三方双语租赁合同 房产租赁合同APARTMENT LEASECONTRACT合同编号/CONTRACT NO.CD甲方(出租方)/Landlord(Party A):身份证号码/ID No.:乙方(承租方)/Tenant(Party B):身份证号(或护照号)/ID/Passport obligationsof bothsides as follows: 一、租赁标的基本情况The basicinformation of the apartment1.1房屋位置房屋套型,建筑面积平方米,结构框架,楼层层,该房屋已/未设定抵押。 The locationof the contract apartment is,with bedrooms,bathrooms,with squaremeters,in the_floor,with/without the condition ofmortgage.1.2该房屋产权证号/购房合同备案号监证权证号The propertyownership certificateNo./the housepurchase contractNo.:监证权证号1.3该房屋用途住宅。 乙方保证,在租赁期间内未征得甲方书面同意以及按规定经有关部门审核批准前,不擅自改变房屋的用途。 The useof the contracted apartment:_residence usage.Without Party Asand the relevantdepartments permissionon thepaper,it is not allowed to changethe useof the apartment.1.4配套设施详见附件一房屋设备清单。 The furnitureand facilitylist areattached asthe attachment1for 二、租期The lease period:2.1租赁期为壹年,自日起至日止。 The lease period isfrom until,lease periodis yearsin total2.2租期届满,甲方有权收回出租房屋及由甲方所配置的家具、电器,乙方应如期完好交还。 If the lease periodruns out,Party Ahas theright to take the contracted apartmentback withall the contracted itemsin the apartment,and theParty B should moveout the apartment on time withoutdamage to the furnitureand equipments.2.3租期满后,乙方如要求续租,在同等条件下享有优先续租权,乙方须在本租约届满前30日向甲方提出申请,续租租金双方另行协商。 Party B,wishes torenew the lease after the expirationof rent,Party B has privilegeand priorityunder samecondition asothers and shall give30days in advance noticeto party A,before theexpiry of thelease.,Both partiescan reach an agreementwith the new rent.Party B,wishes torenew thelease afterthe expirationof rent,Party Bhas privilegeand priorityunder samecondition asothers andshall give30days inadvance noticeto party A,before theexpiry of thelease.,Both partiescan reachan agreementwith thenew rent. 三、租金及支付方式:The rent and paymentoption:3.1租金标准人民币¥元(月(大写),The rentis¥RMB permonth3.2支付类型:,乙方应每次提前天支付甲方下一季租金,(租金支付时间表详见附件).Payment method:,party Bshall paydays inadvance everyquarter topartyA.(payment datesis attached as Appendix)3.3租金支付方式:乙方以银行转帐或者银行转账方式的形式支付甲方租金。 (银行帐号:详见附件3)The wayof thepayment:Party Bshall paythe rent to Party A bybank transferor cashbank aountdetails isattachedasAttachment3)3.4甲方收取租金及房屋租赁保证金后,应向乙方开具收条。 Party Ashould makethe invoicefor the rentanddeposit. 四、房屋租赁保证金:The depositof the contracted apartment:4.1乙方应向甲方支付房屋租赁保证金,具体金额为人民币¥元(大写)。 Party Bshould pay¥_RMB asdeposit to Party A.4.2租赁期满或合同解除后,乙方付清所有该承受的费用及租金,且物屋内设施设备无人为损坏,甲方将全额退还乙方押金。 Until Leaseexpiration ortermination of the contract,Party Bshould pay off allusage feesand rent,and makesure thatfacilities,equipments andfurniture within the apartmenthas nodamage,Party Awill refundParty Bthe deposit. 五、其他费用Some otherfees:租赁期内,使用该房屋所产生的费用,包括水、电、气、通讯、设备、物业管理费用由乙方承担。 During thelease period,Party Bshould paythe feesfor water,electricity,gas,and municationexpense,facility expense,and themunity property management fee. 六、房屋的交付及返还:Handover andreturn the apartment:6.1交付甲方应于年月日前将房屋按约定条件交付给乙方,并签署附件二物业交接单,签字后视为交付完成。 Handover:Party Ashall handover the apartment toParty B beforeaording tothe contractedcondition,and both parties signtheProperty HandoverList,attachment1,2,as pletionof theHandover.6.2返还租赁期满或合同解除后,乙方应返还该房屋及其附属设施。 甲乙双方验收后认可在附属件二物业交割单上签字盖章。 甲乙双方应结清各自应承担的费用。 