出租方(以下简称甲方)与承租方(以下简称乙方)于年月日,双方全都就以下各项条款达成协议。(本合同以中文为准)

Anagreementmadeonthedateofbetweenthelandlord(hereinafterreferredtoasPartyA)andthetenantasPartyB)isherebymutuallyagreedbyandbetweenthesaidpartiestobeasfollows:

一、租赁标的:

Tenancy:

甲方同意将室及其家具电器设备在良好状态下租给乙方,租用分户面积总计约平方米。家具与电器设备清单见附件。

PartyAherebyagreestoandthefurnitureandelectricalappliancesthereinincleanandtenantableconditiontoPartyB,thesizeoftheleasedpropertybeingPleaseseeappendixforthelistoffurnitureandelectricalappliances.

二、租期:

TermofTenancy:

2.1租赁期为年,自年月日起至年月日止。

Theabovepropertyisherebyleasedforatermofyear,commencingonandexpiringon

2.2租赁届满,甲方有权收回全部出租房屋及家俱、电器,乙方应如期交还(正常损耗及房屋构造上的潜在缺陷除外;返还的租赁房屋应当符合租赁房屋性质使用后的状态),乙方如要求续租,在同等条件下享有优先续租权,须在本租约期满前一个月向甲方提出书面申请,租金和租期双方另行协商。

Onexpiryofthislease,PartyAhastherighttotakebacktheleasedpropertywithfurnitureandelectricalappliancesinfull,andPartyBmustdelivertheleasedpropertyonthedateofexpiry(fairwearandtear,structuralandinherentdefeatsexcepted).Aftertheleasingterm,theapartmenthastomaintainthereasonablecondition.IfPartyBwishestoextendthelease,PartyBshallhavetheprioritytorenewtheleasewiththesameconditionandisrequiredtogivewrittennoticetoPartyAOnemonthpriortheexpiryofthislease,therevisedrentalrateandperiodshouldbenegotiatedbetweenthetwoparties

三、租金:

Rent:

3.1,取暖,家具,电器(另见附件1)(家具及电器预算人民币元整).

3.2租金支付方式为年付(十二个月)一次性支付,共计人民币

foroneyearrental。

3.3租金以人民币支付。乙方在收到甲方的付款通知后须尽快付款,甲方收到租金后付给乙方全额收据。

3.4在本租约有效期内,租金不予调整。

四、押金:

Deposit:

4.1本租约签订之日,乙方应向甲方缴付壹个月租金额的租赁押金计人民币。租约期满,乙方如不再续租,甲方应在租赁期完毕后十日内(在乙方将租赁期间发生的全部水,电,煤气等杂费付清后),将押金退还(不计利息)

ThedayafterthesignatureofthisTenancyAgreement,PartyBmustpaytoPartyAonemonthsrentalasdeposit,totalingOncompletionofthetenancyperiod.ifPartyBdoesnotcontinuetorenttheleasedproperty,PartyAmustreturnthedepositinfulltoPartyB(excludinginterest)withintendaysaftertheterminationorearlyoftheLeaseAgreementundertheconditionthatPartyBhaspaidalltheutilitiesfeesuchaswater,electricity,gasandtelephone.

4.2乙方如违反租约规定,致使甲方未能如期收取租金或因而发生费用开支,甲方可以依据凭证拘留全部或局部押金抵付。缺乏局部甲方有权要求乙方赔偿。

IfPartyBbreaksanypartofthiscontract,suchasnotpayingtherentpunctually,orcausingadditionalexpensestoPartyA,PartyAhastherighttoretainpartoforallofthedepositascompensationaccordingtoitsactuallosses.IfthesaiddepositisinsufficienttocoverPartyA’scosts,PartyAhastherighttoaskforcompensationifany.

4.3发生4.2条款状况,押金缺乏抵付时,乙方必需按接到甲方付款通知后十日内补足。

IfClause4.2isbroughtintoeffect,andthesaiddepositisinsufficienttocoverPartyA’scosts,PartyBshouldpaytheextraamounttoPartyAwithintendaysofreceiptofPartyA’sinvoicenotice.

