remium,suchinsurance5.1.3reattacheswhen,withouthavingdischargedthesubject-matterinsuredatthefinalportorplaceofdischarge,thevesselsailstherefrom,and5.1.4terminates,subjectto5.2and5.3below,eitherasthesubject-matterinsuredandastoanypartasthatpartisthereafterdischargedfromthevesselatthefinal(orsubstituted)portorplaceofdischarge,oronexpiryof15dayscountingfrommidnightofthedayofre-arrivalofthevesselatthefinalportorplaceofdischargeorarrivalofthevesselatasubstitutedportorplaceofdischarge,whichevershallfirstoccur.5.2Ifduringtheinsuredvoyagetheoverseavesselarrivesatanintermediateportorplacetodischargethesubject-matterinsuredforon-carriagebyoverseavesselorbyaircraft,orthegoodsaredischargedfromthevesselataportorplaceofrefuge,then,subjectto5.3belowandtoanadditionalpremiumifrequired,thisinsurancecontinuesuntiltheexpiryof15dayscountingfrommidnightofthedayofarrivalofthevesselatsuchportorplace,butthereafterreattachesasthesubject-matterinsuredandastoanypartasthatpartisloadedonanon-carryingoverseavesseloraircraft.Duringtheperiodof15daystheinsuranceremainsinforceafterdischargeonlywhilstthesubject-matterinsuredandastoanypartasthatpartisatsuchportorplace.Ifthegoodsareon-carriedwithinthesaidperiodof15daysoriftheinsurancereattachesasprovidedinthisClause5.25.2.1wheretheon-carriageisbyoverseavesselthisinsurancecontinuessubjecttothetermsoftheseclauses,or5.2.2wheretheon-carriageisbyaircraft,thecurrentInstituteWarClauses(AirCargo)(excludingsendingsbyPost)shallbedeemedtoformpartofthisinsuranceandshallapplytotheon-carriagebyair5.3Ifthevoyageinthecontractofcarriageisterminatedataportorplaceotherthanthedestinationagreedtherein,suchportorplaceshallbedeemedthefinalportofdischargeandsuchinsuranceterminatesinaccordancewith5.1.2.Ifthesubject-matterinsuredissubsequentlyreshippedtotheoriginaloranyotherdestination,thenprovidednoticeisgiventotheUnderwritersbeforethecommencementofsuchfurthertransitandsubjecttoanadditionalpremium,suchinsurancereattaches5.3.1inthecaseofthesubject-matterinsuredhavingbeendischarged,asthesubject-matterinsuredandastoanypartasthatpartisloadedontheon-carryingvesselforthevoyage;5.3.2inthecaseofthesubject-matternothavingbeendischarged,whenthevesselsailsfromsuchdeemedfinalportofdischarge;thereaftersuchinsuranceterminatesinaccordancewith5.1.4.5.4Theinsuranceagainsttherisksofminesandderelicttorpedoes,floatingorsubmerged,isextendedwhilstthesubject-matterinsuredoranypartthereofisoncraftwhilstintransittoorfromtheoverseavessel,butinnocasebeyondtheexpiryof60daysafterdischargefromtheoverseavesselunlessotherwisespeciallyagreedbytheUnderwriters.5.5SubjecttopromptnoticetoUnderwriters,andtoanadditionalpremiumifrequired,thisinsuranceshallremaininforcewithintheprovisionsoftheseClausesduringanydeviation,oranyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.(ForthepurposeofClause5“arrival”shallbedeemedtomeanthatthevesselisanchored,mooredorotherwisesecuredataberthorplacewithintheHarbourAuthorityarea.Ifsuchaberthorplaceisnotavailable,arrivalisdeemedtohaveoccurredwhenthevesselfirstanchors,moorsorotherwisesecureseitheratorofftheintendedportorplaceofdischarge“overseavessel”shallbedeemedtomeanavesselcarryingthesubject-matterfromoneportorplacetoanotherwheresuchvoyageinvolvesaseapassagebythatvessel)6Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.7AnythingcontainedinthiscontractwhichisinconsistentwithClauses3.7,3.8or5shall,totheextentofsuchinconsistency,benullandvoid.CLAIMS88.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.8.2Subjectto8.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.99.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.9.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.BENEFITOFINSURANCE10Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.MINIMISINGLOSSES11ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder11.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and11.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.12MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.AVOIDANCEOFDELAY13ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.LAWANDPRACTICE14ThisinsuranceissubjecttoEnglishlawandpractice.NOTE:--ItisnecessaryfortheAssuredwhentheybecomeawareofaneventwhichis"heldcovered"underthisinsurancetogivepromptnoticetotheUnderwritersandtherighttosuchcoverisdependentuponcompliancewiththisobligation.INSTITUTESTRIKESCLAUSES(CARGO)RISKSCOVERED1Thisinsurancecovers,exceptasprovidedinClauses3and4below,lossofordamagetothesubject-matterinsuredcausedby1.1strikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions1.2anyterroristoranypersonactingfromapoliticalmotive,2Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofaffreightmentand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromariskcoveredundertheseclauses.EXCLUSIONS3Innocaseshallthisinsurancecover3.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured3.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured3.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause3.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)3.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured3.5lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(exceptexpensespayableunderClause2above)3.6lossdamageorexpensearisingforminsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevessel3.7lossdamageorexpensearisingformtheabsenceshortageorwithholdingoflabourofanydescriptionwhatsoeverresultingformanystrike,lockout,labourdisturbance,riotandcivilcommotion3.8anyclaimbaseduponlossoforfrustrationofthevoyageoradventure3.9lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter3.10lossdamageorexpensecausedbywarcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower.44.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfromunseaworthinessofvesselorcraft,unfitnessofvesselcraftconveyancecontainerorliftvanforthesafecarriageofthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein.4.2TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination,unlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.55.1Thisinsuranceattachesfromthetimethegoodsleavethewarehouseorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringtheordinarycourseoftransitandterminateseither5.1.1ondeliverytotheConsignees’orotherfinalwarehouseorplaceofstorageatthedestinationnamedherein,5.1.2ondeliverytoanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedherein,whichtheAssuredelecttouseeither5.1.2.1forstorageotherthanintheordinarycourseoftransitor5.1.2.2forallocationordistribution,or5.1.3ontheexpiryof60daysaftercompletionofdischargeoversideofthegoodsherebyinsuredfromtheoverseavesselatthefinalportofdischarge,whichevershallfirstoccur.5.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thegoodsaretobeforwardedtoadestinationotherthanthattowhichtheyareinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.5.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforaboveandtotheprovisionsofClause6below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.6IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthegoodsasprovidedforinClause5above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforcesubjecttoanadditionalpremiumifrequiredbytheUnderwriters,either6.1untilthegoodsaresoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthegoodsherebyinsuredatsuchportorplace,whichevershallfirstoccur,or6.2ifthegoodsareforwardedwithinthesaidperiodof60days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause5above.7Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.88.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.8.2Subjectto8.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.99.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredon
