①固定期限劳动合同Fixedtermlaborcontract固定期限劳动合同是指用人单位与劳动者约定合同终止时间的劳动合同。用人单位与劳动者协商一致,可以订立固定期限劳动合同。Afixedtermlaborcontractreferstoalaborcontractinwhichtheemployerandtheemployeeagreeontheterminationtimeofthecontract.Theemployerandtheemployeecanreachafixedtermlaborcontractthroughconsultation.1、劳动合同的概念、种类
Theconceptandtypesoflaborcontracts(2)种类Types②无固定期限劳动合同Unfixedtermlaborcontract无固定期限劳动合同,是指用人单位与劳动者约定无确定终止时间的劳动合同。用人单位与劳动者协商一致,可以订立无固定期限劳动合同。Unfixedtermlaborcontractreferstoalaborcontractwheretheemployerandtheemployeeagreeonanindefiniteterminationtime.Employersandworkerscanenterintoopen-endedlaborcontractsthroughconsultationandagreement.有下列情形之一,劳动者提出或者同意续订、订立劳动合同的,除劳动者提出订立固定期限劳动合同外,应当订立无固定期限劳动合同:Ifaworkerproposesoragreestoreneworenterintoalaborcontractunderanyofthefollowingcircumstances,inadditiontotheworkerproposingtoenterintoafixedtermlaborcontract,anopen-endedlaborcontractshallbeconcluded:(一)劳动者在该用人单位连续工作满十年的;(1)Theworkerhasworkedcontinuouslyfortheemployerforatleasttenyears;(二)用人单位初次实行劳动合同制度或者国有企业改制重新订立劳动合同时,劳动者在该用人单位连续工作满十年且距法定退休年龄不足十年的;(2)Whenanemployerimplementsthelaborcontractsystemforthefirsttimeorwhenastate-ownedenterpriserestructuresandsignsanewlaborcontract,theemployeehasworkedcontinuouslyfortheemployerforatleasttenyearsandislessthantenyearsfromthestatutoryretirementage;(三)连续订立二次固定期限劳动合同,且劳动者没有用人单位可以解除劳动合同的情形,续订劳动合同的。(3)Continuouslysigningtwofixedtermlaborcontracts,andtheemployeehasnosituationwheretheemployercanterminatethelaborcontract,andrenewthelaborcontract.用人单位自用工之日起满一年不与劳动者订立书面劳动合同的,视为用人单位与劳动者已订立无固定期限劳动合同。Ifanemployerfailstosignawrittenlaborcontractwiththeemployeeforoneyearfromthedateofemployment,itshallbedeemedthattheemployerandtheemployeehavesignedanopen-endedlaborcontract.

Fulltimeemployment全日制用工是指规定了劳动时间和劳动合同期限等主要内容的用工模式。Fulltimeemploymentreferstotheemploymentmodethatspecifiesthemaincontentssuchaslaborhoursandlaborcontractterms.全日制用工模式具有稳定性和持久性,对用人单位培养人才、长远发展、调动员工工作积极性、形成企业凝聚力有利;对劳动者而言具有保障性、稳定性和发挥个人能力和提升个人有利。全日制用工模式也是目前绝大多数用人单位普遍采用的劳动用工模式。Thefull-timeemploymentmodelhasstabilityanddurability,whichisbeneficialforemployerstocultivatetalents,long-termdevelopment,mobilizeemployees'workenthusiasm,andformcorporatecohesion;Forworkers,ithassecurity,stability,andtheabilitytoexertpersonalabilitiesandenhancepersonalbenefits.Thefull-timeemploymentmodeisalsowidelyadoptedbythevastmajorityofemployersatpresent.2、劳务用工模式Laboremploymentmode(2)非全日制用工
Nonfull-timeemployment非全日制用工是指以小时计酬为主,劳动者在同一用人单位一般平均每日工作时间不超过四小时,每周工作时间累计不超过二十四小时的用工形式。Nonfull-timeemploymentreferstoaformofemploymentwherewagesaremainlycalculatedbythehour,andtheaveragedailyworkinghoursofworkersinthesameemployergenerallydonotexceedfourhours,andthecumulativeweeklyworkinghoursdonotexceedtwenty-fourhours.2、劳务用工模式Laboremploymentmode(2)非全日制用工

