IWAY-MUST的执行及监管方案IWAY-MUSTExecutionandSupervisionProgram,江苏江都建设集团有限公司JiangsuJiangduConstructionGroupCo.,Ltd.,二一四年三月十八日18th,March,2014,目录Contents,童工Childlabour强迫性与束缚性用工Forcedandbondedlabour商业道德Businessethics严重环境污染Severeenvironmentpollution严重的健康安全隐患Severehealthorsafetyhazards工作时间Workinghours工资Wages工伤意外保险Workers,accidentinsurance,一、童工Childlabour,我司用工管理制度要求,公司所雇佣员工,无论是管理人员和工人必须是年满18岁的合法公民,其中男性不超过60岁、女性不超过50岁。根据中华人民共和国劳动法,我司坚决杜绝雇佣童工、未成年人及大龄工人,并要求所有我司的分包商及材料设备供应商都必须禁止雇佣童工、未成年人及大龄工人参与项目实施。在签订劳动合同前,被雇佣人须出示身份证原件,证明真实年龄,并保留身份证原件的复印件作为劳动合同附件。项目建立用工人员台帐,打卡考勤。Ouremploymentmanagementsystemrequiresthat,theemployeesworkingfortheCompany,includingmanagementpersonnelandworkers,mustbelegalcitizensagedatandabove18.ofwhichnotmorethan60-year-oldmen,womenlessthan50yearsold.InaccordancewiththeLaborLawofthePeoplesRepublicofChina,wecompletelyeradicatetheemploymentofchildlabour、juvenilesandolderworkers,andrequireoursubcontractorsandmaterials/equipmentsupplierstosurelyprohibittheemploymentofchildlabour、juvenilesandolderworkersforprojectimplementation.Beforesigninglaborcontract,werequireemployeestoshowtheoriginaloftheiridentitycardtoprovetheirrealage,andretainthehardcopyoftheoriginaloftheiridentitycardasanattachmenttolaborcontract.Fortheproject,wehaveestablishedmachineaccountoflaborersused,andexecutedworkattendancecheckingbymeansofcardpunching.,项目现场任命一位负责人力资源管理的经理,确保有足够的政策及程序以监察工地工人的年龄,包括临时用工。Weappointamanageratprojectsitetotakechargeofhumanresourcesmanagement,inordertoensuresufficientpoliciesandproceduresforsupervisingtheageofeachworkeratworksite,includingcasualworkers.制订一套补救程序以应对发现未满十八岁的工人在工地工作。包括:即时把该名年轻人撤离工地;在指定的时间段内把儿童送往其最初与父母或监护人居住的地方,并负责当中所涉及的所有交通和住宿费用。Wehaveformulatedasetofremedyprocedurestocopewiththatanyworkeragedatlessthan18worksatworksite,includingmakingunder-agedpeopleleavetheworksite;sendingchildrentotheplacewheretheylivetogetherwiththeirchildrenorguardiansinitiallyinaspecifiedperiodoftime,andassumingallthecarfareandaccommodationfeeinvolvedtherein.在所有工人工作前核实其年龄。如发现出生证明或核实年龄的文件不齐全或不可靠,必须另觅方法以核实工人的年龄。Wechecktheageofallworkersbeforetheystarttoworkforus.Incaseanyworkersbirthcertificateorage-provingdocumentisdiscoveredincompleteornon-reliable,wewillsurelylookforothermeasurestocheckandverifytheworkersage.保存与聘任登记及核实有关的文档记录。Weretainthedocumentationrelatedtoemploymentregistrationandverification.,二、强迫性与束缚性用工Forcedandbondedlabour,我司与所有用工在开始工作前都会签订劳动合同或劳务合在签订劳动合同(劳务合同)前会与工人协商关于用工的各项条款,并保证这些条款是公开透明的,公司在提供给每名员工的安全手册中也列出了相关的法律法规及员工应享有的权力。合同内容包括雇主姓名、工人姓名、职位、薪水、工作时间、期限等所有国家法律法规要求在劳动合同中必须明确的事项。