thecostoftheservicesprovidedandthoseoftheservicescarriedoutfromthemomentofadvancedre-entry如果其他变更的方案不可行，或者因严重和正当的原因被消费者所拒绝，组织者应以原先所预期的交通方式将消费者送回出发地点，或者最终协商的其他地点，为其提供交通方式和座位/舱位，并返还消费者已经支付的服务费用与返回时已给予了的服务所用费用之间的差价。11.SUBSTITUTIONS合同当事方的替代人Therenouncingclientcanbesubstitutedbyanotherpersonprovidedthat:明示放弃合同的当事方可以由其他人替代。只要替代人符合以下条件：a.)Theorganizerisinformedinwritingatleast4workingdaysbeforethefixeddateofdeparture,receivingcontextuallycommunicationregardingthegeneralitiesofthetransfereeassignee;组织者在约定启程前至少提前4个工作日得到书面通知，并接到有关受让方的的一般情况的常规通报。b.)Thesubstitutesatisfiesalltheconditionsforthefruitionoftheservice(exart.89Cod.Cons.)andinparticulartheprerequisitesrelativetopassport,visaandhealthcertificates;替代方应符合接受服务的条件，如：消费者法第89条(art.89Cod.Cons.)之规定，特别是有必需的护照、签证和健康证明。12.OBLIGATIONSOFTHEPARTICIPANTS参团人员的义务Theparticipantsmusthavean(individualorpersonal)passportorotherdocumentationvalidforallthecountriesinthecontentsoftheitinerary,aswellasavisaoftransportationandhealthcertificatesthatwillberequested.TheparticipantsmustadheretotherulesofprudenceandcautionandtothoserulesthelawsenforcedwithintheItalianterritory,toalltheinformationprovidedtothembytheorganizer,andtotherulesandadministrativeandlegislativeprovisionsrelativetothetourismpackage.参团人员必须持有个人护照或旅行路线上各个国家都有效的其他证件，以及旅行签证和必需的健康证明。参团人员必须审慎遵守规定，遵守意大利境内实施的法律法规，依从组织者提供给他们的所有信息以及涉及团队旅游的规章、行政法令和其他立法。13.HOTELCLASSIFICATION酒店的等级TheofficialclassificationofthehotelsareprovidedbytheprogramwithinformativematerialbasedontheexplicitandformalindicationsbycompetentauthorityoftheProvinceofArezzo.Theorganizerreservestherighttoprovideintheprogramortouristbrochureapersonaldescriptionoftheaccommodationstructure,sotopermitanevaluationandconsequentacceptanceonbehalfoftheconsumer.酒店的等级是在日程中根据Arezzo省主管当局的明文正式规定在通报资料中提供的。组织者有权在日程中或者旅游宣传册中做自己的描述，因此也允许代表消费者做评估和接受。14.SYSTEMOFRESPONSIBILITY责任划分Theorganizerisresponsiblefordamagescausedtotheconsumerduetopartialortotalnon-fulfilmentofthecontractualservicesdue,bothifthesearecausedbyhimorbythirdpartyserviceproviders,unlessprovedbytheconsumer(therewithinitiativeindependentlytakenuponthemselvesinthecourseofthetouristservices)orbyextraneouscircumstancestotheservicesprovidedinthecontract,afortuitousevent,circumstancesbeyondone’scontrolorcircumstancesthattheorganizercouldnot,inaccordancewithstandardprofessionalism,reasonablyforeseeorresolve.组织者要对由于自己未能部分或者全部履行合同服务而给消费者造成的伤害负责，包括这些伤害是组织者或者第三方服务提供者的责任，除非能够证明是消费者在旅游过程中自己造成的，或者是合同履行过程中外来因素、偶然事件、无法控制的因素、或者是由于组织者无法根据职业规范标准合理预见和解决的原因造成的。Thevendoratthelocationofwherethereservationwasmadeofthetourismpackageisnotresponsibleinanycaseoftheobligationsthatarisefromtheorganizationofthetrip,butisresponsibleexclusivelyfortheobligationsthatariseregardingtheintermediary’squalitiesandwithinthelimitsofresponsibilityoftheregulationsinforceonthesubject.在旅游团队所预定的场所的客户不对旅途中组织所发生的任何事件负责，但要对组织质量承担完全义务，其责任限于对该事件的强制性规定。15.LIMITSOFCOMPENSATION赔偿标准CompensationfordamagestothepersoncannotexceedtheforeseenlimitsbytheinternationalconventionsforwhichItalyandtheEuropeanUnionarepartofwithreferencetotheserviceswhoseperformancehasdeterminedtheresponsability.Inanycasethecompensationlimitcannotexceedtheamountof50,000Eurofordamagestopeople,2,000Eurofordamagestoobjects,5000Euroforanyotherdamage.对人身的伤害赔偿，根据意大利和欧盟所参与的国际公约，不超过可预见的范围，参照服务的履行而定责任。无论任何情况下，对人身的伤害赔偿不超过5万欧元；对财物的损失不超过2千欧元；其他赔偿不超过5千欧元。16.OBLIGATIONSOFASSISTENCE组织者的协助义务Theorganizerisresponsibletoprovidethemeasureofassistancetotheconsumerthatisimposedbythecriteriaoftheprofessionalstandardexclusivelyinreferencetotheobligationsofhis/herjobundertheprovisionsofthelaworcontract.Theorganizerandthevendorareexoneratedfromtherespectiveresponsibilities.(art.14and15oftheseGeneralConditions)whenthemissingorinexactcarryingoutofthecontractischargeabletotheconsumerorisdependentonathirdpartyinanunforeseeableorinevitableway,orinthecaseoffortuitouseventorcircumstancesbeyondone’scontrol.组织者应根据法律和合同所规定的职责，按照职业规范为