4.4押金以人民币支付。甲方收到押金后付给乙方全额收据。

五、其它费用:

5.1乙方在租赁期内所用的水、电、煤气,电话等费用由乙方缴付。

PartyB’sutilitiesexpensesduringtheleasetermwillbepaidbyPartyB.

六、甲方的责任:

Landlord’sResponsibilities:

6.1租赁期内甲方不得无故收回房屋,如甲方中途要求收回房屋,乙方可以拒绝。

PartyAisnotpermittedtotakebacktheleasedpropertyduringthetermofthecontractwithoutanyreason.IfPartyAwishestodoso,PartyBhastherighttoobject.

6.2负责对乙方正常使用中发生的房内家具、电器及其他设施损坏或故障进展准时修理并担当费用。

Toundertakeresponsibilityandassumesuchcostsfortimelyrepairstofurniture,electricalappliancesandotherfacilitiesthataredamagedorhavemalfunctionedthroughnormalusagebyPartyB.

6.3催促物业公司供应充分的保安、消防工作及宁静清洁的居住环境。Tosupervisetheestatemanagementofficetoprovideadequatesecurity,firepreventionandquirtcircumstance.

6.4催促治理公司向乙方供应所应供应的效劳,如冷水、热水、电的供给及各种设备(包括空调)的正常工作,并供应公共区域和公共设施的开放,如健身房、儿童房和其他消遣场所。催促公共区域和公共设施的清洁;公共区域的照明并供应道路指示牌。催促道路和公共区域的维护;催促修理、保养和更换大厦的保安设施、消防设施、电器设施、变压器、煤气、排水、空调、电梯和其它设施。

ToensuretheestatemanagertoprovideproperservicetoPartyB,suchassupplyofcoldwater,hotwater,electricity,propermaintenanceofallkindsofequipment(includingair-conditioners),andtoprovidefreeaccesstopublicareasandfacilitiessuchasgymnasium,children’sroomandotherrecreationalareas.Tocleanpublicareasandfacilities;toilluminatepublicareasandprovidesigns;torepairaccesswaysandpublicareas;torepair,maintain,andreplacesecurity,firefightingandelectricalappliances,transformer,gas,sewage,airconditioningsystems,elevators,liftsandotherfacilitiesofthebuilding.

6.5保证物业的合法性,保证有合法权利出租该物业。

Ensurethelegalityoftheleasedproperty.Ensureitslegalrightstoleasetheproperty.

6.6负责因违反上述责任而对乙方造成的全部损失的赔偿。

TocompensatePartyBforalllossarisingfromanybreachoftheabove-mentionedresponsibilities.

6.7负责开通电话及宽带,负责乙方入住前清洁室内卫生.

七、乙方责任:

Tenant’sResponsibilities:

7.1乙方应按本租约三、四、五条款规定交付租金,押金和各项费用,如有拖欠,则作违约论。

PartyBshouldpromptlypaytherent,depositandotherchargesassetoutinClauses3,4and5oftheAgreement.Non-paymentofthesechargesconstitutesabreachofthisAgreement.

7.2租赁期内未经甲方同意,乙方不能转租其所租房屋,私自转让无效。DuringtheperiodofTenancy,unlesswiththeagreementofPartyA,PartyBcannotsub-letorletinpartorinfulltheleasedpropertytootherParty.

7.3乙方应爱惜房屋及其设备,如因使用不当导致损坏应负责赔偿。

PartyBmusttakecareofthepropertyanditscontents,otherwisePartyBshouldpaycompensationtoPartyAforhisimproperuseoftheproperty.

7.4在房内已有的装饰和设施之外,乙方如要增加设备或其他装修须征得甲方同意;租赁期满必需恢复原状如有损坏(正常使用磨损、构造或原有的问题除外),并担当其费用,经甲方验收认可后归还甲方。

Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsordecoratetheproperty,PartyBshouldgetthepermissionfromPartyA.Oncompletionofthetenancy,PartyBmusthand-overthepropertytoPartyAinitsoriginalcondition(fairwearandtear,structuralandinherentdefectsexpected),andallfeesarisingfromsuchworkhavetobebornebyPartyB.

