In the probation period, either party can terminate the contract with no special reason.二、工作内容Job contents第二条甲方聘用乙方担任本公司产品安全及质量部门项目工程师职务,从事与甲方公司经营有关之工作乙方保证有能力及愿意从事上述工作。对任职后之工作内容与职务,甲方可因工作需要和Z 方的能力表现调动之。乙方亦有反映本人意见的权利Article 2: Party A hires Party B to hold post of the project engineer of the product safety and quality department of our company and to be engaged in the work related to the company business of Party A. Party B ensures having ability to be engaged in the above work. For the job content and position after holding the post, the position of Party A can be transferred due to the needs of the work and the ability performance of Party B. Party B also has the right to report the personal opinions. 第三条经双方协商后,乙方应按照甲方确定的岗位责任,按时、按质、接量完成工作。Article 3: After through the negotiation of the both parties, Party B shall finish the work according to the responsibility of the post, with the quality and quantity defined by Party A三、工作条件Working conditions第四条甲方需为乙方提供符合国家规定的安全卫生的工作环境,保证乙方在人身安全及人体不受危害的环境条件下从事工作。Article 4: Party A shall provide the safety and health working environment which accord with the national regulation for Party B, ensure Party B working in environmental condition of safety and the human body not being damaged.第五条甲方提供乙方必要之设备及场所进行工作。工作时间、工作内容、工作质量要求悉由甲方指派与规定。Article 5: The necessary equipment,working time, working content, working quality requirements that Party A provides for Party B shall be assigned and stipulated by Party A第六条乙方愿全力为甲方效力,不再兼职于其他企业或单位,亦不以亘接或间接的方式损害甲方或损害甲方的人事、财务、信用、资讯、知识产权等。任职期间与职务相联系的或利用公司其他资源条件的所为研究、发明、制作、设计、改良、生产等全属甲方公司所有因而获得之专利权/著作权亦完全归属甲方所有。Article 6: Party B is willing to do the best to work for Party B, and shall not do the part-time job in the other enterprises or units, and also not indirect or indirect damage Party A or damage the personnel, finance, credit, information, intellectual property rights and etc of Party A. During the tenure, all the research, invention, production, design, improvement, production and etc made relating to the position or by using the company or other resource condition shall all belong to the property of Party A, and the patent/copyright obtained from it are all belonging to Party B.四、劳动报酬Payment of labor第七条甲方每月25 日以货币形式支付乙方工资,月工资为税前人民币主8,000.元。甲方将根据公司的经营状况,地方的物价指数,员工个人及工作小组的表现,每年对乙方的工资作适当的调整。此外,乙方每年将获得一次双薪。Article 7: In 25th every month, Party A shall pay the salary to Party B in the monetary form. The monthly salary is pre-tax RMB 8000 Yuan. Party A shall be according to company performance, local price index, and the performance of staff personal and work group, make the appropriate adjustment for the salary. In addition, Party B shall get double pay once yearly.第8条保险福利待遇甲乙双方按国家和北京市的规定参加社会保险。甲方为乙方缴纳国家规定的社会统筹保险和住房公积金。Article 8: Insurance welfare and remuneration: Both parties shall participate in the social insurance in accordance with the regulations of the state and of Beijing. Party A shall pay social insurance and housing fund prescribed by the state for Party B第九条甲方为乙方办理有关社会保险手续。Article 9: Party A shall handle the relevant social insurance formalities for Party B第十条乙方患病或奔因工负 .其医疗待遇按国家和北京市有关规定执行。Article 10: For the illness or injury suffered on the job of Party B, the medical treatment shall be according to the related regulations of the state and Beijing第十一条乙方患职业病或因工负伤的待遇按国家和北京市的有关规定执行。Article 11: For the occupational disease or injury suffered on the job of Party B, the treatment shall be according to the related regulations of the state and Beijing to implement.五、工作时间和劳动保护Working time and Labor protection第十二条甲方安排乙方执行定时工时制度。乙方每日工作日才闽8 小时,每周工作40 小时。Article 12: Party A shall arrange Party B to execute the timing working hour system. The working time of Party B daily is 8 hours daily and 60 working weekly.第十三条甲方可以根据工作需要在符合法律,法规的情况下安排乙方加班,乙方需服从甲方安排。甲方安排乙方延长工作时间,应支付不低于工资的150%的工资报酬,甲方安排乙方休息日工作又不能安排补休的,应支付不低于工资200% 的工资报酬。甲方安排乙方法定休假日工作的,应支付不低于工资的300% 的工资报酬。