1、聘(雇)用契约书新(标准版)甲方:乙方:签订日期:签订地点:(以下简称甲方)为应业务需要,聘(雇)用 生(女士)(以下简称乙方)为约聘(雇)人员,双方订立契约条款如下:一、聘(雇)用期间:自年月日起至年月日止。二、聘(雇)用报酬:甲方按月支给乙方报酬 点( )。三、工作内容(具体叙明):。四、受聘(雇)责任:乙方受聘(雇)后须确保甲方公务机密,有保密期限者从其规定,无保密期限 者自离职日起 为限(解聘(雇)者亦同)。乙方不得有不法行为或违背约定义务,如有违背者,除涉及民、刑事责任,由甲方依法追究外,并得随时 解聘(雇)。在聘(雇)用期间,乙方愿接受与甲方约定之工作上的指派调遣,并遵守此工 作上
2、之相关规定。若乙方违背上述相关规定确属情节重大,甲方得随时终止契约; 甲、乙双方如因特别事故须提前终止契约时,应于一个月前提出预告,经甲、乙 双方协议后乙方始得离职。乙方离职时,应先依照规定办妥离职手续。如有损害 公物,或侵权情事(或违反甲方智能财产权规定),应负责赔偿。五、乙方在受聘(雇)用期间,除应遵守甲方一切行政法规之规定外,其假期、 离职储金给与、劳工保险及全民健保等,依左列约定:假期核给:依、理。离职储金之扣缴及给与依 定办理,按月扣缴储存生息,并于离职时依规定发给。按乙方每月支报酬之百分之存储金,其中百分之由乙方于每月报酬中扣缴作为自提储金,另百分之由甲方提拨作为公提储金,并由甲方
3、在金融机构开立专户储存孳息,列帐管理。乙方因契约期满离职、或经甲方同意于契约期限届满前离职、或在职因公、因 病或意外死亡者,发给公、自提储金本息。乙方因违反契约所定义务而经甲方予以解聘, 或未经甲方同意而于契约期限届 满前离职者,仅发给自提储金之本息。其余未尽事宜请参考关规定。乙方受聘(雇)用期间,甲方应善尽投保劳工保险及全民健康保险之义务。六、乙方于受聘(雇)期间之著作或工作成果,如系于甲方企划下,或法定工 作期间完成者,其所有权归属甲方。因前开著作或工作成果所生之智能财产权, 应依本院之相关规定办理。七、本契约期间届满当然失效,如因业务需要须续聘时,另行签订新契约。八、本契约未订定事项,悉

8、d a may in its discreti on reprima nd b or termi nate this agreeme nt. a also reserves the right to in stitute suit aga inst b for civil compe nsati on or to impose crim in al liability.4.2 duri ng the term of this agreeme nt b shall comply with the directi ons and in structi ons of his/her supervis
9、ors perform his/her duties in accorda nee with all regulati ons and releva nt worki ng rules. where b violates any obligatio n specified in this paragraph and the case is con sidered to be serious in n aturea may in its discreti on termi nate this agreeme nt. if at any time the parties intend to ter
10、mi nate this agreeme nt due to causes bey ond the reas on able con trol of such partyeither shall give thirty (30) days' no tice of can cellati on to the other party prior to the inten ded termin atio n date. b shall vacate his/her office un der and pursua nt to the stipulati ons agreed upon by
11、both parties. b shall submit to the proceed ings in prescribed manner as to be vacated of his/her office.i n case of any one of the follow ing con diti ons which is due to b's fault, b shall be responsible for compensation (1) where b inflicts damage to or excessively abuses machinery equipment,
12、 tools, raw materials, products or other article belonging to academia sinica (2) where b commits torts; (3) where b violates a's own ership of in tellectual property rights.5. b shall comply with any adm ini strative regulati ons and rules provided by a. in regard to the matters of abse nee on
13、leave pay-as-you-go con tributi on ben efit, labor in sura nee and n ati onal health in sura nqe the follow ing terms and con diti ons shall be applicable.5.1 abse nee on leave shall be operated pursua nt to regulatio n of abse nee on leave for pers onnel served in all executive yua n orga ni zati o
14、ns un der civil eon tractual relatio nship.5.2 the deducti on and grant of pay-as-you-go eon tributi on ben efit shall be operated pursua nt to regulati on of 'pay-as-you-go' eon tributi on ben efit for pers onnel served in all orga ni zati ons and schools un der civil eon tractual relatio n
15、ship. certa in amount of salary shall be deducted per month and accrue on the finan cial in stitute over the term of this employme nt.5.2.1 an amount equal to seve n perce nt (%) of the mon thly salary shall be con tributed. fifty perce nt ( 50%) of the con tributio n shall be draw n from b's mo
16、n thly salary. ( here in after called pers onal con tributi on ben efit) a shall provide the other fifty perce nt ( 50%) of the con tributi on ( here in after called public con tributi on ben efit), and shall ope n a special acco unt on finan cial in stitute as to accumulate and man age this con tri
17、buti on (pers onal plus public).5.2.2 the total amount of the con tributi on ben efits (pers onal plus public) shall be gran ted to b, if at any time (a) b leaves the office on the expiry of this agreement (b) b vacates the office prior to the expiration date with the consent of, and (c) b deceases
18、due to undertaking of duty illness or accident.5.2.3 the amount of pers onal con tributi on ben efits accumulated shall be gran ted to b, if at any time (a) a term in ates this agreeme nt in asmuch as b breaches any obligati on, and (b) b resig ns from the office prior to the expirati on date withou
19、t the consent of a.5.2.4 any matter or eve nt not provided in the con text of this article shall be operated pursua nt to regulati on of 'pay-as-you-go' con tributi on ben efit for pers onnel served in all orga ni zati ons and schools un der civil con tractual relatio nship and releva nt reg
20、ulatio ns.5.3 duri ng the term of this agreeme nt a shall in sure b subject to the terms and con diti ons pursua nt to labor in sura nee regulati ons and n atio nal health in sura nee regulati ons.6. both parties agree that a shall own proprietary right perta ining to the literary works or achieveme
21、 nts completed by b un der the projects in itiated or coordi nated by a duri ng the term of this agreeme nt. the own ership of in tellectual property rights(in cludi ng but not limited to certa in pate nts, trademarks, copyrights, tech ni cal in formatio n and kno w-how ) accrued from the literary w
22、orks or achieveme nts herein contained is subject to the releva nt regulatio ns and rules provided by a.7. expirati onat the expirati on of the term of this agreemen, the employme nt relati on ship shall automatically term in ate without any con diti on. a new employme nt agreeme nt shall be sig ned