7.5保证赔偿由于乙方或乙方有关系的官员、上司、雇员、客人、来访者、雇佣工人、代理、执照持有者或被邀请人等(统称与乙方相关的人)的马虎及疏忽造成的房屋的损害或损失,并允许甲方或其代理人在事先通知后进入房屋,对房屋的损失或损害进展弥补及修复,在此所发生的费用由乙方负担。

ToindemnifyPartyAforanylossordamagetotheleasedpropertyfromnegligentactoromissionofPartyBoranyofficer,director,employee,guest,visitor,servant,agentlicenseeorininviteeofPartyB(eachreferredtohereinafterindividuallyasan“associate”),topermitPartyAorhisauthorizedrepresentatives,withanadvancenotice,toentertheleasedpropertytorepairanysuchlossordamageattheexpenseofPartyB.

7.6在甲方预先通知后,乙方应允许甲方或其代理人在有理由的状况下在合理的时间进入及巡察房屋进展必要的修理或修复工作;在租赁期最终一个月内,允许甲方或其代理人带着有意租赁或购置房屋的客人视察房屋,但乙方已按第2.2条书面通知甲方将续租时除外。

WithPartyA’snoticeinadvance,PartyBshouldpermitPartyAandthepersonauthorizedbyPartyAunderreasonablecircumstancestoenterandviewtheleasedpropertyatreasonablehours,tocarryoutanyworkandrepairswhichisnecessarytobedone.DuringthelastonemonthsoftheTenancy,PartyAhastherighttoshowtheleasedpropertytoprospectivelessorsorpurchasers,unlessaccordingtoclause2.2,PartyBhasinformedPartyAofitsintentiontorenewtheLease.

7.7在未经甲方书面同意下,乙方不得擅自设立、安装或移动设施及设备,不能擅自设立隔段,不得擅自对房屋的构造机关改动或增加。

Nottoerect,installorremoveanyfixturesorpartitioning,ortomakeanystructuraladditionsandalterationswithoutthepriorwrittenconsentofPartyA.

7.8租赁房屋过程中,必需严格遵守中华人民共和国的有关法律、细则、规章及法令的规定,并严格制止乙方利用房屋进展违犯法律及不道德的行为。

Strictlytocomplyandadhereintheuseoftheleasedpropertywithalllaws,regulationsanddecreesofthePeople’sRepublicofChinaapplicabletosuchuse,andspecificallynottopermitorsuffertheleasedpropertytobeusedforanypurposethatisunlawfulorimmoral.

7.9房屋除供乙方居住之外,未经甲方书面同意,房屋不行作办公或协议未曾说明之用。上述同意不应不合理地拒绝。

TousetheleasedpropertyexclusivelyastheresidenceofhisfamilyandnottousetheleasedpropertyasanofficeorforanyotherpurposewithoutthepriorwrittenconsentorPartyA,whichconsentshallnotbeueasonablywithheld.

7.10未经甲方书面同意,屋外不得擅自放置标示板及陈设任何设施,不允许在房外、窗及门上挂晒衣物以影响房屋外观面貌,该条件不得被不合理拒绝。

NottoaffixordisplayanysignboardorotherdevicevisiblefromoutsidetheleasedpropertywithoutthepriorwrittenconsentofPartyA,whichconsentshallnotbeueasonablywithheld,andnottousetheoutsideoftheleasedpropertyoranydoorsorwindowstohanganywashing.

7.11租客必需遵守物业条例准则,如消失纠纷需与业主来协商调解。

Toobeytheregulationissetbythemanagementoffice,incaseanydisputearises,thetwopartiesshallnegotiatefriendly.