Article 13 Party A can arrange work overtime for Party B according to the need of work in accordance with the laws, rules and regulations. Party B shall obey the arrangement of Party A. Party A shall pay Party B not less than 150% of the salary for the extended working time arranged by Party A for Party B. Party A shall pay Party B not less than 200% of the salary for Party B working on the rest day arranged by Party A but Party can not arrange the compensatory time off. Party A shall pay Party B not less than 200% of the salary for Party B working on the legal holiday arranged by Party A.第十四条乙方享有以下带薪假期:Article 14: Party B shall have the following paid holidays:1 、法定/公司假日Legal/company holidays种元旦( 1 月1 日) 1天New Years Day (January 1) 1 day劳动节( 5 月1 日, 2 日, 3 日) 3天Labor Day (May 1, 2, 3,) 3 days国庆节( 10 月1 日, 2 日, 3 日) 3天National Day (October 1, 2, 3,) 3 days圣诞节( 12 月25 日, 26 日) 2天Christmas (Christmas 25, 26,) 2 days春节(农历正月初一、初二、初三) 3天Spring Festival (the first day, second day and third of the first month of the lunar year of the lunar calendar) 3 days2 、国家规定的婚假、丧假、产假。The wedding leave, funeral leave and maternity leave prescribed by the state第十五条乙方每年享有15 天的带薪年假(不包括法定/公司假期)。工作每满1 年,增加1 天,最多不超过20 夭。乙方申请年假应根据甲方工作需要在适当的时候提出,并经甲方批准。Article 15: Party B shall have 15 days paid annual leave each year (not including legal/company holidays). One day shall be added for the each one working year of Party B, but which shall not exceed 20 days. Party B applying for the annual leave shall need proposing in the proper time, and get the approval of Party A.第十六条乙方每年享有10 天的带薪病假。乙方应给甲方出示医院病假证明,申请获得。如需交接工作,乙方应听从甲方安排。Article 16: Party B shall have 10 days paid sick leave. Party B shall display the sick leave certification of the hospital to apply the paid sick leave. If needing the handover work, Party B shall obey the arrangement of Party A.第十七条甲方可因无法抗拒之天灾人祸及工作需要,视情况调整工作时间。Article 17: Due to the natural and man-made disaster and the work needs, Party A can adjust the working time according to the situation.六、劳动纪律Labor discipline第十八条甲乙双方应遵守国家的法律法规。Article 18: The two parties shall observe the laws and regulations of the state.第十九条乙方应遵守甲方的各项规章制度,遵守甲方规定的工作程序、保密规定等制度。Article 19: Party B shall observe the various kinds of the rules and regulations of Party A, and observe the provisions of the working procedure, confidentiality regulations and other system of Party A.第二十条乙方愿遵守甲方员工手册之规定,服从主管人员之管理。乙方有违反甲方规定,甲方可作口头警告、书面警告等纪律处分,直至解除本合同。Article 20: Party B is willing to observe the regulations in the “employee handbook”, and obey the management of executive staff. When Party B has violated the provisions of Party A, Party A shall give the verbal warming and written warming and the disciplinary action, as well as terminating this contract.第二十一条乙方应严格遵守甲方的老勤制度不得无故迟到、早湿、旷工。在上班时间未经请假不得擅自离开岗位,否则按旷工处理。Article 21: Party B shall strictly observe attendance system of Party A, and shall not late, early leave, absence from work without cause or reason. Party B shall not leave the post without authorization in the work time. Otherwise, it shall be treated as absence from work.第二十二条乙方若有侵害甲方公司资产(包括人力资产/财务资产/资讯资产/信用资产/知识产权等)之行为,或泄漏甲方公司机密(包括产品机密/人事机密薪资机密/商业机密)之事情时,甲方宦接解除合同。Article 22: If Party B violates the assets of the company (including human assets/financial assets/information assets/credit assets/intellectual property rights and etc) and other behaviors, or leaking the company confidentiality (including product confidentiality/personnel salary confidentiality/commercial secrets) and etc, Party A can directly terminate the contract.第二十三条不得自行经营或为他人经营与甲方经营范围相同的公司或其他企业Article 23: Party B shall not self operate or operate for other companies or enterprises which the business scope is the same as the business of Party A.第二十四条甲方依据经营需要或内部管理制度有权安排乙方之任务目标、在职训练、职位升迁、知识技能培训,乙方应遵守。Article 24: Party A has right to arrange the task object, on-the-job training, job promotions and knowledge skills training for Party B according to the business needs and the company internal management system.