建筑工程合同模板中英文版ThisContractismadeandenteredintoonthis______dayof______,20____,in______,byandbetween:PartyA:[NameofClient/Owner],havingitsprincipalplaceofbusinessat[AddressofClient],hereinafterreferredtoas"PartyA";PartyB:[NameofContractor],havingitsprincipalplaceofbusinessat[AddressofContractor],hereinafterreferredtoas"PartyB".WHEREAS,PartyAdesirestoengagePartyBtoconstructabuildingat[ProjectLocation](hereinafterreferredtoasthe"Project");andWHEREAS,PartyBdesirestoaccepttheengagementandconstructtheProjectforPartyAonthetermsandconditionssetforthinthisContract.NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementshereincontained,thepartiesheretoagreeasfollows:1.ProjectDescription1.1TheProjectNameis[ProjectName].1.2TheProjectLocationisat[ProjectLocation].1.3TheProjectScope:Theconstructionofa[TypeofBuilding,e.g.,residential,commercial]buildingaspertheattacheddesigndrawingsandtechnicalspecifications,includingbutnotlimitedto[listofmainworks,e.g.,foundation,structure,exteriorwalls,roof,interiorfinishing,MEPsystems].2.ContractPriceandPayment2.1TheContractPricefortheProjectis[ContractPrice][CurrencyUnit](hereinafterreferredtoasthe"ContractPrice").2.2PaymentMethod:PartyAshallpayPartyBtheContractPriceaccordingtothefollowingschedule:(a)30%oftheContractPriceuponsigningthisContract;(b)40%uponcompletionofthefoundationwork;(c)20%uponcompletionofthemainstructure;(d)5%uponcompletionoftheProjectandpassingtheinitialacceptance;(e)5%aswarrantypayment,tobepaidwithinonemonthaftertheexpirationofthewarrantyperiod.2.3PaymentshallbemadetoPartyB'sdesignatedbankaccount:[BankAccountNumber],[BankName],[BankAddress].3.ContractDuration3.1TheestimatedconstructionperiodfortheProjectis[StartDate]to[EndDate](atotalof[Number]months).3.2PartyBshallcompletetheProjectwithintheContractDuration.IftheProjectisdelayedduetoreasonsbeyondPartyB'scontrol,thedelayshallnotexceed[Number]months,andPartyAshallnotbeliableforanyadditionalcostsincurredbyPartyB.4.QualityStandard4.1ThequalityoftheProjectshallmeettherequirementsspecifiedintheattacheddesigndrawings,technicalspecifications,andtherelevantnationalandlocalstandardsandcodes.4.2PartyBshallberesponsibleforthequalityoftheProjectthroughouttheconstructionprocess.PartyAshallhavetherighttoinspecttheconstructionprocessatanytimeandtorequirePartyBtorectifyanydefectsfound.5.ChangestotheProject5.1AnychangestotheProjectshallrequirethewrittenconsentofPartyA.Thecostandtimeimpactofanychangesshallbeagreeduponinwritingbybothparties.6.ProjectSchedule6.1PartyBshallsubmitadetailedprojectscheduletoPartyAforapprovalbeforecommencingconstruction.6.2PartyBshallstrictlyfollowtheapprovedprojectscheduleandshallnotifyPartyAinwritingofanyanticipateddelays.7.ProjectAcceptance7.1UponcompletionoftheProject,PartyBshallnotifyPartyAforinitialacceptance.7.2PartyAshallinspecttheProjectwithin[Number]daysofreceivingthenotificationandshallissueanacceptancecertificateiftheProjectmeetsthequalitystandards.7.3IftheProjectdoesnotmeetthequalitystandards,PartyBshallrectifythedefectswithin[Number]daysandre-submitforacceptance.8.ProjectWarranty8.1PartyBshallprovideawarrantyperiodof[Number]yearsfortheProjectfromthedateofinitialacceptance.8.2Duringthewarrantyperiod,PartyBshallberesponsibleforrectifyinganydefectsfoundintheProjectatitsowncost.9.LiabilityforBreachofContract9.1IfPartyAfailstopaythecontractpriceontime,PartyBshallhavetherighttoclaimadefaultinterestatarateof[InterestRate]perannum.9.2IfPartyBfailstocompletetheProjectwithintheContractDurationwithoutvalidreasons,PartyBshallcompensatePartyAwith[CompensationAmount][CurrencyUnit]andshallrectifythedelay.9.3IfthequalityoftheProjectdoesnotmeettheagreedstandards,PartyBshallberesponsibleforrectifyingthedefectsatitsowncostandshallcompensatePartyAforanyresultinglosses.10.DisputeResolution10.1AnydisputesarisingoutoforinconnectionwiththisContractshallfirstbesettledthroughfriendlynegotiationbetweentheparties.10.2Ifthedisputecannotbesettledthroughnegotiation,itshallbesubmittedto[ArbitrationCommissionName]forarbitrationaccordingtothearbitrationrulesof[ArbitrationRulesName].Thearbitrationshallbeheldin[City,Country].Thearbitralawardshallbefinalandbindinguponbothparties.11.ForceMajeure11.1IfeitherpartyisunabletoperformitsobligationsunderthisContractduetoforcemajeureevents(suchasearthquake,flood,war,etc.),theaffectedpartyshallnotifytheotherpartyinwritingwithin[Number]daysandproviderelevant证明documents.TheperformanceperiodoftheContractshallbeextendedbythedurationoftheforcemajeureevent.12.ContractEffectiveness12.1ThisContractbecomeseffectiveuponthesignaturesandsealsofbothparties.13.ContractTermination13.1ThisContractmaybeterminatedbyeitherpartywiththewrittenconsentoftheotherpartyiftheProjectiscompletedorifbothpartiesagreetoterminatetheContract.14.ContractAttachments14.1ThisContractshallbeaccompaniedbythefollowingattachments,whichareintegralpartsofthisContract:(a)DesignDrawingsoftheProject;(b)TechnicalSpecificationsoftheProj