八、房屋不能居住时其他大事:

Otherthings:

房屋由于火灾,恶劣天气,战斗或其它甲方不行抗拒因素,而不是由于乙方直接或间接的疏忽及有意行为造成房屋毁坏而不能被正常使用及居住时,乙方从该日起停顿支付租金,直至房屋可再被使用及居住时为止,如该房屋因任何不能归因于乙方的缘由不能正常使用超过10天,乙方有权终止合同并无需担当任何责任,甲方应退还剩余局部押金及预付租金。甲方依据自己的意愿及经济、实际意义等缘由,没有义务必需修缮复原房屋。若此状况发生,甲方应书面通知乙方,并在作出上述通知的十天之内将押金及预付租金全部退还乙方。

Iftheleasedpropertyaresubstantiallydestroyedordamagedbyfire,badweather,war,forcemajor,orothercausesbeyondthecontrolofPartyAandnotattributabledirectlyorindirectlytothenegligenceormaliceofPartyBorareotherwiserenderedunfitforuseoroccupation,therentshallceasetobepayablefromthedatetheleasedpropertybecomeunfitforuseoroccupationuntiltheleasedpropertyshallagainberenderedaccessibleandfitforuse,ifthelessor’spropertycannotbeproperlyusedforanyreasonsbeyond10days,PartyBhastherighttoterminatetheagreementwithoutany.

2.1租金每月为元整,形式支付

2.2租金包括家具和电器的配置(详见附件),供暖费,物业治理费、水费,电费,+煤气费、健身卡、卫星收视费。TheRentincludestheFurniture、theElectricalAppliances(seeAppendixA),HeatingFee,Managementfee,waterfee,electricityfee,gasfee,Fitnesscard,SatelliteTVservicefee.

2.3租金应在入住前及此后每月的号前支付。甲方应在收到租金后向乙方开具正式发票。甲方应每月提前向乙方发出支付租金的书面通知。

2.4租金以人民币支票或转账形式支付.

2.5在本租约有效期内,租金不予调整。

3押金Deposit:

3.1乙方须支付相当于两个月房租的押金(即RMB),以人民币支票或转帐形式支付)。甲方应在收到押金后向乙方开具统一收据。

Adepositoftwo(2)months’equivalentrental(RMB)shallbepaidbyPARTYBinRMBbycheckorbybanktransfer.PARTYAshallissuetoPARTYBofficialreceiptuponreceivingthedeposit.

3.2押金在合同终止后10天内由甲方以一样币种全额退还给乙方(不计利息)。假如延期返还,则每延期一日,按每日万分之四支付给乙方利息。

Thedepositshallberefundableinfullamountin10daysafterthecontractexpiration,insamecurrencyandexcludinginterestthereupon.IncasePARTYAdelaystherefundofthedeposit,PARTYAshallpayinteresttoPARTYBattherateof0.04%perdayofdelay.

3.3甲方应按时付清各种帐单。若以上出租房屋及其家具、设备等因乙方缘由消失遗失或非正常的损坏,乙方应负责赔偿。

PARTYAshallpayoffontimeallthebillsdue.Incasethereisanylossorunusualdamagetothefurnishings,contentsortherentalpremisesduetoPARTYB’sreason,PARTYBshallcompensateforit.

4租期

Leaseterm:

乙方租用出租房屋期限为1年,即自年月日至年月日。

5出租人的责任

PARTYA’sobligation:

5.13甲方声明及保证甲方为该出租房屋的合法拥有人,有合法地位出租此房屋,并就出租事宜已取得有关方面的批准。

PARTYAassurestobethelegalowneroftheleasedpremises,tohavethenecessarylegalcapacitytoleaseit,andPARTYA’actionhasbeenratifiedbytheauthoritiesconcerned.

5.2租赁期内,若甲方出售该出租房屋导致该出租房屋全部权发生转移,甲方须保证本合同能连续执行。

IncasePARTYAsellsthepremisesduringtheleasewhichleadstothepremisesownershipbetransferred,PARTYAshallensurethatthesaidcontractwillbeimplementedcontinuously.

