On August 26, 2010, the Ministry of Industry and Information Technology, Ministry of Environmental Protection, Ministry of Agriculture, and General Administration of Quality Supervision, Inspection and Quarantine jointly issued the pesticide industry policy announcement. Reads as follows: Ministry of Industry and Information Technology,Ministry of Environmental Protection,Ministry of Agriculture,General Administration of Quality Supervision, Inspection and Quarantine,AnnouncementFederation of Trade Unions Industrial Policy 2010 No. 1To implement the Pesticides Management Regulations and the State Council on the issuance of the petrochemical industry restructuring and revitalization plan requirements, standardize and guide Chinas pesticide industry to healthy and sustainable development, we developed the Pesticides Industrial Policy and published as below.Attachment: Pesticides Industrial PolicyAugust 26, 2010Attachment Pesticides Industrial PolicyPesticides is an important agricultural production material and relief supplies, it plays an indispensable role on the prevention of pests, protection of agricultural harvest, improving quality of agricultural products, ensuring food security, and controlling the pests in public health, industry and other related areas. With over half a century development, Chinas production capacity and production volume of pesticides is leading in the world, not only to meet domestic demand for agricultural and related fields, but also become the worlds major producer and exporter of pesticides. However, during the rapid development in the pesticide industry, there is serious overlapping of overcapacity, the industry structural contradiction, disorder and other operational issues affecting the pesticide industry for sustainable development. To speed up the pace of industrial restructuring on pesticides industry, improve pesticides capabilities on food security, and guide the pesticide industry to sustained and healthy development, according to relevant state laws and regulations, we developed this policy. Chapter 1 Policy objectivesArticle 1: ensure agricultural production and keep environmental & ecological safety. By policy development and implementation, to improve pesticides capabilities on crop production and food protection, ensure quality and safety of agricultural production and agricultural products, to ensure environmental and ecological safety, to promote sustained and healthy development on pesticides industry. Article 2: control the total quantity. Fully evaluate the relations among domestic and external demand, economics, society, resources, and environment, adhere to the timely, appropriate and orderly development principles, to curb the pursuit of local interests, which ignoring the resource consumption, causing environmental pollution by the blind expansion and repeated construction practices, strict control the total size of the production of pesticides, and change the pesticides industrys development mode from quantity expansion to quality improvement. Article 3: optimize the layout. Promote regional reasonable position and coordination of the whole pesticides industry. Vigorously promote industrial clustering, accelerate the pesticides companies gathering to the industrial parks or chemical concentrations, reduce production dispersion and reduce pollution. Strive to meet the target: the national pesticides companies in the chemical pesticides concentration area over 50% of total number of enterprises by 2015, and over 80% by 2020. Article 4: accelerate the organizational restructuring. Vigorously promote corporate mergers and acquisitions, increase industrial concentration; optimize the industrial division of labor and cooperation, and promote the technical pesticides companies as a leader to establish a complete industrial chain. Promote pesticides industry changing the direction to intensification, large-scale, and specialization. Reach 30% reduction in the number of pesticides companies by 2015, and the top 20 domestic pesticides enterprise groups total sales should over 50% by 2015, and over 70% by 2020. Article 5: accelerate the improvement on process technology and facilities. Set strict regulations on production access, increase technological innovation, improve the application of high technology and automation in the industry. Formulation processing and packaging achieve full automation and control by 2015; the bulk technical pesticides achieve 70% automatic controlled production and large-scale equipments in 2015, and over 90% in 2020. Article 6: improve innovation. Further reinforce the foundation for innovation, improve the existing innovation system and mechanism on pesticides, and strengthen intellectual property-orientation, turning the innovation led by the state to pesticides companies or a combination of research institutes and production companies. Chinas top ten pesticide companies to establish a better innovation system and its accompanying intellectual property management system, innovative R & D costs to sales income should over 3% by 2015, and over 6% by 2020. Article 7: reduce pesticides risks to society and the environment. Stringent pesticide safety and environmental protection, strengthen process innovation and the development and application of pollution control technology, promote clean production and energy savings; accelerate development on high security, low risk products, and application technology research, and gradually restrict and eliminate high toxic, high pollution, high environmental risks pesticides products and technology; establish and improve the pesticides waste disposal system, to reduce the environmental impact of pesticide waste. By 2015, environmental pollution treatment technology meet the needs of environment protection, the three wastes emissions decrease 30%, by-products utilization increase 