10.按时、按质、按量完成本身岗位所分解绩效考评指标,并接收监督检验。10.Theemployeeshallfinishtheworkallocatedtohis/herpositionontimewiththerequiredqualityandacceptsupervisionandinspection.

11.每位职员有依据本身岗位实际情况提出合理化提议义务,对工作步骤、工作程序中不合理之处应立即提出并报直接上级立即处理,严格按企业管理模式运作,确保工作步骤和工作程序实施顺畅高效。11.Everyemployeemustworkaccordingtotheregulatedworkflowandproceduresefficiently.Ifthereisanysuggestiononimprovementontheworkflowandprocedures,theemployeeshallimmediatelymakeareporttohis/herleader.12.遵守企业制订相关会议和学习制度,按时参与企业、部门、班组组织政治、业务学习。12.TheemployeeshallexecutethemeetingandlearningscheduleandattendontimethepoliticalandvocationalstudiesorganizedbytheCompany,thedepartmentortheteam.13.企业职员应遵守职业道德,不徇私情,不弄虚作假,不向企业用户或其它利益相关人收受或索取任何不正当利益,不得借用企业或企业职员名义从事欺骗或其它有损企业利益或声誉行为。13.Complywithprofessionalethics;donotplaytricksintheworktopromotehis/herprivateinterest,demandorreceiveillegaladvantagesorbenefitsfromtheclientsorothercooperator,practicefraudinthenameofthecompanyortheemployeeofthecompanyordoanyinfringementtothecompany.14.业务交往中要讲究礼貌,诚恳待人。14.Theemployeeshallbepoliteandfriendlyinbusinesstransaction.15.企业职员不背后议论企业和她人,严禁搬弄是非,恶意中伤她人。15.Theemployeeshallnottelltales,makemischiefamongco-workers,defameormaliciouslyslanderothers.16.按时上下班,不迟到早退,不得私自离开工作岗位,认真推行岗位职责。工作期间不得无故脱岗、串岗,工作时间不喧哗、不闲谈,严禁做一切和工作无关事情。严禁利用企业设备、工具干私活、办私事。16.Theemployeeshallimplementthecompany’sworkinghoursystem,startingandfinishingtheworkontime,andtheemployeeshallperformthedutiesofhis/herpositionandshallnotquithis/herpostwithoutpermission,visitotherpost,havechitchatordoprivateaffairsatworkinghours.Theemployeeshallnotusethecompany’sequipmentsorotherresourcesforprivateaffairs.17.珍惜公共财物,勤俭节省,不浪费企业资源,不化公为私,不得用企业财物馈赠她人。17.Theemployeeshallbethriftyandtakegoodcareofthecompany’sproperties.WastingresourcesoftheCompany,embezzlingorproratingorgiftingthecompany’spropertiesshallbeabsolutelyforbidden.18.未经同意不得翻看同事文件、物品等。18.Theemployeeshallnotpeepatdocumentsorrummagethearticlesofotherco-worker’s.19.不得将亲友或无关人员带入工作场所,不得在值班时间留宿外来人员。19.Theemployeeshallnotbringirrelevantpersonstoworkplaceorputupthepersonwhoisnotemployeeofthecompanyforthenightatwatchhours.20.工作结束后不得将工作物品带出工作场所。20.Afterwork,theemployeeshallnotbringthecompany’spropertiesoutofworkplace.21.主动正面,工作认真。不发怨言不埋怨,不传输负面信息。21.Theemployeeshallbeconscientious,positiveandoptimisticandshallnotcomplainorspreadnegativemessages.22.企业职员上班时要严格遵守职员着装要求,职员工作时间须着正装或企业统一制作工装,左胸佩带工作胸卡。仪表及着装应洁净整齐,保持良好个人形象和企业形象。22.Theemployeesshallobeythecompany’srulesondress.Theemployeesshallwearformalsuitsortheuniformdistributedbythecompanywithnamecardontheleftchestinworkinghours.Theemployee’sappearancesanddressesshallbecleanandtidy,maintainingagoodimageofhisownandtheCompany.23.和领导及客人同行时,应面带微笑侧身站立,请领导和客人先行经过。23.Whenfacedwiththeleaderorvisitorbytheentranceorexit,theemployeeshallstandsidewayswithsmileandlettheleaderandvisitorgofirst.24.