Return:Party Bshould returntheapartmentand all the contracted items toParty Aafterthe contract expiresor invalid,andshallclear andpayoffalltherelated fees6.3乙方添置的新物可由其自行收回,而对于乙方装饰、装修的部分,具体处理办法为双方协商处理Party B can takeaway thenew itemsit bought.About thedecoration madeby Party B,the wayto dealwith is_bothpartieswill reachan agreement6.4返还后对于该房屋内乙方未经甲方同意遗留的物品,甲方有权自行处理。 After Party B returnsthe contracted apartment toParty A,Party Ahas theright tomanage thestuff leftby Party B withoutParty Bs permission. 七、房屋使用要求和维修责任:The requirementsof theusage andrepair responsibilities:7.1租赁期内,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复。 甲方应在接到乙方通知后的7日内进行维修。 逾期不维修的,乙方可代为维修,费用由甲方承担。 During thelease period,Party Bshould inform Party Ain timeif the contracted apartmentof the contracted itemsare broken.Party Ashould fixthem within_7_days afterParty Binforms him.Party B can fixthem for Party A if Party A doesnt fixthem in time,and Party A is in charge of the repair fee.7.2租赁期内,乙方应合理使用并爱护该房屋及其附属设施。 因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修,或甲方可代为维修,费用由乙方承担。 During thelease period,Party Bshould takegood careof the contracted apartmentand itemswith properuse.If the contracted apartmentor the contracteditemsare brokenbecause of the improperway Party B uses,Party Bshould fixthem.,Party Acan fixthem and Party Bisinchargeof the repairfees.7.3除本合同附件(一)外,乙方另需装修或者增设附属设施和设备的,应事先征得甲方的书面同意,按规定应向有关部门办理审批的,则还由甲方委托乙方报有关部门批准后,方可进行。 乙方增设的附属设施和设备及其维修责任于甲、乙双方另行书面约定。 Apart fromthe contracteditems(seen onthe attachment1),Party Bshould havethe permissionfrom Party Aif Party Bwants tore-decorate oradd somenew items.And alsoParty_B_should havethe permissionfrom relevantdepartment ifnecessary.Party A and Party B can reachan agreement abouttherepairresponsibility of thenewitems Party B buys. 八、转租,及所有权变动:Sub-lease,ownership changes:8.1除甲乙双方另有约定以外,乙方不可在租赁期内将该房屋部分或全部转租给他人。 Unless Party A and Party Bhave an agreement,Party Bisnotallowedtore-rent orsublet partor fullof theapartmenttothe others.8.2租赁期内甲方出售该房屋的,甲方应当提前30日书面通知乙方,乙方在同等条件下享有优先于第三人购买的权利(此项甲方不用支付违约金)。 During thelease period,if Party A sellstheapartment,Party Ashould inform Party Bby writing_30_days inadvance.Meanwhile,Party Bhas priorityto buytheapartmentover others(this itemwithout paymentof liquidateddamages) 九、合同的解除:The conditionsto invalid the contract:9.1经甲乙双方协商一致,可以解除本合同。 The contractcan beinvalided ifboth Party A and Party Bcanreachan agreement.9.2有下列情形之一的,本合同终止,甲乙双方互不承担违约责任Both theParty AandParty B arefree frompenalty responsibilityof endingthecontractif its because of thefollowing reasons:9.2.1该房屋因城市建设需要被依法列入房屋拆迁范围的。 The contracted apartment ischosen torear downand relocationrequired byCity Constructionneeds.9.2.2因地震、火灾等不可抗力致使房屋毁损、灭失或造成其他损失的。 The contracted apartment isdamaged bythe naturalreasons,such asearthquake,fire etc.9.2.3在本合同非固定期限内(详见2.1条),双方如需解约均需提前30天通知对方In thenon-fixed termcontract(see2.1),both Party AandParty Bare requiredfor cancellation30days inadvance noticetotheother.9.3甲方有下列情形之一的,乙方有权单方面解除合同The Party Bcaninvalid thecontract with the reasonsas following:9.3.1未按约定时间交付该房屋达日的。 Party A doesnt handoverthecontractedapartment intime until_days late.9.3.2交付的房屋不符合合同约定严重影响乙方使用的。 The contractedapartment isnot matchedwith thecontract andParty B couldnt livewith it.9.3.3不承担约定的维修义务致使乙方无法正常使用该房屋的。 Party Adoesnt fulfill the requiredrepair obligationandParty Bcouldnt usethecontractedapartment properly.9.3.4交付的房屋危及乙方安全。 