1、聘任协议甲方自愿聘请乙方作为外籍教师。各方本着友好合作的原 则签署此协议并保证严格履行协议上所规定的条款。乙方的月工资为元/月，服务期限从年月日至年月日。一、甲方的义务A：甲方将向乙方介绍中国的法律及关于政策，学校的体制和相关的外教管理规定。B：甲方将知指导、监督和评估乙方的工作。C：甲方给乙方提供必要的工作设备和居住条件。D：甲方将指派一名教师作为乙方的工作联系人，协助其履行工作任务。E：甲方将按月付给乙方工资。二、乙方的义务A：乙方应遵守中国法律、规定和制度，并保证不从事与本人身份不符的活动。B：乙方应熟悉甲方的工作制度和相关的外教管理规定并接受甲方对工作的指导、安排、监督和评估。未 经甲

2、方许可，乙方不得在其它地方兼任工作或担任与甲方工作无关的职位。C：乙方将按商定的进度履行教学任务并保证教学质量。D：乙方应尊重中国的宗教政策并且未能够举办一些不适合教师身份的宗教活动。E：乙方应尊重中国的道德规范和社会习俗。三、协议的修改、取消和中止A：各方应遵守协议规定，未经各方许可不得擅自修改、取消和中止协议。B：经各方许可，可修改、取消和中止协议。在各方未达成新的协议之前，各方要严格遵守协议。C：甲方有权在以下情况下以书面形式通知乙方中止协议：1、乙方未能履行协议，或在甲方提出问题后，乙方仍未能履行条款列明的义务。2、乙方在请30天病假之后，经医生诊断不适宜再继续正常工作。D：乙方有权在

3、以下情况下以书面形式通知甲方中止协议。1、甲方未能根据协议给乙方提供必要的工作和居住条件。2、甲方未能按规定给乙方报酬。四、违约处罚A：如各方任何一方违反协议规定，应付数额为乙方一个月工资的违约金。B：如乙方由于不可预见情况，要求取消协议，需提供关于部门证明并征得甲方同意，但需自付回程费 用。C：如乙方无正当理由擅自中止协议，需自付回程费用并要向甲方交付罚金。D：如甲方由于不可预见情况要中止协议，应得到乙方的许可，但要负担其回程费用。E：如甲方无正当理由擅自终止协议，不仅要负担乙方的回程费用而且要向乙方交付罚金。五、协议附件同正文具有同样效力。六、此协议自签署之日起生效并且于终止之日自动解除。

4、如各方中任何一方要求订立新合 同。乙方自付在协议终止之后逗留的费用。七、调解各方将相互协商解决在协议执行过程中发生的争端。如努力失败，可以上交外专局外国专家事务组调停。此份协议签于年月日签于，英文与中文各；一式两份。甲方：xx科学技术学院乙方：（签名）：（签名）：附件：一、工资1、乙方的报酬根据乙方的工作量和专业技能，及其学历和教学经验所订。甲方将在乙方接受此职位之前 告知乙方的报酬标准。2、报酬按月付给乙方，自乙方履行职责之日起至协议终止之日止。如乙方工作不足一个月，则报酬按 天数计（每天报酬为月薪的三十分之一）。3、甲方将付给乙方人民币元/月。4、乙方如有需要，甲方可协助乙方离境前申请兑换

5、一定数额的外币。二、xx费用1、来程路费由甲方支付。如乙方遵守协议并履行学年任务，由甲方提供其回国单程经济舱机票。2、如服务期限是一学年或少于半年，甲方将付乙方回国单程机票的半额。三、证件费用1、甲方负责为乙方办理协议期间内居留证和外国专家证，并付办证费用。2、甲方负责为乙方办理单次往返签证。甲方可协助乙方伸办多次往返签证，但乙方需付额外费用。四、享受待遇1、甲方为乙方提供一套公寓，配有全套家具及必要的电器或燃器具，包括彩电、空调、冰箱、微波炉、 热水器、燃气灶、取暖器、电话等。2、甲方为乙方支付每月电话月租费28元及不超过50元的人民币的市内电话费、不超 过200元 的水电费和不超过100元

6、 人民币的煤气开支。超额费用由乙方自付。3、乙方享受医疗待遇甲方教职工同等。乙方需付20%的医疗费用。常规治疗在校医 院，经校医院医生准许乙方可在外就医，甲方支付在外就医费用但不包括挂号费、出诊、xx费、？牙、洗牙、配眼镜、整容、住院的餐费和非治疗性的补药费用， 乙方家属不享受上述待遇。五、假期除大学课程安排表上的假期和本地的公众假期之外，乙方可享受两日的特别假期（如圣诞 节），聘期为一学年以上者在学校假期时的工资照付六、病假和事假1、当乙方生病，凭医疗证明可请病假。如病情延续半个月，工资可照常发放。如病假超出期限，甲方有 权终止协议。2、乙方在得到甲方的准许下可请事假，事假期间的报酬将按事假

8、作时间为五天2、外国教师享受中国下列节日休假：（l）元旦（2） 春节（3）国际劳动节（4）国庆节（5）法律、法规规定的 其他休假节日3、外国教师可按其国籍和信仰相应享受下列节日休假：（l）圣诞节两天（2） 宰牲节（古尔邦节）三天（3）开斋节一天（4） 泼水节一天聘方受聘方协议附件（二）第一条外籍教师实行带薪年休假。协议期为一学年的，享受一个假期（寒假或暑假）带薪休 假。第二条外籍教师请病假，须凭xx大学校医院或指派的涉外医院（友谊宾馆门诊部、协和医 院）医生证明。第三条根据聘用单位指派医院医生的诊断证明，外籍教师在一个协议期内累计请病假不满三十 天工资按100；超过三十天后，聘用单位有权解除聘