在办公室使用手机不得选择怪异铃声,且将响铃声音调小。会议期间养成手机静音好习惯,以免干扰她人。24.Inordertoavoiddisturbingotherco-workers,theemployeeshallnotchoosethewackyring-toneonhis/hermobilephoneandturnitdowninworkplace.Duringmeetings,themobilephoneshallbeturnedtomute.25.打电话严禁大声喧哗以免影响她人,不得长时间接听或拨打工作以外电话,接听私人电话以三分钟为限,长话短说。25.Theemployeeshallnotspeaktooloudlywhenmakingphonecallssoasnottodisturbtheco-workers.Andphonecallsirrelevanttoworkshallbebriefandbelimitedinthreeminutes.26.碰到领导出入、客人到访及职员见面要面带微笑道早问好,交流时使用“您好、谢谢、请、对不起、再见”等礼貌用语。26.Theemployeesshallgreetandsmilewhilefacedwithleader,visitorsandco-workers.Andwhenservethemoranswertheirquestions,theemployeeshallbepoliteandusecourtesiessuchashello,thanks,please,excusemeandseeyou.第四章录用和离职EmploymentandDisemployment1.职员录用1.Employment1.1职员招聘将依据企业年度用人计划按需要进行。本企业各部门如因工作需要,必需增加人员时,应先由部门经理向人力资源部提出申请,经总经理及人力资源部签字同意后,由人力资源部统一安排招聘。1.1TheemployeesshallberecruitedaccordingtotheCompany’sannualstaffingplanwhenneeded.Ifmoreemployeesareneededonaccountofthebusinessineachdepartment,thedepartmentmanagershouldmakeanapplicationtoHRdepartmentfirstandtheunifiedrecruitmentshallbemadebytheHRdepartmentafterapprovedbytheHRdepartmentandthegeneralmanager.1.2企业录用政策是采取公平、公正、公开标准,招聘和录用优异、适用之人才,无种族、肤色、宗教、性别等区分。1.2Theprinciplesofequity,opennessandfairnessshallbefollowedintherecruitment,andanyapplicabletalentcanbeemployed,irrespectiveofsex,color,religionorrace,etc.1.3条件和要求1.3Conditionsandrequirements1.3.1“德才兼备、能力优先”是企业择才基础标准。1.3.1ThebasiccriterionofrecruitmentintheCompanyistosearchforemployeeswithbothabilityandintegrity,butabilitypreferred.1.3.2通常来说职员年纪必需达成18周岁以上,含有中国认可有效身份证实。1.3.2Asarule,theminimumageoftheemployeesshallbe18years,withvalididentificationapprovedbythePeople'sRepublicofChina1.3.3应该含有应聘岗位所要求教育背景、工作经验、专业能力和一定辅助能力(比如熟练利用电脑和外语能力)和所应聘岗位特殊要求。企业在招聘职员时,人力资源部和需求部门将明确其具体要求。1.3.3Theemployeesshallhavetheeducationalbackground,workingexperience,professionalability,somesupportiveabilities(e.g.goodskillsinEnglishcommunicationandcomputer)andthespecialqualificationsrequiredbythepositionapplied.TheHRdepartmentandtherequiringdepartmentsshallmakeclearthespecificrequirementstotheemployeeswhenrecruiting.1.4面试职员在被正式录用前,企业人力资源部门将对职员进行面试,必需时由人力资源部门联合部门经理、总经理进行面试。1.4InterviewsTheHRdepartmentshallconductaninterviewwiththeprospectiveemployeesbeforeemployingthem,andshalldoittogetherwiththedepartmentmanagerandthegeneralmanagerifnecessary.1.5录用禁忌1.5ProhibitionsonrecruitingItisabsolutelyforbiddenintheCompanytoacquireapositionortohelpotherstoacquireapositionbymeansofdishonesty.TheCompanyshallnotemployanykindofemployeesasthefollows:●未满十八周岁者;Thecitizenisundertheageof18yearsold;●被剥夺公民权利还未恢复者;Thepersonwhohasbeendeprivedofrightsasacitizenandhasnotbeenrevivedyet;●受公安机关通缉者;Thecitizenwhohasbeenissuedawarrantbythepolicebureau;●宣告破产个人,宣告破产企业法定代表人或责任人,破产程序还未终止;Theindividualhasbeenannouncedforbankruptcyandtheprocedurehasnotbeenfinished;Thelegalrepresentativeorapersoninchargeinanenterprise,andtheenterprisehasbeenannouncedforbankruptcyandtheprocedurehasnotbeenfinished;●吸食(曾经吸食)毒品或其它代用具者;Thecitizenwho(hastherecordoftakingdrugs)takesdrugsorothersubstitutes;●有犯罪统计者;Thecitizenwhohascriminalrecord;●亏欠公款受处罚还未结案者;Thecitizenwhohasbeenpunishedforowefund,andthelawsuithasnotbeenendedyet;●患有精神病或传染病者,或企业认为不适合为其服务病症者;ThecitizenwhohassufferedfrommentaldisorderorinfectiondiseaseorothersregardednotfittingforworkingintheCompany;●资料核实或背景调查发觉向企业提供虚假信息、虚假文件者;ThecitizenwhohasprovidedfalseinformationandfalsedocumenttotheCompany;●体格检验经企业认为不适合者;Thecitizenisunsuitableaftermedicalexamination;●品行不端,经公私营机关开除者;Thecitizenisinbadconductandhasbeenexpelledbyenterprisesbothofstateandindividual;●曾因违纪被本企业解除劳动协议;或自动离职但曾受过本企业记过及以上处分者;ThecitizenwhohasbeenterminatedtheemploymentcontractbytheCompanyforviolatingtheregulations;orhasleftofficevoluntarilybutbekeptrecordsforademeritormoreseriouskindsofpunishment;●曾在企业用户、供给商或竞争对手处就职,且仍在《就业限制竞争协议》相关条款或要求约束期间者;Thecitizenwhohaseverworkedforthecustomers,suppliersorcompetitorsoftheCompany,andstillinrestrictedperiodstipulatedbytheEmployment-Limit-Competition-Agreement;●其它相关法律、法规或企业政策要求不适合录用情形。Othersarenotsuitabletobeemployedaccordingtorelevantlaws,regulationorpolicyoftheCompany.1.51.5.3Awithdrawalsystemfortherelatives●为保护平等就业,避免利益冲突,职员在介绍其亲属应征或应征者已经有亲属在企业就职时,有责任将情况提前通知人力资源部,不然将视为欺诈行为。InordertoprotectequalemploymentandavoidconflictofinterestintheCompany,bothemployeesandcandidateshavedutytoreporttoHRdepartmentinadvanceincaseofemployeesintroducingtheirrelativestotheCompanyorcandidateswhoserelativeshavealreadyworkedintheCompany.Ifnot,itshallberegardedascheating.●相互有亲属关系职员应该在互不关联岗位上工作,不能够在同一个部门工作,不能够有直接领导关系。Relativesshallworkintheunrelatedpositionsandshallnotbeallowedtoworkinthesamedepartment,andwithdirectreportingline.●假如职员和企业内部另一职员结婚或长久同居,则企业有权要求并安排双方分别任职于不相关联岗位,对此职员应该服从并遵守。IfanemployeeintheCompanyismarriedtoorcohabitswithanotheremployeeforlongtime,theCompanyshallhavetherighttoarrangethetwoemployeesintheunrelatedpositionsandtheemployeesshallhavetoacceptandfollowit.TheCompanyistheonlyemployeroftheemployees.●职员在为企业服务期间不得再其它任何企业或机构从事兼职或专职员作;未经同意,职员不得为其它任何企业或机构从事商业活动,即使是无偿。Theemployeesshallnottakefull-timeorpart-timejobsinanyothercompaniesororganizationswhenworkingintheCompany.Theemployeesshallnotcarryoncommercialactivitiesforanyothercompaniesororganizationswithoutapproval,evenwithoutbeingpaid.●职员期望为其它个人、企业、各类机构临时工作,应该取得企业事先书面同意。企业有权随时撤销上述同意。Iftheemployeehopestoworktemporarilyforanyindividual,companyorkindsoforganizations,thewrittenapprovalshallbeneededfromtheCompany.AndtheCompanyhastherighttorescindtheaboveapprovalatanytime.●未经同意,职员首次接收其它酬劳时,亦将被视为其主动向企业提出辞职。Withoutapproval,theemployee’sfirstacceptinganypaysfromotherorganizationsshallberegardedashisofferingtoresign.2.