5.3甲方须按时将清洁状况良好的出租房屋交付乙方使用,保证在租赁期内出租房屋内的各项设施能正常使用。

PARTYAshallhandoverthesaidpremisestoPARTYBontimeandassurethesaidpremiseswillbecleanedandingoodstatusduringtheleaseterm.

5.4甲方有义务负责出租房屋及设施的正常维护和保养,如房屋或设施非因甲方缘由消失故障,甲方应在收到乙方通知后二十四(24)小时内自行或通过其他方式解决故障,否则,乙方有权雇佣第三方进展修理,由甲方担当全部费用并担当相关责任。由于不行抗力(如地震、台风、洪水、非人为的火灾等)、自然损耗或乙方以外的缘由造成的损坏,亦由甲方担当有关费用。

PARTYAshallbeartheresponsibilityofthesaidpremises’normalrepairsandmaintenance,andpaythecostrelated.IncasethepremisesorfacilitiesareinbadconditionsnotduetothereasonofPARTYB,PARTYAshallcompletetherepairworkwithin24hoursuponreceiptofthenoticefromPARTYB.Otherwise,PARTYBshallhavetherighttohireanythirdpartiesfortherepairworkatthecostofPARTYA.Thecostofrepairstothesaidpremises,ifdamagedbyForceMajeure(suchasearthquake,typhoon,floodnon-manmadefire,etc)reasonablewearandtearorbyaccidentsbeyondPARTYB’Scontrol,shouldalsobebornebyPARTYA.

5.5租赁期内,在乙方遵守合同及支付租金的前提下,未经乙方允许,甲方不得进入该出租房屋。

Duringthelease,PARTYAshallnotgetinthesaidpremiseswithoutPARTYB’SpermissionifPARTYBhasbeencarryingoutthecontractnormally.

5.6甲方应催促治理公司向乙方供应足够的效劳,如冷水、热水、煤气,电的供给及各种设备的正常工作。

PartyAshalldirectPropertyManagementCompanytoprovidesufficientandcontinuousservicestoPartyB,includingprovisionofcoldwater,hotwater,gasandelectricityandensurepropermaintenanceofequipmenttherein.

5.7房产税及与租赁有关的全部税费由甲方担当。

PremisestaxandotherleasingrelatedtaxesshallbepaidbyPARTYA.

6承租方的责任

PARTYB’Sobligations:

6.1乙方申明及保证其在中国拥有合法居留权,并按有关规定办理必要的居住登记手续。

PARTYBassurestohavethelegalrightofresidenceinChina,andshallcompletetheresidentialformalitiescomplyingwiththelocalregulations.

6.2住客应按时支付电话费含上网费、水电煤气费。

Theoccupantshallpaythetelephonebillsandinternetfee,extrawaterelectricitygasfeeontime.

6.3乙方只能将出租房屋用做住宅,不得将之用作公司及代表处的注册地址,亦不行作为公开的办公室。

ThepremisesarelimitedforresidentialuseonlybyPARTYB,andareprohibitedfromregisteringaslegaladdressforanycompanyoragency,orusingaspublicoffice.

6.4乙方不得在出租房屋内进展违反法律及政府对出租房屋用途有关规定的行为。

PARTYBshallnotcarryinthepremisesanyunlawfulorillegalactivitieswhicharenotallowedaccordingtotheleasingregulationsfromthegovernment.

6.5租赁期内,未经甲方书面同意,乙方不得将出租房屋局部或全部转租他人。

PARTYBshallnotpartlyortotallysubletthesaidpremiseswithoutthewrittenpermissionfromPARTYA.

6.6若因乙方使用不当或不合理使用,出租房屋及其内的设施消失损坏或发生故障,乙方应准时联络治理机构或甲方进展修理,并负责有关修理费用.

ThedamageofthepremisesorthefittingsthatarewithinthecontrolofPARTYBshallbebornebyPARTYB,andPARTYBshallcontactthemanagementofficeorPARTYAinstantly.

