I.GeotechnicalinvestigationcontractorandHolcimhavediscussedtheoldpaymenttermsandformedanewpaymentterminthecontract.Bothsidesagreedthatthenewpaymenttermswhichshouldbeprescribedingeotechnicalinvestigationcontracttoreplacetheoldterm.

II.Geotechnicalinvestigationcontractorpointedoutthatarticle6.2oncontractagreementwhichisnotacceptableaccordingtoMadagascarlaw.Contractorrequiredthatpenaltyvaluelowerto0.3%ofthetotalcontractpriceperday.Huaxinagreedthiscommentandmodifythisvalueto0.3%.Itwillbeprescribeinthegeotechnicalinvestigationcontract.

III.Asforcontractor’stimingofwork,Huaxincementthinkthatit’stoolongandcannotacceptthattotalworktiming.Socontractor’scompleteworktimingispending.

IV.DuetotheEPCcontactnegotiationbetweenHolcimandHuaxinissuspended,Huaxincannotsignthegeotechnicalinvestigationcontractrightnow.However,bothsides()agreedthegeotechnicalinvestigationcontractcontents.This

V.Contractoragreedtoperformthreecontinuouscoredrillingforknowingsoillayerclassificationonsite.AdetailedboreholeslayoutwithdifferenttypesoftestsmarkoutshouldbeinstantlyreturnedtoHuaxinafterfinishthefirstthreecontinuouscoredrilling.

VI.Forsitetopographysurveying,Huaxinrequiredthatsixcontrolpointsareneededforthattopographysurvey.Contractoragreedthissuggestion.

J.SlobodzianrepliedthattheProjectTeamwouldliketohavetheEAfiledpriorthenextroundofprovincialandmunicipalelections.

FindingroutealternativesthroughDurhamRegion,andWhitby/Ajaxinparticular,(withrespecttoa401-407link)willbedifficultbecauseofdevelopmentandgrowth.Ifthisprocessisdelayedfurther,theremaynotbesufficientalternativestoevaluate.

J.SlobodzianrespondedthattheProjectTeamisma-ki-ngeveryattempttoexpeditetheprocessinordertoaddressthenotedconcern.

AtthelastDurhamRegionPlanningCommitteemeeting,thereappearedtobesomemisunderstandingbythepoliticalrepresentativesregardingtheStudyAreasbeingcarriedforwardintheEATOR.

Regionalstaff,alongwithJohnSlobodzianconfirmedthattheStudyAreaswillhavetobere-examinedduringtheIEAandwouldnotappearintheTOR.TheRegionalOfficialPlanincludesthePreviouslyRecommendedRouteofHighway407andthe401to407links.TheRegionisattemptingtoprotectroutealternativesthroughdevelopmentreviewtothebestofitsability,yet,withoutadesignatedrouteorstudyareaitisverydifficultto"freeze"development.