Beforestartofwork,wesignlaborcontractorlaborservicecontractwithalllaborersused;andbeforesigninglaborcontract(laborservicecontract),wenegotiatewithworkersonvariousclausesaboutemployment,andensurethattheseclausesareopenandtransparent.TheCompanylistsrelatedlawsandrules,andpowerstobeenjoyedbyworkersinthesecuritymanualprovidedbyeachemployee.Thecontentsofcontractincludesthemattersthatmustbemadeclearinlaborcontractaccordingtonationallawsandrules,liketheemployersname,workersname,post,wage,workinghours,andperiod,etc.公司财务确保在每月的10号前将用工合同中约定的报酬全额发放到工人手中,在公司资金安排中,员工薪酬的资金安排在第一位。TheCompanysfinancialdepartmentensurestomakefull-amountpaymentofremunerationregulatedinemploymentcontracttoworkersonthe10thofeachmonth.Intermsofcapitalarrangement,theCompanyarrangesthecapitalforemployeesremunerationatthefirstplace.,若有员工按照约定的告知时间解除合同,根据劳动法,公司不会以任何借口也无任何权力扣留部分薪酬作为条件,且薪酬已在平时全额发放。我公司每个项目建立工资发放台帐,根据考勤、约定工资水平每月发放工资,工资单中须每个员工签字、留档备查。IncaseanyemployeeterminatescontractwiththeCompanyaccordingtothestipulatednotificationtime,inaccordancewithLaborLaw,theCompanywont,anddonthaveanyrightto,retainpartialremunerationasconditionbyanyexcuse,andwhatsmore,theremunerationhasbeenfullypaidatordinarytimes.TheCompanyestablishesmachineaccountofwagepaymentforeachproject,payssalarymonthlyaccordingtoworkattendancecheckingandstipulatedwagestandard,requireseachemployeetosignonpayslipandfilethepayslipforfuturereference.每个工作班次结束后,工人有完全的自由离开施工现场的,同时公司根据治安管理法的规定,加强对驻外员工的综合管理。Aftercompletionofeachworkshift,workershavecompletefreedomtoleaveconstructionsite,andmeanwhile,accordingtotheregulationsofSecurityLaw,theCompanyhasstrengthenedthecomprehensivemanagementonoutpostedemployees.公司有自己的劳务公司和较大额的在建工程量,因此有充足的劳动力资源可供调派,一般情况下不需要通过中介招聘员工;如通过中介招聘的用工,会根据约定及时给予中介佣金。TheCompanyhasitsownlaborservicecompanyandabigamountofconstructioninprogress,soithassufficientlaborresourcesfordispatching,anddoesnotneedtorecruitemployeesthroughintermediaryagencygenerally;incaseofrecruitinglaborersthroughintermediaryagency,theCompanywillpayacommissiontotheintermediaryagencyintimeaccordingtostipulations.,项目现场任命一位负责人力资源管理的经理,其应遵守相关政策与程序,并确保所有在场工人(包括临时工)是自愿到场并获得全额工资。Amanagerisappointedtotakechargeofhumanresourcesmanagementatprojectsite.Themanagerisrequiredtoobserverelatedpoliciesandprocedures,andtoensurethatallon-siteworkers(includingcasualworkers)workoutoffreewillandobtainfull-amountsalary.工人在预先给出合理的预先通知后,均可终止受雇关系,并且能够及时地得到之前劳动所得的全额收入。AnyworkermayterminatetheemploymentrelationshipwiththeCompanyaftersendingareasonablenotificationinadvance,andmayobtainintimethefull-amountincomeforthelaborservicesprovidedpreviously.工人始终保有出入工地及工地宿舍的自由,并且其出入不受保安的限制。