9、循自愿、公平、公正和诚实信用的原则,经甲乙双方就射洪中央景峰项目钢筋工程合作事项协商一致,特订立本合同如下:一、工程概况及承包内容1、工程名称:2、 工程概况:3 、 结构形式:4、承包范围:(1)、从筏板基础钢筋开始到主体结构顶为止的全部制作和安装,(注:预制和现浇构件的钢筋,砖墙拉结筋、构造柱、过梁、预埋、焊接;预埋铁钢筋、屋面钢性层等本工程图纸及规范要求的所有钢筋工程的制作、安装及焊接工作(乙方不包括框架主体的板筋、箍筋的制作,但砌体拉结筋和箍筋的制作,由乙方安排加工)。筏板和转换层钢筋的脚手架的搭设,后浇带钢丝网的安装和加固。( 2)、焊接工程包括:本工程规范允许焊接的所有焊接工作的人
10、工及相应的焊接材料,包括电渣压力焊及筏板钢筋连接工料。二次结构的植筋由项目部负责。( 3)、钢筋工程包括:原材料进场配合卸车,加工场所有钢筋运输至施工现场人工上下车(运输工具由甲方提供),场内运输卸货就位,分类堆放整齐,场内二次搬运,制作和绑扎、安装钢筋,垂直、水平运输,马凳保护层,制作、安放垫块保护层,浇砼时钢筋值班保证负筋保护层正确,及时利用短钢筋,现场短钢筋清理堆放整齐。( 4)、钢筋的制作和绑扎需要的扎丝和焊条.焊药以及机具由乙方承担。(5)、承包人根据工程需要向发包人承诺的施工作业人员不少于名(本合同自乙方达到规定人数后开始生效)。二、合同工期:1、开工日期:年月日,竣工日期:年月日

23、thening "four good" leadershipconstruction3、乙方必须按照甲方项目部的要求安排人员,如乙方不能达到甲方的要求,甲方有权依据现场情况另行增派班组或者更换乙方。三、合同单价1、地下室筏板部分:(工程量按图计算)2、地下室筏板以上:(工程量按图计算)3、工程量增减: 如发生图纸范围内的变更, 所产生的增减工作量甲方不另行计算, 即包含在每平方米承包价范围内(工期不顺延) 。四、工程款的支付办法1、工程进度款支付办法:按工程进度节点拨付工程款( 1)、地下室部分:( 2)、商业部分:( 3)、住宅:( 4)、工程主体完成后支付完成的层以上工
24、程量的80%。( 5)、余款在工程屋面刚性层钢筋完成后一个月内支付至,余款在工程竣工验收后一年内付清。( 6)、以上均为完成节点工作后乙方报送此段已完成工程量,甲方审核后支付工程款。2、乙方必须按设计及相关规范保证质量,如乙方完成部分需要整改或者有相关的遗留问题必须在拨付工程进度款之前处理完成,否则不予拨付工程款。3、乙方必须按照甲方及项目部的进度计划要求进行合理安排,滞后的工期必须及时安排赶上,如工期已经滞后且乙方未合理安排时,甲方或项目部有权组织突击班组进行突击,费用由乙方支付,高出平常工资部分由乙方负责补足,在工期未赶上计划工期之前不予拨付工程进度款。4、乙方必须听从甲方及项目部的指挥和
25、安排,不得野蛮施工,如乙方拒不听从,甲方及项目部有权停拨工程款,必要时更换班组,乙方工程款必须待工程达到工程款拨付节点后方能结算工程款。五、工人工资的发放办法1、承包人保证工人进场时,严格参照中华人民共和国劳动法及其法规同每位工人签订劳动合同,记载劳动合同期限、工作内容和工作地点、工作时间和休息休假、劳动报酬及其支付方式、社会保险、劳动保护、劳动条件、劳动安全和职业危害防护。2、乙方应在工人进场时必须如实将所有参与本项目施工的员工的基本信息报甲方备案,记载姓名、性别、年龄、籍贯、公民身份号码、联系电话、职位,年龄不满18 周岁和已满55 周岁以上的人员不得进场施工作业,所有人员必须配合甲方在当

39、uot; leadershipconstruction3、乙方必须接受甲方及项目部对乙方施工人员的上班人员的考勤监督和考勤制度(指纹卡或平安卡记录),对乙方上班人数、工作部位每天进行公示,承包人第二天根据公示情况提交详细的考勤,如承包人提供虚假考勤,甲方有权按所涉金额的10 倍进行处罚,因此引起的责任由乙方承担。4、甲方只负责按合同支付乙方劳务进度款;乙方发放工人劳务工资金额不足的,由乙方自行解决。乙方须参照劳动法律法规和劳务合同的规定按时全额发放工人劳务工资。5、为了保证本合同的全面履行和不引发劳务纠纷,乙方收取工程款时, 必须提供由工人签名的工资发放表,原件交由甲方备案;甲方有权优先将工程
40、进度款直接发放工人工资,扣除工人工资后向乙方支付工程进度款。乙方在工人工资全额发放前,挪用工程进度款的视为违约行为,应承担违约责任。6承包人领取工资后,必须按实际现场工人名字出具工资表,由工人本人签字和盖手印,提供与甲方。7、如乙方未按时全额发放工人劳务工资而出现工人罢工、闹事、上访时,乙方应当优先无条件解决纠纷,阻止工人罢工、闹事,立刻支付拖欠的工人工资。施工现场如因劳务纠纷引发罢工、闹事、上访等事件,甲方按 10000 元 /起对承包人进行罚款,罚款在当月工程进度款中扣除。8、如发生劳务纠纷,乙方无能力及时处理,而乙方工人需甲方出面解决时,乙方同意根据实际出勤人数及相关工资标准结算退场;如
41、造成甲方经济损失,乙方同意全部承担。六、安全施工1、进入施工现场的乙方人员,必须遵守施工现场的各项规章制度。2、进入施工现场必须正确佩戴安全帽,高空作业必须系好安全带,特种作业时必须按要求配戴(备)相应的安全防护措施。3、进入施工现场作业人员必须熟练掌握各项操作规程,严格按照相关操作规程操作,不得违章操作。4、进入施工现场的乙方人员,不得私拉乱接电线路,需要时必须要由专业电工操作。5、工人在施工现场中违反安全操作规程及纪律。甲方视情节轻重可处罚款50 200 元。6、以上各项必须严格执行,如有违规操作或者非法操作,项目部有权按照施工现场相关规定进行相应处罚,造成后果的由乙方负责,屡教不改的甲方
42、及项目部有权责令当事人及乙方及时退场。并执行先退场后算账的规定。七、文明施工1、进入施工现场必须遵守施工现场各项文明施工管理规定,必须服从甲方及项目部管理人员统一指挥和安排,维护公司形象。2、进入施工现场必须文明穿着,男同志不得穿拖鞋及赤身,女同志不得穿高跟鞋及穿裙子。3、严禁酒后上班、疲劳作业,严禁在施工现场随地大小便。4、施工现场及宿舍内严禁打架斗殴,聚众赌博、寻衅滋事。play levels cadres i n enterprisedevelopment in the ofbackbone backbone role; t o full strengtheni ng members y
