BILLOFLADINGTERMSANDCONDITIONS(EXAMPLEB/LOFFORAPLCOPTELTD)

1.DEFINITIONS

Carrier”includesAPLCo.PteLtd,AmericanPresidentLines,Ltd,theVessel,itsowner,operator,charterer(whetherdemise,time,voyage,spaceorslot),themaster,andanyconnectingorsubstitutewatercarrier.

APLCo.PteLtdAmericanPresidentLines,

Ltd.

Merchant”includestheShipper,Consignee,Receiver,HolderoftheBillofLading,OwnerofthecargoorPersonentitledtothepossessionofthecargoorhavingapresentorfutureinterestintheGoodsandtheservantsandagentsofanyofthese,allofwhomshallbejointlyandseverallyliabletotheCarrierforthepaymentofallFreight,andfortheperformanceoftheobligationsofanyofthemunderthisBillofLading.

Person”meansanynaturalperson,company,firm,bodycorporateofunincorporatedassociationorbody,includinganyGovernmentorgovernmentalorstatutoryinstrumentalityorportauthority.

Sub-Contractor”includesownersandoperatorsofvessels(otherthantheCarrier),stevedores,terminalandgroupageoperators,roadandrailtransportoperators,longshoremen,warehousemenandanyindependentcontractoremployedbytheCarrierinperformanceoftheCarriage.

Indemnify”includesdefend,indemnifyandholdharmless.

Goods”meansthecargoreceivedfromtheMerchantandincludesanyequipmentorContainernotsuppliedbyoronbehalfoftheCarrier.

AnendorsementonthisBillofLadingthattheGoodshavebeenshipped“onboard”meansonboardtheCarrier,sVessel,oranothermodeoftransportoperatedbyoronbehalfofCarrierenroutetothePortofLoadingforloadingaboardCarrier,sVessel.

Container”includesanyopenorclosedcontainer,van,trailer,flatbed,transportabletank,flat,pallet,skid,platformoranysimilararticleusedtoconsolidateGoodsandanyequipmentassociatedorattachedthereto.

Carriage”meansthewholeoranypartoftheoperationsandservicesundertakenbytheCarrierinrespectoftheGoodscoveredbythisBillofLading.

CombinedTransport”arisesifthePlaceofReceiptand/orthePlaceofDeliveryareindicatedonthefacehereofintherelevantspaces.

PorttoPortShipment”arisesiftheCarriagecalledforbythisBillofLadingisnotCombinedTransport.

Vessel”includesthevesselnamedonthefaceofthisBillofLadingandanyothervessel,lighterorwatercraftowned,operated,charteredoremployedbytheCarrieroranyconnectingorsubstitutedwatercarrierperformingCarriageunderthisBillofLading.

Freight”includesallchargespayabletotheCarrierinaccordancewiththeApplicableTariffandthisBillofLading.

CARRIER’SAPPLICABLETARIFF

2.

ThetermsoftheCarrier,sApplicableTariffareincorporatedherein.ParticularattentionisdrawntothetermsthereinrelatingtoContainerandVehicledemurrage.

CopiesoftherelevantprovisionsoftheApplicableTariffareobtainablefromtheCarrieroritsagentsuponrequest.IncaseofinconsistencybetweenthisBillofLadingandtheApplicableTariff,thisBillofLadingshallprevail.

WARRANTY

3.

TheMerchantwarrantsthatinagreeingtotheTermsandConditionshereof,includingtheApplicableTariff(s),itis,orhastheauthorityof,thePersonowningorentitledtothepossessionoftheGoodsand/orContainerandthisBillofLading,andthatallprioragreementsandFreightarrangementsaremergedinandsupersededbytheprovisionsofthisBillofLading.

SUB-CONTRACTING4.

i)TheCarriershallbeentitledtosub-contractonanytermsthewholeoranypartoftheCarriage,loading,unloading,storing,warehousing,handlingandanyandalldutieswhatsoeverundertakenbytheCarrierinrelationtotheGoods.