30%, pesticides waste disposal rate to 30%. By 2015, the three wastes emissions decrease 50%, by-products utilization increase 50%, and pesticides waste disposal rate to 50%.Article 8: standardize the market order. Strengthen market supervision, standardize the market behavior and improve the efficiency of supervision. Promote the integrity building, improve the level of industry self-regulation, and maintain a fair competition environment; implementation of brand strategy, cultivates leading brands, and improves the market share. By 2015, the well-known pesticides brands sales take more than 30% of total sales by 2015, and more than 50% by 2020. Article 9: Improve collaboration among the market allocation of resources, government macro-control, and the intermediary organizations coordination. Streamline and improve the pesticides market regulation, management and regulatory agency coordination system, to create fair competition, full coordination and efficient management market environment. Chapter 2 Industrial layoutArticle 10: considering the geography, resources, environment and transportation, and etc. to adjust pesticides industrial layout. Through the production and access management, to ensure that all pesticides production site in line with the production function of the main body of the country area planning, land use planning, regional planning and urban development planning, and away from the fragile ecological environment areas and environmentally sensitive areas. Article 11: New construction or relocation of the original technical pesticides manufacturers comply with the national land policy and enter into industrial clusters, new construction or relocation of the formulation manufacturers considering both the market and convenient transportation, encouraged access to industrial clusters. Article 12: the existing pesticide companies layout does not meet the requirements of pesticides industry, new products and expansion on production capacity primarily will not be approved. Promote the gradual adjustment, relocation or changing products. Article 13: strictly control new pesticides plants and blind new capacities in production capacity surplus region, restrict transfer excess production capacity products to the central and western regions. Guide the development of the western region according to local resource conditions, and in line with local market needs. Chapter 3 Organizational structureArticle 14: improve relevant laws, regulations and policies to encourage competitive enterprises to restructure of production factors and to unify brand management of its hold, equity participated, joint ventured, or mergered corporations; support competitive enterprises to expand leading products production capacity in other regions, and develop the leading brands; promote social resources centralized to the competitive enterprises, support competitive enterprises grow bigger and stronger. Article 15: within the scope allowed by laws and regulations, promote the rational flow and transfer of intangible assets, such as intellectual property rights, pesticide registrations, and etc., promote the pesticides industry to adjust and optimize production factors to achieve intensive, large-scale production. Article 16: support pesticide manufacturers to the rational use of production factors across regions; promote contract manufacturing among the enterprises which obtained the same registration and license on the same product.Article 17: establish and improve tracing system for the technical products, promote the technical manufacturers and formulation manufacturers establish long-term stabilized labor division and cooperative relations based on the product chain, form strategic alliance to create the brand, and clean up the market. Article 18: improve the exit mechanism for pesticides companies. Bring rigid industry access conditions, restrict the surplus, eliminate the backward companies, broaden the channels for the rational flow and integration of production factors, improve the relevant policies and guidance of the exit compensation mechanism, speed up the process to squeeze the pesticide companies with irrational product structure, backward technology and equipment, poor management, severe environmental pollution, out of the market. Chapter 4 Product structureArticle 19: through scientific and technological support, technological innovation, economic policy guidance and other measures to support the development on efficient, safe, economical and environmentally friendly new pesticide products, accelerate the substitution and elimination of high pollution, high-risk products, promote the products structure constantly optimized. Article 20: focus on the development of insecticides and nematicides on the frequently occurred, refractory pests, soil pests, nematodes, and invasive pests, and the development of herbicides adapt to to the farming system and farming technological changes, and the development of new fungicides and virus inhibitors for fruit trees and vegetables, and the development of fungicides, seed treatments and environmentally friendly fumigants for greenhouses, urban greenings, flowers, and garden crops, and the development of plant growth regulators and fruit preservatives, encourage the development of pesticides for minor crops, bio-pesticides, and new products for non-agricultural fields. Vigorously promote the agricultural used formulations to efficient and safe direction: water-based, dust free, controlled release, and etc., support the development, production and promotion of water-dispersible granules, suspensions, emulsions in water, micro-capsules and large granules (tablets) and other new formulations, and its accompanying new solvents and additives, reduce the proportion of powders, EC, WP, strict control of the usage of toxic and hazardous solvents and additives. Encourage