RealRightLawofthePeople'sRepublicofChina(Adoptedatthe5thsessionoftheTenthNationalPeople'sCongressonMarch16,2007)PartIGeneralRulesChapterIBasicPrinciplesArticle1InaccordancewiththeConstitutionLaw,thepresentLawisenactedwithaviewtomaintainingthebasiceconomicsystemofthestate,protectingthesocialistmarketeconomicorder,clearlydefiningtheattributionoftheres,bringingintoplaytheutilitiesoftheresandsafeguardingtherealrightoftherightholder.ThecivilrelationshipsincurredfromtheattributionandutilizationoftheresArticle2shallbegovernedbythepresentLaw.Theterm"res"asmentionedinthepresentLawmeansrealtiesandchattels.Whereitisprescribedinanyprovisionthatcertainrightshallbetakenasanobjectofrealright,suchprovisionshallbeapplicable.Theterm"realright"asmentionedinthepresentLawmeanstheexclusiverightofdirectcontroloveraspecificresenjoyedbytheholderinaccordancewithlaw,includingownership,usufractuaryrightandrealrightsforsecurity.Article3Intheprimaryphaseofsocialism,thestateadherestothebasiceconomicsystemwiththepublicownershipplayingadominantroleanddiverseformsofownershipdevelopingsidebyside.Thepubliceconomyshallbeconsolidatedanddevelopedbythestate,andthedevelopmentofthenonpubliceconomyshallbeencouraged,supportedandguided.Thesocialistmarketeconomysystemshallbepracticedbythestateaswellastheequallegalstatusanddevelopmentrightsofallmarketsubjectsshallbeprotected.Article4Therealrightofthestate,collective,individualoranyotherrightholdershallbeprotectedbylaw,andmaynotbedamagedbyanyentityorindividual.

Article5ThevarietiesandcontentsArticle5ThevarietiesandcontentsArticle6Thecreation,alteration,alienationorterminationoftherealrightofarealtyArticle6shallbesubjecttoregistrationinaccordancewithlaw.Thecreationoralienationoftherealrightofachattelshallbedeliveredinaccordancewithlaw.Article7Article7respectsocialmoralsandmaynotinfringeuponthepublicinterestsorthelawfulrightsandinterestsofanyotherperson.Article8Incasethereexistsanyotherspecialprovisioninrespectofrealrightinanyotherlaw,suchspecialprovisionshallprevail.ChapterIICreation,Alteration,AlienationandTerminationofRealRightArticle9Section1RealityRegistrationinaccordancewithlaw,thecreation,alteration,alienationArticle9Section1RealityRegistrationinaccordancewithlaw,thecreation,alteration,alienationorterminationoftherealrightofarealtyshallcomeintoeffect;unlessitisotherwiseprescribedbyanylaw,itshallhavenoeffect讦itisnotregisteredinaccordancewithlaw.Asregardstheownershipofthenaturalresourcesownedbythestateinaccordancewithlaw,theregistrationisnotrequired.Article10Theregistrationofarealtyshallbehandledbytheregistrationorganatthelocalityoftherealty.Auniformregistrationsystemoverrealtiesshallbepracticedbythestate.Thescope,organandmeasuresofuniformregistrationshallbespecifiedbytherelatedlawsandadministrativeregulations.Article]]Inlightofthedifferentregistrationitems,anapplicantshall,whenapplyingfortheregistrationofarealty,providetheownershipcertificateoftherealtyandsuchnecessarymaterialsasthelocationandareaoftherealty.