TheMerchantundertakesthatnoclaimorallegationshallbemadeagainstanyPersonwhomsoeverbywhomtheCarriageisprocured,performedorundertaken,whetherdirectlyorindirectly(includinganyindependentcontractorsandanySub-ContractorsoftheCarrierandtheirservantsoragents),otherthantheCarrierwhichimposesorattemptstoimposeuponanysuchPerson,oranyVesselownedbyanysuchPerson,anyliabilitywhatsoeverinconnectionwiththeGoodsortheCarriageoftheGoods,whetherornotarisingoutofnegligenceonthepartofsuchPersonand,ifanysuchclaimorallegationshouldneverthelessbemade,toindemnifytheCarrieragainstallconsequencesthereof.WithoutprejudicetotheforegoingeverysuchPersonshallhavethebenefitofeveryright,defence,limitationandlibertyofwhatsoevernaturehereincontainedorotherwiseavailabletotheCarrierasifsuchprovisionswereexpresslyforitsbenefit;andinenteringintothiscontract,theCarrier,totheextentoftheseprovisions,doessonotonlyonitsownbehalfbutalsoasagentandtrusteeforsuchPersons.

TheMerchantfurtherundertakesthatnoclaimorallegationinrespectoftheGoodsshallbemadeagainsttheCarrierbyanyPersonotherthaninaccordancewiththetermsandconditionsofthisBillofLadingwhichimposesorattemptstoimposeupontheCarrieranyliabilitywhatsoeverinconnectionwiththeGoodsortheCarriageoftheGoods,whetherornotarisingoutofnegligenceonthepartoftheCarrierand,ifanysuchclaimorallegationshouldneverthelessbemade,toindemnifytheCarrieragainstallconsequencesthereof.

5.CARRIER’SRESPONSIBILITY

PORT-TO-PORTSHIPMENT

A.

IftheCarriagecalledforbythisBillofLadingisaPort-to-PortShipment,theCarrier’sliability,ifany,shallberestrictedtotheperiodwhentheGoodsareloadedonboardtheVesseluntildischargedtherefromortranshippedtoanotherVesseltackle-to-tackle,tobedeterminedinaccordancewiththeprovisionsofClause6hereof.

COMBINEDTRANSPORT

i)IftheCarriagecalledforbythisBillofLadingisaCombinedTransportShipment,theCarrierundertakestoperformand/orprocureinitsownname,performanceoftheCarriagefromthePlaceofReceiptorthePortofLoadingtothePortofDischargeorthePlaceofDelivery,whicheverisapplicable,andtheCarrier’sliability,ifany,shallbedeterminedinaccordancewiththeprovisionsofClause6hereof.

i)

ii)

DuringtheperiodpriortoloadingontotheVesselandafterdischargefromtheVessel,theCarriershallbeentitledasagainsttheMerchanttoallrights,defences,immunities,exemptions,limitationsoforexonerationsfromliability,libertiesandbenefitscontainedorincorporatedinthecontractbetweentheCarrierandanyPersonwhomsoeverbywhomtheCarriageisprocured,performedorundertaken,whetherdirectlyorindirectly(andincludingsuchPersonsmentionedinClause4ii)hereof)andwhowouldhavebeenliabletotheMerchantiftheMerchanthadcontracteddirectlywithsuchPersonorcontainedinanycompulsorylegislationapplicabletosuchPerson.However,innoeventshalltheCarrier'sliabilityexceedthatdeterminedinaccordancewiththeprovisionsofClause6hereof.

IfitcannotbeprovenwhereorwhenoratwhatstageoftheCarriagetheGoodsorContainersorotherpackageswerelostordamaged,itshallbeconclusivelydeemedtohaveoccurredwhilstatseaandtheCarrier’sliability,ifany,shallbedeterminedinaccordancewiththeprovisionsofClause6hereof.

GENERALPROVISIONS(APPLICABLETOBOTHPORT-TO-PORTANDCOMBINEDTRANSPORTSHIPMENTS)

C.

