7、ntal is more than ten working days overdue, party b will pay 0.5 percent of monthly rental as overdue fine every day, if the rental be paid 15 days overdue, party b will be deemed to have with drawn from the premises and breach the contract. in this situation, party a has the right to take back the
8、premises and take actions against party bs breach.五、 保证金 deposit 为确保房屋及其附属设施之安全与完好,及租赁期内相关费用之如期结算,乙方同意于_年_月_日前支付给甲方保证金人民币 _元整,甲方在收到保证金后予以书面签收。guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term,

10、erest on the day when this contract expires and party b clears the premises and has paid all due rental and other expenses. 因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用,甲方可在保证金中抵扣,不足部分乙方必须在接到甲方付款通知后十日内补足。in case party b breaches this contract, party a has right to deduct the default fine, compensation for damage
11、 or any other expenses from the deposit . in case the deposit is not sufficient to cover such items, party b should pay the insufficiency within ten days after receiving the written notice of payment from party a.六、 甲方义务 obligations of party a 甲方须按时将房屋及附属设施(详见附件)交付乙方使用。party a will provide the premi
12、ses and attached facilities (see the appendix of furniture list for detail) on schedule to party b for using. 房屋设施如因质量原因、自然损耗或灾害而受到损坏,甲方有修缮并承担相关费用的责任。in case the premise and attached facilities are damaged by quality problems, natural damages or disasters, party a will be responsible to repair and p
13、ay the relevant expenses. 甲方应确保出租的房屋享有出租的权利,反之如乙方权益因此遭受损害,甲方应负赔偿责任。party a will guarantee the lease right of the premises. otherwise, party a will be responsible to compensate party bs losses.七、 乙方义务 obligations of party b 乙方应按合同的规定按时支付定金、租金及保证金。party b will pay the rental, the deposit and other exp
14、enses on time. 乙方经甲方同意,可在房屋内添置设备。租赁期满后,乙方将添置的设备搬走,并保证不影响房屋的完好及正常使用。party b may decorate the premises and add new facilities with party as approval. when this contract expires, party b may take away the added facilities which are removable without changing the good conditions of the premises for norm
15、al use. 未经甲方同意,乙方不得将承租的房屋转租或分租,并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损,乙方应承担赔偿责任。party b will not transfer the lease of the premises or sublet it without party as approval and should take good care of the premises. otherwise, party b will be responsible to compensate any damages of the premises and attached faci
16、lities caused by its fault and negligence. 乙方应按本合同规定合法使用该房屋,不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则,如该房屋及附属设施因此受损,乙方应承担全部责任。party b will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. otherwise, party b will be responsibl
17、e for the damages caused by it 乙方应承担租赁期内的水、电、煤气、电讯、收视费、等一切因实际使用而产生的费用,并按单如期缴纳。party b will bear the cost of utilities such as communications, water, electricity, gas, management fee etc. on time during the lease term.八、 合同终止及解除的规定 termination and dissolution of the contract 乙方在租赁期满后如需退租或续租,应提前两个月通知甲
18、方,由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。within two months before the contract expires, party b will notify party a if it intends to extend the leasehold. in this situation, two parties will discuss matters over the extension. 租赁期满后,乙方应在当天将房屋交还甲方;任何滞留物,如未取得甲方谅解,均视为放弃,任凭甲方处置,乙方决无异议。when the lease term expire
19、s, party b will return the premises and attached facilities to party a within days. any belongings left in it without party as previous understanding will be deemed to be abandoned by party b. in this situation, party a has the right to dispose of it and party a will raise no objection. 本合同一经双方签字后立即
20、生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。this contract will be effective after being signed by both parties. any party has no right to terminate this contract without another partys agreement. anything not covered in this contract will be discussed separately by both parties九、 违约及处理 breach of the contract

49、el代 理 人representative日 期date上海市房屋租赁一、本合同适用于本市行政区域范围内的商品房预租以及按市场化原则协商确定租金的房屋租赁,不包括按市政府规定的租金标准出租的公有居住房屋、行政调配方式出租和政府投资建造的公益性的非居住房屋以及在条例施行前按照市政府规定的租金标准出租的私有居住房屋的租赁。二、预租仅限于房地产开发企业投资建造,并已取得预售许可证的商品房,但房地产开发企业已经预售的商品房不得预租。三、本合同条款中的出租或预租为提示性符号,表示该条款适用于出租行为或预租行为。本合同作为房屋租赁合同使用时,只能采用标有出租部分的内容;而作为商品房预租合同使用时,则预租部
50、分的条款和补充条款中的“预租有关事宜”部分的条款。其他未标有符号的条款作为通用性条款,不论预租或出租都适用。四、本合同用于商品房预租的,在该商品房竣工,房地产开发企业办理了房地产初始登记、取得了房地产权征后,预租双方当事人应当签订商品房使用交接书。商品房使用交接书生效后该合同内的原预租条款履行完毕。五、本合同文本系市房地资源局和上海市工商管理局根据上海市房屋租赁条例制定的示范文本(试行)。其合同条款均为提示性条款,供租赁双方当事人约定采用。本合同中的示尽事宜可由甲、乙双方协商一致后,订立补充条款予以明确。六、本合同签订前,出租人应向承租人出具房地产权证或其他权属证明,房地产开发企业向预租人出具
51、预售许可证。并相互交验有关身份证明。其中将房屋出租给外来流动人员的,出租人还应出示公安部门发放的房屋租赁治安许可证。七、本合同签订后的15日内当事人应按规定办理合同登记备案。其中,属房屋租赁的,应向房屋所在地的房地产交易中心或农场系统受理处办理,领取租赁合同登记备案证明;属于商品房预租的,外销商品房应向市房地产交易中心办理登记备案;内销商品房向房屋所在地的房地产交易中心办理登记备案。预租商品房竣工取得房地产权证,由双方当事人订立预租商品房使用交接书后,再按规定向房屋所在地的房地产交易中心或农场系统受理处办理登记备案,租赁合同登记备案证明。租赁合同经登记备案扣,当发生重复预租、出租、租赁期间房屋转让或设定抵押后被处分等事实时,可以对抗第三人。八、凡当事人一方要求登记备案,而另一方不予配合的,要求登记备案的一方可持本合同、有效身份证明等有关文件办理登记备案。九、房屋租赁保证金是一种履约保证的措施。房屋出租时,出租人可以与承租人在合同中约定收取房屋租赁保证金。租赁保证金的数额由租赁双方当事人约定。租赁关系终止时,房屋租赁保证金除用以抵充合同约定由承租人承担的费用外,剩余部分应当归还承租人。十、本合同文本可向市或房屋所在地区、县房地产交易
