COMPULSORYLIABILITYINSURANCE-NOFAULT39A:I-1.Definitionsa."Automobile"meansaprivatepassengerautomobileofaprivatepassengerorstationwagontypethatisownedorhiredandisneitherusedasapublicorliveryconveyanceforpassengersnorrentedtootherswithadriver;andamotorvehiclewithapickupbody,adeliverysedan,avan,orapaneltruckoracampertypevehicleusedforrecreationalpurposesownedbyanindividualorbyspouseswhoareresidentsofthesamehousehold,notcustomarilyusedintheoccupation,professionorbusinessoftheinsuredotherthanfarmingorranching.Anautomobileownedbyafarmfamilycopartnershiporcorporation,whichisprincipallygaragedonafarmorranchandotherwisemeetsthedefinitionscontainedinthissection,shallbeconsideredaprivatepassengerautomobileownedbytwoormorerelativesresidentinthesamehousehold.b."Basicautomobileinsurancepolicy"meansanautomobileinsurancepolicypursuantto39:6A-3.1.c."Economicloss"meansuncompensatedlossofincomeorproperty,orotheruncompensatedexpenses,including,butnotlimitedto,medicalexpenses.d."Essentialservices"meansthoseservicesperformednotforincomewhichareordinarilyperformedbyanindividualforthecareandmaintenanceofsuchindividual'sfamilyorfamilyhousehold.e."Healthcareprovider"or"provider"meanspersonslicensedorcertifiedtoperformhealthcaretreatmentorservicescompensableasmedicalexpensesandshallinclude:(1)ahospitalorhealthcarefacilitymaintainedbyastateoranyofitspoliticalsubdivisions,(2)ahospitalorhealthcarefacilitylicensedbytheDepartmentofHealthandSeniorServices,(3)otherhospitalsorhealthcarefacilitiesdesignatedbytheDepartmentofHealthandSeniorServicestoprovidehealthcareservices,orotherfacilities,includingfacilitiesforradiologyanddiagnostictesting,freestandingemergencyclinicsoroffices,andprivatetreatmentcenters,(4)anonprofitvoluntaryvisitingnurseorganizationprovidinghealthcareservicesotherthaninahospital,(5)hospitalsorotherhealthcarefacilitiesortreatmentcenterslocatedinotherstatesornations,(6)physicianslicensedtopracticemedicineandsurgery,(7)licensedchiropractors,(8)licenseddentists,(9)licensedoptometrists,(10)licensedpharmacists,(11)licensedpodiatrists,(12)registeredbio-analyticallaboratories,(13)licensedpsychologists,(14)licensedphysicaltherapists,(16)certifiednurse-midwives,(17)certifiednurse-practitioners/clinicalnurse-specialists,(18)licensedhealthmaintenanceorganizations,(19)licensedorthotistsandprosthetists,(20)licensedprofessionalnurses,and(21)providersofotherhealthcareservicesorsupplies,includingdurablemedicalgoods.f."Hospitalexpenses"meansthecostoftreatmentandservices,asprovidedinthepolicyapprovedbythecommissioner,byalicensedandaccreditedacutecarefacilitywhichengagesprimarilyinprovidingdiagnosis,treatmentandcareofsickandinjuredpersonsonaninpatientoroutpatientbasis;thecostofcoveredtreatmentandservicesprovidedbyanextendedcarefacilitywhichprovidesroomandboardandskillednursingcare24hoursadayandwhichisrecognizedbytheadministratorsofthefederalMedicareprogramasanextendedcarefacility;andthecostofcoveredservicesatanambulatorysurgicalfacilitysupervisedbyaphysicianlicensedinthisStateorinanotherjurisdictionandrecognizedbytheCommissionerofHealthandSeniorServices,oranyotherfacilitylicensed,certifiedorrecognizedbytheCommissionerofHealthandSeniorServicesortheCommissionerofHumanServicesoranationallyrecognizedsystemsuchastheCommissiononAccreditationofRehabilitationFacilities,orbyanotherjurisdictioninwhichitislocated.g."Income"meanssalary,wages,tips,commissions,feesandotherearningsderivedfromworkoremployment.h."Incomeproducer"meansapersonwho,atthetimeoftheaccidentcausingpersonalinjuryordeath,hadanoccupationearningorproducingincome.i."Medicalexpenses"meansreasonableandnecessaryexpensesfortreatmentorservicesasprovidedbythepolicy,includingmedical,surgical,rehabilitativeanddiagnosticservicesandhospitalexpenses,providedbyahealthcareproviderlicensedorcertifiedbytheStateorbyanotherstateornation,andreasonableandnecessaryexpensesforambulanceservicesorothertransportation,medicationandotherservicesasmaybeprovidedfor,andsubjecttosuchlimitationsasprovidedfor,inthepolicy,asapprovedbytheCommissioner."Medicalexpenses"alsoincludeanynonmedicalremedialtreatmentrenderedinaccordancewitharecognizedreligiousmethodofhealing.j."Medicallynecessary"meansthatthetreatmentisconsistentwiththesymptomsordiagnosis,andtreatmentoftheinjury:(1)isnotprimarilyfortheconvenienceoftheinjuredpersonorprovider,(2)isthemostappropriatestandardorlevelofservicewhichisinaccordancewithstandardsofgoodpracticeandstandardprofessionaltreatmentprotocols,assuchprotocolsmayberecognizedordesignatedbytheCommissionerofBankingandInsurance,inconsultationwiththeCommissionerofHealthandSeniorServicesorwithaprofessionallicensingorcertifyingboardintheDivisionofConsumerAffairsintheDepartmentofLawandPublicSafety,orbyanationallyrecognizedprofessionalorganization,and(3)doesnotinvolveunnecessarydiagnostictesting.k."Motorvehicle"meansamotorvehicleasdefinedin39:1-1,exclusiveofanautomobileasdefinedinsubsection(a).l."Namedinsured"meanstheperson(s)identifiedastheinsuredinthepolicyand,ifanindividual,theindividual’sspouse,ifthespouseisnamedasaresidentofthesamehousehold.Ifthespouseceasestobearesidentofthehouseholdofthenamedinsured,coverageshallbeextendedtothespouseforthefulltermofanypolicyperiodineffectatthetimeofthecessationofresidency.m."Noneconomicloss"meanspain,sufferingandinconvenience.n."Pedestrian"meansapersonwhoisnotoccupying,enteringinto,oralightingfromavehiclepropelledbyotherthanmuscularpoweranddesignedprimarilyforuseonhighways,railsandtracks.o."Standardautomobileinsurancepolicy"meansanautomobileinsurancepolicywithatleastthecoveragerequiredpursuantto39:6A-3and39:6A-4.Source:39:6A-2.COMMENTThissectionissubstantiallyidenticaltotheoriginal,butthedefinedtermshavebeenlistedinalphabeticalorder.39A:I-2.Compulsoryinsurancecoveragelimitsa.Exceptasprovidedby39:6A-3.1,everyownerofanautomobileregisteredorprincipallygaragedinthisStateshallmaintainautomobileliabilityinsurancecoverage,underprovisionsapprovedbytheCommissionerofBankingandInsurance,insuringagainstlossresultingfromliabilityimposedbylawforbodilyinjury,deathandpropertydamagesustainedbyanypersonarisingoutoftheownership,maintenance,operationoruseofanautomobile.Suchcoverageshallbeatleastinanamountorlimit:(1)Of$15,000,exclusiveofinterestandcosts,onaccountofinjuryto,ordeathof,oneperson,inanyoneaccident;(2)Subjecttosuchlimitforanyonepersonsoinjuredorkilled,of$30,000,exclusiveofinterestandcosts,onaccountofinjurytoordeathof,morethanoneperson,inanyoneaccident;and(3)Of$5,000,exclusiveofinterestandcosts,fordamagetopropertyinanyoneaccident.b.Allautomobileinsurancepoliciesissuedorrenewedshallincludeatleastthecoveragerequiredpursuantto39:6A-3and39:6A-4unlessthenamedinsuredelectsabasicautomobileinsurancepolicypursuantto39:6A-3.1oraspecialautomobileinsurancepolicypursuantto39:6A-3.3.Electionofabasicorspecialautomobileinsurancepolicyshallbeinwritingandsignedbythenamedinsuredonthecoverageselectionformrequiredby39:6A-23.Thecoverageselectionformshallcontainastatement,clearlyreadableandin12-pointboldtype,inaformapprovedbytheCommissioner,that:(1)Electionofabasicautomobileinsurancepolicywillresultinlesscoveragethanthe$250,000medicalexpensebenefitscoveragemandatedpriorto39:6A-1.1etal.orthatelectionofaspecialautomobileinsurancepolicywillresultincoverageonlyforemergencycare;and(2)Electionofaspecialautomobileinsurancepolicy,orabasicautomobileinsurancepolicywithouttheoptional$10,000liabilitycoverageprovidedforin39:6A-3.1maysubjectthenamedinsuredtoaclaimorjudgmentfornoneconomiclosswhichisnotcoveredbytheinsurancepolicy,andwhichmayplacetheinsured’sassetsatrisk,andintheeventtheinsuredissued,theinsurershallnotprovidelegalcounsel.c.Theinsurancecoverageprovidedforin39:6A-3.1shallbeofferedbyeveryinsurerwhichwritesinsurancecoveragepursuantto39:6A-3and39:6A-4foraperiodoffiveyearsbeginningMay19,1998.TheCommissionershallrequireeverycompanywritingsuchinsurancecoveragetoreportannuallyduringthatfive-yearperiodastothenumberofpolicieswrittenpursuanttothissubsectioninthepreviousyear,thenumberofpolicieswiththecoverageofferedpursuantto39:6A-4convertedtopolicieswiththecoverageofferedpursuantto39:6A-3.1andanyotherinformationtheCommissionermayrequireincludingtheageofthepolicyholdersandtheterritoriesinwhichthepolicyholdersreside.TheCommissionershallreporttotheGovernorandtheLegislatureregardingtheacceptanceofthebasicautomobileinsurancepolicybytheautomobileinsuranceconsumersofthisStateannuallyforthefirstfouryearsthebasicpolicyissold.OnorbeforeJanuary1,2003,theCommissionershallmakeafinal,cumulativereporttotheGovernorandtheLegislaturewhichincludesrecommendationsastothecontinuationofthebasicpolicy.d.Theinsurancecoveragesprovidedforin39:6A-3.3shallbeofferedorprovidedpursuanttosubsectionf.ofthatsectionforaperiodoffiveyearsaftertheeffectivedateof17:30A-2.1etal.OnorbeforeJanuary1,2008,theCommissionershallmakeafinalreportwhichincludesrecommendationsastothecontinuationofthespecialpolicytotheGovernorandtheLegislature.e.Nolicensedinsurancecarriershallrefusetorenewtherequiredcoveragestipulatedbythisactofaneligiblepersonasdefinedin17:33B-13exceptinaccordancewiththeprovisionsof17:29C-7.1orwiththeconsentoftheCommissionerofBankingandInsurance.Source:39:6A-3;39:6A-3.2.COMMENTThissectioncontainsthesubstanceoftheoriginalsectionsandconsolidatesthem.In(c),theeffectivedateofthestatutereferencedhasbeenincludedinsteadofsimplyreferringtotheeffectivedate.39A:I-3.Automobileinsuranceforlowincomeindividualsa.ToassistcertainlowincomeindividualsinthisStateandencouragetheirgreatercomplianceinsatisfyingthemandatoryprivatepassengerautomobileinsurancerequirements,theLegislaturehasestablishedaspecialautomobileinsurancepolicy.Thespecialautomobileinsurancepolicyshallbeofferedonlytoindividualswhoqualifyfor,andareactivelycoveredby,designatedgovernmentsubsidizedprogramsintheState.Forthepurposeofthissection,"eligiblelowincomeindividual"meansanindividualwhomeetstheincomecriteriaestablishedbythecommissionerbyregulation.Insettingthelowincomecriteria,thecommissionershalllimitavailabilitytothosepersonseligibleandenrolledinthefederalMedicaidprogram.b.Asanadditionaloptiontothemandatorycoverageprovidedin39:6A-3and39:6A-4orthealternativecoveredprovidedin39:6A-3.1,anownerorregisteredownerofanautomobileregisteredorprincipallygaragedinthisState,whoisaneligiblelowincomeindividual,mayelectaspecialautomobileinsurancepolicyprovidingthefollowingcoverage:(1)Emergencypersonalinjuryprotectioncoverage,forthepaymentofbenefitswithoutregardtonegligence,liabilityorfaultofanykind,onlytothenamedinsuredanddependentmembersoftheinsured’sfamily,asdefinedbythefederalMedicaidprogram,residingintheinsured’shousehold,whosustainbodilyinjuryasaresultofanaccidentwhileoccupying,enteringinto,alightingfromorusinganautomobile,orasapedestrian,causedbyanautomobileorbyanobjectpropelledbyorfromanautomobile,andtootherpersonssustainingbodilyinjurywhileoccupying,enteringinto,alightingfromorusingtheautomobileofthenamedinsured,withthepermissionofthenamedinsured.Intheeventbenefitspaidbyaninsurerpursuanttothissubsectionareinexcessof$75,000onaccountofbodilyinjurytoanyonepersoninanyoneaccidentcoveredbyapolicyissuedorrenewedpriortoJanuary1,2004,thatexcessshallbepaidbytheinsurerandshallbereimbursabletotheinsurerfromtheUnsatisfiedClaimandJudgmentFundpursuantto39:6-73.1.(A)"Emergencypersonalinjuryprotectioncoverage"issuedpursuanttothissectionmeansandincludesonlypaymentoftreatmentforemergencycareinanamountnottoexceed$250,000perpersonperaccident."Emergencypersonalinjuryprotectioncoverage"shallalsoincludeallmedicallynecessarytreatmentofpermanentorsignificantbraininjury,spinalcordinjuryordisfigurementafterthepatientisdischargedfromacutecare.(B)"Emergencycare"meansallmedicallynecessarytreatmentofatraumaticinjuryoramedicalconditionmanifestingitselfbyacutesymptomsofsufficientseveritysuchthatabsenceofimmediateattentioncouldreasonablybeexpectedtoresultin:death;seriousimpairmenttobodilyfunctions;orseriousdysfunctionofabodilyorganorpart.Suchemergencycareshallincludeallmedicallynecessarycareimmediatelyfollowinganautomobileaccident,including,butnotlimitedto,immediatepre-hospitalizationcare,transportationtoahospitalortraumacenter,emergencyroomcare,surgery,criticalandacutecare.Emergencycareextendsduringtheperiodofinitialhospitalizationuntilthepatientisdischargedfromacutecarebytheattendingphysician.Emergencycareshallbepresumedwhenmedicalcareisinitiatedatahospitalwithin120hoursoftheaccident.(2)Deathbenefitintheamountof$10,000;(3)Thetortoptionprovidedin39:6A-8(a)shallapplytoeverynamedinsuredandanyotherpersontowhomthespecialautomobileinsurancepolicyapplies.c.Aspecialautomobileinsurancepolicyshallnotprovideliability,collision,comprehensive,uninsuredorunderinsuredmotoristcoverage.d.ThepolicyformforspecialautomobileinsurancepoliciesshallbesubjecttotheapprovaloftheCommissionerofBankingandInsuranceandshallclearlyandconspicuouslysetforththelimitationsonbenefitsprovidedunderthepolicy.e.Thecommissionershallapprovetheratingsystemtobeusedforaspecialautomobileinsurancepolicy,whichshallbeadministeredbytheplancreatedpursuantto17:29D-1,toprovideauniformStatewideratetobeutilizedbyallinsurersprovidingcoveragethroughaspecialautomobileinsurancepolicy.TherateestablishedbythecommissionershallbesufficienttoreimbursetheinsurerforthecostofwritingthepolicyandanamountsetbythecommissionertobeforwardedtotheUnsatisfiedClaimandJudgmentFundtooffsetclaimspaidbytheUnsatisfiedClaimandJudgmentFund.Thecommissionermayadjusttherateannually.f.Specialautomobileinsurancepoliciesshallbeassignedtoinsurerspursuanttotheapportionmentmethodologyoftheplancreatedpursuantto17:29D-1.Thenumberofpoliciesassignedpursuanttothissubsectionshallnotbeincludedinthedeterminationofacompetitivemarketpursuantto17:33B-15(d).Source:39:6A-3.3.COMMENTThissectionissubstantiallyidenticaltotheoriginal.39A:I-4.PersonalinjuryprotectioncoverageExceptasprovidedby39:6A-3.3and39:6A-3.1,everystandardautomobileliabilityinsurancepolicyissuedorrenewedonorafterMay19,1998shallcontainpersonalinjuryprotectionbenefitsforthepaymentofbenefitswithoutregardtonegligence,liabilityorfaultofanykind,tothenamedinsuredandmembersoftheinsured’sfamilyresidingintheinsured’shouseholdwhosustainbodilyinjuryasaresultofanaccidentwhileoccupying,enteringinto,alightingfromorusinganautomobile,orasapedestrian,causedbyanautomobileorbyanobjectpropelledbyorfromanautomobile,andtootherpersonssustainingbodilyinjurywhileoccupying,enteringinto,alightingfromorusingtheautomobileofthenamedinsured,withpermissionofthenamedinsured.Noinsurerorhealthproviderprovidingbenefitstoaninsuredshallhavearightofsubrogationfortheamountofbenefitspaidpursuanttoanydeductibleorcopaymentunderthissection."Personalinjuryprotectioncoverage"includes:a.Medicalexpensebenefits.Paymentofmedicalexpensebenefitsinaccordancewithabenefitplanprovidedinthepolicyandapprovedbythecommissioner,forreasonable,necessary,andappropriatetreatmentandprovisionofservicestopersonssustainingbodilyinjury,inanamountnottoexceed$250,000perpersonperaccident.Intheeventbenefitspaidbyaninsurerpursuanttothissubsectionareinexcessof$75,000onaccountofbodilyinjurytoanyonepersoninanyoneaccident,thatexcessshallbepaidbytheinsurerandshallbereimbursabletotheinsurerfromtheUnsatisfiedClaimandJudgmentFundpursuantto39:6-73.1.(1)Thepolicyform,whichshallbesubjecttotheapprovalofthecommissioner,shallsetforththebenefitsprovidedunderthepolicy,includingeligiblemedicaltreatments,diagnostictestsandservicesaswellassuchotherbenefitsasthepolicymayprovide.Thecommissionershallsetforthbyregulationastatementofthebasicbenefitswhichshallbeincludedinthepolicy.(2)Medicaltreatments,diagnostictests,andservicesprovidedbythepolicyshallberenderedinaccordancewithcommonlyacceptedprotocolsandprofessionalstandardsandpracticeswhicharecommonlyacceptedasbeingbeneficialforthetreatmentofthecoveredinjury.Protocolsandprofessionalstandardsandpracticesandlistsofvaliddiagnostictestswhicharedeemedtobecommonlyacceptedpursuanttothissectionshallbethoserecognizedbynationalstandardsettingorganizations,nationalorstateprofessionalorganizationsofthesamedisciplineasthetreatingprovider,orthosedesignatedorapprovedbythecommissionerinconsultationwiththeprofessionallicensingboardsintheDivisionofConsumerAffairsintheDepartmentofLawandPublicSafety.Thecommissioner,inconsultationwiththeCommissioneroftheDepartmentofHealthandSeniorServicesandtheapplicablelicensingboards,mayrejecttheuseofprotocols,standardsandpracticesorlistsofdiagnostictestssetbyanyorganizationdeemednottohavestandingorgeneralrecognitionbytheprovidercommunityortheapplicablelicensingboards.Protocolsshallbedeemedtoestablishguidelinesastostandardappropriatetreatmentanddiagnostictestsforinjuriessustainedinautomobileaccidents,buttheestablishmentofstandardtreatmentprotocolsorprotocolsfortheadministrationofdiagnostictestsshallnotbeinterpretedinsuchamannerastoprecludevariancefromthestandardwhenwarrantedbyreasonofmedicalnecessity.