Equipment Lease AgreementLeaser: Sinkiang Branch of the 12th Metallurgical Construction Corporation of China Nonferrous Metal Industry Lessee: Shifeng Construction Equipment Rental Station of Midong District of Urumchi Based on the principles of equality and mutual benefit, having reached unanimity through consultation and negotiation, the leaser and lessee, hereby agree to enter into the following contract to clarify the rights and obligations of both parties according to relevant provisions of Contract Law of Peoples Republic of China.I. Property right The property right of leased equipment related to the contract is owned by the leaser.II. Contract duration The contract will not be terminated until the return of all leased equipment and the payment of rental.III Model and price of dumpers Model of dumpers Monthly rental Quantity/Set 30TRMB15000 yuan30IV. The rental fee is calculated from the next day when the dumpers entered into the site according to actual lease term.V. A sum of money (rental and fee paid for entering and leaving the site) related to the contract is the tax-included price only. VI. Rights and obligations of leaser The dumpers provided by the leaser must be qualified with complete procedures; or loss caused by the reason shall be borne by the leaser.VII. Rights and obligations of the lessee After the entrance of dumpers at the site of leaser, the leaser will be responsible for the dumpers to avoid the burglary and damage of accessories of the dumpers. ix. Responsibilities for breach of the contract 1. The lessee must pay the rental once a month in accordance with method of settlement stipulated in the contract, if the lessee fails to pay the rental, the leaser is entitled to ban the use of the dumpers, but the lessee still need to pay the rental during the prohibition period. The total rental fee shall be settled before the leaving of the equipment, if the lessee delays and fails to pay the rental, he has to pay penalty to the leaser at the rate of 5% of due rental for each day of delay. 2. During the lease term, the lessee is not allowed to transfer or sublet the leased equipment to Party C, and he is prohibited to sell off, mortgage and close down the leased equipment, the leaser has the right to terminate the contract, take back all leased equipment if any, and the lessee will be responsible for corresponding legal liabilities and economic loss caused by himself. X. The articles of the contract come into effect after the signing by both parties.