the development of saving and environment-friendly packaging materials. Article 21: enhance non-agricultural market research, and actively develop readily marketable products and using technologies to expand the scope of application of pesticides to meet the needs of national economy related fields. Article 22: timely announce of the encouraged, restricted, eliminated pesticides catalog, and by land, credit, environmental and other policy measures to strictly control the new production capacities on the resources wasting, the high three wastes emissions, and forbid the transfer of high energy consumption, low technology, pollutant treatment difficult pesticides transfer to other regions, speed up the process to eliminate the inferior products. Chapter 5 Technology PolicyArticle 23: support and encourage enterprises to use new technology and new equipments, speed up technological progress and improving the level of information technology to achieve continuous production, control automation, large-scale equipments, and modern management. Article 24: focusing on development and application of the core technology and the key common technologies, enhance catalytic efficiency, efficient purification, directed synthesis, depth of use of the chiral isomers and bio-technology, speed up the research and application of low-solvent, water-based, and sustained-release formulations, and the research and application of efficient and economical three wastes treatment technology. Article 25: continues treat pesticides as high-tech industry, support the basic platform construction, improvement and innovation system, development of new pesticides, and etc.; support enterprises to establish technology centers, and form production and research centers with research institutes, universities and other research entities. Organize and develop the Pesticide Industry and Technology Development Guidance, to guide enterprises, research institutes and universities to carry out targeted innovation. Article 26: encourage pesticides companies to set up overseas R&D institutions by investment, joint ventures, mergers and acquisitions, and etc., extensively absorb international advanced technology and talents. Support enterprises, research units to apply overseas patents, registrations and trademarks. Article 27: improve intellectual property management mechanism, strengthen intellectual property awareness from research, production to sales, export and other sectors, enhance pesticides companies abilities on intellectual property creation, use and protection. Article 28: Based on the development of pesticides industry, timely update and publish the encouraged, limited and eliminated technology and equipment directory, guide and regulate investment, promote technological progress, improve the overall industry. Article 29: full implementation of ERP (enterprise resource planning, such as SAP) and other information management system in pesticides industry; comprehensively improve the information management of pesticides companies. Chapter 6 Production managementArticle 30: implement access management for the production of pesticides, implement the registration of pesticide products and the production license system, the company shall not engage in pesticides production without approval, products without registration and license shall not be produced, sold, exported or used. Pesticides production and registration management departments should promptly announce the approved pesticides companies; continue approved pesticides companies, product registration and manufacturing license information to the public.Article 31: production upgrades, new types of production, and production relocation are treated as new pesticides plant, and follow the implementation of access management. Article 32: establish databases, including pesticides access permit, production, sales, environmental protection, export, credit records, intellectual property and other related business information, gradually realize the information sharing among industry, agriculture, environmental protection, commerce, quality inspection, customs, statistics, intellectual property and other related departments, improve management efficiency. Article 33: pesticides companies should establish data files from purchasing to production, sales, export, the whole process, improve product quality and traceability system. Article 34: establish and improve national disaster mitigation pesticides reserves and early warning mechanisms, increase the reserves of pesticides in the off-season, improve the disposes abilities to sudden natural disasters. Improve tax and credit policies, regulating pesticides imports and exports according to domestic and global market changes and differences in seasonal sections, to ensure market supply. Article 35: standardize and strengthen the pesticides quality standardization and management systems, ensure the pesticides standard is scientific and uniform. Actively promote the development, revision and improvement of the standards, and increase efforts to implement standards to ensure product quality. Article 36: enhance the statistical work to ensure that pesticides statistics are true and accurate. Pesticides manufacturers should strictly implement the national statistical requirements according to the PRC Statistics Law requirements, carefully fill the data in accordance with the meaning and requirements of each statistical indicator, and report the statistics accurately. Production management department shall assist statistics department to fulfill the statistics on pesticides. Industry associations shall assist statistics department to strengthen statistical data audit. The statistics will be used as a basis for the pesticides laws and regulations, industrial planning, industrial policy, standards development and implementation of such decision-making.