6.7租赁期内,乙方对出租房屋进展装修或增加水、电、消防等设施,须经甲方同意并经有关部门批准,并由甲方执行监理,所需费用由乙方担当。双方解约时,乙方不能移走自行添加的构造性设施,甲方亦不必对上述添加设施进展补偿。

PARTYB,uponwrittenpermissionofPARTYA,maymakeadditionsoralterationsdealingwithwater,electricitysupplyorfireprotection,athisownexpense,subjecttonecessarypermitsorlicensesrequiredbytheauthoritiesconcernedandunderthesupervisionofPARTYA.Nostructuralalterationsoradditionscanberemovedfromthepremisesupontheexpirationofthiscontract.Noreimbursementforthesaidadditions.

6.8乙方有权在墙壁上悬挂画、图片或其他装饰性物品。合同履行期限届满或提前解约时,甲方应担当费用拔掉钉子、粉刷墙壁或使墙壁恢复原状,并承诺不以此为由拘留乙方的押金。

PARTYBisentitledtohangpictures,paintingsorotherdecorativearticlesonthewalls.Uponexpirationorearlyterminationofthecontract,PARTYAshallbearthecosttoremovethenails,repaintthewallorrestorethewalltotheoriginalstate,andPARTYAshallnotretainPARTYB’Sdepositforthereasonofdoingthingsabove.

6.9租赁合同期满的前一个月内,经合理事先书面通知,乙方应允许甲方或其授权人引领潜在客人参观在出租房屋。

Duringthelastmonthofthecontract,afterreasonablepriorwrittennoticetoPARTYB,PARTYAorhisnomineeshallbeallowedtoshowthesaidpremisestothepotentialclients.

6.10租赁期满,若甲,乙双方未达成续租协议,乙方应于租期届满时或之前迁离出租房屋并将钥匙及清理洁净的房屋归还甲方.

PARTYBshallreturnthepremisesinacleanconditiontoPARTYA(exceptwearandtear)attheexpirationofthecontractifthereisnorenewalthereupon.

7提前解约Earlytermination:

7.1六(6)个月后,乙方如要退租,应提前一(1)个月书面通知甲方终止本租约。在此状况下,甲方应在本租约终止后十(10)日内将押金全额退还乙方。

Aftersix(6)months,PartyBmay,uponone(1)monthadvancewrittennoticetoPartyA,terminatethisTenancyAgreementwithoutanyliabilities.Underthiscircumstance,PartyAshallreturnthedepositinfulltoPartyBwithinten(10)daysafterthetermination.

7.2若因自然界的不行抗力,如火灾、洪水、台风、地震、战斗等意外损害导致出租房屋无法居住,合同即自动终止,甲、乙双方互不担当责任。

Ifthesaidpremisesaresodamagedbyforcemajeure(fire,flood,typhoon,earthquake,war,andetc)thatit’snolongerhabitable,thecontractshallbeterminatedautomatically.NeitherPARTYAnorPARTYBshallbearanyresponsibilitytoeachother.

8续租

Renewal:

租赁期满,乙方有优先续租权,但须提前一个月通知甲方,并安排签订续租合同。

9争议的解决

DisputeResolution:

9.1本合同适用法律为中华人民共和国相关法律。

9.2在履行本合同过程中产生的任何争议由双方协商解决,协商不成,可向中国国际经济贸易仲裁委员会(北京)申请仲裁。

篇三:房屋租赁合同中英文版

出租方:(以下简称“甲方”)Landlord:(hereaftercalled“PartyA”)

承租方:(以下简称“乙方”)Tenant:(hereaftercalled“PartyB”)

甲、乙双方就甲方情愿出租,乙方自愿承租房屋之事宜,经双方协商全都,同意签订该房屋正式租赁协议。

ThisAgreementismadebetweenPartyAandPartyBinconnectionwithrentalofpropertywherebythefollowingisagreed:

1房屋Property

1.1租赁房屋地址:(以下简称“该房屋”)

LeasedPropertyAddress:(hereaftercalledthe“Property“)

1.2用途:该房屋只供住宅使用。Usage:Forresidentialuseonly.