9、用协议；若解除协议，工资可按70发给，直至恢复工作为止。第四条在协议期内，外籍教师因私外出就诊的费用自理。协议期内，在xx、xx、xx地区 和中国境外就诊的医疗费用自理。第五条外籍教师请事假须经聘用单位同意，可按日扣发工资。在协议期一学年内，事假累计不 得超过十天，连续事假不超过三天。超过一天，可扣发两天工资。第六条未经聘用单位同意而擅离职守的，旷职一天，扣发三天工资。情节严重的，我校有权解 除协议，并追究其违约责任。聘方受 聘方Party A wishes to engage the service of Party Bas a foreign expert/teacher. 10、 parties, in a spirt of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it. Party B shall observe the Chinese law , decrees and relevant regulations, and shall not paticipate in the activities irrelevant to his/her

Party B shall observe Party As work system and regulations concering adminstration of foreign teachers and shall accept Party As arrangement, direction, supervision and evaluation in regard to his/her work . without Party As consent , Party B shall not render service elsewhere or hold con

14、currently any post unrelated to the work agree on with Party A.3. .Party Bshall complete the teaching tasks agreed on schedule and guarantee the quality of work .4. Party B shall respect Chinas religious policy and shall not conduct religious activities incompatible with the status of a teacher .5.

15、Party B shall respect the Chinese peoples moral standards and customs. Revision, Cancellation and Termination of the Contract1. Both parties should abide by the contract and should refrain from revising,canceling,or terminating the contract without mutual consent.2. The contract can be revised,cance

16、led or terminated with mutual consent .Before both parties have reached a new agreement, the contract should be strictly observed.3. Party A has the right to cancel the contract under the following conditions:(1) Party B does not fulfill the contract or does not fulfill the contract obligations acco

17、rding to the terms stipulated, and has failed to amend after Party A has pointed it out .(2) According to the doctors diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.4. Party B has the right to cancel the contract with a written notice to Paerty A under the following

18、 conditions.(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.(2) Party A has not paid Party B as scheduled.: Breach Penalty1. When either of the two parties fails to fulfill the contract obligations according to the terms stipulated ,tha

19、t is ,breaks the contract ,it must pay a breach penalty ,which amounts to Party Bs one month salary.2. If Party B ask to cancel the contract due to events beyond control , it should produce certifications by the department concerned , obtain Party As consent, and pay its own return expenses;3. If Pa

20、rty B cancels the contract without valid reason ,it should pay its own return expenses and pay a breach penalty to Party A .4. If Party A ask to cancel the contract due to events beyond control , with the consent of Party B ,it should pay Party Bs return expenses;5. If party A cancels the contract w

21、ithout valid reason,it should pay Party Bs return expenses and pay a breach penalty to Party B .:The appendix of this contract is an inseparable part of the contract and has equal effect .:This contract takes effect on the date signed by both parties and will automatically expire when the contract e

22、nds. If either of the two parties asks for a new contract , it should forward its request to another party 90 days prior to the expiration of the contract , and sign the new contract with mutual consent .Party B shall bear all expenses incurred when staying on after the contract expires.:Arbitration

23、The two parties shall consult with each other and meditate any disputes which may arise about the contract . If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of experts and ask for a final arbitration .This Contract i

If Party B should work less than a month , payment would be made on a daily basis ,which amounts to one thirtieth of the months salary .3. 27、rty B to apply for the exchange of certain amount of foreign currency upon departure if necessary .: Transportation costs1. The air ticket and other expenses for coming to the place of work in China should be born by Party B .If Party B is under contract for a period of one academic year ,Party A sh

28、all provide Party B with one-way economy class air ticket when he/she is returning home at the expiration of the term of service .2. If the service time is one semester or shorter then six months , Party A will pay to Party B half of a one-way economy class air ticket .Certificates Cost1. Party A sh

29、all provide Party B with Foreign Experts Certificate and Permit of Foreigner Residence and bear the cost .2. Party A shall provide Party B with one entry visa . Party A will help Party B apply for double or multiple entry visa but Party B shall bear the extra cost .: Benefits1. Party A will provide

30、Party B with a furnished apartment with necessary electrical or gas appliances (a TV set, a refrigerator, an air conditioner, a microwave oven ,a shower water heater, an gas stove, an electric heater , telephone , etc .)2. Party A will pay for Party B his/her water and electricity bill of less than

31、200 RMB Yuan , and an gas bill of less than 100 RMB Yuan . The excessive expenditure shall be born by party B.3. Party B shall enjoy the same Medicare service as faculties of Party A . The university hospital provides ordinary Medicare service . 20% of the fee shall be born by Party B. with the doct

32、ors advice, Party B may have Medicare treatment outside . Party A will pay the fee but not including the charges for registration, doctors home visits, transportation to and from hospital , putting in artificial teeth ,tooth cleaning ,plastic surgery, mounting of spectacles, boarding during hospital

33、ization and non-medical tonics Party Bs non-working family members can not enjoy the above benefits.: Vacation and HolidaysBesides the vacations in the university time-table and local public holidays , Party B may also enjoy a two-day holiday for Christmas, and the salary is paid as usual during the

34、 vacation if the service time exceeds one semester.: Sick leave and leave for personal matters1. When Party B is ill and is medically certified, he/her shall ask Party A for sick leave , salary shall be paid as usual even if party B remains sick for half an consecutive month . If sick leave should e

35、xceed that limit and Party A refrains from exercising the right stipulated in the contract.2. Should Party B, with the consent of Party A, ask for leave on account of private business, salary deduction would be made according to the number of days of absence, which are not supposed to be over one we
