2025建筑工程施工合同-中英对照版ContractAgreementonConstructionEngineering-BilingualVersion(2025)ThisContractAgreementisenteredintoonthisdayof,2025,byandbetweenthefollowingparties:甲方(PartyA):Name:Address:ContactInformation:乙方(PartyB):Name:Address:ContactInformation:Hereinafterreferredtoas"theContractor"and"theEmployer"respectively.鉴于(WHEREAS)TheEmployerintendstocarryouttheconstructionoftheProject(hereinafterreferredtoas"theProject")andhasselectedtheContractorastheconstructioncontractorfortheProject.TheContractorhasthenecessaryqualifications,experience,andcapacitytoundertaketheconstructionoftheProjectinaccordancewiththerequirementsoftheEmployer.为明确双方的权利义务，依据《中华人民共和国合同法》及相关法律法规，本着平等、自愿、诚实信用的原则，双方经协商一致，签订本合同。(INORDERTOCLARIFYTHERIGHTSANDOBLIGATIONSOFTHEPARTIES,THECHINACONTRACTUALLAWANDOTHERRELATEDLEGALPROVISIONSAREHEREBY_referenced,andbasedontheprinciplesofequality,voluntariness,andgoodfaith,theEmployerandtheContractorhaveagreeduponandenteredintothisContractthroughmutualconsultation.)第一条工程概况(Article1-GeneralDescriptionoftheProject)1.1工程名称(ProjectName):1.2工程地点(ProjectLocation):1.3工程规模(ProjectScale):1.4工程结构类型(TypeofStructure):1.5工程承包范围(ScopeofWorks):详见附件一(AnnexI).第二条合同工期(Article2-ContractDuration)2.1开工日期(CommencementDate):2.2竣工日期(CompletionDate):2.3总工期(TotalContractDuration):日历天(calendardays).2.4若因不可抗力或甲方原因导致工期延误，乙方有权要求延长工期。(Ifthe工期isdelayedduetoforcemajeureortheEmployer'sreasons,theContractorhastherighttoclaimanextensionoftime.)第三条质量标准(Article3-QualityStandards)3.1工程质量标准(EngineeringQualityStandards):须达到《混凝土结构工程施工质量验收规范》(GB50204-2025)及其他相关国家规范。(Theengineeringqualitymustmeetthe"ConcreteStructureEngineeringQualityAcceptanceSpecification"(GB50204-2025)andotherrelevantnationalstandards.)3.2质量保修范围和期限(ScopeandPeriodofQualityWarranty):详见附件二(AnnexII).第四条合同金额与支付方式(Article4-ContractPriceandPaymentMethods)4.1合同总价(TotalContractPrice):元(RMB).4.2付款方式(PaymentTerms):预付款(AdvancePayment):合同签订后日内支付合同总价的%。(WithindaysafterthesigningofthisContract,theEmployershallpay%ofthetotalcontractpriceasadvancepayment.)进度款(ProgressPayment):按月支付已完工程的%。(Monthlypaymentof%ofthecompletedworks.)结算款(FinalSettlementPayment):工程竣工验收合格后日内支付余款。(Withindaysafterthesuccessfulcompletionacceptance,theremainingamountshallbepaid.)4.3若甲方未按约定支付款项，乙方有权暂停施工并要求违约金。(IftheEmployerfailstomakepaymentsasagreed,theContractorhastherighttosuspendconstructionandclaimpenalties.)第五条工程验收与保修(Article5-EngineeringAcceptanceandWarranty)5.1分部验收(PartialAcceptance):工程施工至各分部时，乙方应提前日通知甲方进行验收。(TheContractorshallnotifytheEmployertoconductpartialacceptanceinspectionsatleastdaysinadvancewhentheconstructionreacheseachsub-item.)5.2中间验收(InterimAcceptance):工程施工至中间节点时，甲方应组织相关单位进行验收。(Interimacceptanceinspectionsshallbeconductedatkeyintermediatestagesoftheproject,organizedbytheEmployer.)5.3竣工验收(FinalAcceptance):工程竣工后，乙方应提交完整的竣工资料，并通知甲方组织验收。(Uponcompletionoftheproject,theContractorshallsubmitcomplete竣工资料andnotifytheEmployertoorganizethefinalacceptance.)5.4质量保修(QualityWarranty):详见附件二(AnnexII).第六条双方权利与义务(Article6-RightsandObligationsofBothParties)甲方权利与义务(Employer'sRightsandObligations):6.1按合同约定支付工程款，并提供施工场地及相关资料。(Paythecontractpriceasagreedandprovidetheconstructionsiteandrelevantdocuments.)6.2有权对施工质量进行监督，提出合理修改意见。(Havetherighttosupervisetheconstructionqualityandproposereasonablemodificationsuggestions.)6.3按合同约定组织工程验收。(Organizeengineeringacceptanceinaccordancewiththecontract.)乙方权利与义务(Contractor'sRightsandObligations):6.4按合同约定施工，确保工程质量和工期。(Carryoutconstructioninaccordancewiththecontract,ensuringengineeringqualityandduration.)6.5有权要求甲方按时支付工程款。(HavetherighttorequesttheEmployertopaythecontractpriceinatimelymanner.)6.6负责施工现场的安全管理，确保施工安全。(Beresponsibleforsafetymanagementattheconstructionsitetoensureconstructionsafety.)第七条违约责任(Article7-LiabilityforBreachofContract)7.1若甲方未按约定支付工程款，乙方有权暂停施工，并要求赔偿由此造成的损失。(IftheEmployerfailstopaythecontractpriceasagreed,theContractorhastherighttosuspendconstructionandclaimcompensationforthelossesthusincurred.)7.2若乙方未按合同工期完成工程，甲方有权要求乙方支付违约金，金额为元/天。(IftheContractorfailstocompletetheprojectwithintheagreedcontractduration,theEmployerhastherighttoclaimapenaltyofRMBperday.)7.3若工程质量问题导致返工或修复，相关费用由乙方承担，并赔偿造成的损失。(Ifqualityissuesintheprojectleadtoreworkorrepairs,therelatedcostsshallbebornebytheContractor,andcompensationfortheresultinglossesshallbepaid.)第八条争议解决(Article8-DisputeResolution)8.1若本合同发生争议，双方应通过友好协商解决。协商不成的，任何一方均可向项目所在地人民法院提起诉讼。(IntheeventofanydisputesarisingfromthisContract,thepartiesshallfirstseektoresolvethedisputesthroughfriendlyconsultations.Ifconsultationsfail,anypartymaybringproceedingsagainsttheotherpartytothelocalPeople'sCourtwheretheprojectissituated.)8.2争议期间，双方仍应继续履行合同，除非争议已经影响到合同的实质履行。(Duringtheperiodofdisputes,bothpartiesshallcontinuetoperformtheircontractualobligations,unlessthedisputeshavesubstantiallyaffectedtheperformanceoftheContract.)第九条合同的生效与终止(Article9-CommencementandTerminationoftheContract)9.1本合同自双方签字盖章之日起生效。(ThisContractshallcomeintoforceuponsignatureandsealbybothparties.)9.2本合同在下列情况下终止：(ThisContractshallterminateunderthefollowingcircumstances:)工程竣工验收合格；(Thesuccessfulcompl