TheCarrierdoesnotundertakethattheGoodsorContainersorotherpackagesshallarriveatthePortofDischargeorPlaceofDeliveryatanyparticulartimeortomeetanyparticularmarketoruse,andtheCarriershallinnocircumstancesbeliableforanydirect,indirectorconsequentiallossordamagecausedbydelayoranyothercause.

ThetermsofthisBillofLadingshallgovernallresponsibilitiesoftheCarrierinconnectionwithorarisingoutofthesupplyofaContainertotheMerchantwhetherbeforeoraftertheGoodsarereceivedbytheCarrierfortransportationordeliveredtotheMerchant.

)WhenaContainerissuppliedbytheMerchant,theMerchantentersintothisBillofLadingcontractforitselfandasagentoftheownerorlessee(ifotherthantheMerchant)oftheContainer,andtheownerorlessee,asthecasemaybe,isboundbythe

iii)

TermsandConditionsofthisBillofLadingasaresult.

Therights,defences,immunities,exemptions,limitationsofandexonerationsfromliability,libertiesandbenefitsshallapplyinanyactionorproceedingwhatsoeverbroughtagainsttheCarrierand/oranyPersonencompassedinClause4ii)hereof,whetherincontract,tort,equityorothertheoryofrecovery.

6.PARAMOUNTCLAUSE6.

FromloadingoftheGoodsontotheVesseluntildischargeoftheGoodsfromtheVessel,theCarrier,sresponsibilityshallbesubjecttotheprovisionsofanylegislationcompulsorilyapplicabletothisBillofLading:

i)

a)whichgiveseffecttotheHagueRulescontainedintheInternationalConventionfortheUnificationofCertainRulesRelatingtoBillsofLading,datedatBrussels,August25,1924,(“theHagueRules”)includingadaptationsthereof,suchastheCarriageofGoodsbySeaActoftheUnitedStates,1936("USCOGSA"),theprovisionsofwhichshallapplyonallshipmentstoorfromtheUnitedStateswhethercompulsorilyapplicableornot,or

a)

b)whichgiveseffecttosaidRulesasamendedbytheProtocolstoAmendtheInternationalConventionfortheUnificationofCertainRulesofLawRelatingtoBillsofLading,datedatBrussels,February23,1968(the“Hague-VisbyRules”)andDecember21,1979(the“SDRProtocol"),butwheretheHague-VisbyRulesorSDRProtocolarenotcompulsorilyapplicable,theyshallnotbegiveneffect.WheretheHagueRules,adaptationsthereofortheHague-VisbyRulesandSDRProtocolarenotcompulsorilyapplicable,exceptastoshipmentstoorfromtheUnitedStates,asprovidedinClause6i)a),thisBillofLadingshallbegovernedbytheHagueRules,exceptthatthelimitationshallbeUS$500perpackageorpershippingunitasstatedinClause7,andwithoutprejudicetotheCarrier'srighttorelyupontheTermsandConditionsofthisBillofLading,notwithstandingthefactthattheymayconferwiderormorebeneficialrights,defences,immunities,exemptions,limitations,exonerations,libertiesorbenefitsupontheCarrierandthird-partybeneficiariesthanthoseaffordedbytheaforesaidconventionsorlegislation.

ii)TheapplicableconventionsorlegislationshallapplytotheCarriagebyinlandwaterwaysandreferencetoCarriagebyseainsuchconventionsorlegislationshallbedeemedtoincludeinlandwaterways.

iii)TheCarrier,notwithstandingwhichconventionorlegislationisapplicable,shallbeentitledtothebenefitofSections4281through4287oftheRevisedStatutesoftheUnitedStatesandamendmentsthereto,asifthesamewereexpresslysetoutherein,includingbutnotlimitedtotheFireStatute.

PriortoloadingontotheVesselandafterdischargefromtheVesselorifthestageofCarriageduringwhichthelossordamagetoGoodsoccurredcannotbeproved,theCarrier’sliabilityshallbegovernedundertheHagueRules,exceptthatthelimitationshallbeUS$500perpackageorpershippingunitasstatedinClause7,andforthispurposetheHagueRulesshallbeextendedtotheperiodsbeforeloadingandsubsequenttodischargeandtotheentireperiodoftheCarrier,sresponsibility.

NotwithstandingClause6iv),iftheprovisionsofanycontractbetweenCarrierandanycontractorortheprovisionsofanyinternationalconventionornationallawapplicabletoanysuchmodeofCarriageemployedatthetimeofsuchloss,damage,misdelivery,conversionordelaywouldresultinliabilitytothemodalcarrier,andsuchliabilityislessthanCarrier,sliabilitydeterminedinClause6iv),thenCarrier,sliabilityshallnotexceedsuchlesseramount

ItisherebyagreedbytheMerchantthattheCarrierqualifiesandshallberegardedasaPersonentitledtolimitliabilityundertherelevantConventionontheLimitationofLiabilityforMaritimeClaimsorsimilarlegislation;excepttotheextentthatmandatorylawofthecountryappliesintheappropriatejurisdiction(inwhichcasesuchlawshallapply),thesizeofthefundtowhichtheCarriermaylimitliabilityshallbecalculatedbymultiplyingthelimitationfundofthecarryingVesselattherelevanttimebythenumberofTwentyFootEquivalentUnits(“TEUs”)aboardatthattimeforwhichtheCarrieristhecontractingCarrieranddividingthattotalbythetotalnumberofTEUsaboardatthattime.

Nothinghereincontained,expressed,impliedorincorporatedbyreference,shallbedeemedtowaiveoroperatetodeprivetheCarrieroforlessenanyofitsrights,defences,immunities,exemptions,limitations,exonerations,libertiesorbenefitsaffordedbyapplicablelegislationorbytheTermsandConditionshereof.

7.PACKAGELIMITATION7.

ForshipmentstoandfromtheUnitedStates,neithertheCarriernortheVesselshallinanyeventbecomeliableforanylossofordamagetoorinconnectionwiththeCarriageofGoodsinanamountexceedingUS$500

(whichisthepackageorshippingunitlimitationunderU.S.COGSA)perpackageorinthecaseofGoodsnotshippedinpackagespercustomaryfreightunit.

InallothertradestheCarriersmaximumliabilityshallbeasprovidedinclause7i)savethatthewords100lawfulmoneyoftheUnitedKingdom”shallsubstitutetheword"US$500"whereverappearingtherein.

NotwithstandingClause7i)andii),wherethenatureandvalueofGoodshavebeendeclaredbytheShipperinwritingtotheCarrierbeforeshipmentandinsertedinthisBillofLadingandtheShipperhaspaidadditionalFreightonsuchdeclaredvalues,theCarriersliabilityifany,shallnotexceedthedeclaredvalueandanypartiallossordamageshallbeadjustedpro-rataonthebasisofsuchdeclaredvalue.

)ShippingunitinthisClause7includescustomaryfreightunitandtheterm“unit”asusedintheHagueRulesandHagueVisbyRules.

Thisclauseappliesinadditiontoandshallnotbeconstruedasderogatingfromanydefenceorexclusion,restrictionorlimitationofliabilityavailabletotheCarrierunderthetermsofthisBillofLadingorotherwise.

8.NOTICEOFLOSS,TIMEBAR

TheCarriershallbedeemedprimafacietohavedeliveredtheGoodsasdescribedintheBillofLadingunlessnoticeoflossordamagetotheGoods,indicatingthegeneralnatureofsuchlossordamage,shallhavebeengiveninwritingtotheCarrieratthetimeofremovaloftheGoodsintothecustodyofthePersonentitledtodeliverythereofunderthisBillofLadingor,ifthelossordamageisnotapparent,withinthreeconsecutivedaysthereafter.

TheCarriershallinanyeventbedischargedfromallliabilitywhatsoeverinrespectoftheGoods,unlesssuitisbroughtintheproperforumandwrittennoticethereofreceivedbytheCarrierwithinninemonthsafterdeliveryoftheGoodsorthedatewhentheGoodsshouldhavebeendelivered.Intheeventthatsuchtimeperiodshallbefoundtobecontrarytoanylawcompulsorilyapplicable,theperiodprescribedbysuchlawshallthenapplybutinthatcircumstanceonly.

