2024离婚协议房产赠与协议书2024DivorceAgreementwithRealEstateGiftDeedPartI:DivorceAgreementArticle1:PartiesInvolvedHusband(PartyA):FullName:_______,IDNumber:_______,Address:_______.Wife(PartyB):FullName:_______,IDNumber:_______,Address:_______.Article2:AgreementtoDivorceBothparties,havingfreelyandvoluntarilyagreedtothedissolutionoftheirmarriage,enterintothisAgreementtoformalizethetermsoftheirdivorce.Article3:PropertyDivisionThepartiesagreetothedivisionofmaritalpropertyasfollows:RealEstate:Thepropertylocatedat_______,withatotalareaof_______squaremeters,andpropertycertificatenumber_______,isherebydivided.Article4:RealEstateGiftPartyAherebyagreestogiftthemaritalpropertymentionedinArticle3toPartyBasfollows:Thepropertylocatedat_______isgiftedtoPartyBfreeofanycharge.PartyAshallassistPartyBinthetransferofthepropertyrightswithin_______daysfromthedateofthisAgreement.Article5:OtherAssetsAllotherassets,includingbutnotlimitedtovehicles,bankaccounts,investments,andpersonaleffects,shallbedividedequallybetweenbothparties.Article6:DebtsandLiabilitiesAnydebtsincurredduringthemarriageshallbetheresponsibilityofthepartywhoincurredthedebt,unlessotherwiseagreeduponbybothparties.Article7:AlimonyandChildSupportThereshallbenoalimonypaymentsmadebyeitherparty.Ifapplicable,childsupportandcustodyarrangementsshallbeasagreeduponbybothpartiesanddetailedinaseparateagreement.Article8:MutualReleaseBothpartiesreleaseeachotherfromanyandallclaims,demands,andcausesofactionthattheymayhaveagainsteachotherarisingfromthemarriage.Article9:GoverningLawThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.Article10:EntireAgreementThisAgreementconstitutestheentireagreementbetweenthepartiesandsupersedesallpriornegotiations,understandings,oragreements,whetherwrittenororal.PartII:RealEstateGiftDeedArticle11:GiftofRealEstatePartyAherebyirrevocablygifts,transfers,andconveystoPartyBthepropertydescribedinArticle3ofPartI,freeandclearofanyliens,encumbrances,orclaims.Article12:AcceptanceofGiftPartyBherebyacceptsthegiftoftherealestatepropertyfromPartyAandagreestoholdthepropertysubjecttothetermsofthisAgreement.Article13:RepresentationsandWarrantiesPartyArepresentsandwarrantsthattheyhavegoodandmarketabletitletotheproperty,freefromanyencumbrances.PartyBacknowledgestheacceptanceofthepropertywiththeunderstandingofitscurrentcondition.Article14:ConditionsoftheGiftThisgiftismadewithoutanyconsiderationandisnotsubjecttoanyconditionsorobligationsonthepartofPartyB.Article15:TaxImplicationsBothpartiesacknowledgethepotentialtaximplicationsofthisgiftandagreetocomplywithallapplicabletaxlawsandregulations.Article16:ExecutionThisAgreementandtheRealEstateGiftDeedshallbeexecutedinduplicate,witheachpartyretainingoneoriginalcopy.Article17:EffectiveDateThisAgreementandtheRealEstateGiftDeedshallbeeffectiveasofthedateofexecutionbybothparties.Article18:NoticesAllnotices,requests,demands,andothercommunicationsunderthisAgreementshallbeinwritingandshallbedeemedgivenwhendeliveredpersonallyorbyregisteredmailtothepartiesattheirrespectiveaddressessetforthherein.Article19:AmendmentThisAgreementandtheRealEstateGiftDeedmaynotbeamendedormodifiedexceptinwritingsignedbybothparties.Article20:SeverabilityIfanyprovisionofthisAgreementortheRealEstateGiftDeedisheldtobeinvalidorunenforceable,suchprovisionshallbestruck,andtheremainingprovisionsshallremaininfullforceandeffect.SignatureofPartyA(Husband):_______Date:_______SignatureofPartyB(Wife):_______Date:_______[Endofthefirsthalfofthe2024DivorceAgreementwithRealEstateGiftDeed](Note:Theabovecontentisatemplateforadivorceagreementthatincludesarealestategiftdeed.Specifictermsshouldbeadjustedandsupplementedaccordingtotheactualsituation.)