澳洲新州租房合同
ThisLeaseAgreement("Agreement")ismadeandenteredintoonthis______dayof______,20__,byandbetween________________________("Landlord"),havinganaddressat________________________("PropertyAddress"),and________________________("Tenant"),havinganaddressat________________________("TenantAddress"),andpotentiallyincluding________________________("AdditionalTenant"),havinganaddressat________________________("AdditionalTenantAddress").
1.PropertyDescription.TheLandlordherebyleasestotheTenantandAdditionalTenant("Tenant"),andtheTenantandAdditionalTenantherebyleasefromtheLandlord,theresidentialpremiseslocatedat________________________("Property"),describedmorefullyinExhibitAattachedhereto(ifany).ThePropertyincludesthelandbeneaththebuildings,thebuildingsthemselves,andallfixturesandimprovementsattachedtotheProperty.
2.Term.ThisLeaseshallcommenceon________________________("StartDate")andcontinueforatermof______month(s)/year(s)("LeaseTerm"),unlessearlierterminatedinaccordancewiththisAgreement.ThelastdayoftheLeaseTermshallbe________________________("EndDate").
3.Rent.TheTenantagreestopayLandlordamonthlyrentof$_________("RentAmount")fortheProperty.Rentshallbedueonthe______dayofeachmonthbeginningwiththeStartDateandcontinuingthrougheachmonthoftheLeaseTerm.RentshallbepaidtotheLandlordat________________________("PaymentAddress"),orasotherwisedirectedbytheLandlordinwriting.Alatefeeof______%shallbechargedonanyRentpaymentreceivedmorethan7daysaftertheduedate,unlessthedelayisduetoalegalhold-up.Thefirstmonth'srentandasecuritydepositintheamountof$_________("BondAmount")shallbepaidbytheTenanttotheLandlordonorbeforetheStartDate.TheBondAmountisheldbytheLandlordsubjecttotheResidentialTenanciesAct2020andthetermsthereof.
4.Bond.TheBondAmountshallbedepositedwiththeNSWFairTradingBondProtectionServicewithin14daysoftheStartDate.TheLandlordshallcomplywithallrequirementsoftheResidentialTenanciesAct2020regardingtheBond.SubjecttotheAct,theLandlordmayretainpartoftheBondtocoverreasonablerepaircostsfordamagecausedbytheTenantorAdditionalTenantbeyondnormalwearandtear.TheLandlordshallrefundtheremainingBondbalancetotheTenantwithin14daysoftheEndDate,afterallowingreasonabletimefortheTenanttovacatethePropertyandmakinganynecessarydeductionsaspermittedbylaw.
5.UseofProperty.ThePropertyshallbeusedexclusivelyasaresidencefortheTenantandAdditionalTenantandtheirrespectiveguests.TheTenantandAdditionalTenantagreenottousethePropertyforanyillegalpurposeorforanypurposethatviolateslocal,state,orfederallaws.
6.MaintenanceandRepairs.TheTenantandAdditionalTenantshallkeepthePropertycleanandinreasonablerepair,includingperformingminorrepairsandupkeepassociatedwithnormalresidentialuse.TheTenantandAdditionalTenantshallnotremoveordamageanypartoftheProperty,includingbutnotlimitedtowalls,floors,windows,doors,plumbing,electricalsystems,orappliancesprovidedbytheLandlord.TheTenantshallnotifytheLandlordinwritingofanynecessaryrepairsattheearliestopportunity.TheLandlordshallberesponsibleformajorrepairstotheProperty'sstructureandsystems.
7.AlterationsandImprovements.TheTenantandAdditionalTenantshallnotmakeanyalterations,additions,orimprovementstothePropertywithoutthepriorwrittenconsentoftheLandlord.AnychangesmadewithoutconsentmayneedtobereversedattheTenant'sexpenseandmayresultintheLandlordterminatingthisAgreement.
8.Utilities.TheTenantandAdditionalTenantareresponsibleforpayingallutilitiesandservicesassociatedwiththeProperty,includingbutnotlimitedtoelectricity,gas,water,sewage,garbagecollection,andinternet,unlessotherwiseagreedinwritingbytheLandlord.
9.NoiseandNuisance.TheTenantandAdditionalTenantagreenottocreateanynoiseorotherdisturbancesthatwouldbeconsiderednuisancetotheLandlord,neighbors,orotheroccupantsinthearea.Thisincludes,butisnotlimitedto,loudparties,excessivepetbarking,orotherloudactivitiesafterquiethours,whichmaybedefinedbylocalby-laws.
10.GuestsandSubtenants.TheTenantmayhaveguestsstayovernightfromtimetotime,providedthePropertyisnotovercrowdedandtheguestscomplywithalltermsofthisAgreement.TheTenantandAdditionalTenantagreenottopermitanysublettingofalloranypartofthePropertywithoutthepriorwrittenconsentoftheLandlord.
11.EntryontoProperty.TheLandlordshallhavetherighttoenterthePropertyatreasonabletimesanduponreasonablenotice(atleast24hours)totheTenantortheirrepresentative,orinanemergency,withoutfurthernotice.TheLandlordshallprovideareasonableopportunityfortheTenanttobepresentduringentryunlessitisanemergency.
12.TerminationandRenewal.ThisAgreementmaybeterminatedbyeitherpartyuponnotlessthan______days'writtennotice.IftheLandlordwishestoterminatetheAgreementearly,theymustprovideatleast______days'writtennoticeandpaytheTenanttheequivalentof______month(s)rentascompensation,unlesstheterminationisduetoseriousbreachbytheTenant.IftheTenantwishestoterminatetheAgreementearly,theymustpaytheLandlordtheequivalentof______month(s)rentascompensation.TheLeaseTermmaybeautomaticallyrenewedforaliketermatthethencurrentrent,unlesseitherpartygivesnoticeofnon-renewalatleast______monthspriortotheEndDate.
13.ViolationsandRemedies.IftheTenantorAdditionalTenantbreachesanytermofthisAgreement,theLandlordmay,aftergivingtheTenantanopportunitytocurethebreach,terminatethisAgreementandpursuedamages.TheLandlordmayalsochargeareasonabledeposittocoverthecostofrectifyingthebreach.
14.EntireAgreement.ThisAgreement,includinganyexhibitsattachedhereto,constitutestheentireagreementbetweentheLandlordandTenantandsupersedesallprioragreements,whetherwrittenororal,relatingtothesubjectmatterhereof.
