leased property to prospective tenants or purchasers during the last two months of tenancy. (6) 乙方应遵守政府部门及物业管理公司所规定的有关该房屋的任何法律规定。如违反规定造成甲方遭受经济损失的,乙方应全额赔偿,甲方有权单方面解除合同并没收押金并保留追索欠款及索赔的权利。Party B shall comply with any rules relating to government authority and Management Office. Party B shall pay for all Party As loss in full due to ilea gal actions for Party B. Party A has the right to terminate the contract and forfeit the deposit and has the right to get back the payment in arrears and compensation.五、违约责任Liabilities of Default1. 甲乙方提前退约:在定约期内,因甲方原因提前终止合同,甲方除应全额退还乙方租赁押金外,须支付乙方相等押金额作为违约金;反之,如乙方提前终止合同,则甲方没收押金。If Party A wishes to terminate this Contract before expiry, Party shall return the deposit in full and in addition to pay the default fee that is equal to the amount of the deposit. In opposite, Party B terminates the contract then Party B shall forfeit the deposit. 2. 乙方延付费用:乙方应按合同规定支付上述费用,若逾期5日未付,除应及时支付所欠费用外,还应每天支付甲方月租金的0.5滞纳金;延期超过10天, 甲方有权单方面解除合同并没收押金及保留追索欠款及索赔的权利。Party B shall pay the above rent and all other fees in accordance with the provisions of this Contract. If the rent is not paid within five days from the due date, Party B shall, in addition to pay the rent in arrears, pay Party A late payment charge of 0.5% of monthly rent per day of late payment. If the payment of rent is overdue by more ten days, Party A shall have the right to unilaterally terminate this Contract and confiscate the full amount of deposit paid by Party B and have the right to get back the payment in arrears and compensation.六、不可抗力: Miscellaneous:房屋由于火灾、恶劣天气、战争或其它甲方不可抗拒因素,而不是因为乙方直接或间接的疏忽及故意行为造成房屋毁坏而不能被正常使用及居住时,乙方从该日起停止支付租金,直至房屋可再被使用及居住为止,如该房屋因任何不能归因乙方的原因不能正常使用超过20天,乙方有权终止合同并无需承担任何责任,甲方应退还全部押金及预付租金。甲方根据自己的意愿及经济、实际意义等原因,没有义务必须修缮复原房屋。若此情况发生,甲方应书面通知乙方,并在做出上述通知的十天之内将押金及预付租金全部退还乙方。 If the leased property are substantially destroyed or damaged by fire, bad weather, war, force major, or other causes beyond the control of Party A not attributable directly or indirectly to the negligence or malice of Party B or are otherwise rendered unfit for use or occupation, the rent shall cease to be payable from the date the leased property become unfit for use occupation until the leased property shall again be rendered accessible and fit for use, if the lessons property can not be properly used for any reasons beyond 20 days, Party B has the right to terminate the agreement without any liabilities, thereof, Party A shall refund the deposit and the pre-paid rent, however ,that the Party A shall be under no obligation to repair the leased property , when in Party As opinion , it is not reasonably or economically or practically to do so . If such an event occurs,Party A shall give a written notice to Party B , and the deposit paid by Party B and the pre-paid rent.七、适用法及争议的解决:Legislation & Arbitration of the Dispute: 本租约受中华人民共和国法律的约束,如发生与本租约有关的争议,由双方友好协商解决,协商不成,提请设在北京的中国国际经济贸易仲裁委员会,依该委员会在仲裁申请提出时有效的仲裁规定进行仲裁,仲裁在北京进行,仲裁语言为汉语,仲裁裁决是终局的,对双方当事人均有约束力。 This Lease Agreement is under the legal authority of PRC.