第二十五条乙方触犯国家的法律,被斗刑,劳教的,本合同无条件解除。Article 25: Party B breaches the law of the state, is getting the criminal punishment or reeducation through labor, this contract is unconditional to terminate.第二十六条乙方结束在甲方工作日才,应当做好交接工作,交清单位的各类文件及财物。Article 26: After finishing the daily work, Party B shall do the handover work well, and clearly hand over the various documents of the company.七、业务机密Business secret第二十七条乙方了解其所从事工作对甲方公司之重要性,任何有关于工作、业务、人事、工资、产品等资料内容的泄漏必将造成公司重大的损害。任职期间或离职后绝不私自复制或保留任何资料内容,亦不将知悉之资料内容泄漏给其他任何第三人,或协助第三人获悉该资料内容。如果乙方违反以上有关保守商业秘密事项,给甲方造成经济损失的,应按照相关法律规定承担赔偿责任。Article 27: Party B shall know well the importance of the work that self is engaged in for Party A . The leaking of any information and contents about work, business, personnel, wages, products and etc shall cause the significant damage of the company. During in he employment period or after demission, Party B shall not self copy or keep any information and contents, and shall not leaking the information and contents to any third party, or assist the third party to get these information and contents. If Party B violates the above item of keeping the business secrets, and causes the economic losses of Party A, then Party B shall according to the relevant provisions of the law to bear the liability for compensation.八、劳动合同变更、解除的规定The provision of the modification and termination of the contract第二十八条有下列情形之一的,甲乙双方应变更劳动合同并及时办理变更合同手续:Article 28: In case of the following situation, Party A and Party B shall alter the labor contract and timely handle the procedures of the alteration of the contract.1 、甲乙双方协商一致的;Both parties reach the unanimous agreement2 、订立本合同所依据的客观情况发生重大变化,致使本合同无法履行的,The base of evidence of the objective conditions that formatted this contract has been taken great changed, which makes this contract unable to fulfill.3、订立本合同所依据的法律、法规、规章发生变化的。The base of the laws, regulations and rules that formatted this contract has been taken changed,第二十九条当事人依据第二十八条第2 项的约定,一方要求变更本合同的,应将变更要求书茵通知另一方,另一方应在15 日内(含15 日)书面答复对方;才5 日内未答复的视为不罔意变更本合同。Article 29: The parties is according to the provisions of the item 2 of article 28, for one party asking for altering the contract, this party shall inform the alteration request letter to other party. The other party shall in 15 days (including 15 days) reply to the other party in written. If no replying in 15 days, it is deeded to be not agreeing to alter the contract.第三十条经甲乙双方协商一致,本合同可以解除。Article 30: Through the consensus of the both parties, this contract can be terminated.第三十一条乙方有下列情况之一的,甲方可以解除本合同,不支付经济补偿Article 31: In the case of one of the following situation of Party B, Party A can terminate this contract, and does not need paying the economic compensation1 、在试用期间被证明不符合录用条件的,1. It is proved that Party B is not conforming to the employment condition in the probationary period2、在正式任期内,发现乙方虚报资历、名不符实、不能胜任任职工作的,甲方则无条件解除本合同。In formal tenure, in case finding the Party made the false declaration and provided unreal information and is unable to hold the post, Party A can unconditionally terminate this contract.3、乙方因严重违反纪律,按甲方奖惩办法规定可以解除合同。Due to Party B is seriously violating the discipline, according to regulations of the rewards and punishment, Party A can terminate the contract.4、乙方被依法追究刑事责任的。Party B is investigated for criminal responsibility in accordance with law5、乙方违反甲方规定,在工作日才间饮酒和吸毒。Party B violates the regulation of Party A, and was drinking and taking drugs in the working days.6、乙方有任何偷窃或者企图偷窃的行为。Party B has any theft or the behavior trying to steal7、乙方篡改或企图篡改甲方文件。Party B is falsifying or attempting to falsify the documents of Party A8 、乙方参与对办公室安全和莫他员工构成威胁的活动,或对甲方业务造成不良影响时,甲方可以解除合同。Party B participates in the activities which threat the security of the office and other staff, or causes the bad effect on the business of Party A. Party A can terminate the contract.9、乙方未经授权向他人泄露公司机密信息。Party B divulges the confidential information to others without the authorization of Party B.