Difference is that the robot begand建 设 工 程 施 工 合 同(GF19990201)中华人民共和国建设部制定国家工商行政管理局制定二0一二年五月建筑工程施工协议发包方:云南天高镍业有限公司承包方:云南中润建筑工程集团有限公司依照中华人民共和国合同法、中华人民共和国建筑法及其他有关法律、行政法规,遵循平等、自愿、公平和诚实信用的原则,双方就本建设工程施工事项协商一致,订本合同。一、工程概况工程名称:云南天高全厂公辅项目运动场工程工程地点:云南省曲靖市师宗县大同工业区工程范围:运动场土建、钢构、装饰、给排水及照明安装工程。工作内容:施工图纸范围内的土建、钢构、装饰、给排水及安装工程,具体详见工程量清单(项目名称及特征)。二、承包方式:包工、包料三、合同工期工程自:2012年5月20日开工,2012年8月28日竣工,工期为100天。四、工程质量工程质量标准:合格。五、合同价款1.本工程的合同包干价为:198万元(壹佰玖拾捌万元整)。包括的工程内容的具体工程量、综合单价及工程做法详见工程量清单。六、付款方式1、 工程款(进度款)支付:承包方每月20日提交当月已完工程量报表,发包方代表对承包方提供的报表于5日内审核和委托第三方审计后根据审计结果确定,次月10日前拨付当月已完成工程量80的工程进度款。工程竣工验收合格并经结算审计后支付至全部工程款的95%,同时承包方开具全额建安税发票交于发包方;工程质量保证金为工程总造价的5%,保修期满二年后若无质量问题一个月内一次性支付。2、付款方式:承兑50%,电汇50%3、对非承包方原因增加的工程量(须有发包方认可的书面手续),所增加的费用,均由发包方负责。发包方应以书面方式明确新增工作量及其相关费用,并按上述付款方式和比例支付工程进度款,在工程竣工验收后并办理结算。七、工程变更发包方对原设计进行变更,承包方应积极配合,发包方应向承包方发出书面变更通知书,无书面通知承包方有权拒绝;承包方应按通知进行变更,不得擅自变更设计。因设计变更、地质情况同地勘资料严重不符、发包方责任、应发包方要求增减工作内容等,以设计变更、现场签证等方式双方确认工程量,清单缺项主要材料价格按实询价。计算原则:按竣工结算相关条款执行。八、工程保修1、承包方须按现行房屋建筑工程质量保修办法条款内容对承建工程质量进行保修,工程在保修期内价款的5%作为质量保证金,工程保修期为两年,保修期满两年后,并无质量问题时,退还保证金。2、质量保修期间,若有质量问题,发包方书面通知承包方,承包方在接到发包方通知7日内派人进行维修工作,承包方在得到通知后对质量问题不做处理时,发包方有权自行处理,所发生的费用从质保金中扣除。九、双方职责1、发包方:监督工程质量、检查落实工程进度完成情况,及时拨付工程款和办理工程结算,组织协调工程事宜,配合承包方正常施工。2、承包方:严格按设计文件资料、国家现行施工验收规范标准组织施工,认真执行国家安全规范标准,采取有利措施进行安全生产、文明施工,在施工过程中所发生的一切伤亡事故和由于承包方管理不善造成的其他损失,均由承包方负责并承担一切赔偿责任,承包方不得因此影响工程进度。十、工程竣工验收及结算1、承包方完成合同所规定的内容后7日之内,向发包方提交竣工验收报告和竣工资料,发包方在7天内组织验收,并提交验收意见,直至竣工验收合格后15日内,承包方向发包方提供完整的技术资料和竣工图2套。2、工程竣工结算:本工程结算采用合同包干价加变更增减价方式。(1)工程量分项增减在5%以内不做调整,增减超出5%时超过部分再做调整,工程量增减执行清单综合单价(清单综合单价包括人、材、机、管理费、措施费、利润、税金等所有费用)。(2)工程变更:清单中有单价的执行清单综合单价;清单中有类似单价的执行类似综合单价;清单中缺项的执行云南2003定额税前造价下浮9%确定的综合单价。十一、违约责任1、本合同生效后双方要认真履行,若单方面解约或出现质量问题,违约方承担合同总价款的10%作为违约金。2、因承包方原因导致工期拖延,每延期一天承包方应按2000元/天赔偿给发包方。十二、争议解决如本合同履行过程中发生争议,双方应本着互谅互让的原则协商解决问题,协商不成,双方均有权向协议签订地人民法院提起诉讼。十三、其他约定1、施工水电费安表计量,由承包方承担。未安表计量的按工程造价的0.8%计取,发包方在承包方的工程款中扣除。2、有关协议及双方认可的设计施工图、工程变更技术文件及书面经济签证单等均为本合同组成部分,与本合同具有同等法律效力。3、承包人不得将所承担的工程进行转包,一旦发现工程转包,发包人有权终止合同并拒付工程进度款;现场材料(除施工单位机具)一律扣押,剩余的工程款不予支付,用以弥补新进场施工单位增加费用。(未经发包人同意的分包视为转包)4、承包人每月工程进度款报送金额超过发包人派驻现场代表审定工程进度款金额的10%以内(含10%)不罚不奖;超出10%20%的按照审减额的5%处罚;超出20%的按照审减额的10%处罚。处罚款由发包人在承包人最终工程竣工结算数额中予以扣除。5、工程竣工结算由发包人聘请的咨询公司审计,上报的“竣工结算金额”与“双方最终认定的结算金额”的审核差额不超出“双方最终认定结算金额”的5%;若审核差额超过“双方最终认定结算金额”的5%,由此产生的“双方最终认定结算金额”的5%以外的审增减结算金额的审计费用【“基本费和审核费”】由承包人承担。并对超报5%7%(不包括5%),按超报金额的50%处罚;超报7%以上的(不包括7%),超多少处罚多少。6、合同签订地:云南省曲靖市师宗县大同工业区。7、本合同一式六份,发包方四份,承包方执两份。双方签字盖章后生效。发包方:(公章) 承包方:(公章) 法定代表人: 法定代表人: 委托代理人: 委托代理人: 签章日期: 签章日期: manipulator control mode and programmable controllers introduction 2.1 Select discussion with manipulator control 2.1.1 classification of control relays and discrete electronic circuit can control old industrial equipment, but also more common.