1.3面积:该房屋建筑面积为平方米。Area:Grossareaissquaremeters.

2租赁期限LengthofTenancy

2.1租赁期限为壹年,自起至止。

2.2为避开歧义,双方同意,本协议下甲方向乙方交付该房屋的交房日为,起租日为,退房日为协议终止日后一天下午2:00前。

Toavoidanyambiguity,bothpartiesagreethatthehandoverdateofthePropertybyPartyAtoPartyBis,therentcommencementdatehereunderisandtheduedayforcheck-outis2:00PM,thenextdayoftheleaseexpiringday.

3租金Rental

3.1租金:租赁期租金为每月人民币元(大写:元整),其中包含括物业每月治理费人民币元(大写:)。房屋租赁税金,小区会所家庭会员卡(2成人+2小孩),有线及正版卫星安装和使用费,电话和宽带安装费。

3.2付租方法:首月租金需于双方签好合同后15个工作日内支付。首月租金计自至,金额为人民币元。甲方收到该租金后的5个工作日内供应乙方正式租赁发票。

自其次租赁月起租金按自然月结算,甲方需在前一个月的15号或之前给到乙方当月发票原件,乙方应在当月1号前支付当月租金,汇至甲方指定的银行帐号(附件三所示),支付租金日期以乙方汇出日期为准。末月租金计自至,金额为人民币元整。

RentalPayment:Therentalforthefirstmonthoftheleaseshallbepaidwithin15workingdaysafterbothPartiessigntheleasecontract.Thefirstmonth’srentalperiodisfromtoandtherentalamountisRMB.PartyAshallprovideanofficialtaxinvoicewithin5workingdaysfromthedatepaymentisreceived.

Startingfromthe2ndmonthoftheleaseterm,therentalshallbepaidonacalendarmonthlybasis.PartyAshallprovideanoriginalofficialrentalinvoicetoPartyBinadvanceonorbeforethe15thofeverymonthforthefollowingmonth’srentalandPartyBshallpayeachmonth’srentaltoPartyA’sbankaccount(seeAttachment3)beforethe1stdayofeachcalendarmonth.Thedateoftransfershallbedefinedasthedateofpayment.

Therentalforthelastmonthperiodisfromto,andtherentalamountisRMB.

3.3全部费用,包括保证金,租金等均以人民币方式支付。

AllpaymentsofSecurityDeposit,rentalandmanagementfeeandetc.hereundershallbemadeinRMB.

3.4乙方同意按上述规定每月按时支付租金给甲方,如乙方逾期支付超过5个工作日(除国定长假外),则须缴纳滞纳金给甲方,滞纳金每日按月租金百分之0.5(0.5%)计收直到所拖欠租金和滞纳金一起付清为止。乙方逾期超过30天的,仍未支付当月租金则被视为违约,则甲方有权提早终止本协议并收回该物业没收乙方保证金,乙方仍须支付迟付房租,相应滞纳金及未付的公用事业费。如由于消失不行抗力的状况包括但不限于,如遇银行方面问题或地震、风暴、洪水和火灾等自然灾难攻击,而使乙方不能准时付款,乙方不须支付其逾期付款所产生的滞纳金并不被视为违约行为。

PartyBagreestopaytherentaltoPartyAontimeaccordingtotheconditionsstatedabove.Wherefullpaymentoftherentalisdelayedformorethan5workingdays(exceptnationalholiday),PartyBagreestopaytoPartyAafinefordelayedpaymentequalto0.5percentofthemonthlyrentalperdayuntilanyoutstandingrental,includinglatefees,hasbeenpaidinfull.Shoulddelayoftheaboverentalpaymentbemorethanthirty(30)daysinarrearsandPartyBhasstillnotpaidtherental,thenPartyBshallbedeemedtohavebreachedtheAgreement.PartyAreservestherighttocancelthisAgreementearlywithoutfurtherprejudice.PartyAhastherighttokeepPartyB’sSecurityDeposit,andPartyBisstillresponsibleforpayingthelaterentalpayment,relevantlatefeesandanyoutstandingutilitiesincurredbyPartyB.Theabove-mentionedfinesshallnotbeimposedtoPartyBincasethatanydelayofpaymentisduetoreasonofForceMajeureincludingbutnotrestrictedtobankstrikes,storm,earthquake,flood,andfirethatrestrictpaymenttransfersdirectly,andinthiscasePartyBshallnotbedeemedtohavebreachedtheAgreement.