(3)Thepolicyformmayprovidefortheprecertificationofcertainprocedures,treatments,diagnostictests,orotherservicesorforthepurchaseofdurablemedicalgoods,asapprovedbythecommissioner,providedthattherequirementforprecertificationshallnotbeunreasonable,andnoprecertificationrequirementshallapplywithintendaysoftheinsuredevent.(4)Thepolicymayprovidethatcertainbenefitsprovidedbythepolicywhichareinexcessofthebasicbenefitsrequiredbythecommissionertobeincludedinthepolicymaybesubjecttoreasonablecopaymentsinadditiontothecopaymentsprovidedforpursuanttosubsectione.ofthissection,providedthatthecopaymentsshallnotbeunreasonableandshallbeestablishedinsuchamannerasnottoservetoencourageunderutilizationofbenefitssubjecttothecopayments,norencourageoverutilizationofbenefits.(5)Thepolicyformshallclearlysetforthanylimitationsonbenefitsorexclusions,whichmayinclude,butneednotbelimitedto,benefitswhichareotherwisecompensableunderworkers'compensation,orbenefitsfortreatmentsdeemedtobeexperimentalorinvestigational,orbenefitsdeductedpursuantto39:6A-6.(6)Thecommissionermayenlisttheservicesofabenefitconsultantinestablishingthebasicbenefitslevelprovidedinthissubsection,whichshallbesetforthbyregulationnolaterthan120daysfollowingtheenactmentdateof39:6A-1.1etal.Thecommissionershallnotadvertiseforbidsfortheconsultantasprovidedin52:34-8and52:34-9.(7)NotwithstandingtheprovisionsofP.L.2003,c.18,physicaltherapytreatmentshallnotbereimbursableasmedicalexpensebenefitspursuanttothissubsectionunlessrenderedbyalicensedphysicaltherapistpursuanttoareferralfromalicensedphysician,dentist,podiatristorchiropractorwithinthescopeoftheirrespectivepractices.(8)Medicalexpensebenefitpaymentsshallbesubjecttoanydeductibleandanycopaymentwhichmaybeestablishedasprovidedinthepolicy.Upontherequestofthecommissioneroranypartytoaclaimforbenefitsorpaymentforservicesrendered,aprovidershallpresentadequateproofthatanydeductibleorcopaymentrelatedtothatclaimhasnotbeenwaivedordischargedbytheprovider.b.Incomecontinuationbenefits.Thepaymentofthelossofincomeofanincomeproducerasaresultofbodilyinjurydisability,subjecttoamaximumweeklypaymentof$100.Suchsumshallbepayableduringthelifeoftheinjuredpersonandshallbesubjecttoanamountorlimitof$5,200,onaccountofinjurytoanyonepersoninanyoneaccident,exceptthatinnocaseshallincomecontinuationbenefitsexceedthenetincomenormallyearnedduringtheperiodinwhichthebenefitsarepayable.c.Essentialservicesbenefits.Paymentofessentialservicesbenefitstoaninjuredpersonshallbemadeinreimbursementofnecessaryandreasonableexpensesincurredforsuchsubstituteessentialservicesordinarilyperformedbytheinjuredpersonforhimself,hisfamilyandmembersofthefamilyresidinginthehousehold,subjecttoanamountorlimitof$12perday.Suchbenefitsshallbepayableduringthelifeoftheinjuredpersonandshallbesubjecttoanamountorlimitof$4,380,onaccountofinjurytoanyonepersoninanyoneaccident.d.Deathbenefits.Intheeventofthedeathofanincomeproducerasaresultofinjuriessustainedinanaccidententitlingsuchpersontobenefitsunderthissection,themaximumamountofbenefitswhichcouldhavebeenpaidtotheincomeproducer,butforhisdeath,undersubsectionb.ofthissectionshallbepaidtothesurvivingspouse,orintheeventthereisnosurvivingspouse,thentothesurvivingchildren,andintheeventtherearenosurvivingspouseorsurvivingchildren,thentotheestateoftheincomeproducer.Intheeventofthedeathofoneperformingessentialservicesasaresultofinjuriessustainedinanaccidententitlingsuchpersontobenefitsundersubsectionc.ofthissection,themaximumamountofbenefitswhichcouldhavebeenpaidtosuchperson,undersubsectionc.,shallbepaidtothepersonincurringtheexpenseofprovidingsuchessentialservices.e.Funeralexpensesbenefits.Allreasonablefuneral,burialandcremationexpenses,subjecttoamaximumbenefitof$1,000,onaccountofthedeathofanyonepersoninanyoneaccidentshallbepayabletothedecedent'sestate.Benefitspayableunderthissectionshall:(1)Besubjecttoanyoptionelectedbythepolicyholderpursuanttosection39:6A-4.3;(2)Notbeassignable,excepttoaproviderofservicebenefitsunderthissectioninaccordancewithpolicytermsapprovedbythecommissioner,norsubjecttolevy,execution,attachmentorotherprocessforsatisfactionofdebts.Source:39:6A-4.COMMENTThissectionisunchangedinsubstance,buthasbeenreorderedslightlyforeaseofreview.Thelasttwoparagraphsoftheoriginalsectionhavebeenmoved.Thefinalparagraphhasbeenmovedtotheendofthefirstparagraphforthesakeofclaritysinceitappearstoapplytotheentiresection.Thesecond-to-lastparagraphintheoriginalsectionhasbeenmovedandisnowsubsection(a)(8);sinceitappearstopertainonlytomedicalexpensebenefitsitisnowapartofthatsection.Theoriginalsubsection(a)hasbeendividedintosubsections(1)–(8)foreaseofreviewandcitation.39A:I-5.AlternateinsurancecoverageAsanalternativetothemandatorycoveragesprovidedin39:6A-3and39:6A-4,anyownerorregisteredownerofanautomobileregisteredorprincipallygaragedinthisStatemayelectabasicautomobileinsurancepolicyprovidingthefollowingcoverage.Noinsurerorproviderprovidingservicebenefitstoaninsuredshallhavearightofsubrogationfortheamountofbenefitspaidpursuanttoanydeductibleorcopaymentunderthissection:a.Personalinjuryprotectioncoverage.Personalinjuryprotectioncoverage,forthepaymentofbenefitswithoutregardtonegligence,liabilityorfaultofanykind,tothenamedinsuredandmembersofhisfamilyresidinginhishousehold,whosustainedbodilyinjuryasaresultofanaccidentwhileoccupying,enteringinto,alightingfromorusinganautomobile,orasapedestrian,causedbyanautomobileorbyanobjectpropelledbyorfromanautomobile,andtootherpersonssustainingbodilyinjurywhileoccupying,enteringinto,alightingfromorusingtheautomobileofthenamedinsured,withthepermissionofthenamedinsured."Personalinjuryprotectioncoverage"issuedpursuanttothissectionmeansandincludespaymentofmedicalexpensebenefits,asprovidedinthepolicyandapprovedbythecommissioner,forthereasonableandnecessarytreatmentofbodilyinjuryinanamountnottoexceed$15,000perpersonperaccident;exceptthat,medicalexpensebenefitsshallbepaidinanamountnottoexceed$250,000:(1)forallmedicallynecessarytreatmentofpermanentorsignificantbraininjury,spinalcordinjuryordisfigurementor(2)formedicallynecessarytreatmentofotherpermanentorsignificantinjuriesrenderedatatraumacenteroracutecarehospitalimmediatelyfollowing