SHIPPER-PACKEDCONTAINERS

IfaContainerhasnotbeenfilled,packed,stuffedorloadedbytheCarrier,theCarriershallnotbeliableforlossofordamagetotheGoodsandtheMerchantshallindemnifytheCarrieragainstanyloss,damage,liabilityorexpenseincurredbytheCarrier,ifsuchloss,damage,liabilityorexpensehasbeencausedby:

i)

themannerinwhichtheContainerhasbeenfilled,packed,stuffedorloaded;or

a)

theunsuitabilityoftheGoodsforCarriageinContainer;or

b)

theunsuitabilityordefectiveconditionoftheContainerarisingwithoutanywantofduediligenceonthepartoftheCarriertomaketheContainerreasonablyfitforthepurposeforwhichitisintended;or

c)

theunsuitabilityordefectiveconditionoftheContainersuppliedbytheShipper.

d)

TheShippershallinspectContainersbeforestuffingthemanditsuseoftheContainersshallbeprimafacieevidenceoftheirbeingsuitableandnotinadefectivecondition.

CARRIER’SCONTAINERS

10.

EachMerchantshallassumefullresponsibilityandindemnifytheCarrierforanylossofordamagehowsoevercausedtoanyContainerorotherequipmentfurnishedbyoronbehalfoftheCarrierwhichoccurswhilesuchContainerorequipmentisinthepossessionofanyMerchantoranyservantoragentoforcontractorengagedbyoronbehalfofanyMerchant.

i)

TheCarriershallnotinanyeventbeliableforandeachMerchantshallbeseverallyliabletoindemnifyandholdtheCarrierharmlessfromandagainstanylossofordamagetopropertyofotherPersonsorinjuriestootherPersonscausedbyContainer(s)furnishedbyoronbehalfoftheCarrierorcontentsthereofwhileintheuseorpossessionofanyMerchantoranyservantoragentoforcontractorengagedbyoronbehalfofanyMerchant.

INSPECTIONOFGOODS

TheCarriershallbeentitled,butundernoobligation,toopenanypackageorContaineratanytimeandtoinspectthecontents.

Ifbyorderoftheauthoritiesatanyplace,aContainerhastobeopenedfortheGoodstobeinspected,theCarrierwillnotbeliableforanylossordamageincurredasaresultofanyopening,unpacking,inspectionorrepacking.TheCarriershallbeentitledtorecoverthecostofsuchopening,unpacking,inspectionandrepackingfromtheMerchant.

ii)

DESCRIPTIONOFGOODS

NorepresentationismadebytheCarrierastotheweight,contents,measure,quantity,quality,description,condition,marks,numbersorvalueoftheGoods,andtheCarriershallbeundernoresponsibilitywhatsoeverinrespectofsuchdescriptionorparticularsfurnishedormadebyoronbehalfoftheShipper.

IfanyparticularsofanyLetterofCreditand/orImportLicenceand/orSaleContractand/orInvoiceorOrdernumberand/ordetailsoranycontracttowhichtheCarrierisnotapartyareshownonthefaceofthisBillofLading,suchparticularsareincludedsolelyattherequestoftheMerchantforitsconvenience.TheMerchantagreesthattheinclusionofsuchparticularsshallnotberegardedasadeclarationofvalueandinnowayaffectstheCarrier’sliabilityunderthisBillofLading.TheMerchantfurtheragreestoindemnifytheCarrieragainstallconsequencesofincludingsuchparticularsinthisBillofLading.

TheMerchantacknowledgesthat,exceptwhentheprovisionsofClause7iii)apply,thevalueoftheGoodsisunknowntotheCarrier.

SHIPPER’S/MERCHANT’SRESPONSIBILITY

13.