入职2.Recruits新进人员入职(报到)时,应向人力资源部缴验下列材料:ThefollowingmaterialsshallbesuppliedtotheHRdepartment,whenthenewemployeetakesofficeintheCompany:●身份证实原件及复印件(身份证、户籍证实、护照等);Theoriginalandcopiesofhisidentitycertificate(IDcard,certificateofhouseholdregister,passportandsoon);●学历证书原件及复印件;Theoriginalandcopiesofhiseducationalcertificate;●职业资格证书原件及复印件;Theoriginalandcopiesofhisoccupationalqualificationcertificates;●解除雇用关系证实(离职证实)或失业(待业)证实原件;Theoriginaloftheproofofterminatingemployment(theproofofleavingjob)ortheproofofunemployment;●相关社会保险证实;Therelatedproofofsocialsecurity;●企业认为必需其它相关证件。OthernecessarycertificatesasrequiredbytheCompany.3.劳动协议及相关尤其协议3.Employmentcontractandrelatedspecialagreements3.1依据国家相关法律要求,企业将和职员在平等协商一致基础上,在职员入职30天内签署书面劳动协议,并依工作性质不一样有选择地和职员签署相关劳动协议附件或尤其协议。假如因职员本人原因造成书面协议无法签署,由职员本人负担全部责任并自愿放弃向企业主张任何相关赔偿、赔偿及二倍工资权利。协议附件(尤其协议)和劳动协议含有相同法律效力。3.1Inaccordancewiththerelevantlawsandregulations,theCompanyshallsignwrittenemploymentcontractandshallsigntheappendixesorspecialagreementsselectivelywiththenewemployeesonthebasisofequalnegotiationofthetwopartieswithin30dayssinceheregisteredaccordingtohisjob.Shouldthewrittencontractnotbesignedduetothefaultoftheemployee,theemployeehimself/herselfshalltakefullresponsibilityforthatandshallvoluntarilygiveuptherighttoclaimforcompensationandtwotimessalaryfromtheCompany.Theappendixesofthecontract(orspecialagreements)shalltakethesamelegaleffectastheemployment3.2在雇用期间,企业依据实际情况需要和职员签署尤其协议、补充协议、任命书、薪资调整决定等包含用工双方劳动关系文书,和劳动协议含有相同法律效力。3.2Duringtheemploymentperiod,thesigneddocumentsbetweentheCompanyandtheemployeessuchasspecialagreement,supplementaryagreement,theappointment,thedecisiononsalaryadjustment,etc.,shalltakethesamelegaleffectastheemploymentcontract.3.3劳动协议变更3.3Theamendmentoftheemploymentcontract企业和职员能够协商变更劳动协议条款,变更劳动协议应该以签署补充协议形式进行。TheprovisionsoftheemploymentcontractcanbeamendedaftertheCompanyandtheemployeereachanagreementthroughnegotiation.Theamendmentstoanemploymentcontractshallbemadeinsupplementaryagreement.3.4劳动协议续签3.4Therenewoftheemploymentcontract3.4.1企业建立并严格遵守劳动协议续签评定制度,职员原劳动协议到期前,由用工部门提出意见,经人力资源部审核,报总经理审批。3.4.1Theevaluationsystemofrenewingtheemploymentcontractshallbeestablishedandstrictlyobserved.Beforetheoriginalemploymentcontractofanemployeeexpires,thedepartmentshallgivetheadviceonthecontractrenewfirstandthenbesubmittedtothegeneralmanagerforapproval,afterapprovedbyHRdepartment.3.4.2企业决定不再和职员续签劳动协议,双方须根据法律要求办理劳动协议终止手续。3.4.2IftheCompanydecidesnottorenewthecontractwiththeemployee,twopartiesshallgothroughtheproceduresofthecontractterminationaccordingtotherelevantlawsandregulations.3.4.3企业决定和职员续签劳动协议,原劳动协议期限届满前30日,企业将《劳动协议续签意向书》发给职员,通知企业续签劳动协议意向。职员愿意和企业续签劳动协议,应在接到《劳动协议续签意向书》后7日内将签署意见后《劳动协议续签意向书》提交人力资源部。