Workersalwayshavethefreedomtocomeintoandgooutofworksiteanddormitoryatworksite,withoutbeingrestrictedbysecuritypersonnel.工人无需为确保受雇而支付“保证金”。Workersneedntpay“cautionmoney”forbeingemployedbyus.工人无需为提供的住宿提供“保证金”。Workersneedntpay“cautionmoney”forthedormitoryprovided.工人无需就为安全开展工作所需的工具、培训以及个人PPE支付保证金。Workersneedntpay“cautionmoney”forpersonalPPE,andthetoolsandtrainingprovidedfordevelopingworksafely.,三、商业道德Businessethics,我司作为集团公司,其市场经营部、审计稽查部和法律事务部联合制订有详细的反腐败政策并一直实施中。每年公司都会安排所有员工学习反腐败政策。严格禁止公司内部及外部的贿赂及腐败行为。确保所有的商务行为都是公开透明的。Asagroupcorporation,MarketOperatorDepartment,AuditDepartmentandLegalAffairDepartmenthavejointlydevelopedandkeptimplementingdetailedanti-corruptionpolicy.TheCompanyarrangesallemployeestolearnanti-corruptionpolicyannually,prohibitsbriberyandmalversationinsideandoutsidetheCompanystrictly,andensuresthatallcommercialbehaviorsareopenandtransparent.,四、严重环境污染Severeenvironmentpollution,项目施工过程中,根据公司环境管理体系(GB/T28001-2003idtISO14001:2003)程序文件,制订有关环境污染行为(如现场粉尘控制、噪音控制、废水控制、固体废弃物控制、油品、化学品控制等)的辨识、预防、应急处理预案都有明确规定和详细描述。TheCompanyhasclearregulationsanddetaileddescriptionabouttheidentificationandpreventionof,andemergencytreatmentpreplanforrelatedenvironmentalpollutingbehaviors(suchasonsitedustcontrol,noisecontrol,wastewatercontrol,solidwastescontrol,oilproductsandchemicalscontrol,etc.)initsproceduredocumentofenvironmentmanagementsystem(GB/T28001-2003idtISO14001:2003)forprojectconstruction.1、化学品的管理:所有进入现场的化学品都必须在容器的显著位置贴有中文的MSDS。现场设有专门的化学品仓库,用于单独存放化学品。并且要求所有化学品容器不得直接与土壤接触,必须有坚硬的表面不易吸收化学品的材料间隔。工人在使用化学品前,都必须在上岗前接受相关培训,确保具备响应的能力后方可以使用化学品。Chemicalsmanagement:AllchemicalsenteringthesitemustinacontainerbearingtheMSDSinChineseatprominentplace.Withdedicatedchemicalwarehouse,usedtoseparatechemicals.Andrequireallchemicalcontainerswithnodirectcontactwiththesoil,theremustbeaintervalwithhardsurfacematerialswhicharedifficulttoabsorbchemicals.Beforeworkersusingchemicals,mustundergotraining,ensuretheyhavetheabilitytorespond.,2、废弃物的处理:我司质量环境职业健康安全综合管理体系程序文件对废弃物的处理及应急预案有详细描述并要求集团下属所有分公司和项目必须严格执行。文件首先要求各项目建立一份废弃物清单,清单中须对无害和有害废弃物做分类登记并不断更新。项目实施过程中对废弃物的处理、储存、运输、回收和处置必须有记录,记录必须按照程序文件的表格要求记录详细。无害和有害、危险和非危险废弃物必须分开储存。对废弃物的最终处置必须交给施工现场当地有资质的公司进行处置。施工现场不得填埋和焚烧废弃物。Wastetreatment:OurQualityEnvironmentOccupationalHealthandSafetyManagementSystemprogramfilesforintegratedwastetreatmentandemergencyplansandrequestdetaileddescriptionofallbranchesandgroupsaffiliatedprojectsmustbestrictlyenforced.Firstofall,inthefilerequiredtobuildawastelist,thelistofharmfulandhazardouswastearerequiredtoclassifyregisteredandconstantlyupdated.Projectimplementationprocessforwastetreatment,storage,transportation,recyclinganddisposalmustberecorded,recordsmustbeinaccordancewiththerequirementsoftheprogramfiletablerecordindetail.Harmlessandharmful,hazardousandnon-hazardouswastemustbestoredseparately.Thefinaldisposalofwastemustbehandedovertolocalqualifiedcompaniesinconstructionsite.Mustnotburyandincineratewasteonsite.,危险品库房Dangerousgoodswarehouse,消防用具Fireappliances,电焊机配置Welderconfiguration,氧气瓶移动车Oxygenbottlesmovingcar,乙炔瓶移动车Acetylenebottlesmovingcar,五、严重的健康安全隐患Severehealthorsafetyhazards,我司知道安全作为项目实施的首要准则,在以往项目实施过程中都将安全放在项目施工的第一要素。公司制订有详细的职业健康安全程序文件和详细的不断更新HSE手册,建立定期的安全培训制度。Weknowthatsafetyisthefirstimportantcriterionofprojectconstruction,andhavetakensafetyasthefirstessentialfactorinpreviousprojectconstruction.TheCompanyhasmadedetailedoccupationalhealthandsafetyproceduredocumentanddetailedandconstantlyupdatedHSEmanual,andestablishedperiodicsafetytrainingsystem.所有人员在进入现场前都必须进行安全培训,在考试合格后方可进入施工现场作业,并给每名员工发放安全操作手册。所有进入现场的人员都必须佩戴PPE,PPE的标准必须达到业主和管理公司的要求。通过佩戴PPE减少对人员的健康损失和减轻意外发生的伤害。涉及特殊工种的作业人员在入场后作业前必须接受体检,确保作业人员的体质能完全适应特种作业的要求。Allpersonnelmustacceptandpasssafetytrainingbeforeaccessingworksite,andeveryemployeewillobtainasafetyoperationmanual.Also,allpersonnelaccessingworksitemustwearPPE,whichmustmeettheClientandManagementCompanysrequirements.WeaimtorelievepersonnelshealthlossandaccidentalinjurybyrequiringthemtowearPPE.Relatestospecialtypesofworkersmustundergoaphysicalexaminationonadmissionbeforeoperation,ensurethattheworkersoftheConstitutioncancompletelymeettherequirementsofspecialoperations.,对所开展的工作,在实施前必须先进行危险源辨识,并针对每一项具体工作和危险源制订专项的安全施工方案(如密闭空间作业、高空作业、吊装作业、移动平台或起重机等相关作业)。通过专项安全方案的实施消除隐患,将风险源得到有效的控制,确保所有人员的健康安全。Itsnecessarytoidentifythesourceofdangersbeforeimplementationofeverywork,andtomakespecialsafetyconstructionschemeaimingateachconcreteworkanddangersource(suchasworkinconfinedspace,workhighabovetheground,hoistingwork,movingplatformorhoist,etc.).Throughimplementationofspecialsafetyscheme,weeliminatehiddentroubles,controlrisksourceseffectively,andensurethesafetyandhealthofallpersonnel.所有进入现场的机械设备,都必须有年检合格证书,配备必要的安全装置。特种设备必须有特种设备操作许可。所有设备的操作人员必须持有操作许可证,并定期培训。确保所有机械和其他生产设备的安全使用,以防止受伤。Allmechanicalequipmentaccessingworksitemusthavecertificateofannualinspectionandbeequippedwithnecessarysafetydevice.LicenseforOperatingSpecialEquipmentisrequiredforoperationofspecialequipment.Allequipmentoperatorsmustholdthelicenseforoperationandacceptperiodictraining,inordertoensurethesafetyuseofallmachineryandotherproductionequipment,andtopreventinjury.,在工地现场设有休息场所和吸烟点,免费向现场人员提供足量清洁的饮用水。现场设有消防点,配备灭火器、水桶、消防斧及沙箱等灭火器材。