TheShipperwarrantstotheCarrierthattheparticularsrelatingtotheGoodsassetoutoverleafhavebeencheckedbytheShipperonreceiptofthisBillofLadingandthatsuchparticularsandanyotherparticularsfurnishedbyoronbehalfoftheShipperarecorrect.

i)

TheMerchantshallindemnifytheCarrieragainstallloss,damage,liabilityandexpensesarisingorresultingfrominaccuraciesinorinadequacyofsuchparticulars.

ii)

TheMerchantshallcomplywithallregulationsorrequirementsofcustoms,portandotherauthorities,andshallbearandpayallduties,taxes,fines,imposts,expensesorlosses(including,withoutprejudicetothegeneralityoftheforegoing,thefullreturnFreightfortheGoodsifreturned,orifon-carried,thefullFreightfromthePortofDischargeorthePlaceofDeliverynominatedhereintotheamendedPortofDischargeortheamendedPlaceofDelivery)incurredorsufferedbyreasonofanyfailuretosocomplyorbyreasonofanyillegal,incorrectorinsufficientmarking,numberingoraddressingoftheGoods,andshallindemnifytheCarrierinrespectofanysuchfailuretocomplyorbyreasonofanysuchmarking,numberingoraddressingoftheGoods.

iii)

FREIGHT,INCLUDINGCHARGES14.

FreightincludingchargesshallbedeemedfullyearnedonreceiptoftheGoodsbytheCarrierandshallbepaidandnon-returnableinanyevent.

i)

TheFreighthasbeencalculatedonthebasisofparticularsfurnishedbyoronbehalfoftheShipper.TheCarriermayatanytimeopenanyContainerorotherpackageorunitinordertoreweigh,remeasureorrevaluethecontentsandiftheparticularsfurnishedbyoronbehalfoftheShipperareincorrect,itisagreedthatasumequaltoeitherfivetimesthedifferencebetweenthecorrectFreightandtheFreightchargedortodoublethecorrectFreightlesstheFreightcharged,whicheversumisthesmaller,andtheexpensesincurredindeterminingthecorrectparticulars,shallbepayableasliquidateddamagestotheCarrier.

ii)

FullFreighthereundershallbedueandpayableattheplacewherethisBillofLadingisissued,bytheMerchantwithoutdeductiononreceiptoftheGoodsorpartthereofbytheCarrierforshipment.AllchargesduehereundertogetherwithFreight(ifnotpaidatthePortofLoadingasaforesaid)shallbeduefromandpayableondemandbytheMerchant(whoshallbejointlyandseverallyliabletotheCarriertherefore)atsuchportorplaceastheCarriermayrequire,Vesselorcargolostornotlostfromanycausewhatsoever.

iii)

AllotherchargesshallbepaidtotheCarrierbeforedeliveryoftheGoodsinfullwithoutoffset,counterclaimordeduction,inthecurrencyspecifiedintheCarrier’sApplicableTariff,or,ifnocurrencyissospecified,inthelawfulcurrencyoftheUnitedStates.

TheMerchantshallremainresponsibleforallFreightregardlesswhethertheBillofLadingbemarked,inwordsorsymbols,“Prepaid”,“TobePrepaid”or“Collect”.

TheCarriershallhavealienonallGoods,ContainersandanydocumentsrelatingtheretoforallsumsdueunderthiscontractoranyothercontractofundertakingtowhichtheMerchantwaspartyorotherwiseinvolved,whichlienshallalsoextendtogeneralaveragecontributions,salvageandthecostofrecoveringsuchsums,inclusiveofattorneyfees,andshallsurvivedelivery.SuchlienmaybeenforcedbytheCarrierbypublicauctionorprivatetreaty,withoutnoticetotheMerchant.

OPTIONALSTOWAGEANDDECKCARGO

16.

