2026年阿联酋工程分包安全责任合同ThisSubcontractSafetyResponsibilityContractismadeandenteredintoon[Date]at[Location](the"EffectiveDate").1.DefinitionsandInterpretation1.1TheWorks:Referstothespecificscopeofengineeringworks,construction,installation,andrelatedactivitiesdetailedintheMainContract,includingalltemporaryworks,sitefacilities,andclean-upoperations.1.2TheSubcontractor:ReferstotheCompany,itssuccessors,assigns,andlegalrepresentatives,includingallemployees,agents,contractors,andsubcontractorsengagedbytheSubcontractortoperformtheWorks.1.3TheGeneralContractor:ReferstothePartywhohasenteredintotheMainContractwiththeClientandhassublettheWorkstotheSubcontractor.1.4Accident:Referstoanyoccurrence,includingsuddenorprogressivedamageresultingfromoneormorecauses,causinginjury,death,lossofproperty,orenvironmentalpollutionarisingfromtheexecutionoftheWorks.2.GeneralSafetyResponsibilities2.1FirstPartyResponsibility:TheSubcontractoristheprimaryandsoleresponsiblepartyforthesafetyandhealthofitspersonnel,subcontractors,andvisitorswithintheSubcontractor’sareaofwork.TheSubcontractormustensurestrictcompliancewithallapplicablelawsoftheUnitedArabEmirates(UAE),includingbutnotlimitedtotheUAELabourLaw,FederalLawNo.8of1980,andrelevantEHSregulations.2.2SafetyManagementPlan:Priortothecommencementofanyworks,theSubcontractorshallprepareacomprehensiveanddetailedHealth,Safety,andEnvironment(HSE)ManagementPlan.ThisplanmustbesubmittedtotheGeneralContractorforapproval.TheHSEPlanmustaddressriskassessment,emergencyprocedures,firesafety,andwastemanagement,andshallbeapprovedinwritingbytheGeneralContractorbeforeanyworkbegins.2.3SiteSafetyMeasures:TheSubcontractorisresponsibleformaintainingitssiteinasafeandorderlyconditionatalltimes.Thisincludes,butisnotlimitedto,installingappropriatefencing,warningsigns,lighting,andbarriersarounddangerousareas.TheSubcontractormustprovideallnecessaryPersonalProtectiveEquipment(PPE)toitsworkforceatnocostandensureitsusageatalltimes.2.4PermittoWork:TheSubcontractorshallstrictlyadheretothe"PermittoWork"system(PTW)establishedbytheGeneralContractor.Nohigh-riskactivities(suchashotwork,workingatheights,orconfinedspaceentry)shallbeperformedwithoutavalidpermitissuedbytheauthorizedsafetyofficeroftheGeneralContractor.3.InsuranceandIndemnification3.1CompulsoryInsurance:TheSubcontractorshallprocureandmaintainthefollowinginsurancepoliciesthroughouttheentiredurationoftheSubcontract,commencingfromthedateofcommencementoftheWorksandendingupontheissuanceofthePracticalCompletionCertificate:*WorkersCompensationInsurance:CoveringallSubcontractor'semployeesinaccordancewiththemaximumcompensationlimitsprescribedbytheUAEMinistryofLabour(MOHRE).*ThirdPartyLiabilityInsurance:Withaminimumcoveragesumof[Amount]AED(orUSD),coveringclaimsarisingfrombodilyinjuryordeathtothirdpartiesanddamagetothird-partypropertycausedbythenegligenceoftheSubcontractor.*Contractor'sAllRisksInsurance:CoveringtheWorksagainstphysicallossordamage,includingtheft,vandalism,andmaliciousacts,uptothevalueoftheWorks.3.2Indemnity:TheSubcontractoragreestoindemnify,defend,andholdharmlesstheGeneralContractor,theClient,andtheirofficers,employees,andagentsfromandagainstallclaims,damages,losses,andexpenses(includinglegalfees)arisingoutoforresultingfromanybreachofthisContractorthenegligenceoftheSubcontractororitsemployees.4.AccidentReportingandEmergencyResponse4.1ReportingObligation:Intheeventofanyaccident,injury,fire,explosion,orenvironmentalincidentoccurringwithintheSubcontractor’sareaofwork,theSubcontractormustnotifytheGeneralContractorimmediately.TheSubcontractorshallsubmitadetailedwrittenreporttotheGeneralContractorandtherelevantUAEauthorities(suchastheCivilDefenceorEnvironmentalAgency)withintwenty-four(24)hoursoftheincident.4.2ScenePreservation:Upontheoccurrenceofanincident,theSubcontractormustimmediatelysecuretheaccidentsitetopreventunauthorizedaccess.TheSubcontractorshallnotalter,remove,ordestroyanyevidenceorpropertyrelatedtotheincidentuntilpermissionisgrantedbytheGeneralContractorortherelevantauthorities.4.3EmergencyPreparedness:TheSubcontractorshallmaintainafullyequippedFirstAidRoom/Stationonsiteandensurethatasufficientnumberoftrainedfirstrespondersareavailableatalltimesduringworkinghours.TheSubcontractorshallcooperatefullywiththeGeneralContractorandemergencyservicesduringanyemergencyresponseoperation.5.SuspensionandRectification5.1RighttoStopWork:TheGeneralContractorshallhavetheunconditionalrighttostopanyworkactivitiesperformedbytheSubcontractoriftheSubcontractorisinmaterialbreachofanysafetyregulations,failstocomplywiththeGeneralContractor’ssafetyinstructions,oriftheGeneralContractorhasreasonablegroundstobelievethattheSubcontractor’soperationsposeanimminentthreattolife,health,orproperty.5.2RectificationNotice:IftheGeneralContractorissuesawrittennoticetotheSubcontractorregardingasafetyviolationornon-compliance,theSubcontractorshallrectifytheissuewithinthetimeperiodspecifiedinthenotice,whichshallnotbelessthanforty-eight(48)hoursunlessotherwiseagreed.FailuretorectifywithinthestipulatedperiodshallentitletheGeneralContractortotakefurtheraction,includingthedeductionofliquidateddamages.6.PenaltiesandLiability6.1SafetyFines:TheSubcontractoragreestopayanyfines,penalties,orsanctionsimposedbytheUAEgovernmentauthoritiesortheClientarisingfromviolationsofsafetylaws.TheGeneralContractorreservestherighttodeductthefullamountofsuchfinesdirectlyfromanypaymentsduetotheSubcontractorundertheMainContractorthisSubcontract.6.2SevereBreach:Anyactofgrossnegligence,willfulmisconduct,orwillfulviolationofsafetyprotocolsresultingininjuryordeathofapersonshallbeconsideredamaterialbreachofthisContract.TheGeneralContractorshallbeentitledtoterminatethisContractimmediatelywithoutnoticeandholdtheSubcontractorliableforallconsequentialdamages.7.GoverningLawandDisputeResolution7.1GoverningLaw:ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsoftheUnitedArabEmirates.7.2DisputeResolution:Anydispute,controversy,orclaimarisingoutoforrelatingtothisContract,includinganyquestionregardingitsexistence,validity,ortermination,shallbereferredtoandfinallyresolvedbyarbitrationinaccordancewiththeArbitrationRulesoftheDubaiInternationalArbitrationCentre(DIAC)ortheAbuDhabiCommercialConciliationandArbitrationCentre(ADCCAC).TheseatofarbitrationshallbeDubaiorAbuDhabi,asmutuallyagreed.ThelanguageofthearbitrationshallbeEnglish.8.Effectivityan