现场设有医务室,设有急救箱、担架及常用药品。武汉夏季炎热,针对夏季施工、项目部必须配备足够数量的防暑降温用品,合理调节工作时间。施工现场坚决杜绝饮酒。Restareaandsmokingpointaresetupatworksite,andthere,sufficientcleanpotablewaterisprovidedforonsitepersonnelforfree.Theworksitewiththefirepoint,equippedwithfireextinguishers,buckets,fireaxandsandboxesandotherfire-fightingequipment.Cliniconsite,afirstaidkit,stretcherandcommonlyuseddrugs.Wuhanhotsummerforsummerconstruction,theprojectmustbeequippedwithasufficientnumberofsummercoolingsupplies,reasonableworkinghoursregulation.Atworksite,drinkingisabsolutelynotallowed.我司在投标报价时已经考虑了在施工现场外免费提供给现场管理人员及工人的住宿场所。男女分开住宿,每个房间约为2530平方米,每间安排6人住宿,每间配有空调,并给每个工人在房间里配备一个可以上锁的储物柜。我司已跟总包单位龙元建设初步谈妥食宿安排,在工人住宿区建有男女厕所和沐浴间,并安排专人打扫,确保健康卫生。Ourcompanyhasalreadytakenintoaccountintender,wewillofferfreeaccommodationoutsidetheconstructionsitetothesitemanagementandworkers.Separateaccommodationformenandwomen,eachroomisapproximately2530squaremeters,andarrange6peopleineachroom,eachequippedwithairconditioning,andprovidealockedlockertoeachworkerineachroom.OuraccommodationarrangementshavebeennegotiatedwithgeneralcontractorLongYuanConstruction,workersresidentialareabuiltwithtoiletandbathingroomsformenandwomen,andarrangethecleaningtoensurehealth.,采用新工艺、新技术、新材料或者使用新设备前,必须采取有效的安全防护措施,并对工人进行必要的安全操作教育和培训。Beforeadoptingnewprocesses,newtechniquesandnewmaterialsorusingnewequipment,wecompulsorilyrequiretheadoptionofeffectivesafetyprotectionmeasures,andprovidenecessarysafetyoperationeducationandtrainingforworkers.负责安全操作监督工作的管理人员必须具备所从亊的生产经营活动相应的安全操作知识和管控能力。Managementpersonneltakingchargeofsupervisingthesafetyinoperationmusthavecorrespondingknowledgeonandtheabilitytocontrolthesafetyofproductionandoperationactivities.,六、工作时间Workinghours,我司在杭州宜家项目管理中关于劳动时间的安排为:根据劳动法及宜家的要求,现调整为每周工作六天,确保每周有一天连续24小时休息,每天工作八小时,每月累计加班时间不超过36小时。加班、加点时间的薪酬,根据国定劳动法的规定予以支付加班、加点工资。WeplannedtoarrangeworkinghoursinIKEAProjectmanagementschemeasfollows,AccordingtoLaborLawandIKEAsrequirements,theworkinghoursisnowadjustedtothat,workersworkforsixdaysweeklyandeighthoursdaily,anddoovertimeworkfornomorethan36haccumulativelyeverymonth,andsurelyhavearestof24hcontinuouslyonceeveryweek.Forovertimework,theCompanypaysover-timewageaccordingtotheregulationsofnationallaborlaw.根据本工程的实际要求,结合总包节点进度计划,我司编排详细的机电安装进度计划,科学合理安排工人工厂化、流水线作业方式,最大限度的减少浪费工时现象,有效的控制劳动力成本支出。Accordingtotheactualrequirementsoftheproject,combinedwiththegeneralcontractornodeschedule,wedevelopthedetailedmechanicalandelectricalinstallationschedule,scientificandreasonablearrangementsforfactoryworkersandassemblylineoperations,tominimizewasteofman-hours,andeffectivelycontrollaborcosts.,劳动合同期限三个月以上十二个月以下的,试用期不得超过一个月:劳动合同期限一年以上不满三年的,试用期不得超过二个月;三年以上固定期限和无固定期限的劳动合间试用期不得超过六个月:对于指定完成某项工作或劳动合同期限在三个月以下的劳动合同,不可以约定试用期。