BytenderingGoodsforCarriagewithoutanywrittenrequestforCarriageinaspecializedContainer,orforCarriageotherwisethaninaContainer,theMerchantacceptsthattheCarriagemayproperlybeundertakeninageneralpurposeContainerorsimilararticleoftransportusedtoconsolidateGoods.

i)

GoodsmaybestowedbytheCarrierinContainers,andContainerswhetherstowedbytheCarrierorreceivedfullystowed,maybecarriedonorunderdeckwithoutnoticeunlessonthefacehereofitisspecificallystipulatedthattheContainersorGoodswillbecarriedunderdeck.TheMerchantexpresslyagreesthatcargostowedinContainersandcarriedondeckisconsideredforalllegalpurposestobecargostowedunderdeck.GoodsstowedinContainersondeckshallbesubjecttothelegislationreferredtoinClause6hereofandwillcontributetoGeneralAverageandreceivecompensationinGeneralAverage,asthecasemaybe.

ii)

Goods(notbeingGoodsstowedinContainersotherthanflats,pallets,orsimilarunits)whicharestatedhereintobecarriedondeckandwhicharesocarried,arecarriedwithoutresponsibilityonthepartoftheCarrierforlossordamageofwhatsoevernaturearisingduringCarriagebyseawhethercausedbyunseaworthinessornegligenceoranyothercausewhatsoever.

METHODSANDROUTESOFTRANSPORTATION17.

.TheCarriermayatanytimeandwithoutnoticetotheMerchant:

i).

useanymeansoftransportorstoragewhatsoever.;

transfertheGoodsfromoneconveyancetoanother;

transhiptheGoods;

undertaketheCarriageoftheGoodsonaVesselorVesselsinadditiontoand/orotherthanthatnamedonthefacehereof;

unpackandremoveGoodswhichhavebeenpackedintoContainerandforwardthesameinaContainerorotherwise;

proceedbyanyrouteinitsdiscretion(whetherornotthenearestormostdirectorcustomaryoradvertisedroute),atanyspeed,andproceedtoorstayatanyplaceorportwhatsoeveronceormoreoftenandinanyorder;

loadorunloadtheGoodsatanyplaceorport(whetherornotsuchportisnamedoverleafasthePortofLoadingorPortofDischarge)andstoretheGoodsatanysuchplaceorport;

g)

complywithanyordersorrecommendationsgivenbyanygovernmentorauthority,oranyPersonorbodyactingorpurportingtoactasoronbehalfofsuchgovernmentorauthority,orhavingunderthetermsoftheinsuranceontheconveyanceemployedbytheCarriertherighttogiveordersordirections;

h)

permittheVesseltoproceedwithorwithoutpilots,totoworbe

towed,ortobedry-docked;

i)

ThelibertiessetoutinClause17i)maybeinvokedbytheCarrierforanypurposewhatsoever,whetherornotconnectedwiththeCarriageoftheGoods,includingloadingorunloadingotherGoods,bunkering,undergoingrepairs,adjustinginstruments,pickinguporlandingPersonsinvolvedwiththeoperationormaintenanceoftheVesselinallsituations.AnythingdoneinaccordancewithClause17i)oranydelayarisingtherefromshallbedeemedtobewithinthecontractualCarriageandshallnotbeadeviation.

i)IfatanytimetheCarriageisorislikelytobeaffectedbyanyhindrance,risk,delay,difficultyordisadvantageofanykind(includingbytheconditionoftheGoods)whensoeverandhowsoeverarisingwhetherornotpriortothecommencementoftheCarriageorthemakingofthecontractofCarriage,theCarriermaywithoutnoticetotheMerchant:

abandontheCarriageoftheGoodsoranypartofthemandwherereasonablypossibleplacetheGoodsoranypartofthemattheMerchant’sdisposalatanyplacewhichtheCarriermaydeemsafeandconvenient,whereupontheresponsibilityoftheCarrierinrespectofsuchGoodsshallcease;or

a)

suspendCarriageoftheGoodsoranypartofthemandstorethemashoreorafloatuponthetermsoftheBillofLadingandusereasonableendeavourstoforwardtheGoodsassoonaspossibleafterthecauseofthehindrance,risk,delay,difficultyordisadvantagehasbeenremoved,buttheCarriermakesnorepresentationsastothemaximumperiodbetweensuchremovalandtheforwardingoftheGoodstothePortofDischargeorPlaceofDelivery,whicheverisapplicable,namedinthisBillofLading.