[Endoftheresponsewithoutanyadditionaltextasinstructed.]Article21:ConfidentialityBothpartiesagreetokeepthecontentsofthisAgreementandtheRealEstateGiftDeedconfidentialandnotdiscloseanydetailstothirdpartieswithoutthewrittenconsentofbothparties.Article22:IndependentNatureofPromisesThepromisesmadebyeachpartyinthisAgreementareindependentandseparate,andthefailureofanyoneormoreofsuchpromisesshallnotaffectthevalidityorenforceabilityoftheremainingpromises.Article23:AssignmentThisAgreementandthebenefitsthereunderarenotassignablebyeitherpartywithoutthepriorwrittenconsentoftheotherparty.Article24:ForceMajeureNeitherpartyshallbeliableforanyfailureordelayinperformingitsobligationsunderthisAgreementtotheextentthatsuchfailureordelayiscausedbycircumstancesbeyondthereasonablecontrolofthatparty.Article25:SurvivalTheobligationsunderthisAgreementwithrespecttoconfidentiality,proprietaryrights,andanyotherobligationswhich,bytheirnature,areintendedtosurvivetheterminationorexpirationofthisAgreementshallsosurvive.AttachmentI:ListofAttachmentsPropertyTitleDeed:Acopyofthepropertytitledeedfortherealestatebeinggifted.PropertyValuationReport:Arecentreportdetailingthemarketvalueofthegiftedproperty.PropertySurvey:Asurveyofthepropertyboundariesandconditions.MortgageStatement:Documentationshowingthepropertyisfreeofanyliensorencumbrances,ifapplicable.TaxDocuments:Relevanttaxdocumentsorassessmentsrelatedtothepropertytransfer.AttachmentII:BreachofContractandDeterminationBreachofContract:AnyfailuretoperformtheobligationsasstatedinthisAgreementortheRealEstateGiftDeed,includingbutnotlimitedtothetransferofpropertyrights.DeterminationofBreach:Abreachisdeterminedwhenonepartyprovideswrittennoticeofthebreachtotheotherparty,andthebreachisnotremediedwithinaspecifiedperiod.AttachmentIII:LegalTermsandDefinitionsGiftDeed:Alegaldocumentthattransfersownershipofapropertyfromonepartytoanotherwithoutanyexchangeofmonetaryvalue.Encumbrance:Aclaimorliabilityattachedtoapropertythatmayreduceitsvalue,suchasamortgageorlien.MarketableTitle:Atitletorealestatethatisfreefromreasonabledoubtandistransferable.Alimony:Financialsupportpaidbyonespousetoanotheraftermarriagedissolution,typicallyforasetperiodoruntilaspecificeventoccurs.AttachmentIV:IssuesEncounteredinExecutionandSolutionsFailuretoTransferProperty:Ifapartyfailstotransferthepropertyasagreed,theaggrievedpartymayseeklegalremedies,includingspecificperformanceordamages.DisputeOverPropertyValue:Ifadisagreementarisesregardingtheproperty'svalue,anindependentappraisalmaybecommissionedtodeterminethefairmarketvalue.TaxDisputes:Iftherearedisputesovertaxliabilitiesrelatedtothepropertytransfer,consultationwithataxprofessionalorlegaladvicemaybenecessary.AttachmentV:AllApplicationScenariosUncontestedDivorce:Whenbothpartiesagreetothetermsofthedivorceandthetransf