Theprobationperiodisnotmorethanonemonthifthelaborcontractperiodicmorethanthreemonthsandlessthantwelvemonths;theprobationperiodisnotmorethantwomonthsifthelaborcontractperiodismorethanoneyearandlessthanthreeyears;theprobationperiodisnotmorethansixmonthsifthelaborcontracthasafixedperiodofmorethanthreeyearsordoesnothaveafixedperiod;theprobationperiodmaynotbestipulatedisthelaborcontracttakesthecompletionofsomeworkasperiodorhasaperiodoflessthanthreemonths.加班以自愿为原则且不应过多。Overtimeworkshallbearrangedinlinewiththeprincipleoffreewill,andshallnotbetoomuch.在和工人协商后,可出于特殊需求延长工作时间,但延长的工作时间一般每日不得超过一小时;因特殊原因需要进一步延长的,在保障劳动者身体健康的条件下延长的工作时间每日不得超过三小时,无论如何每月总的延长工时不得超过三十六小时。Itsavailabletoextendtheworkinghoursuponspecialdemandafternegotiatingwithworkers,buttheextensionshallgenerallynotexceedonehoureveryday;ifitsnecessarytofurtherextendtheworkinghoursforspecialreasons,theextensionshallnotexceedthreehoursinconditionofguaranteeinglaborersphysicalhealth.Anyway,thetotalextensionshallnotexceedthirty-sixhourseverymonth.,七、工资Wages,我司的报酬水平每年根据国家法律法规及公司工会、职工代表大会通过的决议,每年确保一定比例的递增,我公司现行的工资水平绝对超过法定最低工资。Accordingtonationallawsandrules,andtheresolutionspassedbyourlaborunionandworkerscongress,weensuretheprogressiveincreaseofremunerationatcertaindegreeannually.Ourexistingwagesabsolutelyexceedthelegallowestwages.我司要求不得通过无意传授技术或无意提供正常雇佣关系的学徒安排、滥用固定期限合同、或其他类似的安排来避免承担正常雇佣关系下劳动或社会保障法律法规所要求的对工人的责任。WerequirenotavoidingtheresponsibilitiesforworkersasregulatedinlabororsocialsecuritylawsandrulesundernormalemploymentrelationshipbyarrangingprenticestowhomtheCompanydoesnotintendtoteachtechniquesorprovidenormalemploymentrelationship,abusingthecontractwithfixedperiod,orothersimilararrangements.为工人提供工资、加班费、福利和带薪休假作为报酬.这些报酬需要分别达到或超过法定最低标准和/或行业基准和/或集体协议中的最高标准。Weprovideworkerswithsalary,overtimepay,welfareandpaidleaveasremuneration.Theseremunerationsreachorexceedthelegalminimumcriterionand/orindustrialbenchmarkand/orthehigheststandardincollectiveagreement.向工人提供关于雇佣条件的易懂的书面信息,包括在入职前及以后每次发工资时提供工资信息。,Weprovideworkerswitheasy-to-understandwritteninformationonemploymentconditions,includingprovidingsalaryinformationbeforeworkersentryandeachtimewhensalaryispaidinfuture.在国家法律未授权或未规定的情况下,不得扣减工资。应当符合以下规定:Thesalaryshallnotbedeductedifnotauthorizedorregulatedbynationallaws.Thefollowingregulationsshallbesatisfied:由于工人违反相关的法律法规而被扣减工资的,扣减的额度不得超过当月工资的20%Incaseanyworkerssalaryisdeductedforviolatingrelatedlawsandrules,thelineofdeductionshallnotexceed20%o
