2025年德国租赁合同协议ThisGermanLeaseAgreement("Agreement")isenteredintoon[InsertDate],2025,byandbetween:Landlord(Mietvermieter):[Landlord'sFullNameorCompanyName],withitsregisteredaddressat[Landlord'sFullAddress,includingCityandPostalCode],hereinafterreferredtoas"Landlord".Tenant(Mietmieter):[Tenant'sFullName],withitsregisteredaddress/abodeat[Tenant'sFullAddress,includingCityandPostalCode],hereinafterreferredtoas"Tenant".LeasedPremises(Mietobjekt):Theresidentialpremiseslocatedat[FullAddressoftheProperty,includingCityandPostalCode],specificallythe[Apartment/UnitNumber,BuildingNameifapplicable],hereinafterreferredtoasthe"LeasedPremises".LeaseTerm(Mietdauer):TheLeaseTermshallcommenceon[StartDate,e.g.,January1,2025]andshallcontinueforanindefiniteperiod(unbestimmteLaufzeit)unlessterminatedinaccordancewiththeprovisionsofthisAgreementorGermanlaw.Thisisaresidentiallease.Rent(Miete):ThemonthlyrentfortheLeasedPremisesshallbe[AmountinEuros,e.g.,1200.00€](TwelveHundredEurosand00/100Cents),dueandpayableonthe[DayoftheMonth,e.g.,5th]ofeachmonth,inadvance,bymeansofbanktransfertothefollowingaccount:[IBANNumber][BankName][BankAddress]Therentisbasedonthecurrentmarketvalueforresidentialuse,inaccordancewithapplicableGermanregulationsregardingrentcontrolwhereapplicable.UtilitiesandAdditionalCosts(Nebenkosten):Tenantshallbearthecostsforwater,electricity,gas,heating(basedonconsumptionmeterreadings),internet,television,garbagecollection,buildinginsurance(Wohnungsversicherungsanteil),andcontributionstotheowners'association(WEG-Beitrag)ifapplicable,asindicatedbytherespectiveinvoices.AllothermaintenanceandrepaircostsshallbebornebytheLandlord,includingordinarywearandtearmaintenance.Specificdetailsareoutlinedinthe附页清单(AppendixList).SecurityDeposit(Kaution):Tenantshallpayasecuritydepositintheamountof[AmountinEuros,e.g.,3600.00€](ThreeThousandSixHundredEurosand00/100Cents)uponsigningthisAgreement.Thisdepositcoversuptothree(3)months'rentandshallbeheldbytheLandlordduringtheentireLeaseTerm.Itwillbeusedtocoveranyunpaidrent,damagesexceedingnormalwearandtear,orothercostsduefromtheTenantasperGermanlaw.ThedepositshallbereturnedtotheTenantwithinone(1)monthaftertheendoftheLeaseTerm,uponTenant'spropermove-out,afterallrentandcostshavebeenpaid,anddamages,ifany,havebeensettled,withoutinterest,unlessotherwiserequiredbylaw.Move-inandMove-out(ZugangundAuszug):TheLeasedPremisesshallbemadeavailabletotheTenantformove-inon[StartDate,e.g.,January1,2025].TheTenantshallgivetheLandlordawrittennoticeofintenttomoveoutatleastthree(3)monthsbeforethedesiredmove-outdate.TheLandlordshallgivetheTenantawrittennoticeofintenttoterminatetheleaseatleastthree(3)monthsbeforethedesiredterminationdate,unlessotherwiseagreedinwriting.Afinalinventorycheckshallbeconducteduponmove-inandmove-out,withawritteninventory("Zugangs-undAuszugsscheck")confirmingtheconditionoftheLeasedPremisesanditscontents.UseandMaintenance(NutzungundInstandhaltung):TenantshallusetheLeasedPremisessolelyforresidentialpurposes.TenantshallnotsubletorunderlettheentireLeasedPremiseswithoutthepriorwrittenconsentoftheLandlord.TenantshallberesponsibleformaintaininganyimprovementsmadebyTenantandshallcompensatetheLandlordforanydamagecausedbyTenant'snegligenceorimproperuse.TheLandlordshallberesponsibleforthemaintenanceandrepairoftheLeasedPremisesduetonaturalwearandtear,aswellasfornecessaryrenovationsrequiredbylaworfortheproperuseofthepremises.TenantagreestoallowtheLandlordaccessfornecessarymaintenanceandrepairs,providingreasonablenotice.Termination(Kündigung):EitherpartymayterminatethisresidentialLeaseTermbyservingwrittennoticeatleastthree(3)monthsbeforetheendofthenextcalendarmonth.Suchnoticeshallbedeliveredbyregisteredletter("Einschreiben").Terminationshallonlybecomeeffectiveonthelastdayofthenoticeperiod.Notwithstandingtheabove,theLandlordisentitledtoterminatetheLeaseTermimmediatelyandwithoutnoticeincaseofsignificantdefaultbytheTenant,suchasfailuretopayrentformorethantwo(2)months,undercertainconditionsprescribedbyGermanlaw.Legalprohibitionsontermination(§543BGBetseq.)shallapply.DefaultandLiability(Vertragsstrafe/Schadensersatz):Incaseofdefault,thedefaultingpartyshallbeliablefordamages.TheAgreementmayincludeagreedliquidateddamagesforspecificdefaults,providedtheyarereasonableunderGermanlawanddonotexceedtheactualdamages.GoverningLawandDisputeResolution(RechtsprechungundStreitbeilegung):ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsoftheFederalRepublicofGermany.AnydisputesarisingoutoforinconnectionwiththisAgreementshallberesolvedthroughamicablenegotiations.Ifnoagreementisreached,thedisputeshallbesubmittedtothecompetentcourtattheplacewheretheLeasedPremisesaresituated.Insurance(Versicherung):Tenantshallobtainandmaintainatenancyinsurancepolicy("Mietschutzversicherung")coveringriskssuchasdamagetothebuildingandpersonalproperty.NoDiscrimination:TheLandlordandTenantagreethattheAgreementandthetenancyshallbeenteredintoandconductedwithoutdiscriminationonthebasisofrace,religion,gender,disability,oranyotherprotectedcharacteristicunderapplicableGermanlaw.ForceMajeure:NeitherpartyshallbeliableforanyfailureordelayinperformingitsobligationsunderthisAgreementifsuchfailureordelayiscausedbyforcemajeureevents,suchaswar,naturaldisasters,oractsofthestate,makingperformanceimpracticable.Notice:Allnoticesrequiredo
