5.Salesofthelikeproductdestinedforconsumptioninthedomesticmarketoftheexportingcountryshallnormallybeconsideredasufficientquantityforthedeterminationofthenormalvalueifsuchsalesconstitute5percentormoreofthesalesoftheproductunderconsiderationtotheimportingMember,providedthatalowerratioshouldbeacceptablewheretheevidencedemonstratesthatdomesticsalesatsuchlowerratioarenonethelessofsufficientmagnitudetoprovideforapropercomparison.Salesofthelikeproductdestinedforconsumptioninthedomesticmarketoftheexportingcountryshallnormallybeconsideredasufficientquantityforthedeterminationofthenormalvalueifsuchsalesconstitute5percentormoreofthesalesoftheproductunderconsiderationtotheimportingMember,providedthatalowerratioshouldbeacceptablewheretheevidencedemonstratesthatdomesticsalesatsuchlowerratioarenonethelessofsufficientmagnitudetoprovideforapropercomparison.WheninthisAgreementtheterm"authorities"isused,itshallbeinterpretedasmeaningauthoritiesatanappropriateseniorlevel.Theextendedperiodoftimeshouldnormallybeoneyearbutshallinnocasebelessthansixmonths.WheninthisAgreementtheterm"authorities"isused,itshallbeinterpretedasmeaningauthoritiesatanappropriateseniorlevel.Theextendedperiodoftimeshouldnormallybeoneyearbutshallinnocasebelessthansixmonths.Salesbelowperunitcostsaremadeinsubstantialquantitieswhentheauthoritiesestablishthattheweightedaveragesellingpriceofthetransactionsunderconsiderationforthedeterminationofthenormalvalueisbelowtheweightedaverageperunitcosts,orthatthevolumeofsalesbelowperunitcostsrepresentsnotlessthan20percentofthevolumesoldintransactionsunderconsiderationforthedeterminationofthenormalvalue.Theadjustmentmadeforstart-upoperationsshallreflectthecostsattheendofthestart-upperiodor,ifthatperiodextendsbeyondtheperiodofinvestigation,themostrecentcostswhichcanreasonablybetakenintoaccountbytheauthoritiesduringtheinvestigation.Itisunderstoodthatsomeoftheabovefactorsmayoverlap,andauthoritiesshallensurethattheydonotduplicateadjustmentsthathavebeenalreadymadeunderthisprovision.Itisunderstoodthatsomeoftheabovefactorsmayoverlap,andauthoritiesshallensurethattheydonotduplicateadjustmentsthathavebeenalreadymadeunderthisprovision.Normally,thedateofsalewouldbethedateofcontract,purchaseorder,orderconfirmation,orinvoice,whicheverestablishesthematerialtermsofsale.Normally,thedateofsalewouldbethedateofcontract,purchaseorder,orderconfirmation,orinvoice,whicheverestablishesthematerialtermsofsale.UnderthisAgreementtheterm"injury"shall,unlessotherwisespecified,betakentomeanmaterialinjurytoadomesticindustry,threatofmaterialinjurytoadomesticindustryormaterialretardationoftheestablishmentofsuchanindustryandshallbeinterpretedinaccordancewiththeprovisionsofthisArticle.Oneexample,thoughnotanexclusiveone,isthatthereisconvincingreasontobelievethattherewillbe,inthenearfuture,substantiallyincreasedimportationoftheproductatdumpedprices.Oneexample,thoughnotanexclusiveone,isthatthereisconvincingreasontobelievethattherewillbe,inthenearfuture,substantiallyincreasedimportationoftheproductatdumpedprices.Forthepurposeofthisparagraph,producersshallbedeemedtoberelatedtoexportersorimportersonlyifForthepurposeofthisparagraph,producersshallbedeemedtoberelatedtoexportersorimportersonlyif(a)

oneofthemdirectlyorindirectlycontrolstheother;or(b)

bothofthemaredirectlyorindirectlycontrolledbyathirdperson;or(c)

togethertheydirectlyorindirectlycontrolathirdperson,providedthattherearegroundsforbelievingorsuspectingthattheeffectoftherelationshipissuchastocausetheproducerconcernedtobehavedifferentlyfromnon-relatedproducers.Forthepurposeofthisparagraph,oneshallbedeemedtocontrolanotherwhentheformerislegallyoroperationallyinapositiontoexerciserestraintordirectionoverthelatter.AsusedinthisAgreement"levy"shallmeanthedefinitiveorfinallegalassessmentorcollectionofadutyortax.AsusedinthisAgreement"levy"shallmeanthedefinitiveorfinallegalassessmentorcollectionofadutyortax.Inthecaseoffragmentedindustriesinvolvinganexceptionallylargenumberofproducers,authoritiesmaydeterminesupportandoppositionbyusingstatisticallyvalidsamplingtechniques.Inthecaseoffragmentedindustriesinvolvinganexceptionallylargenumberofproducers,authoritiesmaydeterminesupportandoppositionbyusingstatisticallyvalidsamplingtechniques.MembersareawarethatintheterritoryofcertainMembersemployeesofdomesticproducersofthelikeproductorrepresentativesofthoseemployeesmaymakeorsupportanapplicationforaninvestigationunderparagraph

1.Asageneralrule,thetimelimitforexportersshallbecountedfromthedateofreceiptofthequestionnaire,whichforthispurposeshallbedeemedtohavebeenreceivedoneweekfromthedateonwhichitwassenttotherespondentortransmittedtotheappropriatediplomaticrepresentativeoftheexportingMemberor,inthecaseofaseparatecustomsterritoryMemberoftheWTO,anofficialrepresentativeoftheexportingterritory.Asageneralrule,thetimelimitforexportersshallbecountedfromthedateofreceiptofthequestionnaire,whichforthispurposeshallbedeemedtohavebeenreceivedoneweekfromthedateonwhichitwassenttotherespondentortransmittedtotheappropriatediplomaticrepresentativeoftheexportingMemberor,inthecaseofaseparatecustomsterritoryMemberoftheWTO,anofficialrepresentativeoftheexportingterritory.Itbeingunderstoodthat,wherethenumberofexportersinvolvedisparticularlyhigh,thefulltextofthewrittenapplicationshouldinsteadbeprovidedonlytotheauthoritiesoftheexportingMemberortotherelevanttradeassociation.Itbeingunderstoodthat,wherethenumberofexportersinvolvedisparticularlyhigh,thefulltextofthewrittenapplicationshouldinsteadbeprovidedonlytotheauthoritiesoftheexportingMemberortotherelevanttradeassociation.MembersareawarethatintheterritoryofcertainMembersdisclosurepursuanttoanarrowly-drawnprotectiveordermayberequired.Membersagreethatrequestsforconfidentialityshouldnotbearbitrarilyrejected.Theword"may"shallnotbeinterpretedtoallowthesimultaneouscontinuationofproceedingswiththeimplementationofpriceundertakingsexceptasprovidedinparagraph
