前言Preface根据相关专业机构的研究报告,航运业目前每年消耗20亿桶燃油,二氧化碳约占全球总排放量的6%。业内人士预测,到2021年全球航运业将需要更多的燃油,温室气体的排放量将在目前根底上增加75%。气候变暖已经成为全世界关注的主要环境问题,各国政府以及各行业都在采取各种可能的措施减少CO2等温室气体的排放。Accordingtothestudyofrelevantprofessionalorganizations,theshippingindustryhasanannualconsumptionof2billionbarrelsoffueloil,andproduces6%oftheoverallglobalcarbondioxideemissions.Industryinsiderspredictthatby2021theglobalshippingindustrywillneedmorefuel,whichwillcausegreenhousegasemissionsincreaseby75%onthecurrentbase.Astheclimatewarminghasbecomeamajorenvironmentalproblemcapturingworldwideattention,governmentsandindustriesaretakingallpossiblemeasurestoreducetheemissionsofCO2andothergreenhousegases.为有效控制船舶营运对环境造成的污染,IMO海环会第59届会议提出了新造船舶能效设计指数〔EEDI〕〔MEPC.1Circ.681EEDIcalculation〕、营运船舶能效营运指数〔EEOI〕〔MEPC.1Circ.682verificationofEEDI〕和船舶能效管理方案〔SEEMP〕〔MEPC.1Circ.683SEEMP〕,要求各航运企业将须逐步制定能效管理方案。在63届会议上又对Circ.683进行了修改,出台了新的MEPC.1/Circ.213?船舶能效管理方案〔SEEMP〕制订导那么?。Forthepurposeofcontrollingtheenvironmentpollutioncausedbyshipoperation,theIMOMarineEnvironmentProtectionCommittee(MEPC)hasputforwardthenewshipEnergyEfficiencyDesignIndex(EEDI)(MEPC.1Circ.681EEDIcalculation),operationalshipEnergyEfficiencyOperationalIndicator(EEOI)(MEPC.1Circ.682verificationofEEDI),andShipEnergyEfficiencyManagementPlan(SEEMP)(MEPC.1Circ.683SEEMP)onthe59thmeeting,requiringallshippingenterprisestomakeenergyefficiencymanagementplanstepbystep.Onthe63rdmeeting,theMEPCmodifiedtheCirc.683andpublishedanewMEPC.1/Circ.213(GuidanceForTheDevelopmentOfAShipEnergyEfficiencyManagementPlan).国际海事组织(IMO)于2021年10月10日在第58届海上环境保护委员会上,以MPPC.176(58)决议通过了的MARPOL73/78公约附那么VI2021修正案,将于2021年7月1日起强制生效。根据该公约第14条要求:2021年1月1日及以后在Sox排放控制区(简称SECA区域)船舶使用燃油的含硫量为0.10%。MARPOL公约附那么六新增一章“船舶能效规那么〞,将在2021年1月1日强制实施“能效设计指数〔EEDI〕〞、“船舶能效管理方案〔SEEMP〕〞。由此,全球航运企业将面临着更加严格的节能减排履约要求。TheInternationalMaritimeOrganization(IMO)passed,byresolutionMPPC.176(58),2021amendmenttotheMARPOL73/78ConventionAnnexVIonthe58thmaritimeenvironmentprotectioncommitteeholdonOctober10,2021,whichshallbeeffectedonJuly1,2021.AccordingtotherequirementsoftheArticle14oftheConvention:thesulphurcontentofthefueloilusedbyshipsinSoxEmissionControlArea(hereinafterreferredtoasSECA)shallbe0.10%forJanuary1,2021andafter.Anewsectionnamed“regulationsonenergyefficiencyforships〞shallbeincludedinMARPOLAnnexVI,andtheEEDIandSEEMPshallbeenforcedonJanuary1,2021.Therefore,globalshippingenterpriseswillfacestricterenforcementrequirementsforenergyconservationandemissionreduction.欧盟2005/33/EC法令,从2021年1月1日起,所有停靠〔包括锚泊〕欧盟港口二小时以上的船舶,将执行其使用的燃油含硫量不得超过0.10%的规定。对抵靠欧盟区域船舶提出了低碳排放的强制性要求。IMO海上环境保护委员会正在研究以海运“碳排放交易〞、“碳排放税〞为主的七种市场机制措施。欧盟可能采取单边行动,继航空运输业之后将海运碳排放纳入ETS〔碳交易系统〕,收取海运碳排放费用。IAPH〔世界港口协会〕制定了“船舶环境指数〔ESI〕〞用于评估船舶Nox、Sox、CO2的排放情况,根据评估结果采取对船舶进行奖励或在港口使费上给予减免等鼓励措施。RIGHTSHIP、OCIMF、BSR〔商业社会责任组织〕依靠自身在散货、油轮、集装箱市场强大的影响力,推出了各自领域的船舶能效评估、评级系统,对散货、油轮、集装箱租船市场的影响重大。AccordingtotheEU2005/33/ECAct,sinceJanuary1,2021,allshipsberthing(includinganchoring)onEUportsformorethantwohoursshallperformtheprovisionofitsuseoffuelsulfurcontentshallnotexceed0.10%.
AndmandatoryrequirementsoflowcarbonemissionswillberaisedtoshipsabuttingtheEUarea.
TheIMOMEPCisstudyingthesevenmarketmechanismmeasuresbasedonthe“carbonemissionstrading〞and"carbontax"ofoceanshipping.
EUmaytakeunilateralaction,followingtheairtransportindustry,toincludeshippingcarbonemissionsintotheETS(carbontradingsystem),tochargeshippingcarbonemissionfees.
TheIAPH(InternationalAssociationofPortsandHarbors)developedthe"EnvironmentalShipIndex(ESI)"toassessships’Nox,Sox,CO2emissions,andtookincentivessuchasrewardingorgivingreliefonportchargesaccordingtotheresultsoftheassessment.
Relyingontheirownstronginfluenceinthebulk,tankerandcontainermarket,RIGHTSHIP,OCIMF,BSR(BusinessforSocialResponsibility)launchedtheirenergyefficiencyassessmentandratingsystemsintheirrespectivefields,causingsignificantinfluenceincharteringmarket