Article12Aregistrationorganshallperformthedutiesasfollows:(1 )toexaminetheownershipcertificateandothernecessarymaterialsasprovidedbytheapplicant;⑵toinquiretheapplicantabouttheregistrationitemsconcerned;3toregistertherelateditemsinIJ丿accordancewiththefactsandinatimelymanner;and⑷otherdutiesasprovidedforinanylaworadministrativeregulation.Incasetherelatedsituationoftherealtyunderapplicationforregistrationneedsfurtherproving,theregistrationorganmayrequesttheapplicanttoprovidesupplementarymaterialsandconducton-the-spotinspectionwherenecessary.Noregistrationorganmaycommitanyofthebehaviorsasfollows:toaskforArticle13 (1)anevaluationofarealty;⑵torepeatedlyregisterregistrationinthenameofannualinspection;or⑶otherbehaviorsconductedbeyonditsscopeofregistrationduties.Asregardsthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectsincethedatewhenitisrecordedintherealtyregisterincasetheregistrationthereofisrequiredbylaw.Article15Article15creation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectupontheconclusionofthecontract,unlessitisotherwiseprescribedbyanylaw;andthevalidityofthecontractisnotaffected,whethertherealrighthasbeenregisteredornot.Article16contentsofArticle16contentsofarealtyandshallbeunderthemanagementoftheregistrationorgan.Article17fortheArticle17fortheofarealty.Theitemsrecordedintherealtyownershipcertificateshallaccordwiththoserecordedintherealtyregister;unlessitisprovedthatthereisanythingwrongintherealtyregister,theonerecordedthereinshallprevailinthecaseofanyinconsistence.Article18Anyrightholderorinterestedpartymayfileanapplicationforconsultingorcopyingtheregistrationmaterials,andtheregistrationorganmaynotreject.Article18Article19Incaseanyrightholderorinterestedpartyholdsthatthereisanythingwronginanyitemrecordedintherealtyregister,it/hemayapplyforacorrectionoftheregistration.Theregistrationorganshallrevisetheregistrationaccordingly,incasetheholderrecordedintherealtyregisteragreestorevisetheregistrationinwrittenformorthereisevidencetoprovethattheregistrationiswrong.Theinterestedpartymayapplyfordissidenceregistration,incasetheholderrecordedintherealtyregisterdoesnotagreetothealteration.Wheretheregistrationorgangrantsthedissidenceregistrationbuttheapplicantfailstolodgeanactionwithin15daysasofthedateofdissidenceregistration,thedissidenceregistrationshallloseitseffect.Incasethedissidenceregistrationisimproperandbringintodamagestotherightholder,theholdermayrequiretheapplicanttocompensatefordamages.Article20Incasetherelatedpartiesenteredintoapurchaseagreementonapremiseortherealrightofanyotherrealty,theymayapplyforadvancenoticeregistrationtotheregistrationorgansoastoensuretherealizationoftherealrightinthefuture.Withouttheconsentoftheholderintheadvancenoticeregistration,anydisposaloftherealty,aftertheadvancenoticeregistration,maynotproduceeffectofrealright.Incasetheobligee'srightisterminatedaftertheadvancenoticeregistrationismade,ortheapplicationfortheregistrationoftherealtyisnotfiledwithin3monthsasofthedatewhenitcanberegistered,theadvancenoticeregistrationshallloseitseffect.Article21Incaseanyrelatedpartyprovidesfalsematerialsforapplyingforregistrationandcausesdamagestoanyotherperson,it/heshallassumetheliabilityforcompensation.Incaseanyregistrationorgancausesdamagestoanyotherpersonbyvirtueofanymistakeinregistration,itshallassumetheliabilityforcompensation.Theregistrationorganmay,aftermakingthecompensation,recovertheamountfromthepersonwhocausestheregistrationmistake.Article22Realtyregistrationfeesshallbechargedoneachpiece,andmaynotbechargedonthebasisofthesize,volumeorcertainproportionoftherealty'svalue.TheconcretechargingratesshallbeformulatedbytherelateddepartmentsintheStateCouncilincollaborationwiththecompetentpricingdepartment.Section2ChattelDeliveryArticle23Unlessitisotherwiseprescribedbyanylaw,thecreationoralienationOftherealrightofachattelshallcomeintoeffectupondelivery.Anide24Thecreation,alteration,alienationorterminationoftherealrightofanyvessel,aircraftormotorvehicleandsoonmaynotchallengeanybonafidethirdparty讦itisnotregistered.Article25Incasetherightholderhaslegallypossessedthechattelpriortotheestablishmentoralienationofachattel'srealright,therealrightshallcomeintoeffectupontheeffectivenessofthelegalact.Article26Incaseathirdpartyhaslegallypossessedthechattelpriortotheestablishmentoralienationofachattel'srealright,thepersonassumingtheobligationofdeliverymay,insteadofdelivery,alientherighttorequestthethirdpartytoreturntheoriginalobject.Article27Incasebothpartiesagreetoletthealienatorcontinuouslypossessthechattelwhentherealrightofachattelisalienated,therealrightshallgointoeffectupontheeffectivenessoftheagreement.Section3OtherRulesArticle28Incasethecreation,alteration,alienationorterminationofarealrightisresultedfromalegaldocumentofthepeople'scourtorarbitrationcommitteeorarequisitiondecisionofthepeople'sgovernment,etc,therealrightshallcomeintoeffectupontheeffectivenessofthelegaldocumentortherequisitiondecisionofthepeople'sgovernment.Artide29Incaserealrightisacquiredthroughinheritanceorbequest,itshallgointoeffectasofthebeginningtimeoftheinheritanceorbequest.Article3oIncasearealrightiscreatedorterminatedasaresultofsuchfactualbehaviorsasthelegalconstructionorpremisedemolition,itshallcomeintoeffectupontheaccomplishmentofthefactualbehavior.Article31AsregardsarealrightofrealtyenjoyedaccordingtotheprovisionsofArticles28through30ofthepresentLaw,anydisposalthereofmaynotproduceeffectofrealrightuntilitisregisteredasrequiredbylaw.Article31ChapterIIIProtectionofRealRightWherearealrightisdamaged,therightholdermaysettletheproblembymeansArticle32ofconciliation,mediationorarbitration,etc.Artide33Whereanydisputeovertheownershiporcontentofrealrightarises,theinterestedpartiesmayrequiretheconfirmationoftheright.Article34Wherearealtyorchattelisunderanunauthorizedpossession,therightholdermayrequirethereturningoftheoriginalobject.Artide35Incasearealrightisunderobstructionormaybeobstructed,therightholdermayrequiretheremovingoftheimpedimentortheterminationofthedanger.Article36Incasearealtyorchattelisdamaged,therightholdermayrequiretherepairing,remaking,changingortherestorationoftheoriginalstate.Article37Incasetheinfringementuponarealrightcauseslossestotherightholder,therightholdermayrequirethecompensationforthelossesortheassumingofanyothercivilliability.Article38ThewaysforprotectingrealrightasprescribedinthepresentLawmayapplyeitherindependentlyorjointlyinlightofthespecificsituationofaninjuryofrealright.Inadditiontoassumingcivilliabilities,anyentityorindividualinfringinguponarealrightshallassumetheadministrativeliabilitieswhereit/heviolatesanyprovisiononadministrativeregulation;incaseanycrimeisestablished,it/heshallassumethecriminalliabilities.Article38IIOwnershipChapterIVGeneralRulesTheownerofarealtyorchattelisentitledtopossess,utilize,seekprofitsfromArticle39anddisposeoftherealtyorchattelinaccordancewithlaw.TheownerofarealtyorchattelisentitledtoestablishausufructuaryrightorArticle40realrightforsecurityovertherealtyorchattel.Theholderofusufructuaryrightortheholderofrealrightforsecuritymay,whenexercisingtheright,notinjuretheownrightsandinterests.AsregardsarealtyorchattelthatisexclusivelyownedbythestateasArticle41prescribedbylaw,itsownershipmaynotbeacquiredbyanyentityorindividual.Article42Inordertomeetthedemandsofpublicinterests,itisallowedtorequisitionlandsownedcollectively,premisesownedbyentitiesandindividualsorotherrealtiesaccordingtothestatutorypowerlimitandprocedures.Whenrequisitioninglandownedcollectively,itisrequiredto,inaccordancewithlawandinfullamount,paylandcompensationfees,placementsubsidies,compensationsfortheabove-groundfixturesofthelandsandseedlingsandotherfees,arrangeforsocialsecurityfeesforthefarmerswithlandrequisitioned,guaranteetheirlivelihoodandprotecttheirlawfulrightsandinterests.Whenrequisitioningthepremisesownedbyentitiesandindividualsorotherrealties,itisrequiredtocompensatefordemolishmentandrelocationinaccordancewithlawandprotectthelawfulrightsandinterestsoftheownersoftherequisitionedrealties;whenrequisitioningtheindividuals'residentialhouses,itisrequiredtoguaranteethehousingconditionsoftheownersoftherequisitionedhouses.Thecompensationfeesforrequisitionandotherfeesmaynotbeembezzled,misappropriated,privatelyshared,detainedordelayedinthepaymentofbyanyentityorindividual.Article43Specialprotectionsareprovidedbythestateforfarmlands,theconversionoffarmlandsintoconstructionlandsisstrictlyrestrictedandtheaggregatequantityofconstructionlandsisundercontrol.Noonemayrequisitionanylandownedcollectivelywithviolationofthestatutorypowerlimitandprocedures.Artide44Formeetingneedsofemergentdangersordisasters,itisallowedforonetousetherealtiesorchattelsownedbyentitiesandindividualsaccordingtothestatutorypowerlimitandprocedures.Suchrealtiesorchattelsshall,aftertheemergentuse,bereturnedtotheowners.Incaseanyrealtyorchattelownedbyanyentityorindividualisusedordamagedorlostafterbeingused,correspondingcompensationshallbemade.ChapterVStateOwnership,CollectiveOwnershipandPrivateOwnershipAnide45Aregardsthepropertiesthatshallbeownedbythestateasprovidedforbylaw,theyshallbeintheownershipofthestate,thatis,ownedbyallthepeople.TheStateCouncilshallexercisetheownershipofstate-ownedpropertiesonbehalfofthestate;incasethereisanyotherwiseprovisioninanylaw,suchprovisionshallprevail.Mineraldeposits,watersandseaareasshallbeintheownershipofthestate.Article46Anide47Urbanlandsshallbeintheownershipofthestate.Asregardslandsintheruralareasandsuburbanareasthatshallbeownedbythestateasprescribedbylaw,theyshallbeintheownershipofthestate.Article48Suchnaturalresourcesasforests,mountains,grasslands,wastelandsandtidalflatsshallbeintheownershipofthestate,exceptforthosethatshallbeintheownershipofcollectiveasprovidedforbylaw.Article49A wildlife^。皿©thatshaHbe°wnedbVthestateasprovisionedbylaw,theyshallbeintheownershipofthestate.Article50只^。spectrumresourcesShdHbeintheOW^ShipOfthestate.Article51Asregardstheculturalrelicsthatshallbeownedbythestateasprovisionedbylaw,theyshallbeintheownershipofthestate.Article52NationaldefenseassetsshaHbeintheownershipofthestate・Aregardssuchinfrastructuresasrailways,highways,electricpowerfacilities,telecommunicationfacilities,andpetrolandgaspipelinesthatshallbeownedbythestateasprovisionedbylaw,theyshallbeintheownershipofthestate.Article53State。咚曲havethepower,inaccordancewiththelawsandtherelevantprovisionsoftheStateCouncil,topossess,utilizeanddisposeofanyrealtyorchatteldirectlycontrolledbythem.Article54Thepublicinstitutionsheldbythestatehavethepowertopossess,utilize,aswellas,accordingtothelawsandtherelevantprovisionsoftheStateCouncil,seekprofitsfromanddisposeofanyrealtyorchatteldirectlycontrolledbythem.Anide55Aregardstheenterprisessetupwiththefundsinvestedinbythestate,theStateCouncilandthelocalpeople'sgovernmentsshallperformandenjoythecontributor'sdutiesaswellasrightsandinterestsonbehalfofthestateinaccordancewiththerelevantlawsandadministrativeregulations.Article56Thestate-ownedpropertiesshaHbeprotectedbylaw,andnoentityorindividualmayencroach,plunder,privatelydistribute,holdbackordamagethem.Article57Theinstitutionsandworkingpersonnelthereofinchargeofperformingthedutiesofmanagingandsupervisingstate-ownedassetsshall,accordingtolaw,strengthenthemanagementandsupervisionofstate-ownedassetssoastopromotethevaluemaintenanceandappreciationpreventthelossesthereof;incaseanyentityorindividualcausesanylossofstate-ownedassetsbymisusingauthorityorneglectingduty,it/heshallassumelegalliabilitiesinaccordancewithlaw.Incaseanyentityorindividual,intheprocessofenterpriserestructuring,merger,divisionoraffiliatedtransactions,causeslossesofstate-ownedassetsbywayoftransferringatalowprice,conspiringtodistributethemsecretly,providingguaranteewiththemwithoutauthorizationoranyotherwaywithviolationoftheprovisionsonthemanagementofstate-ownedassets,it/heshallassumelegalliabilitiesinaccordancewithlaw.Article57Thecollectively-ownedrealtiesandchattelsshallcontain:Lands,forests,Article58 (1)mountains,grasslands,wastelandsandtidalflatsthatshallbeintheownershipofcollectiveasprovidedforbylaw;2Buildings,productionfacilities,farmland,and(2)waterconservancyfacilitiesthatareintheownershipofcollective;(3)Facilitiesforeducation,science,culture,sanitationandsports,etcthatareintheownershipofcollective;⑷Otherrealtiesandchattelsthatareintheownershipofcollective.Article59Therealtiesandchattelsthatareintheownershipofafarmers'collectiveshallbecollectivelyownedbyallthemembersofthiscollective.Thefollowingissuesshallbedeterminedbythemembersofthecollectiveaccordingtothestatutoryprocedures:(1)landcontractingplanandwhethertocontractoutalandtoanentityorindividualnotincludedinthecollective;⑵adjustmentofthecontractedlandsamongtherightholdersofthecontractedmanagementofland;⑶methodsforusinganddistributingsuchfeesaslandcompensationfees;⑷thealterationofownershiporanyother

(5)relatedissueofanenterprisesetupwiththefundsinvestedinbythecollective;andotherissuesprovidedforbyanylaw.(5)Asregardsanycollectively-ownedland,forest,mountain,grassland,wastelandArticle60ortidalflat,theownershipthereofshallbeexercisedaccordingtotheprovisionsasfollows:⑴Incaseitisownedbyafarmers'collectiveofavillage,acollectiveeconomicorganizationorthevillagers'committeeofthevillageshallexercisetheownershiponbehalfofthecollective;⑵Incaseitisownedbytwofarmers'collectivesormore,allthecollectiveeconomicorganizationsorvillagers'groupsofownedbyafarmers'collectiveofatown,acollectiveeconomicorganizationofthetownshallexercisetheownershiponbehalfofthecollective.Article61Article61collectivehastherightstopossess,use,seekprofitsfromanddisposeofitaccordingtotherelatedlawsandadministrativeregulations.Article62Thecollectiveeconomicorganization,villager'scommitteeorArticle62Thecollectiveeconomicorganization,villager'scommitteeorshall,inaccordancewiththerelevantlaws,administrativeregulations,articlesofassociationandvillageregulationsandvillagers'pledges,publicizethesituationofthepropertiesownedbyacollectivetothemembersofthecollective.Article63orArticle63orindividualmaynotencroach,plunder,privatelydistribute,holdbackordestroythem.Wherethelegitimaterightsandinterestsofanymemberofthecollectiveareinfringeduponbyanydecisionmadebyacollectiveeconomicorganization,villagers'committeeortheprinciplethereof,suchmembermayrequirethepeople'scourttocancelthedecision.Articie64Anindividualhastherighttoownhislegalincome,premise,householdgoods,productioninstruments,rawmaterialsaswellasotherrealtiesandchattels.Article65Thelegalsavings,investmentsandtheproceedstherefromofanindividualshallbeprotectedbylaw.Anindividual'srightofinheritanceaswellasotherlegalrightsandinterestsshallbeprotectedbythestateinaccordancewithlaw.Article66Anindividual'slegalpropertiesshallbeprotectedbylaw,anyentityorindividualmaynotencroach,plunderordestroythem.Thestate,anycollectiveorindividualmayinvesttosetupalimitedliabilityArticle67company,acompanylimitedbysharesoranyotherformofenterprise.Incasethestate,acollectiveoranindividualinvesttherealtiesorchattelsitownsinanenterprise,thecontributorshall,inaccordancewiththeagreementoronthebasisofhisproportionofinvestment,enjoyrightssuchasobtainingassetreturns,makingimportantdecisionsandselectingoperatorsandmanagersandperformtheirduties.Article68Inaccordancewiththelaws,administrativeregulationsanditsarticlesofassociation,Anenterpriselegalpersonisentitledtopossess,utilize,seekprofitsfromanddisposeofanyrealtyorchattelitowns.Asregardstherightsovertherealtiesandchattelsownedbyalegalpersonotherthananenterpriselegalperson,theprovisionsoftherelatedlaws,administrativeregulationsanditsarticlesofassociationsshallapply.TherealtiesandchattelsownedbysocialorganizationsinaccordancewithlawArticle69shallbeprotectedbylaw.ChapterVIOwners'PartitionedOwnershipofBuildingAreasAsregardssuchexclusivepartswithinthebuildingsastheresidentialhousesorArticle70thehousesusedforbusinesspurposes,anownershallenjoytheownershipthereof,whileasregardsthecommonpartsotherthantheexclusiveparts,theownershallhavecommonownershipandthecommonmanagementrightthereof.Article71Anownerisentitledtopossessutilize,seekprofitsfromanddisposeoftheexclusivepartsofthebuilding.Anyownermaynotendangerthesafetyofthebuildingorinfringeuponthelawfulrightsandinterestsofanyotherownerwhenexercisinghisoritsrights.Article72Anownerenjoystherightsandassumestheobligationsoverthecommonpartsotherthantheexclusivepartsofthebuilding,andmaynotrejectperformingtheobligationsunderthepretextofabandoningrights.Incaseanowneralienateshisresidentialhouseorthehouseusedforbusinesspurposeswithinthebuilding,thecommonownershipandthecommonmanagementrightenjoyedbyhim/heroverthecommonpartsshallbealienatedatthesametime.Theroadswithinthebuildingzone,exceptforthepublicroadsofcitiesandArticle73towns,shallbecommonlyownedbytheowners.Thegreenlandswithinthebuildingarea,exceptforthepublicgreenlandsofcitiesandtownsorthosewhicharedefinitelyascribedtoindividuals,shallbecommonlyownedbyalltheowners.Theotherpublicplaces,commonfacilitiesandhousesusedforrealtyserviceswithinthebuildingzoneshallbecommonlyownedbyalltheowners.Article74Theparkingplacesandgarageswithinthebuildingareaplannedforparkingcarsshallbeusedtomeettheneedsoftheownersaboveallelse.Theownershipoftheparkingplacesandgaragesshallbeagreeduponbytherelatedpartiesinthemannersofselling,complementaryusingorleasing,etc.Theparkingplaces,whichoccupytheroadsorotherfieldscommonlyownedbyallowners,shallbeinthecommonownershipofalltheowners.

Article75Theownersmaysetupanowners'assemblyandvoteforanowners'committee.Article75Fortheestablishmentoftheowners'assemblyandthevoteoftheowners'committee,therelateddepartmentsunderthelocalpeople'sgovernmentsshallprovideguidanceandassistance.⑵⑵andrevisethestipulationsonmanagingthebuildingandaffiliatedfacilitiesthereof;3IJ丿tovotefortheowners'committeeoralterthemembersthereoft;tohireorfiretherealtyserviceenterpriseoranyothermanager;⑸toraiseorusethefundsformaintainingthebuildingandaffiliatedfacilitiesthereof;⑹torebuildthebuildingoranyofitsaffiliatedfacilities;⑺otherimportantmattersonthecommonownershipandthecommonmanagementright.FormakingadecisiononmattersprescribedinItem(5)or(6)oftheprecedingparagraph,theconsentofthe2/3ormoreofthetotalownerswithexclusivepartsaccountingfor2/3ormoreofthetotalareaofthebuildingshallbeobtained.Formakingadecisiononanyotherissueprescribedintheprecedingparagraph,theconsentofhalfofthetotalownerswithexclusivepartsaccountingforhalfofthetotalareaofthebuildingshallbeobtained.AnyownermaynotalteraresidentialhouseintoahouseusedforbusinessArticle77purposeswithviolationofanylaw,regulationormanagementstipulation.Anownershall,whenchangingaresidentialhouseintoahouseusedforbusinesspurposes,obtaintheconsentoftheinterestedowners,inadditiontocomplyingwiththelaws,regulationsandmanagementstipulations.Article78owners'assemblyortheowners'committeeareArticle78owners'assemblyortheowners'committeearetoeachowner.Incasethelegitimaterightsandinterestsofanyownerhasbeeninjuredbyanydecisionmadebytheowners'assemblyortheowners'committee,theinjuredownermayrequirethepeople'scourttocancelthedecision.Articie79Thefundsformaintainingabuildingandaffiliatedfacilitiesthereofshallbecommonlyownedbytheownersofthebuilding.Thefundsmay,uponthecodeterminationoftheowners,beusedformaintainingsuchcommonpartsaselevatorsandwatertanks.Thecircumstanceabouttheraiseanduseofthemaintenancefundsshallbereleasedtotheowners.AsregardssuchmattersastheexpensesallocationandtheproceedsdistributionArticle80ofabuildingoranyofitsaffiliatedfacilities,incasethereexistsanystipulationforthese,suchstipulationshallapply;inthecaseofnostipulationorunclearstipulation,thesemattersshallbedeterminedinaccordancewiththeproportionofeachowner'sexclusivepartstothetotalareaofthebuilding.Article81Theownersofabuildingmaymanagethebuildingandaffiliatedfacilitiesthereofbythemselvesortheymayentrustarealtyserviceenterpriseoranyothermanagertoconductthemanagement.Asregardstherealtyserviceenterpriseoranyothermanagerh