劳动保护是指依靠技术进步和科学管理,采取技术和组织措施,消除劳动过程中危及人身安全和健康的不良条件与行为,防止伤亡事故和职业病,保障劳动者在劳动过程中的安全和健康。Laborprotectionreferstorelyingontechnologicalprogressandscientificmanagement,adoptingtechnicalandorganizationalmeasurestoeliminateadverseconditionsandbehaviorsthatendangerpersonalsafetyandhealthduringthelaborprocess,preventingaccidentsandoccupationaldiseases,andensuringthesafetyandhealthofworkersduringthelaborprocess.3、劳动保护和劳动条件Laborprotectionandworkingconditions

ManagementofLaborEmployment(1)劳务人员:其年龄和身体条件必须符合岗位要求;劳务人员上岗前应接受相应的岗前培训,掌握一定的技术技能,提高文明施工、安全生产及法律法规意识,以适应相应的工作岗位的需要。Laborpersonnel:Theirageandphysicalconditionsmustmeetthejobrequirements;Laborpersonnelshouldreceivecorrespondingprejobtrainingbeforestartingwork,mastercertaintechnicalskills,improveawarenessofcivilizedconstruction,safetyproduction,andlawsandregulations,inordertoadapttotheneedsofthecorrespondingjobposition.2、劳务用工的管理
ManagementofLaborEmployment(2)劳务分包队伍进场:其资质必须符合《建筑业企业资质管理规定》,且其承接的业务需符合资质许可的规定范围;劳务分包企业施工队伍还必须配备相应的管理人员,全部管理人员应100%持有国家相关部门颁发的管理岗位证。
Mobilizationoflaborsubcontractingteams:Theirqualificationsmustcomplywiththe"RegulationsontheManagementofConstructionEnterpriseQualifications",andthebusinesstheyundertakemustcomplywiththeprescribedscopeofthequalificationpermit;Theconstructionteamoflaborsubcontractingenterprisesmustalsobeequippedwithcorrespondingmanagementpersonnel,andallmanagementpersonnelshouldhold100%ofthemanagementpositioncertificatesissuedbyrelevantnationaldepartments.二、劳务分包款管理

Managementoflaborsubcontractingpayments劳务分包合同价款Priceoflaborsubcontractingcontract1.工人工资Workers'wages2.文明施工及环保费中的人工费Laborcostsincivilizedconstructionandenvironmentalprotectionfees3.管理费Managementfees4.劳动保护费LaborProtectionracketfee5.各项保险费Variousinsurancepremiums6.低值易耗材料费Lowvalueconsumablescost7.工具用具费Toolandequipmentcosts8.利润Profits3、劳务分包合同价款应当分别约定和必须明确的内容Thepriceoflaborsubcontractingcontractsshouldbeseparatelyagreeduponandclearlydefined⑴发包人将工程劳务作业发包给一个承包人的,正负零以下工程、正负零以上结构、装修、设备安装工程等应分别约定;Iftheemployercontractsengineeringlaboroperationstoacontractor,theprojectsbelowplusorminuszero,structuresaboveplusorminuszero,decoration,andequipmentinstallationprojectsshouldbeseparatelyagreedupon;⑵工人工资、管理费、工具用具费、低值易耗材料费等应分别约定;
Workers'wages,managementfees,toolandequipmentfees,andlowvalueconsumablesfeesshouldbeseparatelyagreedupon;3、劳务分包合同价款应当分别约定和必须明确的内容Thepriceoflaborsubcontractingcontractsshouldbeseparatelyagreeduponandclearlydefined⑶承包低值易耗材料的,应当明确材料价款总额,并明确材料款的支付时间、方式;Forcontractinglowvalueandconsumablematerials,thetotalamountofthematerialpriceshouldbespecified,andthepaymenttimeandmethodofthematerialpaymentshouldbespecified;⑷劳务分包合同价格风险幅度范围应明确约定,超过风险幅度范围的,应当及时调整。
Theriskrangeofthelaborsubcontractingcontractpriceshouldbeclearlystipulated,andifitexceedstheriskrange,itshouldbeadjustedinatimelymanner.4、劳务分包合同价款结算的时间限制Timelimitforsettlementoflaborsubcontractingcontractprice发包人、承包人应当在劳务分包合同中明确约定对劳务作业验收的时限,以及劳务合同价款结算和支付的时限。Theemployerandcontractorshallclearlystipulateinthelaborsubcontractingcontractthetimelimitfortheacceptanceoflaboroperations,aswellasthetimelimitforthesettlementandpaymentofthelaborcontractprice.5、劳务分包合同价款支付的有关规定Relevantregulationsonpaymentoflaborsubcontractingcontractprice⑴合同价款支付的时间限制Timelimitforpaymentofcontractprice⑶支付形式Paymentform⑵农民工工资的支付