The contractedapartmentisdangerous for Party B.9.4乙方有下列情形之一的,甲方有权单方解除合同,收回该房屋Party Ahas theright to invalidthecontract andtake back theapartmentif:9.4.1不支付或者不按照约定支付租金达日的和/或欠缴各项费用达人民币元的。 Party B doesnt payrent ordoesnt payintimeuntil_days later,or PartyB ownsthe requiredfees morethan_RMB.9.4.2擅自改变该房屋用途的和/或擅自拆改变动或损坏房屋主体结构的和/或擅自将该房屋转租给第三人的。 PartyBchanges theusage orbreaks structureof thecontractedapartmentor re-rents theapartment withoutParty As permission.9.4.3利用该房屋从事违法活动的。 PartyBuses thecontractedapartmentto doillegal activities. 十、违约责任:Responsibility ofbreaking thecontract:10.1甲方有本合同第九条第9.3款约定的情形之一的,应按月租金的100%向乙方支付违约金。 Party Awill pay_100_%oftherent toPartyBif hebreaks one ofthe rules mentionedin number9.3in thecontract.10.2租赁期内,甲方需提前收回该房屋的,应提前30日通知乙方,将已收取的租金余额退还乙方并按月租金的100%支付违约金。 During theleaseperiod,if PartyA wantstotakebackthecontractedapartment inadvance,he shouldinformPartyB_30_days inadvance andgive backthe restoftherent PartyBhas paid andalso give100_%oftherent toPartyBas pensation.10.3乙方有本合同第九条第9.4款约定的情形之一的,应按月租金的100%向甲方支付违约金。 If PartyB breaksoneoftherulesmentioned bynumber9.4inthecontract,he should pay_100_%oftherent as pensation.10.4租赁期内,乙方需要提前退租的,应提前30日通知甲方,并按月租金的100%支付违约金。 甲方退还剩余租金及押金During theleaseperiod,ifPartyB needsto returnthecontractedapartmentinadvance,then PartyBshouldinformPartyA_30_days inadvance andpay_100_%oftherenttoPartyAas pensation,PartyAwill refundPartyBthe restoftherent whichPartyBhaspaidas advancepayment.10.5甲方未按约定时间交付该房屋或则乙方不按约定支付租金但未达到解除合同条件的,以及乙方未按约定时间返还房屋的,应按甲方未按约定时间交付该房屋或则乙方不按约定支付租金但未达到解除合同条件的,以及乙方未按约定时间返还房屋的,应按标准支付违约金。 If PartyAdoesnt handovertheapartment asdue time,or PartyBdoesnt paytherentontime(not reachingtheconditionto invalidthecontract),either partyshouldpayaspensation. 十一、经纪服务费用Intermediary fees:11.1甲方应在本合同签订时向丙方支付居间服务费人民币?元(大写:)PartyAwill pay?RMB asmission tothe intermediarywhiling signing thecontract.11.2乙方应在本合同签订时向丙方支付居间服务费人民币?元(大写:)PartyBwill pay_?RMB asmission tothe intermediarywhile signing thecontract.11.3本合同签订后,如果甲方和/或乙方原因导致本合同不能履行或提前解除的,丙方已收取的居间服务费不予退还。 If thecontract isnot appliedor invalidedbecause ofPartyAorPartyB aftersigningthecontract,the intermediarywill notgive backthe mission.11.4由于丙方已经为甲乙双方提供居间服务促成合同签订并尽到自己如实告知的义务,故无论基于何种原因甲乙双方不能依本合同之条款完成本次租赁交易,导致丙方未能收取居间服务费的,则丙方有权要求违约一方依据月租金的100%支付违约金,以弥补丙方居间服务费的损失。 As the intermediary hasfulfilltheobligation ofagency servicehonestly,no matterwhat happenedto causethecontracttoinvalidbecauseofPartyAorPartyB andthe intermediaryfailed toget themission,the intermediaryhas theright tothe onewho breaksthecontractfor100%oftherent aspensation tomake upthe loss.11.5在房屋租赁期间,丙方应积极提供相应的后续服务如甲乙双方需要帮助,以及如出现房屋租赁及相关事务纠纷,丙方应积极配合,协助予以解决。 During theleasing period,Party Cshall activelyprovide after-sales serviceswhen PartyAandPartyBneeds help,for leasingrelated disputesand problems,Party Cshall cooperateactively andfacilitate toresolve. 十二、争议处理:Dealing withthe problems:本合同在履行中如发生争议,各方应协商解决。 协商不能解决的,各方同意按以下第2种方式解决纠纷。 If thereis anyproblem whilefulfilling theobligation inthecontract,both Partiesshould tryto reachanagreement.If theycouldnt reachanagreement,they agreeto dealwiththeproblem by_the second1.提交成都仲裁委员会仲裁Arbitration 2、依法向房屋所在地的人民法院提起诉讼。 Court Lawsuit 十三、本合同经甲、乙、丙三方签字即生效,本合同壹式叁份,甲、乙、丙三方各执壹份,具有同等法律效力。 本合同生效后,双方对合同内容的变更或补充应采取书面形式,作为本合同的附件。 附件与本合同具有同等的法律效力。