3.5月租金包括全部有关于该房屋的税金及物业治理费用,甲方应准时支付上述费用。如因甲方不支付或延期支付上述任何款项而导致乙方任何损失、责任或义务的,甲方应当向乙方担当相应的补偿责任,并使乙方免受损害。

ThemonthlyrentalincludesalltherelevanttaxesandmanagementfeesconcerningtheProperty.PartyAshallmaketimelypaymentsoftheaboveexpenses.PartyAshallcompensatePartyBforandholdPartyBharmlessfromanydamages,obligationsorliabilitiesincurredbynon-paymentorlatepaymentofanyoftheabovesaidexpensesbyPartyA.

4公用事业费FeesandUtilities

4.1租期内,房屋内全部除3.1条款及附件一中租金所包含的费用外,由乙方使用产生的公用事业费及其它使用费等均由乙方担当。

PartyBagreestomakefullpaymentofanyutilityandpersonalusagefees,exceptthefeesinclusiveintherentalinclause3.1andAttachment1,incurredbythematthePropertyduringtheleaseperiodasoutlinedinthisAgreement.

4.2乙方应准时支付由乙方产生的公用事业费及其它使用费,如因乙方不支付或延期支付上述任何款项而导致甲方任何损失、责任或义务的,乙方应当向甲方担当相应的补偿责任,使甲方免受损失。

PartyBshallmaketimelypaymentsoftheutilityandpersonalusagefees.PartyBshallcompensatePartyAforandholdPartyAharmlessfromanydamages,obligationsorliabilitiesincurredbynon-paymentorlatepaymentofanyoftheabovesaidexpensesbyPartyB.

5保证金SecurityDeposit

5.1本协议下租赁保证金为人民币(大写:元整),乙方需于双方签好合同后15个工作日内以银行转账向甲方支付该保证金。甲方收款后的10个工作日内供应乙方收据。

ItisalsoagreedthatPartyBshallpaytoPartyA,arefundablerentalSecurityDepositofRMB(inwords:).Thisamountshallbepaidviabanktransferwithin15workingdaysafterbothPartiessigntheLeaseAgreement,forwhichPartyAshallissueaseparatereceiptwithin10workingdaysafterPartyAreceivessuchrentalSecurityDepositpayment.

5.2如乙方在协议期满时不再续租,乙方同意不会使用保证金抵扣租金。

UpontheexpirationoftheAgreement,thedepositshallnotbeusedtosetofftherental.

5.3除本协议另有商定之外,甲方应于租赁期限满或提前终止本协议之日起且乙方己清空、点清、并付清全部应付费用的10个日内将剩余租赁保证金无息退还乙方。

UnlessotherwiseprovidedintheAgreement,PartyAshallreturntoPartyBtheremainingSecurityDepositwithoutinterestwithin10daysafterexpirationorsoonerterminationoftheAgreementprovidedthatPartyBhasvacatedthePropertyandsettledallrelatedcharges.

5.4如以下状况发生,甲方有权合理地从保证金中扣除以下费用,如保证金缺乏抵付时,则乙方应负担差额局部。

PartyAisentitledtowithholdreasonableamountfromthisSecurityDepositrequiredtocovercostsinthefollowingsituations.ShouldtheSecurityDepositnotbeenoughtocoverthedamageoftheProperty,PartyBshallcovertherestofthecost.

I.租期内,房屋之一切设备如有因乙方非正常使用而导致的损坏的,且该损坏的物品已于退房日经甲乙双方签字认可的但乙方未支付该修复费。甲方扣除该修复费必需合理并在抵扣后的三天内向乙方供应正规修理发票原件。
