According to the requirements of the Fire Services Act, so that everyone has of keeping fire control safety, protecting fire control facilities, fire prevention, reports of fire广东省民办非学历教育机构退费管理办法第一章 总 则 第一条 为进一步规范民办非学历教育机构（以下简称教育机构）的办学秩序，加强对教育机构清退学生费用的管理，维护教育机构及学生的合法利益，根据中华人民共和国民办教育促进法、中华人民共和国价格法、中华人民共和国消费者权益保护法及民办教育管理的有关法规,结合我省民办教育实际,制定本办法。 第二条 民办教育机构的退费,是指教育机构在办学过程中因各种原因退还学生费用的活动。 第三条 经教育行政部门批准成立并领取办学许可证的民办教育机构招收的高等教育学历文凭考试、自学考试和非学历培训的学生退费活动，适用本办法。 第四条 各级教育部门要加强对教育机构退费的管理和监督，督促教育机构严格执行有关退费管理的政策规定。 第二章 退费办法和手续 第五条 属下列情形之一的，教育机构必须退回全部费用及其利息并承担其他合理费用： （一）筹办期招生的； （二）处以停止招生的行政处罚期间招生的； （三）超出办学许可证规定范围招生的； （四）超出收费许可证规定范围、标准收费的； （五）教育机构刊登、散发虚假广告（简章）的； （六）教育机构未按约定向学生提供教育服务的； （七）因学校要求学生转学或转专业而造成学生退学的； （八）由于教育机构违背诺言,教学管理混乱,致使教学质量不保,或使学生不能正常学习的； （九）教育机构跨学年收费的； （十）因教育机构其他违反国家有关教育法律、法规的行为或校方造成的其他原因。 第六条 学生登记注册后有正当理由要求退学，属下列情形之一的，教育机构必须按规定退费： （一）中途死亡的；因意外伤害或严重疾病，经身体健康检查确实不适宜继续学习的（需持县级以上的医疗单位的证明）； （二）学生应征服兵役的（出具武装部门的应征入伍通知）； （三）因不可抗拒力造成学生家庭特殊困难（凭家长单位或街道居委会出证明），无法继续学习的； （四）举家搬迁或调往外地工作的（凭家长单位或街道居委会出证明）； （五）学生经教育机构及有关部门依照规定批准转学的； （六）被列入国家计划的高等院校录取（出具国家承认学历的院校的正式录取通知）； （七）学生出国留学或出国定居的（出具国家承认学历的院校的正式录取通知或签证）。 属以上情形，按学期收费或学制不足半年的教育机构退费办法如下： （一）开课前申请退费的，退回收取的全部学费、住宿费。 （二）完成1/5学时及以下的, 核退70%学费、住宿费；完成1/5-2/5（含2/5学时）学时的,核退60%学费、住宿费；完成2/53/5（含3/5学时）学时退学的,核退40%的学费、住宿费；完成3/5以上学时退学的,不退学费、住宿费。 第七条 学生因其他原因退学，如按学期收费或学制不足半年的，开课前申请退费的，退回收取的80%学费、住宿费；完成1/3学时及以下的,核退50%学费、住宿费；完成1/3以上1/2学时退学的,核退30%的学费、住宿费；完成1/2以上学时退学的,不退学费、住宿费。 第八条 按学年收费的,第一学期按第六条或第七条标准退费后，第二学期的学费、住宿费等应全部退还学生。学生第二学期退学的，第二学期退费办法按上述标准处理。 第九条 学生因故休学的，休学期间，教育机构不得收取学费和住宿费。已收取的，要按实际休学时间折算后退还学生，或转入学生重新入学的学期或学年。 第十条 属下列情形之一者，学费一般不予退还。 （一）学生被学校开除学籍、勒令退学、触犯刑律不能继续在校学习者。 （二）学生私自离校时间达一个月及以上者。 第十一条 学生报名后,因各种原因不来登记注册的,不退报名费。 第十二条 代收费按实际开支扣减，退回余额。书籍已订购但还未发放的,原则上要退费；若不退费,应在开学两周内将书籍发放给学生。 第十三条 不得以预留学位费、订金等名义扣减应退费用。 第十四条 学生退费时间从学生提出申请之日起计算。开课时间从军训或正式上课之日起计算。教育机构在开课前对学生的课前补课不得作为正式开课时间。 第十五条 学生要求退费,应履行以下手续: （一）由学生本人或代理人向教育机构提出书面申请, 阐明理由，并出具有关材料和凭证。 （二）教育机构根据有关规定认为材料不全需要补充的，必须在收到申请之日起2个工作日内向申请人提出。 （三）教育机构受理退费申请必须给申请者回执，注明受理日期。必须在收到申请之日起5个工作日内作出是否退费的决定。 （四）教育机构认为不予退费的应向申请人作出书面答复。 （五）教育机构认为可给予退费的，应在2个工作日内区别不同情况核定退费金额，加盖印章后退费给学生；学生或代理人签字后有效。由代理人领取退费的,其代理人应有合法凭证。 第三章 违规处理办法 第十六条 教育机构应退还学生部分或全部费用而拒不退费的、退费数额未达规定或借故拖延退费的、拒不受理学生退学申请的，由办学审批机关责令限期退还；仍不退还的由审批机关给予暂缓年检或年检不合格的处理；违反国家法律、法规的按照有关法律、法规处理。 第四章 附 则 第十七条 学生对教育机构的退费决定不服的可向教育机构申请复查，教育机构应在收到申请之日起10个工作日内向申请人作出书面复查决定。 第十八条 学生对教育机构的退费决定不服的，可以通过下列途径申请救济： （一）向教育机构的业务主管部门或审批机关申诉； （二）请求消费者协会调解； （三）向人民法院提起诉讼。 第十九条 教育机构对行政处罚不服的,可依据有关法律、法规提请复议或行政诉讼。 第二十条 本办法由省教育厅负责解释。 第二十一条 本办法自公布之日起执行，原省教育行政部门制定的有关教育机构退费规定与本办法不符的，以本办法为准。 广东省教育厅 二三年八月二十二日编制本施工方案时，分析了本工程的工程特点，地质条件和设计要求，结合我公司其它工地施工经验及教训，本着创一流的质量Electricity lines, equipment inspections, found hidden in time for rectification, maintenance, and security. 9, do not use an open flame in the classroom, prohibit burning stove, lit candles, mosquito repellent, no smoking, and banning messy wiring.