3.4.3IftheCompanydecidestorenewthecontractwiththeemployee,aletterofintentforcontractrenewshallbesenttotheemployee30daysinadvancebeforetheoriginalemploymentcontractexpires.IftheemployeeintendstorenewthecontractwiththeCompany,thesignedletterofintentshallhavetobesubmittedtotheHRdepartmentwithin7daysuponreceivingtheletterofintent.3.5拒不签署劳动协议处理3.5Thetreatmentofrefusingtosigntheemploymentcontract企业严格实施书面劳动协议制度。不管是首次签署劳动协议,还是续签劳动协议,自企业书面通知要求职员签署之日起7日内,职员不和企业签署劳动协议,视为职员不一样意签署或续签劳动协议,双方劳动关系终止。TheCompanyshallimplementthewrittenemploymentcontractsystem.Whethersigningthefirstcontractorrenewingthecontract,itshallberegardedasarefusalofsigningorrenewingthecontractthattheemployeefailstoconcludeanemploymentcontractwiththeCompanywithin7daysfromthedayofreceivingthewrittennoticefromtheCompany.Andthenthelaborrelationsbetweenbothpartiesshallbeterminated.4.试用期4.Probationperiod4.1企业依法对新职员实施试用期制度,依据相关法律法规要求,企业能够在劳动协议中和职员约定试用期。4.1TheCompanyshallimplementaProbationperiodsystemforthenewacceptedemployees.Accordingtotherelatedlawsandregulations,theprobationperiodcanbeagreeduponintheemploymentcontract.4.2试用期期限和工资由企业和职员根据法律法规要求在劳动协议中确定。4.2Thetermandsalaryofprobationperiodshallbeagreeduponintheemploymentcontractbybothpartiesaccordingtotherelatedlawsandregulations4.3试用期结束前,由部门主管依据其工作职责和岗位要求,对该职员工作表现等进行全方面评定考评,经过试用期评定职员,方可成为企业正式雇员。4.3Whentheprobationperiodexpired,thedepartmentmanagershallmakeacomprehensiveevaluationandappraisaltotheemployee,accordingtohisJobDescriptionandPositionrequirements.Onlythosewhocanpassthroughtheappraisalcouldbetheformalemployees.5.新职员培训5.Thetrainingoftherecruits新进职员在被录用前一至六个月内,有义务参与由企业安排相关入职培训活动。TherecruitshavethedutytoattendtherelevanttrainingorganizedbytheHRdepartmentduringthefirstsixmonthsafterbeingemployed.6.职员档案及信息管理6.Themanagementofemployees’fileinformation企业认为,对职员档案及个人信息合适管理十分关键,它表现了企业对每个职员重视。为此,每位职员全部有责任:TheCompanyconsidersthemanagementofemployees’fileinformationisveryimportant,whichshowstheattentionandcaretotheemployeesfromtheCompany.So,eachemployeehasthedutyto:6.1在劳动关系开始前,真实地填写相关资料。职员因隐瞒或虚报材料而造成任何不利后果将由职员本人负担,所以给企业造成重大损失,企业有权解除劳动协议。6.1Fillintherelevantmaterialstrulybeforebeingemployed.Theemployee,whowillfullywithholdsmaterialinformationorprovidesfalseinformation,shallassumeanytheadverseconsequencesbyhimself/herself.AndtheCompanyshallbeentitledtoterminatetheemploymentcontractifagreatlosscausedthereof.6.2雇用期间,职员个人资料如有变更,应立即书面通知直接主管及人力资源部。6.2Duringhisemployment,ifthereisanychangeofthepersonalmaterial,theemployeeshouldinformthedirectmanagerandHRdepartmenttimelyinwritten.6.3对个人资料保守秘密。6.3Keepconfidentialforthepersonalmaterials.6.4除业务需要并取得同意外,不得私下探询她人个人信息。6.4Itisnotallowedtoinquireaboutother’spersonalinformation,exceptbusinessneedsandgettingapproval.7.岗位变更(调整)7.TheJobtransfer(adjustment)企业有权依据经营业务需要、并综合职员表现、业绩和能力,能够调整其工作岗位和职务。如任何部门需要进行人员岗位变动需提前一周通知人力资源部。人力资源部负责监督审批程序进行。本部门及转岗部门经理、人力资源部、财务部、总经理及职员本人签字。人力资源部负责向相关人员及部门公布岗位变更公告,如有必需通知全企业。