第三十二条有下列情形之一的,甲方可以解除本合同,但应提前30 日书面形式通知方。Article 32: In case of one of the following situation, Party A can terminate this contract, but shall be 30 days in advance to notice to Party B in written form.1 、乙方因病和因工作负伤在规定的医疗期满后,经劳动鉴定委员会确认不能从事原工作的,甲方可以依法解除合同。Due to the illness and injury suffered on the job of Party B (After in the specified expiration of the medical treatment, confirmed by the labor appraisal committee that Party B can not be engaged in the original work) Party A can terminate the contract in accordance with law.2、甲方因技术经营情况发生变化,乙方无法胜任莫岗位工作,甲方可以解除合同。Due to the technology business condition of Party A has taken change, Party B can not be qualified for the post work, Party A can terminate the contract.3 、双方不能依据合同第二十八条第2 项就变更合同达成协议的。Both parties can not reach the agreement on the alteration of the contract according to the item 2 of the article 28 of this contract第三十三条有下列情况之一的,乙方可以解除本合同。Article 33: In case of one of the following situation, Party B can terminate this contract1 、在试用期内的。In the probation period2、甲方以侵害乙方合法人身权利手段强迫劳动的。Party A infringes the legal rights of Party B to force labor.3、经国家有关部门确认,甲方劳动安全、生条件恶劣,严重危害乙方身体健康的,乙方可无条件解除合同。Through the confirmation of the relevant departments, the labor safety, bad living condition, and seriously harming the health of Party B, Party B can be unconditional to terminate the contract.4、甲方不按照本合同规定,向乙方支付工作报酬,或者保险金和公积金的,乙方可无条件解除合同。Party A is not applying the work remuneration, or insurance and accumulation fund according to the contract provision, Party B can be unconditional to terminate the contract.5、如因某种原因,乙方认为其工作不再合意。Due to some reason, Party B considers that the work is no longer desirable.第三十四条乙方转正后离职必须于一个月前提出书面申请,并服从甲方交接等工作安排,经甲方许可后,乙方在确保工作妥善移交后方可以离职。若离职未经甲方同意即自行离职,则视为违反本合罔之规定处理,甲方有权要求乙方支付等同于乙方前一月工资总额的补偿金并有权依照法律及公司相关规定追究乙方违约责任。Article 34: For the dismissing of Party B after becoming a regular worker, Party B shall submit the written application to Party A one month in advance, and obey the work arrangement of Party A. After getting the permission of Party A, Party B can dismiss. If the dismissing of Party B is not through the permission of Party A, then it shall be regarded as the violations of the contract, Party A has the right to ask Party B paying the compensation equal to the total amount of the monthly salary of the previous month of Party B accordance with the laws and the relevant previsions of the company to ask Party B to take the liability for breach of contract.乙方的保证The guarantee of Party B第三十五条乙方保证其与原用人单位己合法解除劳动关系。如因未与原单位合法解除劳动关系给甲方造成损失的,由乙方承担赔偿责任。Article 35: Party B ensures to legally terminate the labor relationship with the original employing unit. Party B shall undertake the liability for compensation for the loss of Party A caused by Party B not legally terminating the labor relationship.第三十六条乙方保证其将及时向甲方递交办理社会保险和住房公积金的有效凭证,如因迟延递交而造成的任何后果,乙方应承担相应责任。Article 36: Party B ensures to timely submit the valid certifications to Party A to handle the social insurance and housing fund. Party B shall take any relevant responsibility for any consequence caused by delayed submitting them第三十七条乙方在被甲方聘用期间,如受甲方派遣到国外培训的,在培训结束后的三年之内,若甲方根据第三十一条或乙方根据第三十三条5 点终止合同的,乙方应就培训费用向甲方作相应赔偿。培训结束后,工作每满一年减免赔偿培训费的三分之一。Article 37: During Party B is employed by Party A, if Party B is assigned to go to oversea to get the training. In three years after finishing the training, if Party A is terminating the contract according to the article 31 or Party B is terminating the contract according to the item 5 of the article 33, Party B shall make the relevant compensation for Party A. After the training is finishing, the training expense shall be reduced a third for working for every one year,十一、争议的处理Settlement of dispute第三十八条因履行本合同发生纠纷,甲、乙双方可协商解决,协商不成,任何一方均可在劳动争议发生之日起60 日肉,向北京市朝阳区劳动争议仲裁委员会申请仲裁。仲裁未果,不服仲裁裁决的一方,向甲方所在地人民法院上诉。Article 38: All disputes in connection with this contract or the execution thereof shall be settled through friendly negotiations.