人力资源部负责更新岗位描述及相关HRP中信息;企业培训师依据岗位变更公告为其设计对应培训计划。转岗职员接收到岗位变更公告后需要向相关人员移交本人工作。岗位变更审批单一式三份,人力资源部一份、薪酬福利专员一份、职员本人一份。TheCompanyshallbeentitledtoadjusttheemployee’sjobaccordingtothebusinessneedsandhis/herperformance,achievementsandability.Ifanydepartmentneedstoadjustthejobofitsstaff,theHRdepartmentshallbeinformedofoneweekinadvance.TheHRdepartmentshallberesponsibletosupervisetheapprovalprocedures.TheApprovalPaperforjobadjustmentshallneedtobesignedbythemanageroftheoriginaldepartmentandthenewdepartment,theHRdepartment,thefinancialdepartment,thegeneralmanagerandtheemployeehimself/herself.TheHRdepartmentshallberesponsibletopublishedanoticeforthejobadjustmenttotherelatedpersonnelanddepartmentsorinformthewholecompanyifnecessary.TheHRdepartmentshallalsoberesponsibletoupdatethejobdescriptionandtheinformationinHRP.ThetraineroftheCompanyshalldesignthecorrespondingtrainingplanforhim/heraccordingtothenotice.Theemployeewhosejobisadjustedshallturnoverhis/herjobtotherelevantpersonnelafterreceivingthenotice.TheApprovalPaperforjobadjustmentshallbeintriplicate,onefortheHRdepartment,onefortheexecutiveforsalaryandonefortheemployeehimself/herself.8.劳动关系终止8.Theterminationoflaborrelationship8.1辞职终止8.1Terminationforresignation8.1.1依据相关法律要求,职员在试用期内提前3日,在试用期满后提前30日向企业提交正式书面辞职申请,可解除劳动协议。职员在书面通知中应该明确其拟离职时间。为避免歧义,未经企业事先书面同意,职员不得以代通知金替换提前通知期。职员给企业造成经济损失还未处理完成或因其它问题正在被审查期间,职员不得依据本条要求解除劳动协议。8.1.1Accordingtherelevantlawsandregulations,anemployeemayterminatehisemploymentcontractupon30days’priorwrittennoticetotheCompanyorthreedays’priornoticetotheCompanyduringhisprobationperiod.Theemployeeshallmakeclearthetimeofleavingthejobinhis/herwrittennotice.Theemployeeshallnotgiveonemonth’swageinlieuofpriornoticewithoutthepriorwrittenconsentoftheCompany.TheemployeeshallnotterminatehisemploymentcontractaccordingtothisArticleiftheeconomiclossestotheCompanycausedbytheemployee8.1.2自书面解除通知提交之日起至劳动协议解除之日止,职员应照常工作,并配合交接工作。如职员未提前通知私自离职或未配合交接工作,企业能够职员旷工、严重违纪为由单方解除劳动协议,并有权要求职员赔偿企业所受到经济损失。8.1.2Theemployeeshallworkasusualfromthedayofsubmittingthewrittennoticetothedayoftheterminationofthecontractandshallsupporttohandoverofhisjob.IftheemployeeleavestheCompanywithoutnoticeinadvanceordoesnotsupporttohandoverofhisjob,theCompanyshallterminatetheemploymentcontractunilaterallyonthegroundsofhisabsenteeismorseriousviolationofdiscipline,andshallbeentitledtoclaimcompensationforthelossescausedthereof.8.2劳动协议期满终止8.2Theterminationontheexpirationofemploymentcontract8.2.1劳动协议期满,企业将视企业经营情况及职员表现和相关法律要求来决定是否续签劳动协议,并书面通知职员。8.2.1Whentheemploymentcontractexpires,theCompanywilldecidetoextendtheemploymentcontractornot,accordingtotheoperationstate,theperformanceoftheemployeeandtherelatedlawsandregulations,andinformtheemployeeinwritten.8.2.2职员于协议期满前,可依摄影关法律要求,提出续签劳动协议申请。8.2.2Beforetheemploymentcontractexpires,theemployeemaysubmitapplicationtotheCompanyforrenewingtheemploymentcontractaccordingtotherelevantlawsorregulations.8.3解聘终止8.3Theterminationfordismissing8.3.1试用期间,职员被发觉含有本章第1.5.2条8.3.1Duringprobationperiod,afterevaluation,ifitisprovedthattheemployeeisinoneofthecaseslistedinArticle1.5.2ofthisChapter,thecompanyshallbeentitledtoterminatethelaborrelationshipwithhim/heratonce.However,therelevantprovisionsontheconfidentialityintheagreement,contractorstatementsignedwiththeCompanyshallbestillineffecttotheemployee,eveniftheemploymentcontractisterminated.8.3.2试用期满前,企业对职员在试用期内综合表现进行评定,认为其工作表现达不到岗位工作要求,企业有权立即解除劳动协议关系。8.3.2Beforeprobationperiodexpires,theCompanyshallmakeacomprehensiveevaluationtotheemployee.IftheCompanythinksthattheemployee’performanceduringprobationperiodcannotsatisfytherequirementsofthejob,theCompanyshallbeentitledtoterminatethelaborrelationshipwithhim/heratonce.8.3.3协议期内职员,因企业经营、生产、技术等原因或其它客观原因造成企业无法继续延续劳动关系时,企业将依据相关法律法规8.3.3IftheCompanycannotcontinuethelaborrelationshipwiththeemployeeduringthecontractperiodduetooperation,production,technology,andotherimpersonalfactors,theCompanyshallterminatetheemploymentcontractwithhim/heraccordingtotherelevantlawsandregulations..4TheCompanyshallbeentitledtoterminatethelaborrelationshipwiththeemployeewhohascausedlossestotheCompanyonthebasisofhisownfaultorotherviolations.8.4劳动协议解除或终止,职员应根据企业要求办理下列工作交接手续:8.4Intheeventofterminationortheendoftheemploymentcontract,thefollowinghanding-overformalitiesshallbehandledbytheemployeeStatethejob,theprogressofongoingprojectsandclientrelationships,etc.tothedesignatedpersonbytheCompany..2Returnthedocuments,data,files,theauthorityofinformationsystems,keys,employeecard,computersoftwareandequipments,creditcard,mobilephonesorotherpropertiesheld,controlledorkeptbytheemployeeandrelatedtothebusinessoftheCompany,tothedesignatedpersonbytheCompany.HandlethesettlementwiththedesignatedpersonbytheCompany,includingbutnotlimitedtopayingoffthemoneyborrowedfromtheCompany,reimbursingtheexpenses,compensatingtheCompanyfortheeconomiclossescausedbytheemployee,andpayingtheCompanyliquidateddamagesaccordingtothetrainingagreement;8.4.4如企业要求,职员应对前述交接工作8.4.4TheemployeeshallprovideadetailedexplanationinwrittenontheabovehandoverifrequiredbytheCompany.8.5职员同意,企业能够自企业对职员应付款项(包含但不限于企业应向职员支付工资、经济赔偿金等款项)中对应扣除其应向企业支付款项,包含但不限于其对企业造成经济损失赔偿、依据双方签署培训协议所应支付违约金等。职员同意本条要求于其受雇于企业期间及离职时均可适用。8.5TheemployeeagreesthattheCompanycandeductthepayablestotheCompany(includingbutnotlimitedtocompensations,liquidateddamages,etc.)fromthepayablestotheemployees(includingbutnotlimitedtosalaries,severancepay,etc.).TheemployeeagreesthatthestipulationinthisArticleshallapplytobothduringhis/heremploymentandupondemission.第五章职员薪酬ChapterFiveThesalaryofemployees1.薪酬基础政策1.Thebasicpolicyofsalary1.1企业薪酬哲学是能够吸引、激励和保留忠诚、有能力并愿意连续为企业发展提供价值职员为目标。
